250 people are confirmed dead. several buildings in the small town are flattened. there are temporary shelters and tents for people who lost their homes. the search for survivors has been non-stop. a 5.9 magnitude quake hit the same region in 2009. rescuers found survivors 72 hours after that earthquake. two men used a crosswalk in aurora on sunday night when an suv came barrelling towards them and one of them was hit and killed. the driver believed the pedestrian who survived said his friend saved him. >> i think that it was really him guiding me to cross , you know, even after the car had hit him. i think that he was still there with me pushing me across the road and making sure that i was still safe. >> coming up at 6:00 on next with kyle clark, a man called denin dalton is remembered by the friend whose life he saved.

downtown denver just sued the city according to a case filed in u.s. district court. the plaintiff's said the city forced them out to clear the why for new economic and downtown development in the downtown denver area. the plaintiffs are represented by jason flores williams. they said city policy led to open season to anyone on downtown denver who were poor or protected themselves from the weather. we reached out to the mayor's office and they went response. quote, the city has not been served with a lawsuit and once we receive the complaint we will respond to them. brazilian police charged american swimmer ryan lochte with filing a false robbery report during the olympics. lochte first claimed that he and three teammates were robbed at gunpoint. he since changed his

was drunk at the time and it was his actions. lochte can decide whether to introduce a defense in brazil. the indictment will be sent to the international olympic committee's ethics commission. arapaho county deputies are looking for two people who took a denver broncos team helmet during an autograph signing. they gave us these shots of them. it happened july 31st. a broncos player sat his helmet on the ground. the man with it off to another man. he's the one on the right. the stolen helmet is valued at more than $400. if you recognize either of the men call crime stoppers at 720-913- stop. so we're talking about a spacecraft that reached a huge milestone last summer. nasa's new horizons flew into history becoming the first man-made object to make it to pluto.

more than 400 national parks, monuments and other sites that the service runs across the country. today through sunday is when it will take place. that's a cool shot. this includes the four national parks that are located here in colorado. after a 7-year hiatus the winter park ski train returns this season. kind of late. amtrak showed off the train today. it stopped running in '09 and cost too much for a private operator. amtrak is begins operation on january 7th through march 26th. the decision to bring it back was partly based on a test run last year. >> it was a huge success. it was minutes or hours and we felt on the basis of what we learned from that test as well as the demand, the very strong demand that we saw at the time that we could be confident coming into this that we could operate this service successfully on a seasonal

>> it will leave at 7:00 and return after the slopes close. tickets go on sale tuesday, starting at $39. good chance it's going to sell out fast. if you'd like more information visit our website at 9news.com. the executives at epi pen maker mylan heard people who were not too happy about their price increases. the drug maker said it plans to boost access to the epi pen auto injector that people with certain conditions need. the news comes after mylan came under price increase over the past decade. mylan is re deucing cost through a use of a savings card that patients can get. patients who have previously paid full rate they will have their out of pocket cut by 50% with the card. it's doubling the eligibility for the patient assistance program which eliminates out of pocket costs for uninsured and under insured

fall in downtown denver. the rain and snow line around 12,000 in the high country. the snow cap peak so pretty the time of year. 70 degrees at dia today. the average is 86. we're running way cool for this time of year and nowhere near record territory. thunderstorms rolling through. a possible airport delay through the wind and rain. 56 degrees in denver at this hour. that's at the airport. downtown we've been just a bit warmer. now we're sun coming out. kind of a crazy afternoon of weather. more rain coming in . the heaviest rain will fall to the west and south of the city as another wave moves in ahead of a low that's spinning over northern nevada. heaviest showers to the east of us, racing out around kingsberg and buyers and strasburg. thunder and lightning. this storm is heading to sterling and burlington. another wave that comes off that low. right now

hail producing storms is out and east of us. in the wichita area flash flooding is a prime concern. tropical moisture feeding in but it's the low off to the west that's sending these waves of moisture up from the southwest. we're cool and stable so the threat for severe weather tonight and tonight is north of denver. for those of you traveling on a busy friday keep that in mind. keep pool of air invading the mountains the heat is on down south. a couple of degrees warmer tomorrow but still below average for this time of year. where you see the yellows where the heaviest rain is going to fall between now and 7:30, pueblo and kim, those heading up 70 may run into slush up there tonight. very little clearing tonight, another round of showers for the metro area and we do this all over again tomorrow before a warming and trying trend kicks in just in time for your weekend. keep the jackets and
