vote, expected tonight in fremont. >> this is ktvu fox two news at 730. >> and tonight, the city council there in fremont is considering a dramatic step to try to limit homeless encampments. good evening everyone. i'm heather holmes. happening now. a new ordinance is being discussed at tonight's city council meeting, which got under way just about a half hour ago. now, here is a live look at council chambers. our photographer there at the scene says the chambers are actually packed. there is a lot to discuss here tonight. this new measure would make it illegal to camp on any street or sidewalk, in any park, or on any other public property. also, with this new ordinance, those causing, permitting, aiding, abetting or concealing an illegal encampment would also be charged with a misdemeanor and could result in a $1,000 fine and six months in jail. obviously, this is a little bit controversial. earlier, we spoke

with fremont's mayor, who says the goal here is to improve public safety. but some homeless advocates argue it is still not a long term solution. >> you can get food, you can get water, you can give a tent, you can help people. the only thing you can't do is you can't build tree houses, you know, on creeks, or you can't build large structures, which can be a fire hazard. they're not safe for the community, and they're also not safe for our unhoused individuals. >> i've seen the just the callousness of the police department in the city and people not thinking of what the end result is going to be. and you know what? the individual goes a block away. >> now, that ordinance in fremont would not prevent anyone from camping out on private property with the consent of the property owner. we are monitoring tonight's meeting and will have an update on that discussion coming up tonight at ten. well, to san jose now. and efforts to address its growing budget deficit. ktvu jesse gary tells us the mayor has a plan to try to tackle the shortfall, and

it includes a major shift in homeless funding. >> rather than having groundhog day every year, we need to simply embrace reality. >> san jose mayor matt mehan says that reality the city does not have enough money to meet its projected obligations for fiscal year 2025 2026. sluggish sales tax receipts, which are down about 11% coupled with inflation, are cited as reasons. >> a lot of people moving, a lot of changes, a lot of expenses, inflation, they are spending more than they have budgeted. >> the mayor believes the $60 million shortfall can be cut by two thirds. by changing the use of measure e funds enacted in 2020. the tax on the transfer of properties above $2 million funds permanent affordable housing, construction and support services for interim housing for the city's 6300 unhoused residents. mehan seeks a council vote to earmark the funds for interim housing.

>> it's a policy decision. if we make permanent the measure e policy decision we made last year, we do not have two thirds of the projected deficit. that's a simple vote of the council. >> advocates for the unhoused are split on the plan, with some saying more spending on immediate needs will save more lives, while others fear not. staying focused on long term permanent housing will leave a group of people without a place to go. >> i don't agree with mayor mehan on a lot of things, but this one i do. letting them stay out there in the fields and the streets is inhumane. we have a humanitarian crisis. we have to act accordingly. >> for those working families, for the veterans, for the aging seniors, affordable housing really is the only solution. and we can't cut off one just to provide the other, because we know at the end of the day, people do need a place to call home. >> if the change is made, san jose would still have a budget deficit of $20 million. the mayor believes he can close that without having to enact layoffs

and instead focus on improving operational efficiencies. experts say that sounds nice, but likely some kind of cuts will have to come somewhere in the budget. outside san jose city hall, jesse gary, ktvu, fox two news. >> well, the city of belmont tonight could become the latest to support a measure that would allow embattled san mateo county sheriff christina corpus to be removed from office. so last year, a scathing report accused sheriff corpus of abuse of power, creating a toxic work environment, as well as retaliation. voters will decide in a special election on march 4th whether to give san mateo county supervisors the power to remove the sheriff. now, a number of municipalities and union groups have come out in support of measure. a sheriff corpus has previously denied any wrongdoing. the belmont city council meeting is underway and we are monitoring it and will let you know the results coming up later tonight at ten. well, new at 730 tonight, a report finds that california students are making some progress

recovering from learning loss during the pandemic. the education recovery scorecard was developed by researchers from stanford university, harvard and dartmouth college. its latest snapshot finds that federal pandemic relief did help contribute to academic recovery, particularly money spent on summer school and tutoring. the oakland unified district is among those that recovered in reading, but they say overall high rates of absenteeism, especially in low income districts, is impeding full recovery. a new bill in the state assembly would expand fee waivers for community college students to part time students, so right now, only full time students can benefit from the california college promise program. the bill would waive fees for part time students for up to two academic years. officials say nearly two thirds of the state's 1.9 million community college students are considered part time. the bill was introduced by silicon valley assembly member patrick aaron.

oakland city union workers who have received layoff notices held a rally at city hall today. they say job cuts will have a harmful impact on public services. >> save our services, save our services. save our services. save our services. >> employee labor unions say about 75 layoff notices were sent to employees effective at the end of this month, and more are expected. the cuts are part of the city's budget shortfall affecting workers from city departments, including public works. one union employee said the city is balancing the budget on the backs of workers. >> that's all we want to do is do our work and not have to worry about whether we're going to get laid off, if we're not going to be able to take care of our families because of mismanagement by this administration. >> the union workers say that the layoffs are illegal under the city charter, and they called on the city to work with them to avoid job losses and service cuts. all right. get ready for even more options while you're shopping in palo

week's intense storm. >> this home on cranberry drive in san rafael was severely damaged during the intense rains last week. a rain and debris filled culvert apparently clogged, creating a small lake of running muddy water draining from the huge mountain behind the community. >> the culvert got stuck and it basically just passed over the tarp of the pool, the cover, and just propelled it across and splashing into our house. >> in a very short period of time, though, there was no landslide, the house went from high and dry to flooded and muddy. the family called their insurer usaa, speaking with multiple people before a claim adjuster was scheduled. >> they sent a claim adjuster out the next day. denied coverage. >> now, when you say they sent the claim, how long was the claims adjuster here? >> it was pouring rain that day, but maybe ten minutes.

>> for its part, usaa says flood damage is caused by flood water coming from outside your property. a standard policy does not include flood insurance. flood policies are obtained through the nfip national flood insurance program. the marinwood community services district, a special purpose government district, owns the culvert drain that clogged but says it has no insurance for such an event. where does that leave you? >> with a gofundme page that my friends and family put together and you know, we have another atmospheric river coming. >> though the house is not in a flood zone and not required by the lender, not having flood insurance may make gofundme his only lifeline. you'll find that on our website. >> we're scrambling for money and you know, we're displaced. >> fact is, insurers keep eliminating coverage. the big five so far are flood,

landslide, earthquake, mold and pest damage, as well as sewer backups and sump pump failures. the question then comes up what's next? is it going to be hurricanes? wildfires? something else? tom baker ktvu, fox two news. >> okay, so let's talk a little bit more about that wet weather that is headed our way with our meteorologist, mark tamayo. >> hi there heather. yeah. we are tracking the clouds right now moving into the bay area. but the main impacts with this next storm will be knocking on our door by this time tomorrow, as rainfall rates will be picking up for wednesday evening. and this will also be a snow producer, a major snow producer out toward the sierra. so this is another atmospheric river. look at those colors blossoming over the bay area. this will be for thursday morning. the thursday morning commute will be such a big challenge. so rainfall projections these are totals expected wednesday through friday. the focus of the highest totals will be in this. in the santa cruz mountains, we could have amounts of around 5 to 6 to maybe seven inches. but this is

significant rainfall for the entire bay area. flood watch begins wednesday evening through saturday evening for all these areas in green, not including the inland valleys or the santa clara valley. and then we also have the winds. the winds will be a key factor here. lots of high wind watches that could soon turn in to high wind warnings. and that means gusts could be going up above 50 miles an hour. those winds really pick up late tomorrow night and into thursday. so there's the chance we could have some downed trees or power outages. so here's our thinking. with the rain timing throughout the day on your wednesday. just the chance of some scattered showers for the morning hours. and then things will begin to ramp up by tomorrow evening into the 10:00 hour as well. here's the satellite and the radar. you'll notice some green showing up, but most of this is falling in the upper levels. but there's the chance you could have some sprinkles or some light showers. but this is not linked up with this with the significant rainfall just yet. as we check out the wind report, just be prepared. the winds will be a big factor increasing tomorrow night. the winds right now are not too bad, but these numbers

will definitely go up wednesday night and into early thursday morning. here's our live camera looking out toward the golden gate bridge and current numbers is kind of a cool day out there. and temperatures in the 40s right now in santa rosa and concord right now in the upper 40s. so mostly cloudy skies tomorrow morning. not a big storm event just yet, but still a chance of some scattered showers for tomorrow morning. here's that atmospheric river developing racing across the pacific. and it really moves in wednesday night into thursday morning. we talked about the strong winds as well. so here's the forecast model. look at you can see into the afternoon hours into the evening hours that rainfall moving across the bay area. and here we go once again this is thursday morning. the possibility of some thunderstorms. this is thursday afternoon 4:00. and then on friday things kind of mellow out, but still the possibility of some scattered showers for friday. in fact, a fairly good chance. so keep the umbrella nearby wednesday night, thursday, friday, and then saturday we get a break. here's a look ahead, your five day forecast and the next main event moving in wednesday night and into thursday. be prepared if you can avoid the thursday

tonight we are getting word of more trouble following that fire at the martinez refining company that happened earlier this month. the company has actually told local health officials that the fire caused harmful chemicals to be released, and that includes chemicals that can cause cancer, as well as heart and lung disease. air quality measurements that were taken by the contra costa health department's hazmat staff during that incident, which happened on february 1st. at that time, they showed concentrations of chemicals in the air during the fire were mostly below the threshold considered dangerous. the fire started after leaked materials caught fire. six workers were injured and nearby communities were told to shelter in place. all right, near san leandro. a homeowner is really

concerned after a hate crime investigation is underway. the woman says that her fence was vandalized with racist graffiti. the sheriff's office is working to find out who's behind it all and asking for any information on surveillance video from anyone in that area. the homeowner, sonya reed, says she believes that some neighbors had some issues with her from the beginning. she said one woman says she did not give permission for the house to be sold to reed. reed says that same woman took offense when a contractor primed reed's fence with white paint. >> i consider whoever put this is ignorant. they don't know any better. i would ask them why not no blacks? why not? why am i not welcome here? >> now reed is a peer support and recovery specialist and narcotics anonymous volunteer who's been recognized for her work. this after kicking her own crack cocaine and alcohol addiction 17 years ago. she was

also once homeless. reed says she is torn now about this incident, and doesn't know whether she should continue renovating the house and sell it or move in when it's all done. since she says she no longer feels safe.
