be very windy here in bay point. the traffic is clear. there's no fog. the wind has blown it all away here. 501 let's go back to the headlines. >> thank you sal. today's prosecutors will reveal more details about the latest charges filed against the man at the center of a highly publicized kidnaping case in vallejo. matthew mueller is currently serving 40 years in federal prison for the 2015 kidnaping of denise huskins. the case is the subject of the docuseries american nightmare. prosecutors in contra costa have now announced they've charged mueller with kidnaping three other victims for ransom near san ramon in 2015. investigators say the three victims kept quiet all these years due to fear of retribution. the announcement of the new kidnaping charges come just one week after mueller was accused of additional crimes in santa clara county, back in 2019. prosecutors say mueller sexually assaulted two women during two separate home invasions in mountain view and

palo alto. >> our time is now 502. we now know the name of the pregnant woman who was killed over the holidays in a car crash in gilroy. 29 year old rachel marie gonzalez gallegos was killed on new year's day at the intersection of leslie road and new avenue. police say miss gallegos was with her husband and young son when they were hit by a driver, who has since been arrested on suspicion of dui. the chp says rachel gallegos was riding in a 2021 chevy suv when it was hit head on around 6:30 p.m. the 50 year old driver of the other vehicle, a gmc truck, was speeding. according to investigators, when that truck veered into oncoming traffic will drive quickly on that road, but it's not overly crowded. >> i never thought it to be dangerous. it'd be nice to have a stoplight there. possibly. >> the unborn child did not survive the crash. a gofundme account with a photo of rachel

gallegos with her family has been set up. the suspect was booked without bail into the santa clara county jail. >> later today, the public will get another chance to honor the late former president jimmy carter. his casket will make its way from atlanta to washington, d.c. later today. then a procession will carry his body to the u.s. capitol, where the former president will lie in state in the rotunda until thursday. officials say security is on high alert for today's procession. >> we're not tracking any credible or specific threats associated with these events. that being said, we are certainly operating in a heightened threat environment. >> vice president kamala harris is expected to speak during president carter's service later today. the public can pay their respects this evening and throughout tomorrow. >> well, president biden was in new orleans. he paid tribute to the 14 people killed in the new year's day terror attack. last night, the president and first lady were at an interfaith

prayer service, and the names of the people killed were read aloud as candles were placed on the altar. most of those who died were in their 20s. president biden said that he and the first lady want the victims families to know they're not alone. >> there's one thing we know. new orleans defines strength and resilience. you define it, whether it's in the form of this attack, from this attack or hurricanes or superstorms. this city and its people get back up. that's the spirit of america as well. >> now, earlier yesterday, the president and first lady met privately with the victims families, as well as with two police officers who were injured. the bidens placed flowers at the memorial on bourbon street. it was set up in memory of the people who were killed. now, today, the president will be in coachella. he'll establish the first of two

national. a new national monument monument honoring indigenous tribes. this comes after tribal leaders proposed where they would want those monuments to be. one will be south of joshua tree national park. this will make drilling, mining and any other energy industrial related activity illegal in that area. the other monument will be up north of the state, covering an area close to mount shasta. >> the competition to be alameda county's next district attorney is underway. 15 candidates have officially applied to replace former district attorney pamela price, who was forced out in a historic recall last year. candidates include prosecutors, a superior court judge, alameda city attorney and an art school director. the board of supervisors will review applications and hold public interviews later this month. a final decision is expected by february. the new district attorney will serve until the 2026 general election. >> time is now 506. well, today,

city leaders in antioch are introducing a new acting police chief. but before that announcement, people in antioch told us how frustrated they feel. ktvu james torres is in antioch now to tell us the concerns neighbors have with this police department that's mired in scandal. good morning james. >> good morning to you, dave. well, the frustration comes from because people don't understand why they don't have a permanent police chief. the announcement that will be learning later this morning. we'll be learning who will be taking over as acting police chief, a role that has been in place that way for about a year and a half. in antioch. now, the police department, plagued with recent controversies. it's experienced quite an officer shortage, like most departments would report throughout the bay area, even the country as well. but more specific to here, there was a racist text message scandal that got the attention of the u.s. department of justice. we spoke to a former city council member with past law enforcement experience. he says he wants to see more transparency from the city.

>> with the history that they've had of interim police chiefs. they've made the wrong selections, and i hope they don't make the wrong one again. but who's involved in that? how did they how did they make the selection? that's a big concern of mine. >> this will be the third acting police chief in the last 18 months. and with growing crime, antioch requested help from the california highway patrol for surge reinforcements. much like what we've seen in oakland over the last year. chp says it's heard that request, but isn't able to commit full time at this time. this morning, the mayor, the city manager and the current acting chief, brian addington, will make that announcement. his position is open because he announced his retirement. that announcement will come later at 10:00. we're live this morning in antioch. i'm james torres, ktvu, fox two news. >> well, yesterday was all about fog. this morning. it's all about wind, has some pretty good gusts, so that has chewed up any low cloud. everyone is clear. and that's the good news. some

two is now 513. california's long delayed high speed rail system continues to be built in the central valley in kern county. governor newsom joined other officials in driving in the ceremonial spikes at the groundbreaking for a new rail yard. that's where equipment and supplies will be kept. the governor said 50 important projects have been completed along the route between bakersfield and merced, with passenger service expected to begin between the year 2030 and 2033. governor newsom says the california has a balanced budget. he unveiled a $322 billion budget plan with no deficit after two years of major budget shortfalls. the governor says he's, quote, proposing little new spending. his plan includes additional investments in public safety, health care, education and infrastructure. the plan is mainly a placeholder until may, as the state waits to

see if president elect trump will follow through on his threats to revoke billions of dollars in federal funding to california. >> revenues in the state are up $16.5 billion. this is a snapshot subject to change significantlyy may. a snapshot of the revenue projections above and beyond what we had projected last year. >> now, governor newsom's administration plans to give more information on the budget plan on friday. that's the deadline to present it to california lawmakers. time is now. 515. san francisco officials are preparing to swear in mayor elect daniel leary during a private ceremony at the civic center plaza tomorrow. the crews are out there covering the ground with flooring and building a riser for the event. law enforcement working out the security plans. the sheriff says the surrounding streets are going to be closed off. metal

of rain there and some cloud cover. emphasis on a little, but that will be the source of the wind as it begins to crank up. so we have a wind advisory that's already been posted. goes through 10 a.m. tomorrow. gusts maybe 50 up in the hills. there's been some pretty good gusts already. santa rosa north to 30. travis north to 35. i've seen lucas valley to 44mph. and not far from mount diablo, almost 50mph. there is some light rain down on the desert. barstow. mojave. i know palm springs. the wind has picked up. mostly cloudy there, even into la. there's been some snow at big bear mountain, but it's really going to be about the wind once that system kind of settles in just to the west of la, there will be some roaring gusts down there. so that's going to play into their forecast not only today, but maybe two more episodes of this offshore breeze. mainly a lot of 50s here. half moon bay 57, berkeley 57 oakland 57. that's all because of this offshore breeze coming in out of the hills. alameda 59 degrees. a lot of 50s here, although if you don't get any breeze, you can

drop down pretty fast into the low 40s. one observation there, walnut creek at 42, but 55 alamo and 55 in dublin. 30s up in the mountains. alturas is 39, yet it's 58 in san diego and 62 in santa barbara and palm springs. 66 so again, it's just a if you get the wind or you don't get that breeze. but southern california bracing for some strong wind and just nothing for us rain wise. i mean, we may be dry for two weeks here. it's kind of kind of the way it's looking here. so ride like the wind. clear skies yet breezy to windy. sunny for all and temperatures will be bumping up, especially if they maintain that north wind 60s to mid 60s. maybe a few upper 60s there dave. >> all right steve thank you. time now 519. what the surgeon general is saying about why he wants a cancer warning label on all alcoholic beverages. we'll talk live with our fox medical team about the

effort to reduce children's toxic metal exposure. now, under the new guidelines, the lead limit is set to ten parts per billion in most processed foods sold in jars, pouches, tubs or boxes for children under the age of two. the limits are only voluntary for manufacturers, but if baby foods exceeds the recommended limit, the agency can take action. here in california, a new law now requires baby food manufacturers to test for arsenic, lead,

mercury and cadmium every month and make the results public. costco has issued a recall for cold and flu medicine that was sold at its stores at the end of last year. the retailer says the kirkland signature brand severe cold and flu plus congestion is being recalled out of an abundance of caution over concerns of contamination. customers who bought the medication between october 30th and november 30th should return that item to their local costco for a refund. well, alcohol is a well-established, preventable cause of cancer, responsible for about 100,000 cases of cancer and 20,000 cancer deaths every year in the united states. that is from the u.s. surgeon general who wants to change the health label warning on alcoholic beverages. fox medical teams doctor mike, joining us now with more on this warning. good morning, doctor mike. first of all, we've heard mixed messages about alcohol, particularly a glass of red wine. might be good for your heart. so is this based

on new research and studies or more just to make sure people are aware of the connection between alcohol and cancer in particular? >> well, pam, the most recent data over the last five, ten years or so has indicated that alcohol is a carcinogen. now, i, i actually used to lecture on the health benefits of alcohol, and i did the research. i did look at red wine and white wine and the fact that there are entities in those beverages, those wines that were thought to be quite healthy and cardioprotective. the problem is, and i'm going to tell you exactly why alcohol is probably not a good thing. but the data now suggests that alcohol gets converted to acetaldehyde, which

can cause dna damage to areas in the mouth, the esophagus, the stomach, the colon, and you see a significant number of people with cancers of those areas through direct contact to the alcohol. the other problem is that it produces free radicals in the body, which then can also cause damage. it also has effects on hormones like estrogen. and i've been telling my patients who have a history of breast cancer. alcohol is really contraindicated. and if you don't have breast cancer, it does increase the risk. finally, a reduction in b vitamins from drinking alcohol and folate in particular that can increase your risk. and if you smoke, god forbid and drink alcohol. alcohol acts as a solvent and makes the, the compounds that

you get from smoking even more deadly. and that goes for smokeless tobacco as well. so you never want to do that. >> okay. so really good information and a lot of information. thank you doctor mike really quick before we go. is that is there any amount of alcohol that is okay. is this is this warning about really no alcohol is best for your health? >> look, if you want to be completely a purist, then don't have any alcohol. no amount of alcohol is safe. i personally am not willing to give up a small to moderate amount of alcohol intake in my life. i am making a conscious decision that it embellishes my life and again, everything is dose related. if you're an alcoholic and you're

drinking a fifth of whiskey every day, your life expectancy is not long. so what you want to do is look, if you want to imbibe and have wine or other spirits, limit the use. and i think that your risk is not zero but low. that's my take on it. and like i said and where you guys are, i'm going to napa. i'm going to enjoy a fine wine. i can even tell you my favorite wine. but that's for another discussion. >> but it's i mean, you bring up a good point because a lot of businesses count on, i mean, the wine country in particular. so in moderation. but good to have all of that information before making those decisions. doctor mike with our fox medical team, thank you. >> thank you pam. >> all right. a joint session of congress certified donald trump's election victory. we have a look at the process. four years a er rioters

budget preview and is already getting responses. ktvu ali rasmus is here now with more about the state's budget. good morning. >> good morning dave. yeah, no deficit this year. and according to the governor, there will be no cuts to basic programs and no tax increases. at least that's governor newsom's prediction for now. and even he says all of that can change depending on what happens with the incoming trump administration. but the governor expressed cautious optimism when he unveiled an early snapshot of his proposed budget this year. it's $322.2 billion. state tax revenues are actually up 16.5 billion, partly because of the tax money collected from investments in the stock market. and the stock market had a good 2024. this budget does also tap into about $17 billion in reserves from the state's rainy day fund. but when it comes to education, things like free school meals will continue in california's public schools, as well as access to before and after school programs and summer school. governor newsom says his budget will also allow the state to fully

implement universal transitional kindergarten. complete funding for that program means schools would be free for about 400,004 year olds throughout the state. we spoke to the new president of the california school boards association with a thousand member districts across the state. >> the tk kinder curriculum is providing us a level playing field at this point, because now every child has the opportunity to really be ready to be successful at kindergarten level. >> we're also walking into headwinds, radically different moment in us history, world history arguably, and as a consequence, we need to be prepared. >> governor newsom says changes in federal funding, possibly under the incoming trump administration, could affect this balanced budget proposal. about a third of california's budget relies on federal funding to including tens of billions of dollars to provide health services. now, this was all just

the alameda county board of supervisors will resume discussions over the sale of the oakland coliseum. city leaders say only the sale of the coliseum property can alleviate the budget deficit and ward off future closures. the price and terms of payment for the coliseum sale to the african american sports and entertainment group remain under negotiation. the board of supervisors will also hold a swearing in ceremony for supervisor elect nikki fortunato bass. >> well, the oakland city council appointed another interim mayor to temporarily lead the city. he's council member kevin jenkins, unanimously selected as council president and interim mayor. he replaces outgoing council president nikki fortunato bass, who filled that role after the recall of shang tao. oakland leaders are facing major challenges with a multi-million dollar budget deficit leading to spending cuts. jenkins says his goal is to make sure his successor will be successful next. >> mayor, i want to get a transition plan ready so that

that person can hit the ground running. that person will come in in the middle of our budget process. first and foremost is public safety and the budget process. we need to make sure that our fire stations stay open. >> now, jenkins will serve as interim mayor of oakland until the city holds a special election on april 15th. as of yesterday, 11 candidates have filed paperwork to run for mayor. well, there are new signs this morning that former east bay congresswoman barbara lee may run for mayor of oakland. the longtime oakland resident and former congresswoman opened a campaign account yesterday to run for mayor. her spokesperson told the chronicle expect an announcement later this week about her decision to run or not. >> a north bay winery could have to pay as much as $8 million in penalties and fines as part of a lawsuit brought on by napa county, a county. the county won a lawsuit against hoopes vineyard that stated it did not have the proper permits to host wine tastings. the county is

asking for nearly $6 million in penalties and $2 million in attorney fees. the vineyard owner says the fines will put her out of business. >> our time now. 538. oil giant exxonmobil suing california, accusing the state of defamation. the lawsuit is a response to another lawsuit filed by the attorney general, rob bonta, accusing exxonmobil of deceiving consumers about the potential for plastic recycling. the oil company is countersuing. they're accusing bonta of working with an australian nonprofit group that competes with exxon's low carbon initiatives. well, the california department of justice released a statement saying, quote, this is another attempt from exxonmobil to deflect attention from its own unlawful deception. the attorney general is proud to advance his lawsuit against exxonmobil, and looks forward to vigorously litigating this case in court. >> bay area firefighters are headed to southern california as

a powerful windstorm is set to hit the region, and a red flag warning is now in effect. cal fire san mateo santa cruz unit shared this photo saying it is sending five fire engines northwest of los angeles to help if a wildfire ignites. >> well, the system that's digging into southern california actually giving them some cloud cover and a little bit of light rain. snow. big bear mountain is reporting some snow. i mean, they have just been, you know, next to zero, practically on rainfall. a little bit of snow up in the mountains. but that system that's the source of the wind as that system digs in there, that's going to form just to the west of la. so as that develops, it's more about wind than any rain. there is no signs of any rain the next two weeks for us. so it is dry for now. we had that january 3rd, but i'll tell you maybe the 20th or 21st or so, but it looks really quiet here today for the city. 65. average is 57. the low is 58. i'm going 56, which would still be ten above average here. the record rain 2.06 and 1853 on

police chief. we'll find out who it is about 10:00 this morning. the new police chief will be taking the job. just days after the city reached an agreement with the department of justice over racist text messages and use of force scandals. as a result, the police department will be under federal oversight for at least five years. and an update on a 2015 kidnaping in vallejo, a case that became known infamously as the gone girl case. prosecutors are bringing new charges now against convicted kidnaper matthew mueller. he's right now serving 40 years in federal prison for the kidnaping. last week, he was accused of even more crimes in santa clara county back in 2019. the latest charges allege that mueller kidnaped three other victims for ransom near san ramon. back in 2015. >> bar and restaurant owners across the bay area are now spreading the word about a man known for skipping out on his

tabs. now they're sharing photos of 36 year old jared scott. prosecutors say he was arrested for dining and dashing at a red lobster in san bruno on new year's eve. but despite that arrest, there are still concerns he could target other businesses. the case has even captured the attention of san mateo county's district attorney. >> somebody doing something like this endlessly, it can really affect the business. so i'm very sympathetic to the restaurant owners. on one occasion, he used the excuse of i've got to go to an atm to get money. he walks out and does not pay for it and isn't seen again. >> we spoke to several bar owners who say they know this man, and they say he has stolen from them. most of them simply refused to serve him now. a person in louisiana is now the first death in the u.s. linked to the highly contagious avian flu. the patient was hospitalized after being diagnosed as the first human to contract the virus. the state says the person was 65 years old

departments throughout the bay area and even the country. but more specific to antioch, there was that racist text message scandal that got the attention of the us department of justice. we spoke to a former city council member with past law enforcement experience, and he tells us he wants to see more transparency from the city of antioch with the history that they've had of interim police chiefs. >> they've made the wrong selections, and i hope they don't make the wrong one again. but who's involved in that? how did they how did they make the selection? that's a big concern of mine. >> with growing crime, antioch requested help from the california highway patrol for surge reinforcements, much like what we saw in oakland over the last year. the chp says it's heard that request, but isn't able to commit at this time. now, this morning, the mayor, the city manager and the current acting police chief, brian addington, will make that announcement. his position is open because he announced he's retiring. but that new announcement will come later this morning at 10 a.m. we're live this morning in antioch.

let's talk about today's weather. here's steve. >> sal. thank you sir. we will start with what's going on in southern california. the system is digging in there, and that is generating wind with high pressure to the north and that low developing to the south. the high doesn't like the low, so it's going to fill it with wind. and that's what we're dealing with already some pretty good gusts here, about 35 to almost 50mph near mount diablo. 49 lucas valley a couple of sites in the marin county hills 44 45mph. santa rosa, fairfield, golden gate bridge and oakland hills 35 36mph. so wind advisory goes until 10 a.m. tomorrow. so it will be an issue today and tonight into early tomorrow. i mean, some of the gusts have come down a little bit. some aren't that bad, but it is no doubt a north northeast breeze here for many. 40s for a few, 50s for most. i mean, santa rosa is 5958 napa airport, fairfield 5657. half moon bay 57 sfo. the city is actually 56 and we are

police say there has been an increase in people being robbed while out in the city. officers are warning people and offering tips to avoid being robbed. they say stay aware of your surroundings, especially when you're entering or exiting your vehicle. stay off your phone to avoid distractions when in public places, and police also suggest traveling in groups, especially at night. one man was arrested in oakland for stealing a u-haul truck and refusing to pull over, leading officers on a chase. the chp says the chase ended on northbound 880 just south of high street last

friday, when the truck's rear tire began to deflate, causing the driver to veer off the highway. the chp says the driver tried to run away but was taken into custody. the suspect was booked on multiple charges related to vehicle theft, evading and resisting arrest. well, the sonoma county sheriff's office says a helicopter crew played a critical role in the arrest of a man on a motorcycle following a highway pursuit sunday in santa rosa. deputies say a motorcycle with no license plates was traveling at speeds of more than 100mph before the rider was taken into custody. the sheriff's office says helicopter crews can track the suspects from above, allowing ground units to follow at a safer distance. we now know the identity of the pregnant woman who was killed in a car crash in gilroy over the holidays. 29 year old rachel marie gonzalez gallegos was killed at the intersection of leavesley road and new avenue on new year's day. police say gallegos was with her husband and young son when they were hit by a driver,

who has since been arrested on suspicion of dui. the chp says gallegos was riding in a 2021 chevy suv when the vehicle was hit head on. this was about 6:30 p.m. officers say the 50 year old driver of the other vehicle was speeding when his truck veered into oncoming traffic. >> will drive quickly on that road, but it's not overly crowded. never thought it to be dangerous. it'd be nice to have a stoplight there. possibly. >> the unborn baby did not survive the crash. a gofundme account with a photo of gallegos with her family has been set up. the suspect was booked into the santa clara county jail without bail. investigators in las vegas are still trying to determine the motive for an explosion outside the trump hotel on new year's day. federal agents are inspecting the burned wreckage of the cybertruck and their search for answers. they say an army green beret took his own life just moments before the explosion that caused seven injuries outside the trump

in contra costa county have now said they've charged mueller with kidnaping three other victims for ransom near san ramon in 2015. investigators say the three victims kept quiet all of these years because they feared retribution. now, the announcement of these new kidnaping charges come just one week after mueller was accused of even more crimes in santa clara county, back in 2019. prosecutors say mueller sexually assaulted two women during two separate home invasions in mountain view and in palo alto. >> governor gavin newsom unveiled his budget for the state of california when it comes to public education. the budget proposal keeps some popular programs in place. ktvu sally rasmus joins us now with the details. sally. >> well, pam, when it comes to education under the governor's early budget plan, free school meals will continue in california's public schools, as well as access to before and after programs and summer school. governor gavin newsom

expressed some cautious optimism when he unveiled an early snapshot of his proposed budget this year. it's $322.2 billion. it includes a modest surplus. the governor says state tax revenues are actually up this year, 16.5 billion, partly because of the tax money collected from investments in the stock market, which did well in 2024. and this budget does tap into about 17 billion in reserves from the state's rainy day fund. but the governor says there is no deficit this year, unlike the previous two years, and there will be no cuts to basic programs and no tax increases. newsom says his budget will also allow the state to fully implement universal transitional kindergarten in california, which will make school free for about 400,004 year olds in the state. it's a move education experts applauded. >> the tk kinder curriculum is providing us a level playing field at this point, because now every child has the opportunity to really be ready to be

successful at kindergarten level. >> we're also walking into headwinds, radically different moment in u.s. history, world history arguably. and as a consequence, we need to be prepared. >> governor newsom says changes in possible federal funding under the incoming trump administration could change everything in this budget. and this proposal. about a third of california's budget relies on funding from the federal government, including tens of billions of dollars to provide health services. now, this was just a preview from the governor. we expect to have more details on his proposed budget by friday. that's when he will formally present it to the state legislature. then the governor and state lawmakers have until the end of june to hammer out the final details on what this budget will include. as we know, a lot can change between now and then. dave and pam will send it back to you. >> thank you. ali. san francisco is preparing to swear in mayor elect daniel lurie during a private ceremony at the civic center plaza tomorrow. crews are busy creating the outdoor space for the event. law enforcement

some of the stories we're following for you this morning. today, the alameda county board of supervisors will continue talks over the sale of the oakland coliseum. city leaders say the sale will help alleviate the budget deficit and help save some important services. the city previously agreed to sell its share of the site to a buyer group called the african american sports and entertainment group. the price and terms of payment remain under negotiation. also today, the city of antioch is set to introduce its new acting police chief. we will learn who that is at about 10:00 this morning. the new chief will take the job. just days after the city reached an agreement with the department of justice over racist text

zone two is now 655. a member of the california republican assembly. assembly is pushing for a bill to ban transgender girls from high school sports. now, the legislation would require organizations regulating high school sports to have rules to make sure that only individuals identified as female at birth are allowed to take part in female sports. the bill comes during several legal battles involving transgender students and athletes here in california. the measure is facing major barriers in the california legislature, where democrats hold a supermajority. well, the 49ers have now cleaned out their lockers. they missed the playoffs for the first time in four years. the 49ers packed up their boxes at levi's stadium. they headed home after a disappointing regular season. the 49ers finished in last place in the nfc west, had their worst record since 2018, and the season came to a painful and

reliable. well, a maintenance project by the martinez refining company will create traffic and noise problems for the next few months. the company announced that the scheduled maintenance will take place through early april. expect more cars in the areas of marina vista and shell avenue, along with noise and increased flaring. executives say the project is a major investment in that refinery's future. time now. 657 bar and restaurant owners around the bay area are now spreading the word about a man known for skipping out of paying his tab. they're also sharing photos of 36 year old jared scott. the prosecutors say he was arrested for dining and dashing at a red lobster in san bruno new year's eve. but despite that arrest, there are still concerns he may target even more businesses. this case has even captured the attention of san mateo county's district attorney.
