>> you do a great especially in that sweater. if you're traveling through the high country, driving out west moving fairly smooth right now not a lot of drivers and you are not really bad -- battling the weather limits. however that will change-up. that snow will start to push in late morning throughout the afternoon and into the high country. you will be battling the snow throughout the duration of your day today. if you are planning to head home later so we are anticipating a little rushed here. earlier than normal with those travelers heading back into denver especially with that broncos game as well. we will want to beat the snow. travel time right now right around 40 to 45 minutes, the green line all the way. we are starting to see if you were shot -- travelers -- we are starting to see a few more travelers but nothing major.

no word on whether this is related to a forcible fondling that happened in the du area last week. and people in alaska woke up to a major earthquake this morning. the 7.1 magnitude quake struck about 20 miles from anchorage. the national weather service says there is no tsunami threat. no word on the extent of damage or repair entered -- any injuries. crews are scrambling to clear roads as travel restrictions are expected to be lifted today. some people are even calling it snowmageddon and for good reason. it dropped more than 26" in central park by midnight and hundreds of thousands lost power. i want to show you what it looks like in dc. they were right in the bull's- eye of the storm.

if they braved the storm. others decided to break out the skis to get where they needed to go. even emergency responders had trouble traveling through the areas. i want to show you another low blow from mother nature in new jersey this time, the destructive impact in new jersey. rising waters turned streets into rivers. water was nearly 20 inches high in some homes and homeowners say they just finished rebuilding after the fed -- after the major flooding from hurricane sandy. stormy weather is to blame for delays and canceled flights . there were 49 cancellations -- at least that many expected today and that could impact folks trying to get here to watch the broncos game so we will keep you posted on all of that.

shooting that happened near the montbello park-and-ride. they say the victim was walking when a shooter opened fire. the victim died shortly after. authorities have not released information about the suspect at this time. broncos and could we see some snow during the big game? meteorologist belen de leon will tell you if you need to

welcome back, both sides of the death penalty debate want to change the laws on the brandon rittiman regs is a deeper look at what lawmakers are thinking. >> reporter: right now on balance of pair -- balance of power, the debate continues and we have seen failed attempts to repeal this punishment. governor john hickenlooper says he would do that but he doesn't think the state is ready. on the flipside supporters want to try something new after the aurora feeding -- shooting case ended in a life sentence. kevin lundberg wants to make it easier for courts to impose the death penalty.

senator, representative, thank you both for being here. senator, you have bill that proposes to change the way the death penalty can actually be imposed on someone. instead of all 12 jurors unanimously, it would be nine of 12 jurors needed in order to oppose the death penalty. how did you arrive at that number and why lower this requirement? >> understand that this is the death penalty phase of the trial, because that's a much more subjective part of the decision. is, what shall the penalty be? we saw in a couple of cases this last year particularly the james holmes case that cold- blooded, premeditated murder of many people still doesn't yield the death penalty. to impose the death penalty it will take a supermajority of unanimous opinion which seems to be impossible to get to in some cases that arguably many in colorado believe should and does deserve the death penalty.

you do have one of these really tremendously awful cases, and you can't get the penalty day and that penalty. is it already over and why do you need the policy? >> it's not over though because we have the -- three people on death row currently. i know because all three are african-american and from my district, my age that went to the same high school. so we've got a problem with the death penalty and how it is being used in colorado, but the solution isn't making it easier to get a conviction. the solution is getting rid of it. we are talking about the highest of high punishment in colorado. bar. >> i don't think there are too many people who think governor sign this. he regularly advocates against the death penalty but says we yet. is this really more about trying to soften the ground on the issue and get people to understand where you would like the policy to go?

process, it is a process. it does take a lot of thought and that's a good thing. do we have a death penalty that functions here in colorado or do we not? i think it's a very legitimate question we need to face and it starts with a bill. so i have a bill, senate bill 64 that says let's move unanimous opinion to a supermajority and frankly i am negotiable on what that magic number is but i don't believe unanimous works because the bar is too high. will the governor sign it? if it made it through both houses, i believe that's a serious question the governor needs to answer. he's been really on both sides of this issue through his political career. >> earlier this year the governor told the representative that he doesn't think the state is ready for a repeal of the death penalty. do you agree with that or do you think the state is ready? >> i think we are seeing more and more states removing it and becoming more like

>> i know we have better investigative tools that we've had in human history but are you 100% shorter our system is foolproof that we could accidentally kill someone? >> of course not. i am not 100% sure that when we take a person and incarcerate them for the rest of their life that we are always accurate. >> but that can be at least partially fixed. >> well it can't be fully undone . >> no but -- this can be any undone. >> no and neither can the person who goes and commits the crime initially, that's a huge reason for this concept of justice, is to tell the person who might be considering such a crime that we will administer the ultimate penalty for the ultimate crime. the judge has the prerogative to say, timeout, this wasn't the right decision. i think we have a lot of safeguards in place. >> you brought up a valid point that this is not foolproof.
