this is when police say he shot and almost killed douglas county detective dan brite. >> he is headed toward the hospital. >> headed toward the hospital. >> reporter: the shooter ran from police and crashed near a retirement home across the street from parker venice hospital. >> 911 where is your emergency? >> parker hospital. somebody is shooting guns. i'm scared to run. >> go where you >> he's shooting at the citizens outside of the hospital. >> reporter: ron knee -- ronnie dorrell ran toward the shooter. >> where's he at?

dorrell was justified to shoot. >> i'm sure it weighs on him he had to take a human life. but the alternative, i don't know. we're never going to have to know that. because he did. that was an amazing shot. >> reporter: anastasia bolton 9 news. >> detective brite is recovering at the hospital. the shooter had multiple gun on him with thousands of rounds of ammunition and had a gun room at home. he owned the the denver police department is taking a new approach to its use of force policy to adapt to the way policing is seen in 2016. denver's police chief is creating a new policy to encourage officers to use the least amount of force and to understand even if it's legal, it may not be necessary. he says the shift in policies because of expectations police are different now than they were a decade ago. >> what i really want the officers to understand is, it is not just good enough today

solely based on legality. we need to understand that we are in an environment where our citizens have a right and they're starting to question us what we do and why we do it. >> the chief says over the last few months he has talked to 500 officers about three specific things. number one, what the department is k do to make life better and safe for officers and make sure they get what they need. two the shanty of life. and three making decisions that are legal but necessary. he says at this point the use of draft form and will need to be approved for several groups. a former rocky ford police officer convicted of murder was sentenced to 16 years in prison. he was accused of shooting and killing jack jacquez. ashby's lawyer was seeking a retrial but the judge dismissed the motion. his mother and fiance has filed the civil lawsuit against the

violent force. the two men accused of burglarizing demarcus wares home are no strangers to trouble. both were in court this afternoon. 40-year-old billy and 31-year- old sergio were arrested and accused of burglary and felony theft. according to an affidavit, a anonymous tip led crime stoppers to billy. a judge set their $10,000 each. both have been in trouble before. they have had several misdemeanors, police report, everything was returned yesterday that was sold including his super bowl ring. authorities have started arresting protesters that have set up camp in private land in pipeline construction.

confronting the protesters and leading some away in handcuffs this afternoon. this is all happening near cannon ball, north dakota. south of bismarck. law enforcement demanded the roughly 200 protesters leave but they refused. nonlethal shotgun bean bag rounds are being asked to remove those protesters. a 3.8 billion pipeline protesters fear could harm cultural sites and drinking water. the pipeline is set to carry oil from western north dakota through south dakota and iowa to existing pipeline in illinois. national republicans are attacking democrat morgan carroll in a tv ad arguing she can't be trusted in congress. however, there is a problem with that line of attack, 9 news political reporter brandon has your truth test.

make morgan carroll seem reckless on the issue of child predators with the tag line, what was she thinking? but there is a problem. we're awarding this ad with cherries for cherry picking her votes on the issue. both claims are technically true but deceptive because they are ignoring other votes morgan carroll cast. >> making it harder to track online sex offenders and child predators. in 2007, carroll voted against the first version of the bill that would have required sex offenders to register with e- mail and social media accounts with the state. so did several lawmakers. they didn't think the first version had a decent decision. so lawmakers drew up a new bill that very same year with better enforcement built in.

the exact opposed side of the issue. the next claim has a similar but bit more complicated story. >> the only one. >> the only one. >> the only one. >> reporter: get it? she was the only one. and that part is true. but the ad is still misleading you because carroll voted yes to that same bill once it was modified. here's what happened back 2009. corey gardener a state represent introduced a bill to crack down on luring kids. by counting a prior conviction in another state against predators and updating the law by adding texting and social media. after it passed the house, the senate tapped on an tempt punishing adults that give pornography to kids and increase the punishment for sex offenders that fail to register. carroll was the only senator to vote no. her campaign says it's because

with tom different areas of the law. in colorado bills can deal with one subject at a time. what is fair to say at that point in the process, she was willing to let this bill die over her stand on parliamentary procedure. which is something you may want to consider about how carroll does business. but that is not the end of this story. the house didn't sign off on the changes the senate made and two amendments got stripped off. the final version of this bill also sailed through, also with carroll voting the opposite of the way this ad portrays her. bottom line, nobody likes to see how the sussage is made at the legislature and this ad cherry picks single steps in that process to make it seem like she doesn't take child predators seriously when in both cases she did in fact vote to tighten laws. with your truth test. >> don't forget you can check all the research in that truth

debunked this week. this is one of the attacks carroll -- that attacks carroll's opponent mike kaufman. in the race for the white house both candidates took hits today. hillary clinton heard by a leaked e-mail saying how her husband made millions. and donald trump hit by a top aid. in battleground states more democrats are voting earlier. there is only a republican majority in three of them at this gives clinton a 9 point lead over trump. more than 975,000 people have returned their ballots. >> colorado mesa university in grand junction is looking into political bias within a classroom saying a professor may have been trying to per sway students. professor brought the campaign director of work and progress an organization senatorring hillary clinton to speak to his

welcome back. we are seeing the damage following two earthquakes that struck central italy on wednesday. the earthquake struck in the same region hit by ad you may remember that. according to the u.s. geological survey, 6.1 magnitude earthquake struck hours after a 5.4 quake hit southwest of milan. people were forced out into the wet rainy streets. nearly 300 people were killed during that quake in august.

responsible for stealing $300 million from 15,000 people. callers posing as tax and immigration agents threatened arrest and deportation. less money is sent to help clear up a warrant or -- the justice department has announced charges in connection to the operation which officials say is based in india. the costume exhibit opens sunday november 13th. and it's expected to attract crowds which isn't ideal for people who need a more peaceful experience. that is why the museum is offering its first low sensory morning that week. it's for individuals and families that require a less stimulating environment.

it's like a summer evening in fall. backyard where temperatures are above average and still remain above 80 degrees. it's very pretty in downtown denver. if you get a chance after work or school to step out, you might as well. the old record 80 and we may break another record tomorrow with high in the low 80s. there will be more cloud cover tomorrow. winds will kick off a bit but temperatures across the eastern plains will be very similar to the numbers we enjoyed today.

desperate for moisture. denver running a humidity level around 9%. calm winds in the backyard with 81 degrees downtown. beautiful evening to be out and about. up in the high country it looks like winter. a little left over snow but it's also extremely dry and the drought scenario begins to play out. it is the snowfall is october 18th and we've certainly passed that. high pressure anchored over the area. a little dip in the jet off to the west. water vapor showing the welcome rainfall across san francisco, portland going up and over this ridge into billings. denver, kansas city, dallas hot and try. warm stable dry layer of air. some high and mid level cloud cover will creep into western colorado and make its way to the front range foothills.

california thrilled with the rain. a very big story. it crossed the west coast with that extreme drought. highs back in record territory. the record is 80. 82 in dallas. other than just a few high clouds tracking in tonight a bit of a mountain wave sitting up in the foothills. some of that high cloud cover moving over denver. good travel weather. we have lows in the 30s for the 50s for lower elevations tonight. and tomorrow night highs again 82 in denver. almost 90 in lamar. foothill temperatures running comfortable as well. good day to be out and about. these are the days to go hike. you don't have to worry about lightning. something we talk about all the time. tonight in the city beautiful evening. high clouds and mild. it will be dry over night. our low at 50. sun up at 7:23 tomorrow. temperatures jump quick. few more clouds around.

formations. late cooler on saturday. mountain rain and snow. denver dry through early next week. great news for the broncos game on sunday and halloween of course. a slight chance of a few showers middle part of next week be not impressed with it. and certainly do not see denver's first official snowfall yet. so let's enjoy this beautiful halloween forecast, a mild night with temperatures in the low 60s when the ghosts and goblins if you see a cloud, a spectacular sunrise or sunset, send that in for me.

broncos running back cj anderson is under going surgery right now and may be forced to miss the rest of the season. anderson suffered a torn meniscus in his right knee on the final play of the fourth quarter. he somehow returned to the game and played wonderfully. running for 107 yards and the touchdown. depending on what doctors find during that operation, that could be cj's f 2016. >> he is obviously not going to play this week. we know that. the positive thing is he played in the game. he played through it. there is something we need to go repair so we need to see to what degree that is. he's in good spirits. he's out there with his family. i think he understands what we have to go do today. we will keep our fingers

and reported anderson was in no pain and not limping before the operation. so why the rush to under go surgery? >> because eventually it would have caused instability in the knee. and no one needs stability in the knee more than nfl running back. think of all the action the players put out there. the running back puts a lot of tension nonthe knee, torque. booker had a torn meniscus last year. and he was out eight months. granted he had two seasonals. the first one didn't take. hopefully this one will take for cj anderson and he will be out between 8-12 weeks. he will go on injured reserve. some chance he might come back for the playoffs. more than likely he's out for the year. but for his long-term health and ability to play beyond this
