during that whole time. >> he'll try to do the shot and drink as much of the beer as he can, and then walk out. >> before that happens, though, bar staff have asked him if he wanted to use their atm, he would say he doesn't want to pay the atm fees. >> i do want to say we have bigger fish to fry. as small business owners. this is this is more of an annoyance. >> there are no pending cases against scott in san francisco. >> somebody's doing something like this endlessly. it can really affect the business. so i'm very sympathetic to the restaurant owners. >> san mateo county da steve wagstaffe says scott has been charged with dining and dashing at a bar and cookery in san mateo a year ago, as seen here, as well as at a sushi restaurant. >> on one occasion, he used the excuse of i've got to go to an atm to get money. he walks out and does not pay for it and isn't seen again. >> on new year's eve, san bruno police arrested him for allegedly stiffing red lobster. >> i just wish he would. we all just want him to stop doing it. just leave us alone and stop robbing us. >> so a guy walks into a bar.

mike, as you know, it's the start of that classic bar joke. but in this case, bar owners across the bay area say this is no laughing matter. now, he was cited and released from red lobster. so owners tell me they have seen him repeatedly come again for free drinks. so it remains to be seen whether he's learned his lesson. >> there you go. henry lee. live tonight in san francisco. henry. thank you. staying in the city. murder charges have now been filed in san francisco's first homicide of the year. prosecutors say 29 year old jose rivera flores shot and killed a man at a gas station on the corner of 17th and south van ness just after midnight on new year's day. there is still no word on a motive for the killing. san francisco police are welcoming its newest class of recruits. the two 283rd recruiting class is being sworn in right now at a ceremony at the scottish rite masonic center on 19th avenue. the 12 officers completed 34 weeks of training. seven of the members are bilingual, and six have earned either a bachelor's or associate's degree. after

tonight's ceremony, the newly sworn officers will begin a 16 week field training program at various stations across the city. the city of antioch is expected to introduce its newest acting police chief tomorrow. brian addington, the current acting police chief who came out of retirement to fill that position, is retiring once again. no word on who antioch's next police chief will be, but they will be starting the job. just days after the city reached a settlement with the department of justice to resolve the investigation into several racist text messages and use of force scandals. police in san jose teamed up with stockton police to arrest two people on drug and weapons charges. investigators say 37 year old justin dixon and 26 year old jade linton were arrested on january 2nd after officers searched dixon's home in stockton. dixon is accused of traveling from stockton to sell fentanyl and other illegal drugs in san jose, as well as san francisco, while lin is accused of buying guns for dixon, who is prohibited from owning firearms. >> we were able to uncover an

array of evidence, including 13 illegal firearms. now these firearms, two were stolen, two were unregistered and two had destroyed serial numbers. >> officers say they also found large amounts of cocaine, oxycodone and other illegal prescription medications. san jose police say dixon was identified as a supplier after intercepting a fentanyl sale just a month prior. both suspects were booked into the san joaquin county jail. and new information about a police shooting in the east bay. we now know the man who oakland police shot this past weekend pleaded no contest to carrying a loaded gun in a car just two days earlier. oakland police say sergeant jared blue lowry shot 25 year old reggie lacy early saturday morning during a foot pursuit on macarthur boulevard. officers say lacy fired a rifle prior to being shot during the pursuit. he eventually barricaded himself inside a home before surrendering. hours later, lacy was grazed by the

bullet and treated for the injury, and is now being held in the county jail. major changes in oakland leadership. the city council unanimously voted to appoint council member kevin jenkins to the role of council president and interim mayor. but another big story also brewing at city hall in oakland, jana katsuyama here, now in studio and a familiar face, jenna has taken a step to run for mayor here in several months. >> that's right. mike. congresswoman barbara lee's preliminary paperwork was filed today with the oakland finance ethics commission office. it is a required first step to run for mayor in the april special election. and it happened just as the city council began their special meeting to choose a new interim mayor. >> a day of big changes monday at the oakland city council meeting. [applause] by a unanimous vote, the new city council appointed district six councilmember kevin jenkins to be president and fill the role of interim mayor. jenkins is the third person in two months to lead the city, after

police academies, temporary closures of six fire stations, and cuts to arts and public works projects. so who would want the job of mayor? on monday, paperwork was filed for congresswoman barbara lee to enter the special election for mayor. >> she has been incredibly diligent, making sure she understands where the city is and what the opportunities are. i know she's also talked with mayor karen bass down in la, and so she has not taken this decision lightly. >> she's met with countless leaders throughout the city of oakland, and she's very deeply aware of what the challenges are for the next mayor. >> i want to get a transition plan ready so that that person can hit the ground running. that person will come in in the middle of our budget process. first and foremost is public safety and the budget process. we need to make sure that our fire stations stay open. >> the city clerk says congresswoman lee still needs to file nominating signatures and other paperwork to officially be on the ballot. her spokesman says that she expects to make a statement later this week. and so far, mike, there are 13

candidates who have filed with the clerk's office. the deadline is january 17th. all right. >> thanks. friday. jenna. thank you. the city of oakland closed two fire stations today in order to help bridge its multi-million dollar budget deficit. tonight, residents and firefighters both expressing their worries about public safety. and as ktvu tom vacar reports tonight, more stations could also be closing those bay doors. >> the singular question for oakland firefighters who want to save their 156 year old department is can they sound the alarm loud enough? enough to serve 80,000 fire and medical service calls every year? residents in ten hill communities from part of shepherd canyon to grass valley. more than six miles west will be the most impacted given longer travel times from available remaining stations. >> you will not quickly have firefighter paramedics to help you or your family. and what could have been a small blaze or a small fire near your house

will become a conflagration, leaving tragedy in its wake. >> then consider four more station closings next month. >> chief covington has been very clear that while these two additional closures are difficult, the four additional closures are going to be impossible. >> the city administrator is gambling with the lives of oakland residents. >> then there are the voters who fully understand the power of recalls, now including incoming councilman zach unger, himself a former firefighter. >> the closure of seven firehouses would be the end of the oakland fire department as we know it. we simply cannot afford to close that many stations. that is a third of our firefighting capacity. >> already, the police services have been cut. the response time to a police. if you got a burglary, you're not getting an officer. you have to be in immediate, absolute physical distress to get an immediate response. >> what are they going to do if it's a major fire or a flood or anything? so that's mandatory.

because february is right around the corner. tom vacar, ktvu, fox two news. >> governor newsom is proposing a $322 billion budget without a deficit. the governor unveiled his budget plan today in turlock. it comes after two years of significant budget shortfalls. the governor says he's, quote, proposing little new spending, end quote. now, his plan does include additional investments in public safety and health care and funding for education and infrastructure. the plan is mostly a placeholder until the month of may, as the state waits to see if president elect donald trump will follow through on threats to revoke billions of dollars in federal funding to california. >> revenues in the state are up $16.5 billion. this is a snapshot subject to change significantly by may. a snapshot of the revenue projections above and beyond what we had projected last year. >> governor newsom's

gate national rec area officials say the point bonita lighthouse in the marin headlands is closed until at least this coming sunday, after a small landslide blocked part of the trail. the lighthouse, built back in 1855, shines out on golden gate strait. visitors can typically go to the lighthouse on sundays and mondays this time of year. a warning to beachgoers about sneaker waves. strong rip currents along the coast tonight and tomorrow. officials warn of large waves that can hit the beach, and then pull people standing on those rocks right into the water. as always, they say, please pay very close attention to your surroundings and do not ever turn your back to the ocean. with that, we bring in our meteorologist, roberto gonzalez, with a closer look at those conditions. roberta. mike. >> i took a look at some of the local buoys and they have been exceeding 18ft in elevation. as far as your wave heights are concerned. hi, everybody. good evening to you. and depending on your location, the water temperatures roughly about 53 degrees. but here's the story. we do have a lot of activity out over the open waters. it's generating some high waves. and therefore the national weather

service has issued that beach hazard statement in effect through tomorrow night. again, these waves lap on shore. so, as mike was alluding to, never turn your back to an angry ocean. and here's that area of low pressure causing all the storminess all the angriness out over the open waters. it's going to continue to move to the east and drop to the south and stay positioned right over that four corners state, setting the stage for an offshore push. but right now we do have the dense fog that is pushed into sfo. the ceiling is roughly down to 300ft. the fog will be pretty patchy and then it's going to be wiped away. i'll tell you why, but first things first. temperatures into the 50s across the board, 46 degrees in fairfield. i wanted to share the current wind speeds with you. they're generally under ten miles per hour, and our inland areas are now beginning to pick up around the peninsula, all the way into redwood shores. 12 mile per hour winds noted around the seashore. these winds are going to change

13 people killed in that terror attack during a visit to new orleans today. the president and first lady attending an interfaith prayer service at the historic saint louis cathedral. tonight, the names of those killed were read as candles were placed on the altar. most of those who died were in their 20s. president biden saying he and the first lady want their families to know they're not alone.

spreading the word about a man known for skipping out on his tabs. he's been identified as 36 year old jared anthony scott. scott was recently arrested for dining and ditching at a red lobster in san bruno. oakland has a new interim mayor. the city council unanimously voted to appoint council member kevin jenkins to the role of council president and interim mayor. he is the third person in just two months to lead the city, following the recall of xiang tao earlier today. former congresswoman barbara lee filed some paperwork in a first step toward a possible run for mayor of oakland. a spokesperson says lee will be making an announcement about if she will run later this week. and president biden and the first lady paying tribute to the 14 people killed in the new year's day terror attack in new orleans, carried out by a u.s. army vet. after meeting with victims families, they viewed the crosses set out on bourbon street. president biden, by the way, is scheduled to fly to

poll on x asking users if america should, quote, liberate the people of britain from their tyrannical government. musk has recently voiced support for far right wing causes in both britain and germany. a judge has denied president elect donald trump's request to pause sentencing on his criminal hush money case indefinitely, while his lawyers appeal. sentencing is scheduled for friday in manhattan. trump's lawyers argued that their appeal to a higher court should trigger an automatic pause in the proceedings. no arguments have been scheduled in that appeal. in the last hour at 4:00, we sat down with uc law professor david levine, who said, the judge wants to wrap up the case. >> commonly, what happens is that you get your sentence and then you appeal both the conviction and the sentence together. mr. trump is trying to separate those out, so he's really asking for something that's quite unusual. and i think judge merchan quite properly said no. >> the president elect could still ask an appeals court to delay sentencing. a delay would

likely mean the case will not be closed until trump's second term ends. the judge has already signaled that trump will not likely face any jail time. former new york city mayor rudy giuliani has been found in contempt of court. this comes after a judge said giuliani has failed to turn over assets to satisfy $148 million defamation judgment against two georgia election workers. he's already turned over his new york apartment, as well as a mercedes benz. however, he has yet to hand over watches and sports memorabilia, including a yankees world series ring. the judge says he will decide on appropriate sanctions against giuliani at a later date. the department of defense has reached a historic legal settlement with lgbtq plus veterans discharged under don't ask, don't tell. the class action lawsuit was brought by veterans who discharged. papers say they were kicked out because of their sexual orientation. in many cases, they received less than honorable discharges, which can interfere with their benefits, as well as eligibility for some jobs. under the

chains, rolling back its diversity goals. mcdonald's announcing it is ending some of its diversity practices, citing the supreme court's 2023 decision outlawing affirmative action at college in college admissions. the company says it will no longer set goals for representation and hiring, and will stop requiring its suppliers to sign mutual commitments to diversity, equity

and inclusion. walmart, john deere, harley-davidson and others have also rolled back diversity programs. a new study finds women who have heart disease may have a greater risk of developing aggressive breast cancer. researchers from the university of texas md anderson cancer center found those with advanced or metastatic breast cancer at diagnosis were more likely to have preexisting cardiovascular disease versus those with early stage cancer. the senior author of the study says cardiovascular disease can create an immunosuppressive state, which can potentially induce accelerated breast tumor cell growth and spread. the finding suggests women with heart disease may benefit from more frequent or earlier breast cancer screenings. norovirus is on the rise, according to the centers for disease control. from august to last month, 495 norovirus outbreaks were reported across the country. that's compared to 363 outbreaks reported during the same time last year. the highly contagious

tuesday. sunup is at 725. same drill there. 30 mile per hour winds. and throughout the santa cruz mountains, where we do have that wind advisory in place. check that out at high noon tomorrow. 24 mile per hour winds in calistoga, 23 in santa rosa and 43 mile per hour winds by 7:00. this time tomorrow night in throughout portions of the north bay. and it just keeps ramping up 45 mile per hour winds before all begins to settle. by the time you wake back up on wednesday morning, it's all generated by this area of low pressure off the seashore right now, and it's nestling into the four corners states as it does so, it's causing this pressure gradient with the offshore push. so the bottom line is the relative humidity is going down, the temperatures increasing and so are the winds. and that's also turning up the surf. we do have waves up to 20ft lapping on shore. never turn your back to the ocean. if you do decide to go to the coastline. meanwhile fire danger in southern california we call them diablo winds here, the santa ana winds there. and boy,
