an investigation this morning after a fatal accident. a man is dead and an officer is in the hospital, after a driver pulled in front of a squad car responding to an emergency. >> i said i don't know why you are doing this. i love you. the woman whose baby was cut from her womb tells jurors of the day in graphic detail that changed her life forever.

forced to close after a huge mess. details overnight. an investigation is underway right now after a driver turns in front of a squad car as it was responding to an emergency. it happened at the intersection of federal and 88th. 9news reporter noel brennan has been there all morning. noel the driver was killed and the officer is in the hospital? >> reporter: that is what we are hearing corey. i want to show you specifically the squad car that was involved in the accident. the front end is smashed up. there is a ton of debris in the middle of this intersection right now as investigators are acttively working, trying to pinpoint what happened with this accident. here's what police say it all started at about 1:15 this morning. they say an officer was responding to a disturbance call involving a gun. he was headed southbound on federal boulevard when another car, headed northbound on federal, turned on to 88th. the squad car ended up plowing right into that other car, sending it right into a ditch at the intersection.

car was killed. and as corey mentioned the officer was also injured. he was taken to the hospital. police say he is going to be just fine, has minor injuries, so that is the good news this morning. this accident investigation, though, just getting started. investigators have been here for hours, working out here. one of the questions we wanted to get answered was whether or not the officer had his lights and siren on at the time as he was passing through the intersection. investigators have not been able to tell us that quite yet this morning. morning. in the meantime, amelia earhart has details on how to get around this intersection. >> reporter: in fact sky 9 is overhead, taking an aerial view of the scene here. obviously. federal is shut down at 88th.

winds. i just saw a wind gust of 78 miles per hour. it is going to take awhile to make it down into the metro area so some of our strong winds come in the foothills throughout the day. they will finally slow down tomorrow afternoon. high wind watch out sheridan boulevard and highway 287 to the west, gusts to 60 miles per hour possible. a lot of 20 on and 30 miles per hour gusts. the high wind watch over the plains goes out tonight. gusts up to 100 miles per hour from the front range mountains and foothills down into the mountains. rain and snow out west and how warm it is going to get, in a couple of minutes.

jurors return today for the second day of the trial for the woman accused of cutting a fetus from a pregnant mother. the jury had a lot to think about last night after michelle wilkins described in graphic detail the attack against her and her unborn child. joins us. yesterday? >> reporter: it was very disturbing testimony. but prosecutors say it is necessary, because they are this case. dynel lane was in court as michelle wilkins testified. she was one of several people the jury heard from. wilkins testified she had gone to dynel lane's house to answer an ad for free maternity clothes posted on craigslist. she told the jury she stayed in the home for what seemed like a long time. that dynel lane kept trying to have a conversation with her. michelle wilkins said on the

talking trying to be polite but eventually she got uncomfortable and tried to leave. when she did, she said dynel lane hit her in the back, and then choked her and punched her and she said this to try to stop the attack. >> i was holding my hand over my head and i said i don't know why you are doing this. i love you. she said if you love me you'll let me do there and then she stabbed it into my neck. >> and that was just part of the testimony that we heard. >> reporter: we also heard from first responders, including a police officer, who responded to the scene after michelle wilkins called 911. the dispatcher described talking to wilkins on the phone, trying to keep her awake after having her baby girl cut from her womb.

lane is being held in jail on a $2 million bond as this trial corey. >> tarhonda thank you. prosecutors won't charge a homeowner who shot a man to death during a robbery. 38-year-old david martinez was killed last month. he and others man robbed the owner owner. the home -- the homeowner. the second suspect was arrested days later. an investigation decided criminal charges weren't warranted even though martinez was shot outside the home. apple versus the federal government. the ceo tim cook says the company is trying to protect the privacy of every user and that is why he is fighting against an effort to unlock a terrorist's cell phone. this is all prompting a big debate.

live to talk with us about this. vida, the question is should apple do it? >> reporter: that is the big debate here. apple could easily create the software needed to unlock the iphone used by the san bernardino shooter. however doing so could create a danger that far outweighs its public benefits. in a letter released on the company's website ceo tim cook says he is challenging a judge's order that apple must assist the fbi, saying it could potentially undermine encryption for millions of users. and endanger privacy for hundreds of millions of law- abiding citizens all around the world. the federal government says it needs to have access to any records in the phone in order to track leads to isis.

maintains the request would only have an impact on one device, and that they are not asking apple to redesign a product or even create a new back door to one of their products. apple has five days to respond to the court ruling. gregg? 6:09 right now. people in colorado bought mer cigarettes last year than they have in a long time. health officials say 194 million packs of cigarettes were sold in 2015. that works out to about 36 for every resident, and that was an increase of more than 1 million packs from 2014. the number of luxury apartments being difficulty in denver is on the rise. the units are being built even though vacancies are increasing in the metro area. it comes down to high demand. in downtown denver renters are willing to pay top dollar, for top amenities, not just a pool

>> how many mac computers do you have? >> reporter: according to the latest reports three years ago, about 30% of renters in the denver area were paying rents below $1000. that number sits now at 11%. take a look at this mess. this is augusta, maine. an ice jam flooded some of the nearby streets. luckily for some people who normally park along the river, they were warned beforehand they had to move their cars. marty, it is ice jam season out there, but usually it doesn't create this kind of mess? >> reporter: no that is amazing. when a mess for augusta. now for us today, more rain and snow on the way. remember we have had the rock slides in glenwood canyon. this weather does not help in that situation. we continue to see the rain

with lake showers and snow continuing, the heaviest snow between 4:00 p.m. and midnight. a few spots north of rabbit ears pass getting a good amount, 4 to 9 inches. most is at 2 to 6 with south and west of crested butte 1 to 3 inches of snow. stronger winds throughout the day, temperatures in the low 70s. if we hit 72 degrees that will be a new record for today's date. >> and if the thermometer doesn't blow away in the wind, we can confirm it right? 6:11 now. well the hope was drivers might be able to get through glenwood canyon sometime day. crews worked all day yesterday to repair i-70 near glenwood springs after the two huge rock slides on monday.

few high clouds here, clear over the plains. we have 20s, 30s, 40s and close to 60 degrees in some of the chinook winds in eastern colorado. these showers are the first foray of the new storm. the main core of storm is still in utah. look for the heaviest snow in 4:00 p.m. so by late in the afternoon, here we are at 5:00, perhaps rain, blowing over the continental divide and the snow being heaviest in the mountains. 60s in the foothills, 60s and 70s. i believe we'll make a record high temperature here today in the strong winds that will continue to build through the day with the strongest winds in my opinion from the i-25 corridor to the east late this afternoon through early tomorrow morning. so it is just going to build as the day goes on.

the afternoon, lasting until about midnight tonight. 40s, 50s in the mountains and west, 60s, 70s and 80s in eastern colorado. extreme winds especially through the afternoon and evening tonight. with strong wind gusts. a few gusts at or higher than 60 miles per hour in the metro area. in the foothills 100 miles per hour gusts absolutely possible. extremely windy tomorrow morning, decreasing tomorrow afternoon. a little breeze out of the turn cooler. we have a chance for a couple of inches of snow coming up morning. we have just something for everyone today don't we? >> we do. sky 9 is taking an aerial view of the overnight crash involving the police officer and another vehicle here. it is a fatal crash, which means the investigation could be underway for several hours and you can see exactly why. so much activity on scene here, tow trucks arriving, additional police units. in terms of the alternate

corridor and out onto the plains. from about 5:30 tonight to 5:30 tomorrow morning i think is when we are going to see some of the strongest winds. during the day as the wind intensifies, we get single digits and low teens for relative humidity, we have red flag warnings out for extreme fire danger from the foothills through castle rock and parker out to watkins and through all of southeastern colorado. rain and know in the west, extreme fire danger for the front range and southeast. marty let's look at our drive here. we have a changing situation across the closure right in our west minister commute after the overnight fatal accident. southbound federal remains closed from 86th to 90th, we just got the text message update that northbound federal is now open in the area. again, northbound federal is open between 86th and 90th. southbound is still closed.

for much of the morning. it is just starting to open up. i went through 19 liters of blood in the first two hours. >> reporter: police officer tony lopez jr. has a plan to get on with his life and get back to work. already a nasty race getting more intense between the republican front runners in the presidential primary. one now threatening to sue another over this campaign ad. 6:31 right now. good morning everyone. one man is dead and a westminister police officer recovering in the hospital this morning, after police say the driver turned in front of the squad car. the intersection of federal and 88th had been shut down for hours. amelia earhart is tracking progress in getting it back open. we start with 9news reporter noel brennan who is live at the scene. the officer was on the way to an emergency.

the officer's car is now up in the bed of a tow truck now. they are about to move the other car that was involved in this accident. they've got northbound lanes of federal boulevard at 88th open now in the past 15 minutes or so. i want to show what you this intersection looked like as emergency crews were on the scene earlier this morning. i know from police that the accident happened about 1:15 in the morning. a westminister police officer had just gotten a call about the disturbance involving the gun. he was headed southbound on federal boulevard when another car traveling southbound on federal turned on to west 88th, right in front of the officer's car. the officer ended up plowing right into that car. sadly, the man driving the other car was killed in the accident. the officer was also sent to the hospital, and has minor injuries. westminister police say he is going to be just fine. one of the things we have asked

get an answer about so far is whether or not the officer had his lights and siren on at the time of the accident as he was passing through this intersection. looks like investigators have wrapped up their work. they have the squad car up and they should have the other car out of here shortly and soon i imagine the southbound lanes will open up. we have seen changes in the closures across federal where the fatal accident happened overnight between 86th and 90th. that is where the previous closure was in both directions. northbound traffic is getting through. yes you will see delays, because there is still a lot of activity in the area, so do keep that in mind. use 92nd to pecos as your alternate route. you can access u.s. 36 in the area. the rest of your metro drive very busy. an accident here at 104th avenue. we want to go live up to sky 9 overhead, looking at the

decent visibility expected with strong winds around the areas. if we hit 72 and i think we will, that will be a new record high for the day. the wind will continue to pour off the foothills. but after 5:00 and especially after sunset, that is when we have the strong winds moving down the hill here over the i- 25 corridor. we have high wind warnings out now for the front range mountains and foothills for up to 100 miles per hour gusts. that goes through noon tomorrow. and here more locally from sheridan, to 287 to the west we could see up to 60 miles per hour gusts. again most of those this afternoon, tonight and early tomorrow morning. >> those are dangerous speeds of winds. >> reporter: it is going to be a noisy one. marty thank you. it has been nearly a year since she was brute lay tacked and her unborn baby was cut from her womb.

attacked, and her unborn baby was cut from her womb. michelle wilkins will testify again today? >> reporter: yesterday was the only day michelle wilkins is going to be speaking as part of this trial. she is the woman whose baby was cut from her and that baby did not survive. prosecutors put michelle wilkins on the stand and her testimony was powerful. she spoke about answering a craigslist ad for maternity clothes, and in the courtroom she identified the person she met, dynel lane. she went to her house and there she said lane showed her several items of clothing, and wilkins started to get uncomfortable and wanted to leave. dynel lane just kept talking over her and convincing her to stay. eventually, michelle wilkins said when she tried to leave by going up the stairs from the basement, lane hit her in the back and then the attack began.

on her neck. she began punching her, hittingler, and then the moment that led to michelle wilkins passing out. >> she pinned down my arms with her legs and actually used i remember she was trying so hard to cut me. and when she got closer she bore down with the whole weight of her hand on my windpipe and i just remember everything going black. >> reporter: the next thing michelle wilkins recalls and waking up and her baby having been cut from her at the time. she had the wherewithal to call 911 and the dispatcher testified about the call. the police officer who was first to respond to the scene also testified. so some very, very intense testimony we heard on the stand and that is only day one of

tarhonda thank you so much. a child he hasn't even met yet was the greatest motivation as a denver police officer was fighting for his life. officer tony lopez jr. is talking about his recovery for the first time. he was shot six times. 9news reporter vida urbonas, @maying to hear him talk about being able to meet his son coming in a few months. >> reporter: we talk about the power of positivity. sergeant tony lopez very says there are two things now he would like to accomplish. he wants to help carry his new borne home from the hospital and he is hoping to do it without crutches. and second he wants to return to full-time within his department by his birthday, which is in september. lopez almost died after getting shot six times during the traffic stop in december. paramedics and fellow officers placed three turn kits on lopez's limbs in the moments

decision to do that almost certainly saved his life. even still, he went through a massive amount of blood loss on the first day. a person's body holds 6 to 9 liters of blood. he went through 19 liters in the first 24 hours and lost even more than that afterwards. but he said he fought to stay awake and alive because of one little precious thing. >> he kept me alive and motivated to live. i remember thinking stay awake so you can see your son. >> tony lopez jr. has been promoted to sergeant. oh he is named after his father, denver police commander tony lopez and he wants to maim his own son when he is born in three months tony lopez iii. corey? a larimer county sheriff's deputy won't face charges for

in january the deputy shot and killed 38-year-old phillip salazar as the man held his girlfriend hostage. deputy chris martin said salazar lunged at him with a pair of scissors. today a man accused of shooting and killing a teenager is going to be in jail after a hash oil went bad. a 16-year-old girl and her dog were injured in a shooting outside the target in march of 2015. they both records. the teen made an arrangement with the man and two others to buy hash oil but when they met the suspects tried to rob the victim. that is when shots were fired. ted cruz is now on top in a new national nbc wall street journal poll and is telling donald trump bring it on. in the poll cruz has 28% to

ready, not for baseball but hockey. on saturday the stadium will hold its first of three lock can i games when the university of denver faces colorado college, followed by the avs red wings alumni game next friday and the stadium game between the two teams a week from saturday. it does feel like baseball season in denver right now, so how exactly do they plan to keep the ice frozen? the first problem is the sun. to combat that, they put a reflective tarp across the ice to help reflect the heat. when the light hides back behind the stadium walls, they then rolled the tarp back and work on the ice until first light shines again. then there is the issue of of our sudden, springlike -- of temperatures. >> we are able to keep it cool with ice pans cooling system. >> that cooling system removes any heat from the water and

for shooting a man near ft. collins. the deputy shot and killed 38- year-old phillip salazar in january as he held his girlfriend hostage. deputy chris martin said salazar lunged at him with a pair of scissors, threatened the woman and the deputy. prosecutors won't charge a homeowner who shot a man to death during a robbery. 38-year-old david martinez was killed last month. he and another man robbed the homeowner while responding to a craigslist ad. the homeowner grabbed a gun and hit and killed martinez. a convicted child rapist could face the death penalty for murdering a correctional officer in prison. miguel perez is accused of kidnapping and killing sergeants mary richard in ap130 of 2012. -- in september of 2012. today a man accused of shooting a teenager after a hash oil deal gone wrong will
