year-old called 911 saying that he and his friend were shot denver police found the teenagers in the backyard of the house near 28th and high street. after using shotspotter, the gunshot detection technology to find them. the 15-year-old died of a gunshot wound. his picture and candles are placed in the alley near the backyard. 48-year-old keith hammock and his female roommate live in the house on the property. and pot plants growing in five- gallon buckets were growing in the ba keith hammock told police he heard an argument and then gunshots. he said someone jumped over his fence and activated the motion detector light. that is when he went downstairs and saw two kids lying on the ground. after serving a search warrant, police went to the second bedroom overlooking the backyard and found him to long rifles, ammunition and spent cartridge cases. >> you can't shoot somebody on the porch. you cannot shoot somebody in the

and you cannot shoot somebody stealing marijuana plants from the backyard. >> a legal analyst says colorado's make my day law cannot be used as a defense. it only applies inside the four walls of a home if an intruder poses a risk of violence to somebody inside. >> the law is very clear. you cannot use deadly force in defense of property ever. >> police did find a gun near the teenagers but have not determined whose gun it is. >> if, in fact, the handgun found in the yard can be tie possibility of a cell the -- self-defense argument. >> the denver da has not formally charged hammock. that could come later this week. in denver, 9news. >> the suspect is still in jail. denver police are not releasing his photograph because they are asking possible witnesses to identify him. a newly released report reveals more about the death of a school bus driver at dia. kari chopper died of lent force injuries when the bus she was driving hit a concrete pillar.

chopper -- that kari chopper also had an enlarged heart which points to the possibility of a sudden medical emergency. her death has been ruled an accident. she was driving the legacy football team. fifteen students and three coaches were hurt in the crash. they have all sense been able to go home. shoppers at the caribou plaza shopping center may notice evidence of this morning's controlled detonation of an improvised explosive device. the fbi is working with the police to figure out who was device. it was inside of a backpack placed in front of the police department which is located inside of the shopping center. the boulder county bombs what detonated the explosive around 1:30 a.m. this morning after closing area roads. a class-action lawsuit today in federal court could force the city of denver to change how it handles the homeless. a group of homeless people is

band. a lawyer representing the group held a news conference this morning saying this is all about the fundamental constitutional rights of homeless people. >> right now, it may be homeless persons. who is next? who is next after that constitutional rights need to be protected. >> the city had warned people for weeks before clearing out homeless camps. belongings were stored in a safe location where owners could pick up belongings. the next hearing is october 20th. hillary clinton showed little patience for donald trump supporters that disrupted her campaign rally in pueblo this afternoon. linton said, you have to feel a little sorry for them. they have had a really bad couple of weeks. several of clinton's campaign events have been interrupted by hecklers. some targeting her husband, former president bill clinton. denton says trump is running a scorched earth strategy.

>> donald trump had two florida rallies today after an event last night in panama city beach. police officers and firefighters in eastern north carolina have been patrolling low-lying areas using horns to tell people to leave now before floodwaters from hurricane matthew arrived. thousands have been ordered to evacuate. officials warned that some communities could be cut off by washed out roads or closed bridges. the news the river which runs 275 miles in the state is expected police are at the edge of evacuation zones to monitor who is coming and who is going 36 deaths have been attributed to matthew. much of the storm damage along the florida coast has been wind related. however, along the eastern shore of saint augustine, it was water that hit the hardest. 9news reporter dan grossman is

on main street in east hartford, this plane, a twin engine private plane went down on main street yesterday killing the student pilot. now the instructor pilot says the two were arguing prior to the crash. and that the student pilot said he did not want to fly anymore. and according to the instructor pilot, intentionally crashed the plane. however, the fbi says there is no evidence of terrorism. the student pilot was a jordanian national. he had received his private license in the united fly single-engine airplanes. and was at this flight academy in hartford, connecticut and was working yesterday on a twin engine plane. so the question is, what happened in the cockpit? was there a personality conflict? was there some sort of psychological or mental breakdown? was there something else? regardless, the ntsb has handed over the investigation to the fbi. as you would expect, you're

the presidential race is not only the hot topic of this election. in nine states, there is a lively debate over whether or not to follow colorado's lead legalizing marijuana. a poll last october shows more than half the country, 58%, think marijuana should be legal. colorado said yes to recreational use four years ago. next month, five more states will also decide whether to legalize marijuana for personal use. and four other states. florida, arkansas, north dakota and montana may join half the country and allowing marijuana for medical purposes. >> it may be passed along to

we are in the nine backyard. a shock to the system today as we had much cooler temperatures. and the clouds that would not get out of here. they will be with us throughout the evening and into the start up tomorrow too. take a look at this 24 hour temperature difference. about 20 degrees cooler here in the metro area across the eastern plains. the western slopes -- this did not affect you at all. the low clouds hugging the flatirons this afternoon. we had a little bit of fog early this morning. nothing but blue skies when you move up in elevation. the ski area looking mighty fine with the sunshine per temperature sitting in the 40s right now across the i-25 corridor. however you go up there toward

at the airport, looking at mostly cloudy skies. wind out of the northeast. providing an upslope. allowing the clouds to stay put. temperatures right now, 48. we have warmed up a bit. in the nine backyard, temperatures around 48 degrees. i think those numbers will be cooling off throughout the next hour or so. just make sure you grab a light sweater if you are heading outside. right now much cooai his mark. toward minneapolis -- this cold front swinging open the door to the cold arctic air that is pushing into our backyard right now. the cold front trekking across parts of chicago, st. louis, bringing them some scattered showers and dusty wind. for us, it has been about the low clouds that have set up shop across eastern colorado and have not moved all day long. i think they are still with us overnight. mostly cloudy skies.

valleys overnight lows into the low 40s tonight. mid to upper 30s in northern colorado and across the far eastern plains where we may have more clearing going on. in the high country, 30s. and mild to the west. the cold front pushed through overnight. now high-pressure starting to build back in briefly. we will take it. and a nice mild afternoon tomorrow. i 10:00 tonight, clouds around. that is the case for tomorrow morning too. l to the west of i-25. we will wake up to those. by lunchtime, we will start to get some sunshine in here. overall, a dry day from the western slope to the eastern plains. mostly clear skies tomorrow evening. a huge warm-up in store tomorrow. we will be at about 30 degrees warmer under partly cloudy skies early on. sunshine in the afternoon.
