jose police department. new body cam footage shows a san jose police canine going after a stabbing suspect after an hours long standoff with the suspect's attorney, now says about the incident. >> this is ktvu, fox two news at 730. >> and good evening, everyone. i'm mike mibach. the man in the video is now filing a federal lawsuit against the city of san jose, as well as the police department, after he says the canine officer bit his face and would not release ktvu crime reporter henry lee live tonight in the newsroom with the very latest. henry. >> well, mike, ktvu has been looking into the use of police canines for a while now. and this is just the latest lawsuit alleging misconduct by these animals. i should warn you, some of the images and video you'll see may be disturbing. san jose police body cam video shows fernando villanueva galvez screaming in pain after he was bitten by a police canine back in 2023. the dog bit off the man's earlobe while searching his apartment. police have been called to the complex to

investigate a laundry room dispute, in which a neighbor said villanueva galvez had stabbed her with a knife. >> it's scary because unlike a bullet, unlike a taser, a canine has a mind of its own. >> angel alexander is an attorney who has filed a federal civil rights lawsuit against san jose and the police department, accusing officers of, quote, an unconscionable act of brutality. >> for these animals. if they don't listen, it can result in someone being mauled and mutilated or dead. >> body cam video shows police using a battering ram to go into the man's apartment. seconds later, a dog is released inside. the canine finds the man. less than two minutes later, alexander says the dog, named ronin, had been called off five times by its handler, officer eliseo anaya, but that the animal continued biting her client. >> a dog, at that point refusing to release. you can see the handler pulling and pulling and pulling, and the dog is just, you know, i mean, he's bloodthirsty at this point. >> villanueva galvez was taken to the hospital. years later, his attorney says her client is

still recovering from his injuries. >> half of his ear is missing. he has deep wounds, gashes in his arm. and that actually caused some nerve damage. >> felony charges against villanueva galvez were reduced to misdemeanors. the lawsuit names the city of san jose, the police department, and officer anaya as defendants. anaya was among four officers who shot and killed a woman on christmas day 2018, after police say she tried to ram them at the end of a wild chase. the d.a. said the shooting was justified, even though the woman was not linked to a shooting, as police originally believed. now, san jose police have declined to comment on the pending litigation. we've also reached out to the city attorney's office but have not heard back. the city has been served with this lawsuit but has not responded to it in court. >> mike henry lee live tonight in the newsroom. henry, thank you for that. the san jose police department right now is searching for the people involved in what they call a despicable act of violence against two officers. officials say two plainclothes officers were in an unmarked car right near mclaughlin avenue and 280

at around 1030 last night as they stopped at an intersection. police say people in another vehicle tried to provoke an argument. at least one person inside opened fire, hitting the police vehicle multiple times. one officer was able to fire back, but the driver was able to get away. no officers were hurt, but tonight it is not clear if any of the suspects were hit. >> motive behind the attack is still under investigation and it is uncertain whether the suspects were aware that the individuals in the unmarked police vehicle were law enforcement officers at the time of the shooting. what is indisputable, however, is that this was a reckless and senseless act of gun violence in a residential neighborhood. >> san jose police did not release any specific information about the shooter's vehicle, and they say that addressing gun violence does remain the department's top priority. in san francisco, bloomingdale's on market street says it will soon close its flagship store in the last remaining major store in the troubled san francisco

center mall. it is scheduled to close by summer, despite its lease having another 20 years. bloomingdale's, a division of macy's, which is also leaving downtown san francisco, said it looks forward to introducing new ways to serve local shoppers through, though it did not provide further details. retail experts say a lot of department stores just have not updated their business models, leading to a decline in shoppers. >> a lot of these big boxes have not changed their business model in the last 50 years. shifting consumer habits to some of the post-pandemic economic shifts. and i think we're still kind of feeling some of the shift towards more, more e-commerce retail in san francisco is not dead, but it's in a process of evolution. >> university of san francisco professor billy riggs says downtown san francisco needs to evolve into a safe, clean, friendly, mixed use experimental destination to be able to keep patrons visiting. for now, there

are other bloomingdale locations in palo alto and san jose. san francisco mayor daniel lurie staying optimistic, releasing a statement saying in part, although this closure is disappointing, i'm energized every day by businesses of all sizes opening and growing in our city. new at 7.30. pleasant hill police say the passing of proposition 36, already having noticeable effects when it comes to combating organized retail theft. prop 36 allows police to charge thieves with a felony for shoplifting if they have two or more prior theft convictions, creating more significant consequences for repeat offenders. in pleasant hill, police say they've made 13 felony shoplifting arrests in just the last month. they say prop 36 has been a step toward reducing theft and also encouraging stronger deterrence. also new at 730, the bay area's oldest independent bookstore chain says it is filing for reorganization. books inc. says filing chapter 11 will allow it

to continue operating while it gets on a solid financial footing. as part of the reorganization, it will close its berkeley store on february 9th. ten other stores across the bay area will remain open. the company says it is losing money due to rising operating costs and dramatically changing consumer buying habits. tonight, there's concern that santa clara county officials will not get an accurate count of the number of unhoused people this year. this comes as the county switches to new technology and methods for the count, and survey. volunteers will go to places where the homeless tend to gather instead of searching for them out there on every street. volunteers will also interview homeless people at the same time as the count. instead of doing that in the following days, advocates say this change could lead to less time to count every person. the change also means this year's data can't be compared to previous years, so trends then cannot be studied. san jose city officials are touting a soon to be completed tiny home site for unhoused

residents as a step toward ending homelessness. that also has the added benefit of protecting a central waterway from pollution. this morning, city and community leaders unveiling the project in the blossom hill neighborhood. this two acre parcel of land owned by valley water will become home to a $100 million, 136 bed interim housing site. it comes after residents in the neighborhood had complained for years about the negative effects of a large homeless encampment. >> i helping out, get people out of their trees, get them into homes where they belong and sheltering, and it helps the neighborhoods. >> it's wonderful that they're putting tiny homes here because there's people here and down there and further down, and it's going to fill up. >> san jose mayor matt mehan says a no encampment zone will be established for 40 acres around the site. city officials say there will be programs to help people transition from interim into permanent housing as well. construction is scheduled to be done by

from the ocean just south of half moon bay this past holiday weekend. the coroner's office has identified them as 39 year old mukund murali and eight year old vihaan mukund, both of santa clara. a relative at their home confirmed to ktvu that the two were father and son. so far, there is no information on how they wound up in the water. both were transported sunday afternoon to stanford, where they later died. the monterey county board of supervisors has ratified the proclamation of a local emergency. after last week's fire at that battery plant in moss landing. that fire forced hundreds of people to evacuate and prompted a portion of highway one to close for several days. supervisors say they plan to send a letter to both vistra energy requesting the plant stay offline until the cause of the fire is determined and addressed. that letter will also go to pg and e. meantime, the environmental impacts of the fire and the potentially toxic fumes are still being examined.

>> we feel fairly confident that at least where our monitors are situated and our sensors are situated, that there was no adverse impact associated with emissions from the plant fire. >> the elkhorn slough reserve is still closed until further notice due to potential health risks from the fire. the epa is expected to test the water for chemicals here in the coming days. governor newsom, now calling on an investigation into the incident there in moss landing. his deputy director of communications releasing this statement, saying the governor believes there should be an investigation into this incident to determine cause and any steps that can be taken to make older facilities like moss landing safer. as the governor has said before, as this technology has evolved, california has done extensive work to advance battery safety and reliability. the governor's office says the cpuc is in communication with vistra, and investigation team will visit the site tomorrow to see if there are any violations against cpuc general orders and

determine what corrective actions need to be taken to return to safe operations. all right. now to our weather meteorologist, mark tamayo. let's start in southern california because they have that red flag warning going on. >> it continues. we're still waiting for rainfall, but they still have the high fire danger once again tonight into tomorrow. mike. so once again, we're showing you a big red area on this map from ventura county all the way down to san diego. red flag, elevated fire conditions. so red flag warning continues right on through. in fact, this there was it was supposed to expire tonight. then another one was supposed to begin later on, but they just extended it until 8 p.m. thursday. winds potentially could be going up above 50 miles an hour in the hills. it's also a very dry air mass as well. those moisture levels could be coming down, possibly down to 2%. so here is the wind forecast for tomorrow. they're definitely picking up. you see that corridor from santa clarita to newhall to malibu hills and camarillo. and then throughout the day wednesday still breezy to windy out there. so we'll keep an eye on the conditions down there for us here in the bay area. lots of sunshine. it's

hard to believe with the chilly mornings. the afternoon hours actually fairly nice. lots of 60s out there and basically have the same pattern for tomorrow as well. here's the big view out in the pacific. and once again, we have this dry weather pattern over northern california, just a few high clouds offshore. so we'll have clear to partly cloudy skies. and if you have stepped outside over the past few minutes, you probably already have noticed that chill. right now it is already down to 40 degrees in fairfield, napa, 48, oakland 50 degrees and san jose in the mid 50s 55. so it is a cold tuesday evening out there and getting colder for your wednesday morning. here's our live camera looking above san francisco with still mostly clear skies, looking out toward the city lights. a freeze warning posted for the north bay tomorrow morning. coolest locations back down into the upper 20s and then for a good portion of the bay area, not including san francisco or parts of the coast, we actually have a frost advisory and temperatures will be in the 30s, around 32 to 37 degrees. so definitely a bundle up first thing tomorrow morning. lots of jackets and

sweaters. we'll have some frost out there as well. santa rosa could be in the upper 20s. here's the setup. our dry weather stretch continues. we talked about that cold start tomorrow morning, but then a mild afternoon. lots of 60s out there and lots of sunshine. this system wants to drop in from the north on saturday, so as a result we'll bring in cool conditions, some windy conditions, and even the chance of a few scattered showers for us. so we're going to take this forecast model into thursday still dry. and then look what happens into the weekend. some activity here, possibly in the bay area and then down towards southern california. that could actually have some showers there and maybe some snow showers in the sierra. so some big changes as we head toward the weekend, but definitely a cool down headed our way. highs tomorrow. most areas will be in the 60s. look ahead. your five day forecast. more sunshine. thursday will bring in a few clouds by friday. definitely a cool down for the to start off the weekend and maybe some shower chances as well. as we head into saturday. >> it would be nice to see the rain. all right mark, thank you. north bay congressman jared huffman says a new bipartisan

bill would help communities protect themselves from wildfires. this bill, introduced by huffman and southern california republican jay obernolte, would create a grant program within fema to help residents harden their homes against wildfire. the bill would invest $1 billion per year for strategies to reduce wildfire risks, such as early detection, creating defensible space, and evacuation planning. the bill is endorsed by more than 20 major environmental groups. coming up in hours long board of supervisors meeting as seven finalists make their case to beco the

difficult decision. >> we have seven candidates. a host of questions. >> the seven finalists seeking to replace the recalled alameda county district attorney. each made their case to the board tuesday. elgin lowe, a 28 year veteran of the alameda county district attorney's office, was first to speak. >> if justice required that a person be incarcerated for an extended period of time, i will not hesitate to do so if that is what justice requires. >> lowe is one of four candidates who have worked within the da's office. alameda county deputy district attorney jimmy wilson said he's a fair, seasoned prosecutor. >> i come from a family of community activists. so i believe in reform. >> annie esposito is a contra costa county assistant da who also formerly worked in the alameda da's office. >> i stand apart from everybody else because i can hit the ground running. >> latricia lewis works as the county's counsel and said she can solve the da office's problems. >> we must tackle the backlog of

while also offering up some super bowl tickets. the red cross says wildfires in southern california have forced the

cancellation of several blood drives there, leading to an additional shortage. it has partnered with the fremont fire department to host the drive at the department's administration building. this drive is going to last from nine in the morning to three in the afternoon. you can sign up on the red cross website and anyone who donates before january 26th will be entered for a chance to win tickets to the super bowl. novato's la fire department foundation benefit concert has officially been sold out, but you might still be able to get some tickets. the concert is scheduled for sunday from 1230 to 8 in the evening at hot monk. some of the performers include the brothers comatose, walking mirrors, and poor man's whiskey. 100% of the proceeds will go to the la fire department foundation. if you haven't been able to get the tickets, they may still be available at the door when they do open sunday at noon. new at 7.30. symphony san jose says it has received its largest bequest from a longtime patron, thanks

to the donation from san mateo resident, the late anne brown, who died in 2004 but was an avid supporter and attendee of the symphony. the symphony says a gift of $1 million will transform the symphony, marking the largest gift in its 23 year history, allowing for a steady income that will be used to support concerts, community initiatives and education programs for generations to come. the executive artistic director of the symphony says this large gift highlights brown's deep commitment to the organization. vallejo native cc sabathia is headed off to the national baseball hall of fame. sabathia, who was on the ballot for the first time, easily made it in. appearing on 86% of the votes, he won 251 career games, spending most of his career with cleveland as well as the yankees. sabathia is also one of only 19 in the 3000 strikeout club with 3093 ks. the 44 year old won the cy young in oh seven and was a six time all-star.
