take a look at the current conditions out the door. we have tumbled into the 30s this morning, but we are recovering now in santa rosa at 41 degrees. we do have that frost advisory in effect for the tri valley at 36 degrees. that frost advisory until 10 a.m. 37 degrees now milpitas, union city and in fremont. some neighborhoods could even be colder than that. walnut creek and alamo, also mid 30s across the bay. good morning, palo alto. you're sporting 39 degrees live weather camera looking out toward san francisco. the sun is beginning to make an appearance at 725. by the time it sets tonight at 501, we will have realized high temperatures anywhere between about 55 degrees and 63 degrees. the warmest locations will be in the southern california area. actually, santa clara area, 63 degrees there, backing through morgan hill at 62. hey, you know what gang i've had on my mind in southern california? because they have red flag warnings in effect there. strong santa ana winds this morning. our winds will be more gentle. and we'll

have your full forecast, claudine. and that's coming up. >> all right. thank you. roberta. well, if you are headed out the door early on this new year's day, let's take a look at the traffic around the roadways. it's a holiday, so things should go pretty easy for you. this is interstate 880, in oakland. as people roll by the coliseum and just a handful of cars in both directions. so things look smooth there. if we take you now down to the south bay in downtown san jose and the 280 as interstate 280 rolls through that area and you can see a little bit of sunshine looks like kind of peeking through and headlights still on. maybe those are just lights. it's still dark out there. bay bridge toll plaza. wow, that's an easy commute. if you have somewhere to be at this hour, you're not going to have a lot of problems on the roadways if you don't have anywhere to be. just hang out, take a little time. enjoy the beginning of the new year. well, we want to turn now to the breaking news out of new orleans, a rampage there with which the fbi just announced agents are investigating it as a

possible terror attack. >> the story is this a man drove a pickup truck into a crowd of people celebrating new year's. at least ten people are dead. 30 others are hurt. he also fired shots at first responders and wounded two police officers. >> now, this incident happened at the end of new year's celebrations on bourbon street. that's in the french quarter, which is one of the city's most popular tourist areas. now, authorities say the driver plowed into a crowd at about 315 this morning. new orleans time new orleans police chief and former oakland chief anne kirkpatrick said this morning, quote, this man was trying to run over as many people as he possibly could. now, the suspect also fired shots at first responders who rushed to the scene to help the victims. so far, ten people have died. at least 30 others have been injured because of the intentional mindset of this perpetrator who went around our

barricades in order to conduct this. >> he was #### bent on creating the carnage and the damage that he did. >> the suspect was shot and killed after a firefight with police, but his identity has not been revealed. the fbi says an improvised explosive was also found. the white house says president biden has been briefed on the situation. we are following developments, as well as a press conference that is expected around 9:00 this morning that we will bring to you live on mornings on two. >> our time is now 705 in oakland. this has been a deadly start to the new year. three homicides reported in less than ten hours. ktvu is amanda quintana is in oakland to tell us what we know so far. good morning amanda. >> good morning. well, we're talking about three separate incidents that happened overnight. the first of them in the 1900 block of 70th avenue. that was a stabbing. police responded there. they said they

found one person with stab wounds. that person was pronounced dead at the hospital. the second incident, just 2.5 hours later, police were called to the 200 block of second street that's in jack london square for a shooting. they found a victim with gunshot wounds there. that person was transported to the hospital. police later learned, though, that three other victims took themselves to the hospital. one of those victims died. police tell us the other three are still being treated at the hospital. and then the third happened on 24th avenue around 345 this morning. police have not confirmed what happened there, but in video from the scene, you can see a body and a very large police presence investigating there. we are working to find out more information about that third incident, but clearly opd very busy overnight as we start the new year. live in oakland amanda quintana, ktvu, fox two news.

>> all right amanda thank you. happening today california will require insurance companies within the state to cover homes in high fire danger areas. the california insurance commissioner announced a package of reforms, including one that allows insurers to use computer catastrophe models to set rates in exchange for the use of those tools. companies commit to sell more insurance, especially in wildfire prone areas. >> is going to make it infinitely easier not only to obtain coverage, but to get competitive bids from more than one company. when there are more options, there's more competitiveness in the marketplace and prices will tend to go down. >> the consumer advocacy group called consumer watchdog is warning the regulations may be flawed. >> problem with this kind of complicated regulation that is presented as a fait accompli at the end of the year, without an opportunity for comment. now, an opportunity for amendment is it's it was clearly drafted by

the insurance industry for the insurance industry, and it's not going to benefit anyone but the insurance industry. >> the consumer watchdog group says insurers can now charge for the cost of reinsurance. reinsurance policies are bought by companies to protect themselves from massive losses, such as the big wildfires and other natural disasters. the consumer group is planning to challenge the new regulations in court. >> our time now 707 starting today. california's minimum wage goes up. employers now have to pay a minimum of $16.50 an hour. now, last year, employees at certain health care facilities were paid a higher minimum wage between 18 and $23 an hour. it all depends on the facility. and some california cities and counties have minimum wages that are higher than the state's minimum wage. well, during the night, new year's celebrations took over the bay area with fireworks lighting up the sky in san francisco. the streets near the ferry building were filled

people were killed and 30 hurt during new year's celebrations. that's after a truck plowed into the crowd on bourbon street in the city's popular french quarter. the police chief says the driver was, quote, trying to run over as many people as he possibly could. witnesses say the driver also got out of his truck and started firing a weapon into the crowd. police returning fire. the suspect was killed after that firefight with

police. the fbi is investigating this as a terror attack. a press conference is scheduled for 9:00 this morning. >> our time is now 713. police in palo alto are investigating several break ins at businesses. in the past two weeks, four downtown businesses were burglarized. some of the break ins appear to be connected. the owners of the copa cafe say thieves broke into the restaurant early yesterday morning, and they stole at least $1,000 in cash. and right across the street from the cafe, burglars hit the restaurant nola, just before christmas, breaking into a safe and caused thousands of dollars in damages. well, the bay area rang in the new year with this, a dazzling fireworks show over san francisco bay. several downtown streets in san francisco were blocked off, so spectators could get a good look at the show. some of the best seats were right outside the ferry building, but this light show could be seen from miles away. >> time now 714, and it is a

colorful new year's day tradition dating back more than a century. tens of thousands of people lining up the streets of pasadena for the 136th tournament of roses parade. let's go now live to reporter mario ramirez, joining us from pasadena. good morning. happy new year. i hear it's a bit cold out there still maybe about 40 degrees where you are, but i expect it's going to warm up. >> yes, claudine. good morning. happy new year to you. it may have warmed up to about 50 degrees, but it's still pretty chilly out here. we're bundled up. a lot of people got their gloves on. they are warm, and we're near the start of the five and a half mile parade route. i want to show you one of the 39 floats that are featured in this year's parade. now, this is the honda float. electrified dreams is the title and it is covered with roses, carnations, and all types of seeds and other natural materials. every visible inch. now these are made with the framework of steel and chicken wire, and they're covered with those all natural materials.

each year, the tournament of roses selects three judges to grant awards based on criteria including float design, floral presentation, and entertainment value. 24 awards have already been granted, but the overall most beautiful float awarded. the sweepstakes award went to the san diego zoo float. so something to keep in mind and look for during the parade. this year's theme, best day ever celebrating life's most memorable moments. we can tell you that sports icon billie jean king is this year's grand marshal. these average 50,000 flowers per float and this is a huge event. 50 million people are expected to watch. this is broadcast in 39 countries, and we have some people here that are among the crowds waiting for the parade to get started. let me ask you, what is it like to be out here? is this your first parade or one of many? >> no, i've been here many times, but this is the first time to be in this position, so i'm so happy. >> you've got a very close seat, so thanks for talking to us. we

yet barely one fifth of them are professionally employed. the rest are either unemployed or chronically underemployed. >> and sherman was no exception. graduating from san francisco state university with a degree in environmental studies with a special concentration in social justice, he found himself unable to find a job in his chosen field, so he took a job stocking shelves at trader joe's. but while he couldn't get the job he wanted, he donated his time volunteering with various community organizations. it was that effort that got him noticed by miyamoto's team. >> he was actually on one of the teams that were doing safety patrols in chinatown, and so his commitment to the community was already evidenced by that volunteer work. >> that commitment and a reputation that preceded him, landed sherman that coveted job, leading miyamoto's critical reelection bid, helping the incumbent snag more than 80% of the votes. and trusting your election campaign to anyone is a big deal. but miyamoto told me sherman's autism was never a factor in his decision. >> i don't think i even asked

any questions about whether or not he'd be able to do things. >> the autism society and advocacy group hopes more companies and organizations actually adopt sheriff miyamoto's thinking, because they see hiring someone on the spectrum is actually good for the bottom line. >> we look at different ways of information processing and different ways of executive function. we might have folks who think in a very systemized way, but we might have folks that think from a bottom up sort of perspective, and that can bring a lot of creativity and other pieces. >> the organization cites research that shows companies that embrace neurodiversity are likely to have a competitive advantage, and businesses employing autistic individuals report increased innovation and problem solving capabilities. >> i think the idea that when we're open to bringing in neurodiverse and autistic talent to a workplace, understand that there's sometimes let's figure out where the best fit could be. let's talk to the individual. where do you think your strengths are? >> it's a conversation that sherman wants to grow in public

can see just a handful of cars rolling on through on that bridge. and if we take a look at the east shore freeway, this can be a busy spot. busier than the other spots we just looked at, but still looking just fine, as you can see in the westbound direction there. folks making their way either to oakland or into san francisco in the other direction. or i should say westbound is busy. eastbound is fine, but busy is all relative. this morning. all right. at 731, we want to go now to the developments out of new orleans this morning. we're monitoring those. police say a man deliberately drove his truck into a crowd celebrating the new year. this all happened in the french quarter. >> and right now we know at least ten people were killed. more than 30 others were hurt. >> authorities say after driving into the crowd, the driver opened fire on the crowd and was then killed in a shootout with police. you're taking a look at new video from that scene that shows the massive police response to that attack. now, the driver's identity and any possible motive has not been

released. law enforcement also found what they believe is a homemade explosive. they are working to determine if it was active. >> what i'm asking at this time are prayers for those who have lost their lives in the city of new orleans due to this tragedy. >> it did involve a man driving a pickup truck down bourbon street at a very fast pace, and it was very intentional behavior. this man was trying to run over as many people as he possibly could. >> among the injured, two new orleans police officers who are now in the hospital after getting shot by the gunman. we are expecting an update around nine this morning and we will bring that to you live. and new orleans police superintendent anne kirkpatrick may look familiar to us here in the bay area. that's because she did serve as oakland's police chief from 2017 until 2020. she was the city's first female police chief. kirkpatrick was fired

information about that third incident, and we will bring that to you when we get it. but clearly, a very busy night in oakland and a busy night for police officers here live in oakland. amanda quintana ktvu, fox two news. >> all right, amanda thank you. well, ktvu has new video to show you to show you how not to celebrate the new year. just look at the pictures. overnight, the police rushed to several sideshows. one of them in vallejo, happened about 2 a.m. at kentucky and alameda street. it was broken up by vallejo police. another sideshow in oakland happened just before three in the morning on macarthur and markley street, market street. at one point, a car dangerously spun into the

crowd. spectators also were firing off fireworks and set a car on fire. there's no word yet if any arrests or injuries were involved. >> well, a recent investigation found an oakland police officer violated the department's policy on racial profiling. that is according to the community police review agency. >> this is the first time the agency has ever come to that conclusion, and likely you haven't heard much about it. but as ktvu. james torres tells us, one man who triggered this investigation wants you to know how much authority it holds in holding police officers accountable. >> february 2023 oakland police officers are proposing to a committee to use military style weapons at sideshows, a problem plaguing city streets for years. one comment raised eyebrows. >> a vast majority of those subjects that are engaging in sideshows are young adults,

particularly male adults. and over 60% of folks who are engaged in sideshow. activity were, you know, south american latin culture and stuff like that. >> what does 60% have? 60% being latin america have to do with anything, some listening, are members of the oakland police commission, a group born from a ballot question in 2016. >> their job is to serve as the check and balance of opd has seen weapons. >> they frisked 60% of the of the participants at sideshows. >> it's why mariano contreras, a 75 year old local activist for minorities, looked to the commission when he heard those comments. >> when someone profiles you and they carry a weapon and they believe that you are armed and you're participating in a sideshow, then that was concerning. i'd like to see some

statistics about the 60%. i mean, how do they you know, i'd like to really look through that officer's lens and goggles and see, you know, where is where does where does he determine that there's 60% of us. >> contreras says he never saw those statistics. in that same meeting, the officer says language barriers make it harder to justify use of force. force that could be necessary if sideshows get out of hand. that, too, is called out by another committee member. >> if it doesn't have the capacity to give instructions in spanish. i don't care whether it's a dangerous situation or like people are planting dandelions. you have to be able to communicate in the language of the people that you're interacting with. >> two months later, contreras went to the full police commission, asking it to launch an investigation. >> this is racial profiling, folks at its best. >> according to opd policy, racial profiling is defined as using race, ethnicity, or

national origin in determining suspicion or probable cause against a person. it's also illegal statewide. this complaint went to the community police review agency. it's the investigating arm of the police commission. matt muir is its executive director. >> this is an agency that's coming with expertise in those areas, ensuring that law enforcement adheres to those standards. and in this day and age, i think that's more important than ever. >> the cra took nearly a year to investigate this case, and many others like it, have never been sustained, meaning there almost always isn't enough evidence to say an officer violated policy. did you have any confidence that this would go anywhere? >> you know, i believe that i did. >> in february this year, muir announced this investigation was sustained, the first of its kind in oakland history and one of 65 total sustained investigations in the last year. muir recommended a discipline plan to

the police chief, which is usually in the form of a training, suspension or even termination. all of those details would normally be public, but state law protects that information so long as an appeal is underway. that's likely happening with this case. >> an investigation isn't over until it's truly over and all appeals have been exhausted. >> we asked opd about the investigation, the appeals, and its efforts toward racial profiling. a spokesperson says the department would not talk about personnel matters. following an open records request, opd said its internal affairs department was consulted and no disclosable information could be released. it's why, contreras says the public needs to know more about the police commission and the ccra. >> it's also going to send a message to not only those two officers, but all officers across in the city of oakland is that, you know, you have to be careful now, you know, not only by making the statements, but also in believing in changing that culture.

prohibits local governments from requiring voter ids in order to cast a ballot. the law was a response to huntington beach residents passing an amendment to allow the city to require identification in local elections. the state is suing huntington beach. they say the amendment violates voting rights protections. and drivers, you're going to pay $8 when you go across almost all bay area toll bridges, along with the mtc, the bay area toll authority, they voted to approve several toll increases beginning in 2026. now, under the toll hikes, some drivers will be paying as much as $11.50 by the year 2030. the mtc says those higher tolls will help pay for bridge maintenance. the toll hike does not include the golden gate bridge. its tolls were increased in july of last year. >> the national weather service has issued a frost advisory for

start in the next hour on that deadly rampage in new orleans. >> what a story overnight. a man drove a pickup truck into a crowd of people celebrating new year's. at least ten people are dead, 30 others are hurt. >> and the fbi is now investigating this as a possible terror attack. this all happened at the end of new year's celebrations on bourbon street. that is in one of the city's most popular tourist areas, the french quarter. authorities say a driver plowed into a crowd about 315 in the morning, new orleans time. the suspect also fired shots at first responders who had rushed to the scene to help the victims. >> because of the intentional mindset of this perpetrator who went around our barricades in order to conduct this. he was #### bent on creating the carnage and the damage that he did.

>> the suspect was shot and killed after a firefight with police, but his identity has not been revealed yet. the fbi says an improvised explosive was also found, and the white house says president biden has been briefed on the situation. again, a press conference is expected to start around nine this morning, and we will bring that to you. live here on mornings, on two and on our website and fox local. >> our time now. 804 new this morning in oakland. it's been a deadly start to the new year, with three homicides reported in less than ten hours. last night. one person was stabbed around 8 p.m. on 70th avenue in a residential area not far from markham elementary school. 2.5 hours later, police were called to jack london square because of a shooting. they found the victim with a gunshot wound. that person was rushed to a hospital. police later found three other victims took themselves to the hospital. one of those victims died. the third

attack happened on 24th avenue about 345 this morning. police haven't confirmed what happened in this case, but in video from the scene, you can see a body and a lot of police investigating. ktvu is amanda quintana will join us in about 30 minutes from now to give us an update on what was a very deadly final day of 2024, in oakland. >> happening today, california will require insurance companies within the state to cover homes in high fire danger areas. the california insurance commissioner announced a package of reforms, including one that allows insurers to use computer catastrophe models to set rates. and in exchange for the use of those tools, the companies commit to sell more insurance, especially in wildfire prone areas. >> it is going to make it infinitely easier not only to obtain coverage, but to get competitive bids from more than one company. when there are more options, there's more competitiveness in the marketplace and prices will tend

to go down. >> but the consumer advocacy group called consumer watchdog is warning that the regulations may be flawed. >> the problem with this kind of complicated regulation that is presented as a fait accompli at the end of the year, without an opportunity for comment. now, an opportunity for amendment is it's it was clearly drafted by the insurance industry for the insurance industry. and it's not going to benefit anyone but the insurance industry. >> the consumer watchdog group says insurers can now charge for the cost of reinsurance. reinsurance policies are bought by companies to protect them from massive losses, such as big wildfires and other natural disasters. the consumer group is planning on challenging the new regulations in court. >> time now 806. starting today, california's minimum wage goes up. employers now have to pay a minimum of $16.50 an hour. now, last year, employees at certain health care facilities received

a higher minimum wage from 18 to $23 an hour, depending on the facility. and some california cities and counties actually have minimum wages that are higher than the state's. >> the stock markets are closed today because of the new year. and here in california, we're starting 2025 with a stagnant labor market. but as ktvu tom vacar tells us, one sector of the economy made up for sluggish job gains elsewhere. >> california's unemployment rate from a year ago ended up at 5.4% from 5.1%, but that's the second highest only to nevada, well above the nation's current rate of 4.2%. >> it's not merely higher than it was a year ago, but our job growth has slowed. we gained only 11,000 jobs in the past month without substantial gain in health care jobs. >> vernick says the golden state might have had no gains at all.

johnson, setting up a potential fight to fill that leadership position. >> our time now. 825. the city of oakland ended 2024 with all types of major crime rates down from january 1st through december 29th. oakland police recorded 77 homicides. that's fewer than the same period last year. the number of robberies have dropped by 1100 and reported car break ins dropped 50%. meantime, the city of vallejo named its new police chief, jason todd. he's been serving as the interim chief, has been selected to serve the as the department's permanent police chief. todd took over as the interim chief in 2022. he served for more than 27 years with the san jose police department before joining the vallejo department in 2021. the city of vallejo says he has helped to stabilize staffing levels, improve the relationship with the community, and also help to implement state reforms.

back. arrive into the bay area. that's in just a few minutes from now. >> okay. thanks, roberta. well, let's take you out on the roads for a quick check of how things are moving, and they're moving along just fine. here's the golden gate bridge and the toll plaza. whether you're going in or out of the city, headed in or out of the north bay, things look great on the richmond-san rafael bridge. also, not a lot of traffic for you on this new year's day, as many people have this holiday and the east shore freeway. it's even lighter than we looked at it a short time ago. so if you have to get out and about, you should have some smooth sailing. >> all right. claudine. time is now 832. we're still monitoring the developments from new orleans this morning. that's where police say a man deliberately rammed a pickup truck into a crowd of people celebrating new year's in the french quarter. right now, at least ten people are dead. more than 30 others were hurt. authorities say that driver also fired shots into the crowd. the driver was killed in a shootout with police. at this point, we still don't know the man's name

or a possible motive, but the fbi is investigating this as a possible terror attack. law enforcement found what they believe is a homemade explosives. they're trying to find out if it was an active explosive. >> what i'm asking at this time are prayers for those who have lost their lives in the city of new orleans due to this tragedy. >> it did involve a man driving a pickup truck down bourbon street at a very fast pace. and it was very intentional behavior. this man was trying to run over as many people as he possibly could. >> now, among the injured are two new orleans police officers who are in the hospital after they were shot by the gunman. we expect to get an update in about a half hour from right now. we will bring it to you here live when it begins on ktvu mornings on two. >> well, it has been a deadly

end to 2024 and start to 2025. in oakland, with reported four homicides over the last day. ktvu is amanda quintana live for us in oakland with what we know so far. amanda. >> well, three of these incidents happened overnight, killing three people in less than ten hours. the first of those incidents happened around 8:00 last night. it happened on 70th avenue in a residential neighborhood there where there was a stabbing. police responded they brought that victim to the hospital, but they say that they were pronounced dead at the hospital. now, 2.5 hours later, a second incident happens. police are called to second street in jack london square for a shooting. there, they found a victim with gunshot wounds. that person transported to the hospital as well. but police later learned that three other victims took themselves to the hospital. one of those victims died. police tell us the other three are still being treated at the hospital. now, the third

happened on 24th avenue around 345 this morning. police have not confirmed what happened there, but in video from the scene, you can see a body and a large police presence investigating. now this all happened overnight. but there was also a deadly shooting yesterday morning. a man was shot outside a commercial dishwashing supplier on 14th street just before 715 in the morning. he was pronounced dead at the scene. now, although this is a deadly end to 2024, crime is actually down in the city overall. last year, just two days ago, city leaders touted a safer oakland, saying the city is seeing a 34% decrease in homicides, and they're crediting the ceasefire prevention strategy for a lot of that progress. now, that strategy identifies people at high risk of being involved in gun violence and offers them services like life coaching, job training and mental health care. staffers say they contacted more

than 200 people over the year 2024. now we are working on getting some more information about that most recent incident, but clearly a very busy end of the year for opd. live in oakland amanda quintana ktvu, fox two news. [applause] [music] >> bay area rang in the new year with fireworks. thousands of people gathered near san francisco's waterfront to watch the city's fireworks show, which was easy to see this year because there was no fog. and those visitors came from all over the bay area and beyond. we do not have the final numbers yet, but firefighters expected as many as 100,000 revelers to watch last night's fireworks show in san francisco. and there were a lot of police officers and firefighters there, too, to make sure those crowds stay safe. people we talked to said

fireworks. well, the chp says maximum enforcement period for the new year's holiday is in effect through tonight, which means you'll be seeing lots of officers patrolling bay area highways all day long. ktvu was given a chance to ride along with the chp crew, as they kept an eye out for dangerous drivers on new year's eve. now, while we were with them, we saw them pull some people over for driving infractions, as well as also helping people who were having problems with their cars, focusing on driving to arrive, especially during the holiday season. >> we're focusing on speed enforcement, reckless driving, distracted driving, driving under the influence. >> it's not just about writing tickets, it's not just about enforcement. we just want everybody to be safe for the holiday season. >> indeed, and the maximum enforcement period ends tonight at midnight. >> well, the new year means new laws in california and several new laws going into effect aimed to increase the amount of housing in our state. one law

cracks down on cities that block or delay new housing projects. the law gives the attorney general the power to impose penalties of up to $50,000 a month on violators, and that money would go towards supporting affordable housing projects in those same cities. another law focuses on ramping up construction of accessible dwelling units, also known as adus. the law would increase the number of adus allowed on multifamily properties. currently, homeowners can have no more than two adus on a property, but the new law increases that limit to eight. it also streamlines the process for approval. and farmworkers will be getting some housing assistance as well. a new law is making it easier to build new housing for farmworkers in santa clara and santa cruz counties. the goal is to help the workforce find affordable, stable housing that's close to their jobs. >> time is now. 839 police in palo alto are investigating several break ins at businesses during the holiday season. in the past two weeks, four businesses in downtown palo alto

were burglarized. some of the crimes appear to be connected. the owners of the copa cafe say the thieves broke into the restaurant early yesterday morning. they stole at least $1,000 in cash. other stores reported thousands of dollars in stolen merchandise as well as damage. all four businesses are less than a half mile away from the palo alto police headquarters, and the owners say they're frustrated with the police department's response time. >> even after police are dispatched, the thieves still do their dirty work because they know the system. they know how long it's going to take for the police to respond, and they go in and out at leisure. >> now, next monday, the palo alto police will meet with the business owners to talk about these recent break ins. >> well, first, for oakland police, the investigation that found an officer violated the department's racial profiling

ten people are dead, and dozens more are in the hospital injured. police say this crash was intentional. the driver was shot and killed by police. now the fbi is investigating this as terrorism. we expect to get an update coming up at 9:00 this morning. the rose parade in pasadena is underway today. large crowds are gathered along the parade route in pasadena. some of the people were sitting out there all night just to claim their spot. the parade is a new year's day tradition. it dates back to the year 1890. and don't forget, you can see the rose parade live with our sister station in los angeles by downloading the fox local app, and then click on los angeles, and fares are higher to starting today on muni and on bart. the fare to pay with clipper cards on busses and streetcars in san francisco went up $0.25 as of this morning, and on bart the

fares went up by about $0.25 as well. it all depends on the ride. both transit agencies say the higher fares will help them deal with rising costs. >> a recent investigation found an oakland police officer violated the department's policy on racial profiling, and that is according to the community police review agency. it's the first time the agency has ever come to that conclusion, and it's likely you've not heard much about it. >> but as ktvu james torres tells us now, one man who triggered this investigation wants you to know just how much authority it holds in holding police officers accountable. >> february 2023 oakland police officers are proposing to a committee to use military style weapons at sideshows, a problem plaguing city streets. for years. one comment raised eyebrows. >> a vast majority of the subjects that are engaging in sideshows are young adults, particularly male adults, and

over 60% of folks who are engaged in sideshow activity were, you know, south american latin culture and stuff like that. >> what does 60% have? 60% being latin america have to do with anything, some listening, are members of the oakland police commission, a group born from a ballot question in 2016. >> their job is to serve as the check and balance of opd has seen weapons. >> they frisked 60% of the of the participants at sideshows. >> it's why mariano contreras, a 75 year old local activist for minorities, looked to the commission when he heard those comments. >> when someone profiles you and they carry a weapon and they believe that you are armed and you're participating in a sideshow, then that was concerning. i'd like to see some statistics about the 60%. i

mean, how do they you know, i'd like to really look through that officer's lens and goggles and see, you know, where where is where does he determine that? there's 60% of us. >> contreras says he never saw those statistics. in that same meeting, the officer says language barriers make it harder to justify use of force. force that could be necessary if sideshows get out of hand. that, too, is called out by another committee member. >> if it doesn't have the capacity to give instructions in spanish. i don't care whether it's a dangerous situation or like people are planting dandelions. you have to be able to communicate in the language of the people that you're interacting with. >> two months later, contreras went to the full police commission, asking it to launch an investigation. >> this is racial profiling, folks at its best. >> according to opd policy, racial profiling is defined as using race, ethnicity, or

national origin in determining suspicion or probable cause against a person. it's also illegal statewide. this complaint went to the community police review agency. it's the investigating arm of the police commission. mac muir is its executive director. >> this is an agency that's coming with expertise in those areas, ensuring that law enforcement adheres to those standards. and in this day and age, i think that's more important than ever. >> the cra took nearly a year to investigate this case, and many others like it have never been sustained. meaning there almost always isn't enough evidence to say an officer violated policy. did you have any confidence that this would go anywhere? >> you know, i believe that i did. >> in february this year, muir announced this investigation was sustained, the first of its kind in oakland history and one of 65 total sustained investigations in the last year. muir recommended a discipline plan to the police chief, which is

usually in the form of a training, suspension or even termination. all of those details would normally be public, but state law protects that information so long as an appeal is underway. that's likely happening with this case. >> an investigation isn't over until it's truly over and all appeals have been exhausted. >> we asked opd about the investigation, the appeals, and its efforts toward racial profiling. a spokesperson says the department would not talk about personnel matters. following an open records request, opd said its internal affairs department was consulted and no disclosable information could be released. it's why contreras says the public needs to know more about the police commission and the ccra. >> it's also going to send a message to not only those two officers, but all officers across in the city of oakland is that, you know, you have to be careful now, you know, not only by making the statements, but also in believing in changing that culture. >> muir says anyone can file a
