tomorrow, chances are pretty good that the decision would be final and you would start looking for a new gig but if you work for metro, it's a far more complex process. police officers who are fired can take their cases to arbitration and in some cases, officers who metro wanted out, still have a badge and are out on the streets. but is this putting your safety at risk? "september 25th, 2011 ... a man named jon gray was following a pickup
10:13 pm
i-15 to jean.. inside the pickup was his sister, jesse and her husband, metro officer james burt" according to the police report... gray had texted his sister.. is everything alright? she texted back.. no. that's when gray then called 911" "has he been hitting her? i don't know, it sounded physical in the car when he grabbed the phone. i believe he probably has but i don't know" police pulled the vehicle over as it got off at the jean exit. according to the police report, jesse told officers that at their home "james held her down on the couch by holding her face and jaw. that james also punched her in the stomach... placed his hand over her mouth to keep her from talking or yelling" before forcing her into the couple's truck. the charges were eventually dropped for a lack of evidence but metro found there was enough evidence to fire him. "the court system may not find that they were guilty of it, we may find
10:14 pm
administratively to terminate or hold that employee accountable" burt's union, the las vegas police protective association took his case to arbitration, and burt got his job back. a little more than 4 years later, police got a 911 call from a woman who told them her sister kelly ryan was en route to southern hills hospital after she was beaten by her boyfriend... the boyfriend's name? james burt we're you afraid for your life? absolutely, absolutely, i've never had a moment in my life where i thought it could end, other than at that moments. kelly ryan says she and burt were only dating for four or five months when things turned horribly violent. the police report reads an awful lot like burt's 2011 arrest report. "burt threw her on the couch as ryan was crying and screaming. he had his body on top of her... with his hand covering her mouth" you don't think when you love someone and you
10:15 pm
relationship that they would ever come at you with a face like that nor all the rage. when someone's like that, there's nothing you can do to stop them, they're in it. kelly also works in law enforcement, she's a corrections officer for henderson.. she says had burt lost his job ... that would have been red flag enough to steer clear of him. huck: and you know what it means when a cop loses their job - ryan: yes, it's very serious, you don't lose a job because you called in sick too much, when you get let go and the badge is taken from you, it's huge, it's a big deal. we don't know if keep his job for a second time. one officer in trouble with the law who is job is richard scavone. the officer faces federal indictment for civil rights violations. scavone, prosecutors say, used excessive force in the arrest of a woman, amanda ortiz... that he suspected of prostitutuion. . scavone "grabbed a.o. (amanda ortiz) around the neck
10:16 pm
threw her to the ground; grabbed a.o. by the head and slammed her face onto the hood of his patrol vehicle (twice). scavone's union, the police protective association will represent him to get his job back. and because scavone's alleged crime happened while he was on duty, the union will represent him in court as well. "(huck) there are some officers that you represented that were accused of some pretty bad stuff - chaparian: we have. huck: why represent them? (chaparian) "because due process is a big deal. we all take an oath as police officers, we all uphold a constitution where you're afforded due prcess and we think an officer should not be afforded anything less" mark chaparian, executive director of the police protective association, didn't want to talk about any specific case... but he says the outcomes of the mediations aren't as important as the process, that ensures officers get a fair shake. according to the ppa... over the last 5 years... 32 officers were
10:17 pm
went to arbitration .. four job back with cases pending. he says the four officers who returned to work over the last 5 years are proof that not every metro firing was in his words "bullet proof" "i'm sure that lvmpd is looking at the risk management side of it, the political side of it, but we're looking at the human side of it. these are men and women just like you or i that put their life on the line, they wan tto come to work every day and to continue to penalize them, then there's no finding of wrong doing, that part irks us. "some of them rise to the level where we should probably disassociate ourselves with them. (huck) and james burt would be one of those people? he'd probably be up there. (huck) and richard scavone? yes" to be fair, fired officers have returned to their jobs with no problem at all. and the union won't represent officers convicted of felonies but with relations between some
10:18 pm
departments and segments of the communities they serve badly damaged.. metro's command says it needs to have the discretion to weed out problem officers regardless of whether they are convicted, regardless of how small a minority they are on the force. metro wants to maintain public trust; kelly ryan says in burt's case.. they should be more concerned about the public's welfare. huck: in your opinion, is james burt a threat to public safety? yes, he needs help, he needs help on how to address that rage and anger and how to cope with it. does he need to be absolutely not. we reached out to james burt... he hung up on us. he faces four felony counts .. including kidnapping and his next court for a preliminary hearing. as for kelly ryan.. she says she wants women to know there are resources for them if they are in an abusive relationship.. you can find links to those resources along
