account program remains on hold because of a court injunction. it was passed as a means for parents to individualize their child's education.... but is now being challenged in a handful of lawsuits. fox 5's abby theodros explored the school choice program and tells us why theres such a stark divide among supporters and opponents. the anderson academy of math and science is a private elementary and middle school in the valley - providing innercity youth with affordable and specialized education. the school just opened in august and has three - yes three students. with our small class room ratio - our experience is working with students who are behind so thats our expertise thats what we love to do. founders drs dajuane and tamara anderson say one on one learning is apart of their schools charm and so is the cost. when we created our tuition we tried our best to make it as low as possible for our parents 500 dollars a month. books included. but even with low tuition -the
10:15 pm
many parents still cant afford that kind of monthly payment. that's why they say senate bill 302 or the education savings account program couldn't have been passed at a better time. - our tuition is the exact amount maybe give or take of what a parent could afford. so low income parents - if they applied for an esa they could go to our school free of cost. theodros: with the school choice program families apply to have their child's education subsidzied by the state through an esa. theodros standup: "here's how it works. in the same way a visa gift card is accepted at most places including your favorite coffee shop. the states new voucher-like program - m ost nevada parents the means to take their kid out of a public school and choose something that better suits them." : its not just going to be about brick and mortar. or about homeschool. theres going to be a lot of other ways to deliver education some ways we cant even contemplate right now. senator scott hammond sponsored the bill and says the goal is to get children in a learning environment that sets them up for success. to qualify for the roughly 5 thousand dollar subsidy your kid must be enrolled in public school
10:16 pm
amanda morgan, atty in parent suit: every parent deserves the right to teach their child how they want the problem is you cant do those choices at the expense of the children that are in public school. amanda morgan is the legal director at educate nevada now and represents some of the families challenging the esa in a lawsuit. in addition to questioning the constitutionality of the program they're concerned it'll take money from an already underfunded school system. morgan: the most expensive part of educating children is staff and teachers and operating school and that doesnt change because a leave and take program. alone educates thousand students. they're also short more according to section 16 of the bill - each grant will be taken from the resident school district in which the applicant is enrolled. as of october - more than 2500 esa applications came from clark county. opponents fear that families whose kids currently attend public - just to y depleting public school dollars.
10:17 pm
im looking at it from is that you thats already broken and break it more. you cant just turn your back on it and say, to private schools then. jenn carr- who is a - says her three children have already experienced the impacts of a tight budget. occupational therapy lessons for her special needs son atticus were provided by the but are now limited to to scholastics. jenn carr, ccsd mom: the school system is not serving our children the way we spoke to ccsd and they say their special needs students are on an individualized educational plan in which any occupational needs are tailored to their needs but could change based on their progress. this isn't the first time a school choice program has received backlash. in colorado - a supreme court ruled that a school voucher program was unconstitutional. supreme courts in arizona north carolina and indiana- upheld their voucher programs. while the fate of nevada's program is yet to be seen - senator hammond
10:18 pm
if a child leaves the clark county school for example and takes an esa they get about 90 percent of the dsa which is about 5100. 10 percent of the esa is left to whatever district that child would have gone to. there are those who are doing a great job with our attorney general's office who are defending the esa program.... abby theodros, fox5 news local las vegas. in another lawsuit, the aclu says the program is unconstitutional because it funds religious schools... but the state maintains the money goes to the parents who ultimately choose. today, the nevada treasurer dan schwartz issued a statement that saying in part... quote-- "while we understand that the court is very busy, the state's failure to fund education savings accounts has left many nevada parents in limbo." as a result, the treasurer's office says in anticipation of next school year they are continuing to accomodate families during the injunction, and are accepting
