run a red light. you can come close to sideswiping a school bus during the morning hours, right in front of a police officer, and the pursuit policy in oakland says, we can't we cannot pursue that suspect. >> this is the second time the governor has called for changes to that policy. he sent a letter to oakland leaders earlier this year. the oakland police commission discussed the issue in september, but ultimately decided not to make any changes. they cited the possible dangers of enabling police pursuits. we did reach out to the commission for their comment. the commission chair sent ktvu a statement that said, quote, we have seen the significant and positive impacts that have resulted in oakland's police department coordination with chp and understand that there is still significant work to be done in regards to opd's pursuit policy and practices. we give our commitment to respond to the call for action and to do our

part to work with city leadership, to make oakland a safer place to work, live and visit. by implementing smart policy and best practices to deter reckless behavior in our city streets. >> new at ten, a man has been arrested for allegedly stealing a car in san francisco and then shooting at deputies with the sacramento sheriff's office, who pursued him. officials say it all happened at around 11 p.m. last night in rancho cordova. a deputy spotted a vehicle linked to a carjacking in san francisco. when they tried to pull that vehicle over, deputies say the driver, 34 year old anthony hurtado, took off, firing multiple shots as he sped away. no one was hit. hurtado then allegedly led deputies on a short chase, officials say, before surrendering peacefully. >> we went from one extreme to the absolute other. he went from literally shooting at deputies, trying to kill them and is again being charged with attempted murder to pulling over, stopping, surrendering and following all commands. >> hurtado is now in custody at the sacramento county jail. san

francisco police are expected to pursue charges for the carjacking tonight. >> many in the bay area are mourning the death of civil rights leader reverend jeff moore. the second he served as president of the san jose silicon valley naacp. friends and family say the cause of moore's death has not yet been determined. the naacp says for decades, jeff had been the voice of people in santa clara county and beyond. moore is survived by his wife and two children. >> we do have some breaking news that a lot of people have been following. there is a winner in tonight's mega millions drawing. after three months without a grand prize winner. a winning ticket worth $1.22 billion was sold for tonight's drawing here in california. the winning numbers were three, seven, 37, 49, 55 with the number six as the mega ball number. we are working to confirm exactly where that winning ticket was sold. we will continue to update this

forcing several road closures west of 101. >> we had constant for days, and so that's just slowly accumulating. >> california highway patrol stopping multiple drivers from ignoring road closures due to flooding and schellville shutting down highways 12 and 121 in both directions. caltrans is on standby for more rain over already saturated soil. >> we get a lot of runoff, and so a creek like sonoma creek, which is a pretty mild creek except for in the winter, can turn into a torrent and jump its banks and close the road. >> while more rain would be beneficial, it's keeping maintenance crews on their toes, using plow trucks to push water out of the way, while chp reminds drivers to take it easy. >> reminding drivers this wet, rainy season to slow down, make sure you leave a good safety

also responsible for collapsing part of the santa cruz wharf on monday. the iconic pier is now closed indefinitely and as ktvu is, jesse gary reports, city officials say the wharf may never be the same. >> friday sees a picture perfect beach day in santa cruz. sun, surf and clear skies over a restless pacific 64 degrees right now is perfect. >> it would be lovely to be out in the water. >> in a cruel twist, the beach is closed and officials say the water off limits despite risk takers and rule breakers. the problem is more a trifecta needing to be managed on the damaged mile long wharf. >> cleaning up, stabilizing and figuring out how we can get this open. >> the whole front just fell off monday. >> officials say historic swells collapsed. a 150 foot section of the wharf into the water. >> i flip around just in time to see the splash of something going in at the end of the stick. >> three city workers checking replacement work on 70 pilings

also went in and had to be rescued by santa cruz lifeguards. officials say the victims minor injuries have healed, but there's major economic hurt to the 20 boardwalk businesses, which employ 400 people. >> our employees are having a hard time. yeah, that's you know, we're like family. >> after a while, officials say upwards of 2 million people visit the wharf each year, but now can't. >> we're really sad because every week we would go to the diner on the pier and the city looking at ways to offset losses that pile up with each passing day. >> it depends how big your restaurant is there, you know, 3 or $4000 a day. if you add it all up, working toward a reopening plan as we move forward as the weekend approaches. >> officials eyeing cleanup of a ten mile debris field from cowell's beach to manresa state beach, and considering if it makes sense to rebuild the wharf as it was. >> every coastal community in the world has some version of

this conversation going on. >> also part of the conversation. why wasn't the large crane and other heavy equipment removed before the storm hit? officials say there's an investigation on the state level and the local level into that. beaches here will reopen on saturday, but the wharf will remain closed indefinitely. in santa cruz, jesse gary, ktvu, fox two news. >> tonight, we are also hearing from the lifeguards who jumped into action to save those who fell into the water when that wharf collapsed. >> it was pretty surreal. it was like this island floating just off the end, just before that collapse happened, lieutenant sam hoffman and isaiah mullen, both lifeguards with the santa cruz fire department, were patrolling the water on jet skis near cowell beach when they heard an ominous creaking and cracking noise. >> i looked out myself, and lieutenant hoffman could see the wharf collapsing into the ocean.

we started to head that way. i got my fins on just in case there was somebody in the water. >> fortunately, everyone did make it to shore safely. more high surf is expected throughout the weekend all along the northern california coastline. >> ten adults and four children were displaced by an apartment complex fire early this morning in san jose. all eight units in one building are uninhabitable. the fire department released photos that shows close up views of the damage. the first emergency call came a little after 5:00 this morning about the complex on gemelli way. two apartment units were in flames when crews first arrived on the scene. >> quote. anytime when someone loses their property and their homes with a fire, we're always reminded that thankfully, everybody got out alive. and that's what's important. but definitely for our firefighters, when they are working through buildings and pushing over christmas trees to fight fire and in search of victims. >> fortunately, no one was injured, and firefighters say they're still investigating what

he has discovered a bird flu mutation in a louisiana patient who was hospitalized. dozens of milder cases have been recorded this year, most of them in california. the louisiana patient was hospitalized after coming into contact with sick and dead birds on that patient's property. a genetic analysis suggests the virus virus mutated inside the patient. the cdc says the mutation may increase the strain's ability to infect humans. there is no evidence right now that the patient passed the illness to anyone else. though there have been 37 confirmed cases in california this month. governor gavin newsom declared a state of emergency over the virus. >> california worries me because of all the spread in cattle in california. that's absolutely unprecedented, and that's why we have a level of alert here. >> health officials say right now the risk to the public remains low. but they do warn that people who drink raw milk

could be at a higher risk of catching bird flu from an infected animal. >> president elect donald trump is urging the supreme court to press pause on a federal law banning tiktok. after initially supporting a ban, trump is now arguing he should have the opportunity to find a political resolution before tiktok is forced to sell or be banned in the united states. as of now, tiktok's chinese parent company bytedance must divest its interests in january by january 19th in order to stay active in the u.s, the supreme court is set to hear oral arguments on whether the law violates the first amendment in two weeks. and two canadian ministers met with members of president elect trump's circle at mar a lago today. the talks were described as a continuation of the discussions canadian prime minister justin trudeau had with trump a few weeks ago to address issues including fentanyl trafficking, immigration and trade. trump has threatened to impose a 25% tariff on canadian

pregnant and she was just telling her experience. >> the post convinced ortega to get online and fill out an application. >> i don't really know if it was really her story. i think it was more so me just wanting to have like some type of purpose or something. >> ortega is a single mother of two and describes her pregnancies as fairly easy, and she's pretty sure she's done having kids. so she says surrogacy was an opportunity to give another family a baby of their own. couples who may be struggling with infertility, which is a journey jeffrey hu and his wife know well. >> we went to four different countries, and eventually we were able to have our children through surrogacy. so i always called them like million dollar babies because literally it took us half a decade. and, you know, dozen, half dozen rounds of ivf before we were able to pursue surrogacy, to start a family. >> today, this is his family thanks to surrogacy. it is a journey that prompted them to create the company known as surrogate first. he says since

2018, they've had an estimated 300 live births. and while finding surrogates is a challenge, the journey can be more fulfilling than some realize. >> so for us in most agencies, there's probably a 3 to 5% qualification rate at the end of the day of someone that becomes a surrogate. she's had four surrogacies, three of them with the same family. they're based in china. they've brought her entire family over for a one month trip, stayed at their house. >> it took a few weeks for ortega to be approved. but then the process began. and while the company will ask many questions to find a match on issues like termination, covid vaccination and how a surrogate feels about international or same sex couples. for ortega, the process of picking the family she would work with was fairly simple. >> to be honest, i only got sent one family. once i got sent that one family, i was like, yeah, i'll do it for them. >> the process after that involves hormone shots and the implantation of the couple's embryo. but the first attempt took and once again, she says

the pregnancy was fairly easy. but there was one very important difference. >> i feel like from the very beginning, i like, mentally prepared myself. like, i'm like, this isn't my baby, it's somebody else. it's going to be somebody else's baby because i didn't know i was going to work with them. so i just knew that, like, it was never my baby. >> she says her kids knew she was doing it to help people, and she got support from her family. but as her belly grew, people started asking questions. >> i'm like telling them like, oh, like i'm a surrogate, i'm going to have a baby. and then everybody's concern is, well, aren't you going to feel like attached? you're giving away a baby. >> she says she told the baby often that it was loved but never got attached. and as far as compensation, she prefers to keep that information private. but who says on average, in addition to medical expenses that are covered, there is a base compensation for surrogates that is paid over the entire pregnancy. >> so for base compensation, i think the average is probably about 50 to 55,000. but that can also go all the way up to 80 to

100,000, depending on the intended parent, what state you're in and you know, are you a repeat surrogate, etc. i would like to break one of the stereotypes, which is the number one reason by far, that the surrogates pursue surrogacy is to help another family in need. >> ortega says that is what motivated her, and she describes the moment that the baby she carried entered the world and met their parents. she says even in that moment, she knew she was delivering a baby that belonged to someone else. >> the parents are just sitting there and they're like, okay, so like, what's going on? i'm like, you guys should probably stand up. like, we're about to have the baby right now. they're like, oh, okay. you could tell they were going to like get emotional. but then they were like smiling like, oh my goodness, my child was just born. i feel like it's kind of like a full circle moment. it's kind of just like fulfilling for me. >> and as we sat with her just three days after giving birth, she was recovering in record time and already pondering the possibility of giving that same gift again. >> why would i do it again? i

unfair labor practices. >> the u.s. circuit court said starbucks lacked legal standing to fire two philadelphia baristas in 2020 because they wanted to unionize. starbucks filed an appeal after a national labor relations board finding came to the same conclusion. however, the court did rule that the nlrb exceeded its authority by ordering starbucks to pay the baristas foreseeable expenses stemming from their firings. many starbucks workers have accused the company of unfair practices this month, which starbucks denies. all of this comes amidst an ongoing strike at more than 300 stores. >> it has been an up and down season for 49ers kicker jake moody. we will talk about what's in store for him com g up n t
