"concerned about this because the fact that the company was not licensed with us, but doesn't have to be licensed with us." it's a loophole... a normally black and yellow issue.. is now gray. businesses who remove bee hives for hire.. are not required by the city or department of agriculture to have a pesticides license...due to the fact they are not exterminating the bees.... "they didn't have a license with us, but we encourage individuals to hire li control companies or bee keepers that are licensed to do pesticide applications and removal of bees." but the key word there is not licenses.. but business.. a title "toms bee hives" refuses to own..... last week a worker of theirs was sent to the hospital after being stung hundreds of times..... "we're concerned about human health and the environment when it comes to pestide applications and bee removal and pest control companies." the department of agriculture tells

an emerging industry in our area..... clark county is a quarantined area for africanized bees...and more and more people are looking to make a profit off them. "people now want to save bees, so i'm sure there are people out there that are looking to do this as a business opportunity and we want to make sure they get licensed so they do it safely." and to ensure proper safety guidelines are met from here on out... the department of agriculture is looking to change the local law. "we are looking at the nevada revised statute currently to bring these unlicensed bee removal and rehabilitiation companies into our realm of licensing so this doesn't happen in the future." the department of agriculture tells me fixing the local statute could be done relatively quickly but it would be on a temporary basis at first.... i'm told we could see action on that in a few months....... from the newsroom.. vince sapienza... fox5

the owner of tom's bee hives... tells fox5 the status of the man who was in critical condition after getting stung hundreds of times.. remains the same. safety advocates are now calling for more oversight after the death of a young boy in kansas on the world's tallest water slide. the park reopens tomorrow-- and today it was confirmed the 10- year-old rider... died... of a neck injury. the circumstances of caleb schwab's death are still under investigation-- but he was found dead in the pool at the end of the 168-foot-tall ride at the schlitterbahn water park. the verrckt - german for "insane"- requires two to three riders to be strapped into a raft with a total weight of between 400 and 500 pounds. an employee of the water park who didn't want to be identified... says there was very little training for water slide operators. mos says: "the only inspections we've ever done is people riding down slides one time -- oh it's ok. you are good to go for the rest of the day now." "verruckt" will remain closed

reopens tomorrow. researchers at nationwide children's hospital in ohio looked at two decades worth of numbers from the consumer product safety commission. they found an average of 4- thousand 423 children under 18 go to the emergency room every year for amusement park injuries. that accident has people taking a closer look at how water parks are regulated... so we took a look at what laws are in place in nevada. fox5's eric hilt is live at cowabunga bay -- eric what did you find out here in southern nevada there are no regulations for water slides -- and its up to parks to inspect their rides. according to the international association of amusement parks and attractions...neva da is one of just a handful of states without laws that regulate amusement parks... clark county requires inpections for amusement rides like roller coasters -- but water slides fall outside that law. because there

regulations -- individual parks are responisble to inspect slides and make sure the park is safe. and its a responsibility that park managers take very seriously. "we also hire an independent third party company that comes in and they do independent random visits to the park, so we never know when they're coming...they've come out twice so far and we've passed with an elite status" along with the random inspections, huish the rides every day before the park opens. they also have several rules and guidlines like height and weight restrictions to make sure passengers are safe on the slides, and they even have scales at the top and bottom of rides to make sure riders fit those requirements. reporting live eric hilt fox5 news local las vegas.

slides themselves fall outside of government regulations -- the water quality and the pools are inspected by the southern nevada health district. a child is recovering in the hospital after being pulled from a pool this morning. police say officers responded to the home on florine street - near alexander and rancho - just before 9 a-m... to investigate reports of a child found unresponsive in a pool. the family tells x pulled the child from the water and performed c- p-r. the child was taken to u-m-c for treatment. the condition of the child was not immediately known to police, but authorities said the child is expected to live. the incident remains under investigation. we're continuing to keep a close watch on the pilot fire in san bernardino county. hundred of homes are under evacuation orders. thousands more are under voluntary

after the driver who hit and killed her son on the side of the 95...is sentenced. gary adair jr. will start his four to 10 year sentence for felony d-u-i. he hit and killed kadar brown while brown was on the side of the freeway changing a tire in march 20- 14. kadar's family was frustrated when the case dragged on for two and a half years. his mother says they can now start the healing process kadar would have wanted for them. "i'm glad that it's over, i'm relieved, and there isn't enough time in the he got enough time for what he did but he's paying for what he did. adair begins his sentence with a credited of 228 days time served. a man sought in the death of his estranged wife - was taken into custody today. metro says a criminal apprehension team arrested arthur lopez without incident. the 55 year old was identified as the suspect in a

sunday. her body was found at a home on colgate lane - near washington and sloan - with what appeared to be severe head injuries. an investigation later revealed the likelihood of a domestic disturbance that took place earlier in the day between the victim and her estranged husband. an arrest is made in a sexual assault case involving a hotel employee. metro police arrested ivon major this morning after concerned citizens tipped off detectives last night. the 22-year-old is facing battery, sexual assault, kidnapping, robbery, burglary and open and gross lewdness. video surveillance captured the suspect saturday after the incident inside a hotel on boulder highway near desert inn. police say the employee was in a room when the man went in and committed the crime. he left when another employee came to the door. a man is fighting for his life after he was shot through the door of his home. metro says the man was shot at least four times through his sliding glass door

police say it happened last night just before 11 o'clock. a woman and small children were inside the home in the avion apartments off lake mead and hollywood. neighbors tell fox five that it feels like crime in the area has gone up...and police agree. "recently we've seen a number of these younger men involved in senseless violence with guns so it is a big concern for us as an agency the man was taken to u-m-c in extremely critical condition....and wasn't expected to survive. police don't have any information on a suspect right now but say it could possibly be gang related. a security guard is beaten and robbed near boulder station early this morning. police say three suspects beat and robbed the guard...taking his handgun...baton...a nd pepper sray before running off. it happened around 2:30 a-m near vegas valley and lamb.

the black box has been recovered.... from the wreckage of "el faro". that's the freighter that sank near the bahamas during hurricane joaquin. the n-t-s-b says it retrieved the data recorder - which investigators hope will offer information on the ship's final moments. the 790-foot "el faro" sank in 15- thousand feet of water in ocotber - while traveling between jacksonville, florida and puerto rico. all 33 crew members died. search crews found the recorder in april - but were unable to remove it. they returned monday and retrieveit remote- controlled vehicle. a day and a-half after delta air lines was hit by a global computer outage - travelers are still coping with canceled and delayed flights. by early afternoon - more than 500 of today's delta flights had been scrubbed... and nearly 12- hundred delayed - according to flight tracking services. that's in addition to about a thousand cancelled flights yesterday. the airline is struggling to recover from an outage at its atlanta headquarters early yesterday that brought a global meltdown

"it's incompetence, but what are you going to do about it." delta is offering refunds and 200- dollars in travel vouchers to people whose flights were canceled or delayed at least three hours. travel problems here in las vegas at mccarran international have been minimal - compared to other parts of the country - but travellers are being encouraged to check on their flights in advance. a surging wildfire continues to burn in the san bernardino mountains. nearly 400 home were under evacaution orders as of monday night. authorities say about five thousand more are under voluntary evacuation orders. tom wait has the latest on how homeowners - and families - are coping with the wildfire threat. closed captioning

home prices continue to inch upwards. the greater las vegas association of realtors says that's due in part to a tight housing supply. the median home price in july was 236-thousand dollars. that's an increase of less than one percent the previous month... but up more than seven percent from the same month one year ago. condominium and townhome prices remained steady at about 115- thousand - the same as last month - and last year - at this time. the organization says about 34- hundred existing local homes, condominiums and townhomes were sold in july. that's down from about 38-hundred in july 2015. nevada officials have approved 125 thousand dollars to defend a voucher style education program. board examiners are allowing the

a funeral has been set for a ten year old boy... killed while on a kansas water park attraction - as the world's tallest water slide. the memorial service for caleb schwab will take place firday. police say he died sunday of an unspecified neck injury - while riding the 168-foot slide... at a water park in kansas city. the boy was the son of a state lawmaker. the water park says it will re- open wednesday in a limited capacity... but the 17-story water slide will remain closed for at least the remainder of the summer season. other water park guests are now
