at six starts now. >> this is ktvu, fox two news at six. >> the suspects entered the facility and wheeled the patient out in the facility's wheelchair, then left the facility's wheelchair in the parking lot. after loading up the patient into their vehicle. >> and we begin in the city of novato tonight, three suspects charged with kidnaping a man from a nursing facility and assaulting an employee who tried to stop the crime. good evening, everyone. i'm mike mibach. this happened over the weekend and the victim is now recovering from the terrifying ordeal. ktvu crime reporter henry lee live tonight in novato with the story. henry. well. >> novato police say the 60 year old man was rolled out in a wheelchair during the kidnaping. and then when a nurse tried to stop it, that nurse was attacked. police say a 60 year old man who could not care for himself was kidnaped over the weekend from a skilled nursing facility in novato. >> the suspects entered the facility through a back door, and they did so without checking

in with staff. >> i've learned from court records that the victim is 60 year old dean birx, and that the incident happened at novato health care center, which bills itself as marin county's premier skilled nursing facility. novato police lieutenant alan bates said it happened at about 1130 saturday morning as the suspect snuck the victim out the back of the facility where he lives. >> they then wheeled the patient out the back door and to the parking lot and loaded him into a vehicle. >> marin county sheriff's deputies spotted the vehicle, a honda crv on highway 101, in sausalito. the victim was found inside and taken to a hospital as a precaution. arrested was the driver, 48 year old michael edward roberts, who also allegedly attacked a nurse during the kidnaping, also taking into custody 56 year old paula birx, a relative of the victim, as well as 60 year old laura boyle. all three have been charged by the d.a. with burglary, kidnaping, conspiracy and false imprisonment of an elder or dependent adult, which are felonies. i've learned boyle's 38 year old daughter has also been implicated in the case, but she has not been charged. the four are all from

orange county. the victim was considered to be at risk and was under conservatorship, in which a judge had appointed someone to manage his affairs. >> the suspects in this case are known to the patient, to our victim, but they are not the rightful conservators. >> police say the defendants tried to fraudulently obtain conservatorship for financial gain by kidnaping the victim. >> it's important to note that conservatorships are legally binding civil actions, and that trying to circumvent that is inappropriate and potentially illegal. >> authorities say the victim was particularly vulnerable because of his condition, which included cognitive disabilities. >> the fact that a conservatorship was in place tends to lead most people to understand what the patient's state was. >> now, i've reached out to the administrator of this skilled nursing facility but have not heard back live in novato. henry lee ktvu, fox. >> two news. nice teamwork all around to get those suspects in custody. henry. thank you for that. a jury in santa cruz county reached a verdict on whether to release the man who confessed to raping and

murdering eight year old maddie middleton nearly ten years ago. adrian gonzalez was 15 years old when he killed middleton. he has spent the last decade in juvenile custody, but petitioned the court for his release. under california law, which does allow offenders who were 15 or younger at the time of the crime to be released from juvenile custody on their 25th birthday. after a number of hearings, postponements, testimonies and court dates, a jury reached a verdict that gonzalez is still too dangerous to be released and will remain in custody for at least another two years. new at six oakland police say they've made an arrest in connection to a hit and run that killed a leading sociology scholar at uc berkeley. retired professor michael burrow was struck back on february 3rd while crossing grand avenue near lake merritt. police say 61 year old kermit miller was behind the wheel. adding they were able to link him to the crime after his hearing aid was located in the suspect's vehicle. tonight, officials are monitoring the battery storage plant in moss

landing after a flare up there at the site. it was reported just about 630 last night at the vistra plant. last month, a large fire sparked up at that facility. county officials say the flare up ignited under a pile of rubble that had previously burned and then quickly intensified. last night, people who live nearby were advised to keep their windows and their doors closed. in a briefing, monterey county officials say the fire burned out at about 8:00 this morning and advisories were lifted this afternoon. >> the fire remains under control and the building is being monitored by personnel for any signs of a rekindle. >> the epa says it has not seen any signs of adverse health effects from the smoke. a kaiser permanente patient says he was sexually assaulted during a surgery last year, and now he has filed a lawsuit charging the nonprofit healthcare company with negligence and battery. ktvu. jana katsuyama spoke with the plaintiff and has the story.

>> i was sexually assaulted and a mohs surgery chair. >> michael timothy bean, alleges that assault happened when he had gone to have a melanoma procedure at a kaiser hospital in san rafael in february 2024. he says he was running late. >> i was greeted by the medical assistant. he was kind of ornery. >> bean says the assistant seated him in a surgical chair. >> the surgeon was on one side of me on my left, and this person was on the right side of me. >> the instructions for the delicate surgery on his face were to remain still. >> don't move and don't speak. keep your eyes closed. >> bean says as the surgeon was making the incisions to his face, he felt something on his right arm. >> and then at the same time, on my right side. the medical assistant was thrusting his hip, his hips and his erect #### into my arm over and over again throughout the entire procedure. >> the lawsuit, filed friday in

superior court in alameda, charges kaiser permanente, the doctor and the medical assistant with negligence battery and for kaiser negligent hiring and supervision with a request for a jury trial and financial compensation. >> he went through a period of thinking it was his fault, feeling that he was the victim. he should have stopped it from happening while it was happening. >> bean's attorney says kaiser had received three complaints from his client detailing the incident, but they never responded with a report on any investigation. >> he was told that they would get back to him with answers and a resolution, and then it never happened. >> i want kaiser to improve training. of course, you know, i'm a training professional at uc berkeley, and obviously something's up. >> kaiser permanente responded with a statement saying, quote, protecting the safety and well-being of our patients is our utmost priority. in keeping with this commitment, kaiser permanente does not tolerate any kind of sexual harassment or misconduct within our premises. while we cannot comment on an active legal matter, we want to

be absolutely clear that we take any such allegation extremely seriously. in san rafael, jana katsuyama, ktvu fox two news. >> after 35 years of rape and murder, cold case in the east bay has been solved. officials today named john perry of oregon as the man who raped and strangled maria jane widenhofer in 1990, in tilden park in contra costa county. she was jogging alone when she was attacked. perry died of a self-inflicted gunshot last november in oregon. east bay regional park district police detectives say his dna was found on hofer's body. perry, who lived in martinez at the time of the killing, became the primary suspect last year. >> holding the person accountable that took maria from her family. justice may have been delayed, but thanks the hard work of our detectives and our federal partners. justice has been served.

>> in 2017, detectives put out a possible image of a suspect. investigators determined he laid in wait on a bench right near the entrance to the tilden park trail before attacking widenhofer. so far, he has not been linked to any other crimes. new at six. the san francisco department of public health says it is continuing to see a decline in overdose deaths. the city says that the medical examiner reported 59 overdose deaths last month, a 17% decrease from january of last year. now, since april, officials say they are seeing a monthly decline in overdose deaths. they say they are also working to address disparities while making up just 6% of the city's population. nearly a third of overdose deaths are among african americans. >> expanding, culturally informed treatment and recovery services such and focusing on african american men over the age of 50 who are most affected by overdose disparities.

>> officials said they also plan to expand the nighttime telehealth outreach program to more areas this coming spring. the ntsb is investigating the country's third deadly plane crash in less than a month, this time in the state of arizona. the crash happened right near marana regional airport, just northwest of tucson. investigators say two people were in each plane. one of the planes landed while the other crashed and caught fire, killing both people on board. the small regional airport has no air traffic control tower and relies on pilots to communicate their movements over the radio. in toronto, crews are removing the wreckage of the delta plane that landed upside down. it's been two days since the plane, which was arriving from minneapolis, flipped over, losing a wing and bursting into flames. all 80 people on board survived, though 21 were hurt. tonight, one person remains in the hospital. investigators with the transportation safety board of canada say they've recovered the plane's black box, but it is still too early to determine the exact cause. in the south bay, people took part in a day of

remembrance at san jose state university. it was 83 years ago that president franklin roosevelt issued an executive order authorizing 120,000 japanese americans to be held in prison camps. san jose state's own cheetah hall, formerly the men's gym, was a processing center for santa clara county. speakers today said it is important to remember the past and to stand up against racial injustice. >> i think that the day of remembrance, we're all here to celebrate the enduring strength and resilience of the japanese american community. we're here to heal from the trauma of racial injustices carried out by the stroke of a pen. >> the san jose city council presented a commendation to the san jose state center for asian pacific islander student empowerment for continuing this annual program. coming up at six, the head of an oakland police unit is leaving his job. why? he says by resigning, other jobs in the department will be saved. also tonight at 630. he

the head of one of its investigative units, mac muir, telling ktvu he is resigning from his role in the community police review agency, or cpra, which investigates allegations of police misconduct and recommends discipline. muir says he hopes his departure will create enough savings to keep his staff from getting laid off, as the city looks for more ways to address its $130 million shortfall. the alameda county courthouse in hayward had to suddenly close due to a strike. >> what do we want? contract. when do we want it? now. >> thousands of alameda county superior court staffers hit the picket line today to fight for better working conditions, after they say negotiations fell

through. more than 90% of union members voted to strike across the county, including at the courthouse in hayward and oakland. workers say their main issue is lack of training. severe understaffing as 1 in 5 open positions have not been filled. along with what they also say has been bad faith bargaining by the county. >> swamped. we're swamped. not no longer hours, but we're swamped. so we're probably doing the job of two courtroom clerks instead of one. >> go, hey, hey! >> alameda county superior court says it is working to keep critical court functions going. it is not clear how long the strike will last. well, you may have noticed gas prices on the rise once again, up about 9% right here in the bay area and climbing for the foreseeable future. ktvu tom vacar has the story. >> the smart money shops at marsh gas in orinda. because a gallon of regular gas here is $0.63 below the bay area average. >> i wait to come to this

watchdog agency that oversees the state's petroleum market, issued an advisory over potential gas spikes following the early february fire at the martinez refinery, which cut a lot of the supply and lowered competition, which up prices. >> because they used it as an excuse. it's no reason to raise the price, it's just an excuse. >> corporate greed lining their pockets and not thinking of the everyday citizen that needs to gas up their car and get to places. >> nationwide, the average is 316 a gallon. that's $0.12 less than a year ago, and a $1.99 a gallon less than the bay area gas prices. bring up the controversial trump card. >> all of the things that the president is talking about, energy will lower the cost of everything. it will be coming down everywhere, including here. hopefully. >> president promised us that he will lower the prices and everything they want. he said

they want. i will lower the prices on gas, groceries and so disappointed that it's not happening. >> the martinez refinery sent out a statement that the refinery will be down for several more weeks, with occasional flaring. what's happening for sure is that as spring approaches, the switch to cleaner burning gasoline blends will raise prices once again. tom baker, ktvu, fox two news. >> pg and e laying out a new plan to underground several lines in south san jose. the utility announcing the plan today while crews were out there working to underground about a mile of power line near the almaden expressway and camden avenue, pg and e says the project will remove transmission lines from high risk fire areas and significantly reduce outages for nearly 10,000 customers currently protected by its enhanced powerline safety settings or apps. those settings shut off power if a hazard is detected to prevent wildfires.

>> here, the electrical circuit that serves these communities, the 6101 line, passes through both urban and high fire risk areas. so in this case, we want to keep the safety settings in the high fire risk area, but reduce the impact of eps outages in the urbanized neighborhoods. >> the utility says once those power lines are underground, 15 steel transmission towers will be removed from the area. >> okay. it was kind of a fun day, right? the showers came down, the light sprinkles drizzle. depending on where you were, what you got, if you're further north, there was some rain up there, a quarter inch half inch up towards cape mendocino, but everything south has been pretty light. 10th of an inch, five hundredths of an inch, 100th of an inch, very light. and then temperatures today were on the mild side because of the cloud cover and a little bit of rain. and then the sun came out right. and then kind of dried everything up. and it looks like a whole new day

>> and in that story, we heard president trump claim the ukrainian president's approval rating is at 4%. but according to the most recent survey from the kyiv international institute of sociology, zelensky's approval rating is at 57%, down from the 7,590% mark he was getting earlier in the war. new at six, the bay area chapter of the council of american islamic relations has designated stanford university a hostile campus. council leaders, citing what they say is the university's ongoing suppression of palestinian advocacy, including a crackdown on student protests and retaliation against faculty who addressed palestinian human rights. a clinical researcher at stanford says she experienced threats from the university over a clinic she and others held to protest israel's bombing of hospitals. >> the day before our clinic. stanford removed this area from the free speech zone, forcing us to relocate and threatening us with arrest. one of our medical students was even threatened with suspension for refusing to

have been charged with breaking into a living facility in novato, kidnaping a man in a wheelchair and then assaulting a nurse who tried to stop the crime. it all happened saturday. at this time, investigators say they believe the suspects were trying to obtain a conservatorship over their victim for financial gain. a bay area man suing kaiser permanente claiming he was sexually assaulted during a medical procedure at their hospital in san rafael. kaiser, not commenting on the active lawsuit, but did tell ktvu they do take the allegations seriously and do not tolerate sexual harassment or misconduct. adrian gonzalez, the man who confessed to raping and murdering eight year old maddy middleton nearly ten years ago, will remain in prison for at least another two years. a santa cruz county jury denied gonzalez's release after he fought for it under a state law which does allow offenders who were 15 or younger at the time of the crime to be released from juvenile custody on their 25th birthday. with that, you're watching ktvu fox two news here

at 630. celebrity chef tyler florence has left san francisco's union square, less than two years after signing a three year deal and receiving a grant from the city to open two new cafes. ktvu christian captain reports tonight the departure is raising a lot of questions about the nature of the deal and the future of union square. >> workers made trips in and out of the miller and lux bakery on the southwest corner of union square, removing items from the now closed cafe. the miller and lux provisions location across the square has a sign in the window that says it's temporarily closed for repairs and renovations. it's now clear that neither location will reopen. san francisco's recreation and parks department released a statement reading in part, quote. miller and lux stepped into the space with a pop up during a critical time for the area, bringing energy and great food when it was needed most. while they made the decision to move on. we're grateful for their time here and optimistic about the future of these cafe spaces. tyler florence opened the locations in 2023 at the time, saying he signed a three year lease and

that he wanted to be a part of the neighborhood's economic recovery. >> we're all in this together to do what we can to bring san francisco back. >> former president of the board of supervisors aaron peskin said he worried about the deal with the department of recreation and parks and the mayor's office of economic and workforce development as it was being made, saying a $440,000 grant to improve the area was intended to fill vacant businesses between geary and market. he now says he hopes the city takes a valuable lesson from the closure of the celebrity chefs union square locations. >> i hope that the mayor really holds rec and park and the office of economic development accountable and asked tough questions and gets real answers and structures future leases in a way where folks like tyler florence will be held accountable. >> the office of economic and workforce development said it oversaw the $440,000 grant to expedite the opening of florence's restaurant locations on union square, which were open in time for the 2023 holiday shopping season. the office of economic and workforce development said florence miller

and lux locations helped boost business in the area, and that a $2 million grant from the state for improvements to the cafe spaces will continue, and those spaces will be ready for the next tenant. local bakery patisserie stepped in over the chinese new year and nba all-star weekend. the union square alliance thanked tyler florence for stepping in at a critical time, but also said it's already preparing for the next tenant to fill these locations. >> ppe patisserie came in and enjoyed the wave of nba all star weekend, so we're going to keep that energy moving and keep the location just as hot as it's ever been, so we're excited. >> the rec and parks department said that the be patisserie pop up at this location was a huge success over the all star weekend, and they're looking forward to working with them on a longer term deal. in san francisco, christian captain ktvu, fox two news. >> san francisco's richmond district received its first speed cameras. those cameras were installed at geary and seventh avenue this morning. the location was selected due to high crash rates and speeding there. at the intersection,

cameras will snap a photo of a driver's license plate. if the driver does go more than 11 miles over the speed limit. fines will range between 50 and $500. walk s.f. says it worked with traffic victims for six years to pass legislation to approve the cameras. >> the people that shared their stories, the victims of traffic violence, the ones that lost children and siblings and moms and dads. those are the ones. those are the stories that change hearts and minds. >> 33 intersections in san francisco will eventually get the cameras. they are expected to be up and running by next month. san francisco has joined a lawsuit to protect access to critical public health data. the lawsuit is led by the group doctors for america. it comes after the trump administration's attempt to erase decades of public health information from federal agency websites. according to san francisco city attorney david chu, the lawsuit seeks to preserve access to essential public health data that medical professionals rely on to treat patients, and that

local health departments use to protect communities from infectious diseases and public health threats. several employees with the u.s. department of agriculture are expected to return to work after they were allegedly fired by mistake. those workers were said to be developing the federal government's response to the bird flu outbreak, which has swept across the nation, killing millions of birds and sickening dozens of people. under elon musk, the department of government efficiency, or doge, has cut thousands of federal jobs through buyouts and layoffs. some republicans are now joining democrats in sounding the alarm. >> the fact that workers were let go or working on avian flu, who are responsible for nuclear safety, shows that we need a far more careful approach. >> there is no sugarcoating this. these cuts will kill more americans. >> doge claims its cost cutting

pneumonia in both lungs. fox's jeff paul reports the pope's condition has drawn worldwide support and prayers for his recovery. >> pope francis spending a sixth day in the hospital where doctors are currently treating him for double pneumonia. officials in rome say he is stable and showing slight improvement. wednesday afternoon, he received a visit from italy's prime minister, who said the 88 year old was alert, responsive and even joking. >> we should all feel reassured that pope francis is in good hands. we look at this particular moment for the church with serenity. >> the holy father was hospitalized with bronchitis last week, but on tuesday, a ct scan of his chest revealed he developed pneumonia in both lungs. the vatican described the situation as complex. though pope francis is reportedly not on a ventilator and is breathing on his own. >> some infections require prolonged treatment because they're just harder to clear from the system. >> the pope has been hospitalized several times in recent years with health issues, and is prone to respiratory

man is back home after completing one of the most grueling athletic competitions in the world. seven marathons in seven days on seven continents. ktvu sports reporter bailey o'carroll talked with the winner of the world marathon challenge about what it really took to cross that finish line. >> it really is actually more of a psychological game at a certain point where you are almost in a grappling match with your own head, trying to prove to yourself you know how capable you are. >> 45 year old chris o'dell, who calls san francisco home, did what many would consider impossible. he ran seven marathons in seven days on seven

continents. and now you're probably asking, how is this not just physically, but logistically possible? >> a lot of credit really goes to the organizers of the event. i mean, they manage a lot of the logistics in terms of the permits, the language differences, organizing the charter flight, which is customized to allow this route in order to basically hit the seven continents in seven days. >> they calculate flight times and race times so that the runners can focus on the physical demands. >> i would say the hardest part was probably the recovery in between each of the races, because especially after the second or third marathon, you realize you still had about 4 or 5 marathons to go. your body is pretty wiped out. you're going through these extreme temperature changes. you're juggling nutrition. you have jet lag. >> o'dell says the runners relied on a diet of chicken mcnuggets and gatorade for the week. >> we tried to basically find foods where we wouldn't risk any sort of food poisoning or anything. so naturally, fast

food sort of became the option. >> he started his journey in cape town, south africa, for an orientation. then it was off to antarctica for the first race. >> we basically hopped a aleutian, russian soviet military craft basically to antarctica. it was about a 5.5 hour flight. the door is open, and i just remember the announcer on the plane basically saying, you are required to wear sunglasses because the sun is so bright, especially when it's reflecting off the snow, that you could actually burn your retinas if you stay out too long. >> the temperature 11 degrees, but with wind chill negative seven. then it was back to cape town for the second marathon. to perth, australia. to dubai, to madrid, then fortaleza, brazil for the sixth marathon. >> that was the race that almost broke me, actually, because it was about 85 degrees, just absolutely oppressive humidity, barely any shade, you know, sixth marathon. i had severe chafing just from the clothing, from sweating through. it was

just brutal. but we managed to get through that. >> before the last race in miami. so yes, it is possible to run seven marathons in a week on seven different continents. adele is proof. so why did he do it? >> i was really looking for something to sort of provide some, i guess you could say. meaning in my life in terms of a new challenge, a new way to stretch myself. >> and the golden question, would he do it again? >> yeah, i would definitely consider doing it again. it's a it's a big financial investment to participate in the event. and also just the sheer amount of time you spend away from family and work to run really makes it a big commitment. but it's just such a once in a lifetime experience. >> in san francisco, i'm bailey o'carroll, ktvu, fox two news. >> all right. spring training officially underway in major league baseball is trying out some new technology and automated ball strike challenge system has been implemented at five cactus league ballparks. all pitches will be analyzed by

everybody south of santa rosa, north of santa rosa is going to rain a bunch. they're going to get a bunch up in crescent city as well. so when you look at the long range model, you see everything else all hit in the north, boom, boom, boom. everything's going to the north and we're down here. right. so we're missing out. there's another big ridge of high pressure that's on february 25th, but the plan for the next few days will be a warming trend dry. we've had plenty of rain, so fire danger not going to go off the charts. southern california is going to have a santa ana wind issue the next 48 hours on and off wind advisories and such. and normally, if that had been, if they hadn't got that last rain that they just got last week, they would be in big concern there as well. but the fuel moistures are up significantly. so that's good news. there's one of the systems that's going to track through the pacific northwest. it's going to miss us. this is the system from this morning, which was it's a little bit of rain, like a 10th of an inch up north and 100th of an inch in san jose, san jose, san jose and in

berkeley, 10/500 of an inch in san francisco. so just really light stuff and gone. so the model shows this for tomorrow morning. there's going to be a little bit of patchy valley fog then tomorrow afternoon. so this is your thursday night and then upper 60s low 70s. and then friday you see some fog on the east side of the valley friday morning, some probably some valley fog around here. and then friday afternoon. it's going to be nice, man. we're not we're not looking at rain for a while and we're not looking at any really, you know, freeze warnings, frost advisory or anything like that. there's some fog for saturday morning. so when you start showing fog, fog needs a stable environment. so that's generally a good indication that there's nothing going on. so when i start talking about fog and things like that then you know yeah not much going on temperatures. you see those above average or a little above average, not a ton. but by the weekend they go way above average. a five day forecast in the mid 70s. mike, what are you going to do with that. >> that's a good looking five day right there. >> i think it is. i think we got

other round of winter weather this week in kentucky and tennessee. conditions are threatening rescue missions still taking place from the deadly floods just this past holiday weekend, officials say. more than 1000 rescues have taken place so far. as temperatures drop, utility crews are scrambling to restore power to hundreds of homes and businesses. we will now have to wait a little bit longer here to learn the fate of new york city mayor eric adams and his corruption case that has ignited a political firestorm. fox's connor hansen has the very latest from today's hearing. >> a judge overseeing mayor eric adams corruption charges has yet to make a decision on dropping the high profile case. >> who forced him to resign. >> protesters in new york city gathered outside the courthouse wednesday. >> honestly, it feels like it's a it's a mockery every time i turn the tv on. >> critics, including an opponent in new york's upcoming mayoral race, say the justice
