e-mails, no change after the fbi reassessment. donald trump who started his day in florida says she's being protected by a rigged system. trump also had events in north carolina, pennsylvania, new hampshire and michigan today. president obama campaigned for clinton in ann arbor michigan today. clinton will be in pennsylvania tonight where she'll join her husband, the president, first lady and a bunch of rock stars to hold a concert and rally tonight. the candidates have been spending a t so-called swing states, colorado being one of them despite the fact that a lot of colorado voters have already turned in their ballots. 9news political reporter brandon rittiman joins us now. we've seen now kind of a changeover in which party is leading as far as getting those ballots in. >> i've been putting together these graphics every morning on social media. it was rather unusual to see democrats start out in the lead. normally they wait a little bit longer. that's just the tendency in

republicans, the red line, have overtaken the democrats by about 7,000 ballots cast. this doesn't tell us how they've voted. it just tells you their party registration and the unaffiliated voters which are actually a bigger voting group than either of those two. >> so they're simply not voting. >> people turned off and our political analyst floyd ciruli expects the total vote count to get up to 2.8 million. i don't think this is who voted over the weekend. we saw that before. it took until about tuesday to see a big spike in the numbers. >> we hear so much on the swing states. it depends who you talk to and what maps you look at. we're kind of swing state light in colorado. >> we've become more of a swing state has things have gone along. this is nbc's final forecast that shows clinton at 274.

discussing climate change and what's at stake during the election. you expect high schools to be tagged time to time, but rarely does the spray paint spell out a political message. that happened at palmer ridge high school in monument. students showed up to see a wall spray painted in red, white and blue. the message read we support trump and trump for president, but they left out the n in president. the school's newspaper says an investigation is underway and administraar through surveillance video to try to catch whatever did this. the high school newspaper gained attention early -- whoever did. this the high school newspaper gained attention earlier this fall after it endorsed hillary clinton. the endorsement outraged some parents. there's no direct link between the two incidents. last week in denver vandals vandalized a trump campaign office in less than 24 hours. someone spray painted the side of the building and threw a rock through window. aurora will pay out the

city's history. it has agreed to pay $2.6 million to the family of an unarmed black man black man shot and killed by a police officer last year. nashali van zandt was on parole and cut off his ankle monitor and was accused of assaulting the mother of his 2-month-old child. he was shot and killed as s.w.a.t. officers were trying to take him into custody. a grand jury said the officer believed van zandt was going to shoot him. later it was determined van a grand jury declined to indict the officer saying he acted reasonably shooting van zandt. aurora police say $500,000 of the settlement comes from city funds and the rest is paid for by aurora's insurance carrier. the settlement also includes changes to the police department to improve community relations. janet reno, the first woman to serve as u.s. attorney general has died early this morning from complications of parkinson's disease. during her eight years in

she was criticized early in her tenure for approving an fbi raid on a texas religious cult where 75 people were killed but won praise for selling responsibility. she was criticized in her role of eliot gonzalez who was seized from the home of relatives. reno was 78 years old. people in oklahoma are cleaning up after a 5.0 magnitude earthquake struck the central part of the state last night. all of downtown cushing was blocked off as ge looked at the damage -- city workers looked at the damage. officials say this is the largest earthquake they've had, but emergency responders were ready. no one was seriously injured. people opposed to the construction of the dakota access pipeline took their protest to a cemetery in bismarck. they say building the pipeline through what they say is their ancestors burial ground is like building a pipeline through cemeteries. counter protesters arrived and set up across the road.

weeks since a denver woman was arrested at the site of the standing rock protests. the 37-year-old is held on a $100,000 bond in morton county, north dakota, after being arrested for firing several shots at officers. today her family in denver spoke for the first time since that incident. here's 9news reporter maya rodriguez. >> reporter: at the four winds american indian council in denver they prayed d red song flowers. >> red song was 100% innocent. we want due process for her. >> reporter: this is red fawn's cousin. like many gathered today he's been up at the protest camp near standing rock, north dakota, where native americans and others are opposing the construction of the dakota access pipeline. they claim the route goes through sacred sites and burial grounds and puts at risk the

there. >> red fawn was up there to protect water, basic principle of standing for environmental justice. >> reporter: but the more ton county criminal complaint -- moreton county criminal complaint charges red fawn with the murder of two minnesota police officers working at the protest site. they claim she had a concealed gun and fired at them several times as they attempted to arrest her for trespassing on private land. here's what a north dakota officer said the day after her arrest. >> it's unbelievable that a law enforcement offices angle that that gun could have been fired at where there was no law enforcement is the angle that it was fired at and it wasn't because she was trying to aim away from law enforcement. it was because it was just our lucky day. >> reporter: as for red fawn, her familiar insists she is be in the -- her family insists she is innocent and say she is in good spirits despite the situation. >> she's a very courageous person. >> reporter: who is also now facing the legal system. maya rodriguez, 9news.
