colorado immigrant's the u.s. supreme court is considering a colorado immigrant's conviction appeal. what their decision could mean for similar then local politics heat up as the men vying for the senate seat take the stage. we have your post-debate wrap- up. we're looking over coorss field as many wake up to a slightly you cloudy and rainy commute. we'll talk about that but first, the bomb squad is checking a possible bomb threat.

you'll see them drive up. they're north of town near erie. things are much better once you get north of the c-470 northwest parkway interchange with i -25. north of us, though, everything is great. south of us and he's of us, pretty much everything is fine. we have limited visibility around lyman so the poor visibility, the drizzle and mist, basically, extends into bowler and denver with very light showers early on that have now ju light mist so we'll begin to see clearing here by the end of the rush hour, sun this afternoon, definitely on the fall side of temperature, though, with 50s. >> thanks, marty. we're getting out to what is a very easy drive even with that very light mist out here. we can see highway 7 and hi, 25 filling in, speeds 55 to 60 miles per hour. 84th further south showing

we're not too worried about flashing lights but you can see the sheen of the roads as they're wet northbound and southbound this mornin . now, what we're looking at across the board is this horseshoe of fog around the city but starting to break down so, corey, tarhonda, i took a wider view and will call it fog monster because -- take a look at this -- he's taken a bite out of denver as he comes through and tries to clamp up but because of the lower visibility, i don't k it's right in the front teeth area. >> very creative. >> so much time on your hand right now with the traffic report. said pena rodriguez did it because he's mexican and "mexican men take whatever they want." two other jurors told lawyers about the statement after the trial and the conviction. the colorado supreme court denied a request for a new trial. yesterday, the u.s. supreme court heard argument in the case. they have yet to make a decision but their final ruling could have a broader impact on deciding whether conversations between jurors can be evidence in court. police said someone left a suspicious item inside the backpack outside the town marshal's office tuesday morning. a boulder county hazmat team and bomb squad were on scene late into the night. they detonated the item around 1:30 this morning. >> it's now 5:34. the first tell vied debate for colorado senate seat is in the books.

questions with bennett and glenn. bennett addressed his stance on the iran nuclear deal. moderators asked why he has no regrets about supporting it, although he thinks iran will try to cheat and build nukes anyway. he said before the deal they had enough uranium for ten bombs and now only enough to make one. he went on to say the plutonium reactor is inoperable. the deal made it possible for nuclear programs. now, glenn has criticized bennett for his support of the iran deal, calling the $400 million exchange a ransom. bennett said it was not a ransom. 9news found the statement needs contex . he implies the money was given for release of prisoners. it's true the u.s. paid iran $400 million and the money was delivered on the same day five hostages were released, but our

owed iran $400 million, used as leverage in the exchange. that, combined with the timing, leaves politicians to debate the point. darryl glenn said he's calling donald trump. he withdrew support after audio of trump making comments about women. on monday he said he supported trump. then on tuesday, he said women should be respec clarify if he personally supported trump. we fact-checked claims about a war on cold and claimed the obama administration is killing the industry with regulations. fact-checkers said that's not a full picture. while new regulations have made things harder, other thing that hurts them is competition from other forms of energy, natural gas without consuming

companies to handle. >> the debate is posted in full on 9news.com right now. a little later in this half hour, we'll get an analysis from a political expert. donald trump revved up a crowd in panama city beach, florida, telling supporters the election will "determine whether we remain a free country." >> trump attacked hillary clinton for her private e-mail servers and stance on immigration. >> the campaign said more than 10,000 people showed up to his outdoor rally. he pledged to get obamacare, protect medicare and social security and create new jobs. trump is staying in florida, where hillary clinton leads by a few points. hillary clinton is facing more scrutiny. the white house is denying anything wrong with the clinton campaign's contact with the justice department and investigating those e-mails.

"today" show billy bush will not come back to the anchor desk any time soon. on monday, nbc suspended bush indefinitely while look into his involvement in the conversation he had with donald trump. now, several media agencies are reporting bush is negotiate his permanent departure from nbc. he had only been with the team for two months. trump described the audio of the tape as "locker room talk." those three words have become one of buzz phrases in the campaign race. we asked aqib talib what it's really like. >> there's a lot of locker room comments. we talk about everything in here. trump may fit in if he came here, who knows? >> now, he didn't elaborate and no one followed up on the question. several current and former pro athletes said that type of talk about women but not happen. >> okay. it's now 5:38. as the flu season approaches, it's time for

shot. your kids may prefer the mist, but this year, it is not an option. christine joins us to talk about that. doctors found out the flumist doesn't work as well as the shot this year. >> reporter: yeah, unfortunately and exactly right. the cdc recommended doctors stick with the regular old flu shot, despite the strain, not the fun or easy option but the only option for kids and parents to fight off the flu bug. as flu season begin in the next month or so, everyone 6 month and up and the there are two options -- basically the same shot, the same vaccine, just different dosages. there is what doctors consider a normal dose recommended for six month to adult. then a higher dose is recommended for elderly adults, which oftentime have weaker immune systems and may not be able to fight off the flu as easily. regardless of what shot you choose, it's best to get one and the sooner the better because they're in high demand. >> because it's going to be a

lot more demand for the injectable form of flu and so there may be some anticipation of shortage with that. >> flu season really kicks off in colorado in the next few weeks, lingering through spring. if you have a question on which to get, ask your doctor, but, again this pain-free mist was not getting it done so kids need to be brave and hopefully doctors are stocking up on su >> would get my kids get the flu shot instead because there used to be question about whether the mist worked as well year ago. >> they're fining out it wasn't as effective so back to the good old shot. >> don't tell them ahead of time. already been told to evacuate. police were called to monitor the situation and according to most reports, most people are heeding the warnings. a really good thing. >> it is. i haven't really said much about hurricane nicole because it won't make landfall in the u.s. but will affect bermuda. here's the latest image of nicole, a well-defined eye in the storm that's developed to a category 2 hurricane and moving towards bermuda tonight through mo actually could pass very close to or right over bermuda as a catted girl 2 hurricane early in the morning. high humidity levels over eastern colorado at the present time. wind is light and also out of the east to give us a weak up slope and that is contributing to this low visibility, kind of damp and chilly if you're out there working early this morning.

today in colorado, a man from arva harassing a state lawmaker is expected in court. 21-year-old dylan hopkins was arrested last month after police said he sent senator laura woods threatening facebook messages. he taunted wood and said he would shoot her and her family. when police caught up with him, he said he was upset about the upcoming election and is expected in court for a pretrial conference. he is charged with harassment. a senator in east tennessee

marijuana. he's paying for his own way to colorado to learn how medical marijuana can help ptsd and other conditions. it's legal to use cannabis oil to treat certain medical problem in tennessee and there's a push to move further when it comes to medicinal use there. we're hearing from a home own who put up a halloween display some people in fort collin felt was racist. what appears to be an african- american woman hanging from the front of the house. police went to talk to the homeowner. the display was not illegal, but the homeowner agreed to take it down. that woman called us yesterday to explain what she says was a misunderstanding. >> there was no intent to have making some sort of political display or anything like that. it was all trying to be creative with decorating. that was it. >> the woman who lived in the

a new study shows wildfire season is getting longer and more destructive. however, researchers say humans are to blame. the university of idaho and columbia university did the study, blaming human-caused climate change for 16,000 square miles of burned forest. that's when you look at figures from 1984 to last year -- not year-over-year, one other. now, the weather to blame, also according to researchers. we have seen hotter and loner dry spells that cause western forests to dry out to make them more susceptible to fires. the beulah hill fire is closer to being contained this morning. it's 95% contained. now, crews are working to put out 16 superior hot spots. the fire has burned 5,000 acres and nearly 2,000 were told to pack up and leave as it spread

the rain we're seeing this morning is welcome. it has been dry, so dry, as witnessed by firefighters sparked by lightning tuesday afternoon. one of the largest was in albert county, about 100 acres and burned near the county line. those fires were quickly brought under com and did not damage any property but, mar ty, it shows you how quickly it can happ misty and drizzly. looking to the west, a sea of smaller disturbances through nevada this morning. that will begin to bring some high clouds this afternoon. that leaves us with mist and drizzle this morning. and high clouds later in the day so don't worry about what comes in late this afternoon. it will be several thousand feet up and won't hurt your visibility at all. as far as high temperatures go,

degrees around here for the foothill and lower terrain on the front range. now, this front that came through has mainly affected eastern colorado and more specifically the metro denver boulder areas. we'll begin to see this thing break up during the morning just in town for these high clouds again with no rain or snow in them today, move through and just put a little overcast in the sky late this afternoon. it's warm out west in the 70s but for the mountains, front range, and east, wee today. tonight, we get another wind shift out of the south tonight that will start warming us back up for tomorrow. today only 58. we get afternoon clearing and then during the evening, clouds drift through, gets overcast, may look a little stormy to you but won't be at all -- we'll break things overnight and tomorrow, warms up. friday is a spike with southwest winds into the low 80s and then a dry, warm

heading out for your wednesday commute, a foggy start down south. check out the view i-25 north of monument. plenty of cars out across the roads but not plenty of crashes today. we have seen a really nice, calm start on area freeways with a few side street issue. we'll get to those in a minute. this is c-470 around university exit so cars traveling through in the mid-50s to mid-60s to nothing to worry about across littleton or highlands ranch and the views ro breaks down south and east. we'll see it move out of here, as marty told us, and with that rain lightening up, roads should dry up with more volume across the streets. we start with a stall at havana and alameda, volume light but a busy thoroughfare so keep that in mind and to the south of i- 25 and a bit east of santa fe, watch for a crash at the intersection of broadway and tennessee. >> all right, amelia, thank
