. it's 6:00 a.m. here's your tuesday morning top stories. a commerce city landfill could hold answers to what happened to charlene voit in july. a jury convictedhe of a 61-year-old man. investigators say derrick web and two other men went to grady's home last year, shot him and took his wallet and truck. a man that served 28 years for a crime he did not commit is free again. a jury found clarence moses not guilty of rape. he was freed in december after a jury overturned his case.

sunrise this morning around 6:45. enter thanks a lot amelia. the warning came. now police will dismantle of homeless camp this morning. anything left behind will be taken. andrew is live. some critics say they're picking on people most in need. >> yeah the city's argument has been that these camps are unsafe. actually there's a paramedic crew on the other side something. these camps have been controversial. the city has been facing a lot of pushback. you can see people are lined up along park here. they haven't left this morning. the city is facing a lawsuit over sweeps. some homeless people say they've got a right to rest. human services will come with police and clear out the camp growing around the block. the city says there are homeless

everyone wants to live with. this is the third homeless sweep this year. police moved a camp here in march and further north in september. a lawyer in charge of the suit says the city says they're moving people along because they want the ball park neighborhood to look more business friendly. the mayor says they're about providing services to citizens homeless or not. >> it's not safe. we've found needles, occur, people defecating on the sidewalk in public space. this not healthy for individuals on the street, not healthy for citizens walking up and down the street. >> it's getting people services when you take their property, the only things they own in the world and destroy that without due process. when you sweep them out of sight out of mind. that's what the city wants, the people to go away. >> people who have been living down here don't know exactly

people out. they say they don't know when they'll come. the former new york city mayor is part of president-elect's inner circle. he made it clear he would like to have that job. so is u.s. former ambassador. trump is considering the finance chair for treasury secretary and conservative radio ingram could become trump's new press secretary. civil rites groups are not happy about the pick for top adviser. steve bannon is trump's steve strategist. he's the former president of bright bart news favor of extremists and white nationalists. the naacp is among those that criticize had the move saying bannon's appointment will not unify the country.

takes office. others defended the situation saying steve bannon is not antisemitic or antiwoman. people will be able to legally use marijuana in businesses in colorado. voters were split on this one. it was so close they couldn't call it for a week. >> they were actually counting the vote till lateas around 17,000 votes. very close. what this does is creates a four year pilot program where businesses in the city can apply for a permit to let customers use marijuana. this is getting interest from restaurants and bars. the colorado restaurant association strongly opposed it over concerns it would promote illegal use like stone driving. some people don't want to deal with the odor.

will be mixed. city council has to navigate a few concerns. it has 60 days to write up the rules. we spoke to restaurants about this when advocates were pushing for it last year. they told us while they're considering getting a permit. >> you never see problems with people who are high from marijuana. you do see problems from people who are high from alcohol. >> one thing people have asked us about is who's going are these businesses going to sell edibles on the side? it's illegal to smoke pot in the same place you buy it. dispensaries won't get permits for social use. this will be a byop situation. it is very warm this morning. the reason chinook wind going on in and around the foothills.

of his dads hot car. a jury said justin harris murdered his 22-month-old son cooper. he told police he forgot to drop cooper off at daycare and didn't realize he was strapped in the car seat seven hours while he was at work. prosecutors argued he killed the little boy on purpose to escape family responsibilities. it's a decision "making a murderer" since it debuted on netflix a wisconsin judge is ordering his release. he confessed to helping his uncle stephen avery kill a photographer in 2005. his taped confession was a subject of a lot of scrutiny. a judge took a fresh look at it this summer after the case aired on "making a murderer ." the judge decided he was forced

speeds in the 40s. >> amelia, thank you much for that. four months, charlene's family has waited for answers. now police in littleton hope that some clues might be hid machine a landfill. the 36-year-old woman was -- hidden in a landfill. the 36-year-old woman went missing missing in july. police will be searching >> reporter: yes, they l. -- they l. littleton police say this is unsettled but they owe it to her family to do as much as they can in this case to seek justice and closure. what are they thinking they may find in this landfill? could be includes in her disappearance and police say sit possible they may find her remains here. charlene disappeared in july of this year.

abandoned. couple months after that, we heard news her boyfriend jeffrey byer had been arrested not in connection with this case. it was in connection with a sexual assault case. in september, prosecutors dropped charges saying they did so because they would have had to turn over evidence to defense attorneys in that case that could be connected to this case jeffrey has not been named a suspect or person of interest in this case. 9 wants to know did investigate and found o for her life, filed a restraining order saying she feared for her life after he assaulted her in 2012. have police connected it to this case? that's not something they're saying yet. they're not saying if they have a person of interest or they came to this landfill. they say it's natural progression of the

henderson and bar serving him that night. the lawsuit claims the bar served him even though he was visibly drunk which is illegal in colorado. can have 37. after 21 years in prison and retrial moses elle was released from prison. anhe crime. moses had long maintained innocence but recently denver da opted for a retrial. moses elle and his lawyers hope to keep wrongful convictions in the future from happening. >> we look forward to constructive dialogue with the new district attorney to make sure what happens to mr. moses never happens to anyone else. >> any plans to sue the district attorney's office?

likely at this point in your morning drive. cross the central portion of 25, got the northbound crash near yale. slow downs lead us with a 33 minute wait from c470 and c225 sluggish because of that problem. up to the north, southbound 25, northbound delays near 104th. both directions sluggish. that's the worst of the three. we'll track over on 20 sounds good. thank you. here's a look at top stories we authorities will continue to go through the tower landfill looking for clues in the disappearance of charlie voight. her boyfriend was originally arrested in a separate case on assault. those charges were dropped after prosecutors said they would have to reveal evidence from this case in order to tie it to sexual assault. he has not been named person of interest in this case.
