tomorrow morning, the city will name its new acting police chief. the yet to be named chief will be the city's third acting chief in less than two years. good evening everyone. >> i'm mike mibach and i'm claudine wong. tomorrow's announcement comes on the heels of antioch coming to an agreement with the department of justice to put the department under federal oversight for at least five years, following the racist text message scandal. ktvu is amber lee joins us live from antioch tonight. she spoke with those who say the department is in need of some stability and reform. amber. >> claudine. city officials plan to announce the new acting police chief tomorrow at the police department. now, residents we spoke with say they don't know who that person is. they're worried about who it will be. and if that person has the ability to solve the department's problems. on tuesday morning, antioch city leaders will name the new acting police chief. this will be the third acting chief since police chief stephen ford retired about

a year and a half ago. >> why have we had so many interim police chiefs? why haven't they selected a permanent police chief? >> ralph hernandez is a former antioch city council member. he says he's worked in law enforcement for more than three decades, including the pittsburgh and half moon bay police departments, and as an investigator for the contra costa da's office. he says antioch has been dealing with serious problems such as violent crime and officer misconduct, including racist text messages. >> you need a really kick type of even interim police chief. >> city officials announced that it had entered into an agreement with the department of justice. this came after the doj launched an investigation into the police department after the racist police text message scandal and use of force practices. under the five year agreement, the police department will hire an expert law enforcement consultant. the city said in

part, we will implement and strengthen sound policies, training programs, community participation and oversight mechanisms to ensure officers act with integrity and justice and that any misconduct is addressed quickly and effectively. >> they do need oversight, and they do need a chief that's going to come in here. and like i say, be empathetic and transparent with what we've been through. >> catherine wade says her late son was the victim of police brutality by antioch police officers on multiple occasions. 29 year old millard baldwin died after an unrelated medical episode in 2021. wade tells me the doj interviewed her twice during its investigation into the police department. she hopes that the new interim chief, and eventually a permanent chief will listen to community concerns. >> this community really needs healing. >> well, tonight i spoke with both the mayor and the current acting police chief. both

declined to answer any questions, including who the new acting chief will be and also when a permanent chief will be selected. now, the new chief, i'm told, will be sworn in on friday. residents tell me the doj will be holding a community meeting on thursday. claudine. mike. >> so, amber a lot happening this week. do we expect those city officials at tomorrow's announcement of who the acting chief will be, will answer some of those timeline questions? and you know, when a permanent chief might be installed? >> when i spoke with both those gentlemen earlier, they both said there will be more details coming tomorrow morning. >> a lot of people will be waiting for those all right. amle reporting live.ha you so much. well, antioch police are investigating tir first homicide of the yea a 26 year old man w found with gunshotndon rockford drive near bmouth drive around 1015 this morning. the victim died at a local hospital ando far, his name has not been released and there's no word of any arrests or a motive in that deadly

shooting. >> the so-called gone girl kidnaper matthew mueller is now being linked to other crimes in the east bay, as ktvu crime reporter henry lee tells us tonight, forensic dna testing has led to new charges in connection to kidnaping cases right near san ramon. >> just a week ago, matthew mueller stood shackled in a san jose courtroom charged with committing two home invasions a month apart in mountain view and palo alto back in 2009. now, contra costa county prosecutors say they've charged mueller with kidnaping three victims for ransom near san ramon in 2015. they say he managed to get tens of thousands of dollars from them in exchange for their release. the victims had kept quiet all these years for fear of retribution. this latest case in contra costa county happened a month after mueller drugged and kidnaped denise huskins in vallejo, raped her in the south lake tahoe cabin and terrorized her now husband. vallejo police had branded the couple liars, saying they made up the attack. mueller is serving 40 years in federal prison and 31 years

concurrently in state prison. in the vallejo case, the da says mueller's m.o. was similar to what happened in the south bay cases. authorities are crediting the work of seaside police chief nick borges, seen here with huskins and quinn in march at a training session for police across the state. the couple urged law enforcement not to fall victim to tunnel vision in solving a case. it was chief burgess who began writing to mueller in prison. authorities say mueller made admissions as to his involvement in the mountain view, palo alto and san ramon cases. at the training session, chief burgess apologized to the couple on behalf of police in general. the chief in santa clara, d.a. jeff rosen, have had this to say about law enforcement's role in investigating mueller. >> we're here because there's so many lessons to be learned where the police really screwed up. i don't know how else to say it. >> we're not perfect in law enforcement, and i think it's fair to say that there were mistakes made in this investigation. >> on tuesday, denise huskins and her now husband aaron quinn, will join chief burgess and other law enforcement officials

to talk about the additional charges mueller is now facing. i will be there and will report back. henry lee, ktvu, fox two news. >> well, new at ten. the santa clara county coroner has identified the pregnant 29 year old woman who was killed in a crash on new year's day. authorities say the woman was with her husband and young son when they were hit by a driver, who has since been arrested on suspicion of dui. ktvu south bay reporter lamonica peters is live outside the santa clara county jail with more. lamonica. >> claudine, we don't have a lot of information about this young woman who died in this car crash, but family members posted on social media about the devastation of losing her and her unborn baby. >> and it's an intersection right there like a t, so you don't pay attention to whatever you can just go straight. >> gilroy resident ruben gonzalez says the intersection of leslie road and new avenue can be dangerous, especially if you're not paying attention. he says sometimes there can be

heavy traffic on leavesley, where a pregnant 29 year old rachel marie gonzalez gallegos lost her life in a car crash on new year's day. >> i live in 10th street and too many years. i mean, it can be taken about ten minutes from from the high school to the to the outlets. right now, it takes like a half an hour to go through there. yeah, it's too much. too much traffic. >> according to california highway patrol, gallegos was riding in a 2021 chevy suv driven by her husband, gonzalez maura, when the suv was hit head on around 6:35 p.m. chp says the 50 year old driver, only identified as mr. thomas, was allegedly speeding eastbound on leslie when his gmc truck veered into oncoming traffic. thomas hit maura's suv and another driver, identified as 34 year old mr. tobar. david gallegos, who says he's rachel's uncle, posted this message on social

man at a gas station on the corner of 17th and south venice. this all happened just after midnight on new year's day. still no word on a motive for that killing. new at ten. >> a retired martinez police chief has been tapped to provide strategic support to the san mateo county sheriff's office. san mateo couy sheriff christina corpus said that manjeet supple has been hired on contract to help with day to day operations, as well as special projects. this comes as the county has set a special election that would allow them to remove the sheriff. following the release of a report detailing allegations of abuse of power by corpus. her lawyers say she is preparing to file a $10 million lawsuit against the county. >> in oakland, major changes happening within the city council. council member kevin jenkins was appointed this afternoon to the new role of council president and interim mayor. >> this all comes on the same day. former congresswoman barbara lee took a step toward running for mayor in april's special election. ktvu jana

katsuyama reports. >> a day of big changes monday at the oakland city council meeting. by a unanimous vote, the new city council appointed district six councilmember kevin jenkins to be president and fill the role of interim mayor. jenkins is the third person in two months to lead the city, after outgoing president nikki fortunato bass stepped in following the recall of xiang tao. >> i believe that he's someone who listens to everyone who has the ability to just focus on what's the solution, the outcome we're trying to achieve and bring folks together that will be really important over these next four months until our election. >> council member noel gayo was appointed president pro tem to lead the council meetings, also by a unanimous vote. the council has three new members. >> i'm able to sit next to noel gallo. legendary. >> i'm really grateful and looking forward to working alongside my amazing city council colleagues. i reject factionalism, score settling and personal aggrandizement. >> if we don't work as a team,

we're going to fail. >> former council member rebecca kaplan was appointed to temporarily fill bass's vacant district two seat. i shall oakland leaders face big challenges. a $129 million budget shortfall has created painful decisions about eliminating two police academies, temporary closures of six fire stations, and cuts to arts and public works projects. so who would want the job of mayor? on monday, paperwork was filed for congresswoman barbara lee to enter the special election for mayor. >> she has been incredibly diligent, making sure she understands where the city is and what the opportunities are. i know she's also talked with mayor karen bass down in la, and so she has not taken this decision lightly. >> she's met with countless leaders throughout the city of oakland, and she's very deeply aware of what the challenges are for the next mayor. >> i want to get a transition plan ready so that that person can hit the ground running. that person will come in in the middle of our budget process. first and foremost is public safety and the budget process.

the item to their local costco for a full refund. >> a patient death in louisiana, now the first in the nation linked to the highly contagious avian flu, which has been spreading among wild birds across the country. now, the virus also driving concerns on bay area farms and at grocery stores. ktvu zac sos is live tonight in colma, where zach, you spoke with one of the store owners there in the city? >> yeah. and that store owner certainly seeing the impact of the bird flu on his egg supplies drastically cut. but a number of shoppers i spoke to saying they're not really concerned about trying to find eggs right now. they're worried about that bird flu death. you just reported. a health expert i spoke to saying, now is not the time to panic. it's a time to use caution. >> people should not be alarmed. >> ucsf infectious disease expert doctor peter chin hong, responding to news of the nation's first human bird flu death. >> it's a different mutation. most people have not been seriously ill.

>> the patient, who had been hospitalized in louisiana after being diagnosed, was over 65 and reported to have an underlying medical condition. still, doctor chin-hong says there are things people can do to better protect themselves, including getting a flu shot and not drinking raw milk or unpasteurized milk products because the risk is just increasing in dairy cattle in california. plus, if you have backyard chickens or a cat. he says, monitor their health. and if they appear, ill, wear ppe if you're bringing them to the vet. >> and i think, above all, if you have symptoms and you have one of these risks, seek medical attention as soon as possible. >> so far, the cdc has confirmed 66 cases of the flu nationwide, with 37 of them in california. meantime, the avian flu, which has been spreading among wild birds, continuing to wreak havoc on chicken farms. causing a widespread egg shortage across the country and here in the bay

area. >> i was at safeway this morning and they had signs no eggs, no, no update on when they'll get eggs. so i thought maybe a local grocer would have eggs, but no luck there either. >> dean's produce in millbrae sold out fast. >> the delivery came 10:00. it's now time. it's 530. >> you know it's going normally. vasileios says his store receives 25 cases of eggs a week from a farm in petaluma. >> now we get, say, 15 cases a week. >> thankfully, he says, so far, his customers have been understanding people they know. >> pretty much everybody knows now. >> and the egg shortage, of course, also driving up prices. an analyst says a box of eggs can cost as much as $10 in some stores, and the prices may not return to normal until this summer. mike. >> yeah, just a couple of months ago, spending $5 for a dozen of eggs. and now all of a sudden that's doubled. happened very

quickly. all right. zac sos live tonight in colma. zach. thank you. health officials in monterey county are warning people about the threat of poisonous mushrooms. they say three people came into the emergency room. emergency room? on new year's eve after cooking with mushrooms purchased from a truck vendor at a supermarket parking lot in east salinas. the patients were treated and then transported to stanford medicine. the mushrooms are commonly referred to as death cap mushrooms. health officials say only eat mushrooms sold at reputable produce outlets. >> well bay area firefighters are headed to southern california as a powerful windstorm is set to hit that region with a red flag warning now in effect. cal fire's san mateo, santa cruz unit shared this photo saying it's sending five fire engines northwest of los angeles. they will be ready to respond if a wildfire ignites. >> norcal resources on the move. always nice to see the support there. meteorologist roberto gonzalez joins us now in studio. but we're also having a little wind, maybe not as much as southern california, but here in the bay area. yeah.

>> and our big saving grace happens to be that we've had above average rainfall throughout most of the bay area, except for the santa clara valley. but nonetheless, we do have winds blowing our way as well. good evening everybody. the wind advisory has now been expanded across the bay area. it encompasses more territory, more neighborhoods than just a couple of hours ago. so says the national weather service. the only areas really not encompassing this wind advisory happens to be the santa clara valley. but certainly the mountain ranges do all the way into the mount hamilton area winds with the gusts 45mph. but in the highest elevations, we can't rule out 50 mile per hour wind gusts. now the winds do increase after sunrise tomorrow morning at 725. look at oakland and then across the bay and san francisco. can you see calistoga at 29? here's lunchtime tomorrow. 24 mile per hour winds in san francisco. pretty much similar situation in oakland as

well. and then the gustiest winds are by the evening commute. but right now the immediate problem is the fog, and it is hampering visibility across the bay area. we do have mile visibility right there around the sea shore. oh, it just lowered to no visibility in half moon bay, one mile to the north. we'll talk more about the fog, the wind, and also what's going on at the beaches. that's coming up next time around. >> all right, roberta, thank you. we'll see you soon. a massive winter storm blanketing much of the midwest and the east coast is only strengthening tonight. snowfall in some areas already setting records. kansas city, missouri reported more than 11in just yesterday. that's the most in one day in more than 30 years there. and some areas in northern kansas received 18in. winter storm warnings are now in effect from the ohio valley to the mid-atlantic, with temperatures plunging in the coming days due to a polar vortex. the storm is also causing travel disruptions still nationwide today. reagan national reported that 58% of arrivals and 70% of departures

had been canceled here in the bay area. san francisco international saw 16 cancellations and nearly 300 delays today that according to flightaware. tonight we caught up with the traveler from new york who says it has been very busy. >> delays. newark had some runway shutdown because of the snow, so we sat on the runway for about an hour and a half more than we were supposed to, but everything was safe in the end. >> nationwide, more than 2500 flights were canceled and more than 9000 were delayed as of tonight. >> well, reform is coming to the minneapolis police department. nearly five years after the murder of george floyd. >> coming up, the big changes approved just today that will put the department under a long-term supervision. >> and president biden and the first lady attend a service in new orleans tonight. their message to the families of the

murder of george floyd. a justice department report found a pattern of civil rights violations by minneapolis police after floyd's death in 2020. the department will overhaul its training and use of force policies to build on changes since floyd's death. an independent monitor will oversee those changes and a judge must approve them. the agreement will put the department under a long term court supervision on capitol hill today. >> a joint session of congress certified donald trump as the winner of the 2024 presidential election. >> donald j. trump of the state of florida has received 312 votes. >> his opponent in the race, vice president kamala harris, made it official, presiding over the certification. >> i did what i have done my entire career, which is take seriously the oath that i have taken many times to support and defend the constitution of the united states. >> there was heavy security as

lawmakers convened for the proceedings. it came on the fourth anniversary of the violent january 6th capitol riots. mr. trump has pledged to pardon those who have pleaded guilty, or who were convicted of crimes related to the insurrection. his inauguration is two weeks from today. >> president biden paid tribute to the 14 people killed in a terror attack during a visit to new orleans tonight. the president and the first lady attended this interfaith prayer service at the historic saint louis cathedral. the names of those killed were read and candles were placed there on the altar. most of those who died were in their 20s. president biden saying he and the first lady want their families to know they are not alone. >> if there's one thing we know, new orleans defines strength and resilience. you define it, whether it's in the form of this attack, from this attack or hurricanes or superstorms. this city and its people get back up.

(vo) learn more at wellsfargo.com/getfargo. mobile is fighting back against a lawsuit by the state of california, accusing the oil giant of deceiving consumers about the potential for plastic recycling. exxonmobil has filed its own lawsuit now against attorney general rob bonta and several environmental groups. according to reuters, the suit, filed in texas, accuses bonta of defaming exxonmobil's plastic recycling program. it also accuses bonta of working with an australian nonprofit that competes with exxon's low carbon initiatives, and the california department of justice said in a statement, quote, this is another attempt from exxonmobil to deflect attention from its own unlawful deception. the attorney general is proud to advance his lawsuit against exxonmobil and looks forward to

vigorously litigating this case in court. >> well, after years of financial struggles, governor newsom is proposing a multi-billion dollar budget projecting no deficit. but that could change after president elect donald trump is sworn into office. ktvu betty yu live tonight in the newsroom with the story. betty. >> mike. this marks a major shift after two years of significant shortfalls. governor gavin newsom unveiled his budget proposal today, but this plan is essentially a placeholder until may. >> this effort is so impactful and so meaningful. >> on monday, governor newsom painted a bright picture of california's economy. previewing a $322 billion budget without a deficit, fueled by big stock market gains by california's wealthiest residents and previous spending cuts. >> we're also walking into headwinds radically different moment in us history, world history, arguably, and as a consequence, we need to be

prepared. >> he warned that the budget could change depending on president elect trump's trade tariff and immigration policies. california will have to wait to see if the incoming president will follow through on threats to revoke billions in federal funding, which could affect health care and schools. >> what gavin newsom's budget that he's going to lay out later this week proposes is a budget that's imbalance has some, if you will, has some bonus to it. not a big number. but he's also going to have to tap into the state's rainy day reserves. it's important here, therefore, since the budget is political, that you put forward a budget that shows a you've turned california around. this budget proposal does that. >> newsom's budget includes minimal new spending. he highlighted successes like tackling homelessness and boosting film and tv tax credits to revive hollywood jobs. >> a budget serves as a proxy for values, and if you're gavin newsom and you're worried about being a lame duck, if you're gavin newsom and you're worried

about directing california forward, whether you're a critic or a proponent, you're going to put forward a budget that's relatively rosy. >> republicans argued that the state needs to curb spending and pay down its pandemic related unemployment insurance debt to the federal government. it's already affecting businesses through higher payroll taxes. >> it's a huge problem, and it's a problem for employment, because we're going to be assessing employers increasing amounts of money on top of what they're already paying for unemployment insurance. that makes it more expensive for employers to hire employees. and we already have the highest unemployment rate in the country. it's a very serious economic issue. >> newsom's administration plans to provide more details on this budget proposal on friday. negotiations will ramp up in may, and then newsom must sign the final budget by the end of june. mike. >> betty yu live tonight in the newsroom. betty. thank you for

that. oakland now has two fewer operating fire stations because of the city's budget problems. residents in ten hill neighborhoods from part of shepherd canyon to grass valley will be the most affected, given longer travel times from available remaining stations, and four more stations are actually being considered for closure next month, and many residents are concerned about public safety. >> already, the police services have been cut. the response time to a police. if you got a burglary, you're not getting an officer. >> that's mandatory. that's just like food and water. we need. we need police department and we need fire stations. >> now, we do know two stations cannot be considered for closure. that's jack london square, which does protect many buildings from potential train derailments, as well as the airport by federal law. city leaders say only the sale of the coliseum property can ward off future closures. the alameda county board of supervisors will resume discussions over the sale of the coliseum tomorrow

morning. the price and terms of payment over the coliseum sale to the african american sports and entertainment group remain under negotiation. the board of supervisors will also hold a swearing in ceremony for supervisor elect nikki fortunato bass. >> well, san francisco will swear in a new mayor this week, and wednesday's ceremony will be followed by a community celebration. ktvu christien kafton reports tonight from the city, where preparations are already underway. >> for san francisco's civic center plaza is buzzing with activity. crews covering the ground with flooring and building a riser as the city prepares to swear in mayor elect daniel lurie on wednesday. the incoming mayor releasing a statement inviting the public, saying this event is for every san franciscan who wants to be part of turning around our great city. i hope to see you all there. the incoming mayor's communication team announcing that the community celebration, set to take place after the inauguration in chinatown, will be headlined by san francisco

native zhu. work is already underway by law enforcement to secure the inauguration. the community celebration and all the attendees. >> we're working with the police department and other law enforcement agencies, as well as other city agencies, to make sure that everybody is safe and that it's a celebration without the concerns of recent events. >> the inauguration is expected to draw thousands, including vips and the public. law enforcement is asking everyone to enjoy the inauguration, but also remain vigilant. >> it's always helpful for everyone to be involved in keeping everyone safe. so if you see something, say something. >> there will be a perimeter established around civic center plaza. streets around the plaza will be closed, and the transition team says there will be metal detectors at the entrances on larkin, at grove and mcallister. concern over the closures have some local businesses worried. umit senior, from euro king on grove street, says in the past, closures for big events have impacted his bottom line. >> so last year we had a couple events in the city and they all closed. closed the streets with

his constitutional rights have been violated due to a 27 year delay in prosecution and lack of corroborating evidence, and a failure to honor immunity agreements. police arrested davis in 2023, relying on old interviews and a memoir where he claimed to have ordered the killing. his trial is scheduled for march. >> san jose police teamed up with stockton police to arrest two people on drug and weapons charges. investigators say 37 year old justin dixon and 26 year old jayden basic were arrested on january 2nd after officers searched dixon's home in stockton. dixon is accused of traveling from stockton to sell fentanyl and other illegal drugs in san jose, as well as san francisco, while linton is accused of buying guns for dixon, who is prohibited from owning firearms. >> we were able to uncover an array of evidence, including 13 illegal firearms. now these firearms, two were stolen, two were unregistered and two had

in oakland for stealing a u-haul truck and refusing to pull over, leading officers on a chase. and the chp says that chase ended on northbound 880 just south of high street on friday around 3 p.m, when the truck's rear tire began to deflate, causing the driver to veer off the highway. the chp says the driver did try to run away, but was quickly taken into custody. the suspect was booked on multiple charges related to vehicle theft, evading and resisting arrest. >> tonight, bar owners and restaurants are spreading the word about a man who has become a little infamous for dining and dashing, and has the attention of one district attorney. as ktvu henry lee reports, the suspect was arrested on new year's eve. but there is still concern tonight that he's not

to your surroundings and don't turn your back to the ocean. ktvu meteorologist roberto gonzalez is here with a look at the current conditions. hey, roberta. >> hi there. claudine. yes, the current water temperature is banking between 50 and 53 degrees. that's mighty cold. if you're heading to the seashore tomorrow. meanwhile, yes, it's the same old drill that we experienced last week and the week before that. beach hazards statement in effect until tomorrow night. just about at this hour. we have those buoys reporting some of these waves up to 20ft. and yet they will lap on shore. the immediate issue happens to be this right here, the fog. it's once again formed. it was stubborn to clear out earlier this morning. but we'll see earlier clearing tomorrow. because of this we do have right now visibility down to about a half a mile in oakland across the bay, one mile visibility at sfo. no clearing at all. it's a very soupy along the sea shore right now. and nine mile visibility in napa. now this is

why we'll see earlier burn off of the fog, the winds by 8:00 tomorrow morning by your morning commute. look at that. oakland international airport, 36 mile per hour winds. and then we see the winds increase in the city by the bay. the city of san francisco, 29, in calistoga, lesser winds across the eastern portion of our bay area. the bottom line is it's going to be breezy to windy throughout your day. and this is why the national weather service has issued a wind advisory, in effect for just about the entire area, just the valley of the santa clara valley. not incorporated in this advisory, but these gusts 45 and perhaps even 50mph in the highest elevations of our local mountain ranges. so we have this right here, this big area of low pressure. it's going to track to the east and take a nosedive over the great basin. it then causes friction with this high pressure that's building in together and offshore push. thus the windy conditions, but not just for us but also for southern california. and keep this in mind. only 4% of normal

49ers season. players were back this morning clearing out their lockers following a disappointing finale to what has been a challenging, really a frustrating year for them. the niners, playing their final game of the season yesterday out there on the road in arizona. the cardinals putting up 47 points in their win over the niners. san francisco losing seven of their final eight and finished last in the nfc west. the team's six and 11 record their worst since 2018. and it
