a funeral has been set for a ten year old boy... killed while on a kansas water park attraction - as the world's tallest water slide. the memorial service for caleb schwab will take place firday. police say he died sunday of an unspecified neck injury - while riding the 168-foot slide... at a water park in kansas city. the boy was the son of a state lawmaker. the water park says it will re- open wednesday in a limited capacity... but the 17-story water slide will remain closed for at least the remainder of the summer season. other water park guests are now

had problems with the water slide. joe chiodo met with one family - who says they complained that a chest harness was faulty. it's a ride taller than the statue of liberty - reaching speeds close to 70 miles per hour. paul oberhauser says on july 26th -- he was ready for that thrill -- until: (paul oberhauser/verruck t rider) as soon as i hit the bottom of the first curve - the shoulder strap just kind of busted loose and i just held on as we went next hill. his wife erin - took this video - as his car came to a stop. (erin oberhauser/verruck t rider) oh, just the reality of it, it's scary. you see belts on his 9 year old son in the front, and pauls friend in the middle, but notice paul's strap - is gone. he says he held onto handles near his legs. service - but then - (erin oberhauser/verruck t rider) we saw the same thing happen to another group of guys and thought hmm they must still be using the same raft. erin posted her concern on facebook - tagging the schlitterbahn- (erin oberhauser/verruck t rider) didn't hear from schlitterbahn and thought ah it must not be a big thing. but then - she got word of caleb's tragic death: (erin oberhauser/verruck t rider) shocked - it was just surreal to know we were just there - just on it - i have pictures still on my phone. pictures that appear to show that loose strap -- in a raft with their own 9 year old boy - in the front seat. (erin oberhauser/verruck t rider) we got to be lucky and he got to go home with us - unlike the schwab's with them our hearts break for them. now their one regret - looking back -- not doing more: (paul oberhauser/verruck t rider) i was just hoping the cause was not due to the strap cause i'd feel horrible if i didn't take it further than just telling the workers at the bottom. water parks in the valley take their own precautions to keep guests safe... despite having little government regulation. clark county requires routine inspection of roller coasters but water slides are not included in the law.

nevada is one of a handful of states without laws regulating amusements parks. cowabunga bay hires a third party company to do random inspections of their rides. they also warn guests ahead of time of height and weight requirements. "every morning our park is inspected by mechanics so every mechanical piece, every pump, every water flow. it's all inspected by our mechanics and they sign that off before anybody does a physical ride on the slide." although there is no government regulations for the rides--the southern nevada health department does perform regular inspections on park water quality. one of three girls - who fell from a ferris wheel in tennessee - suffered a traumatic brain injury - and remains in critical condition. it happened furing a county fair monday night - in the town of greeneville.. the girl is just six years old. police say she was in a seat with her ten year old sister - and a 16 year old girl - who are also in the hospital - but stable. investigators are trying to confirm reports the basket was

"and they fell, bounced off a tubing, one fell bounced off, the other one fell immediately behind, bouncing off and then hitting the concrete, bouncing off the concrete.. all of the rides at the fair have been closed until they pass new inspecttions. both theme park incidents... are raising new questions about saftey. researcher "nationwide children's hospital" in ohio looked at two decades of numbers from the consumer product safety commission. they found an average of 4,423 children under 18 go to the emergency room every year for amusement park injuries. add in water parks and the most recent numbers show about 30-thousand children injured last year - with no one agency overseeing all kinds of rides. researchers say parents should make sure kids follow all height, weight and age requirements - use

regularly played baseball since he was a junior in high school-- but tim tebow is looking to make the professional switch. the former nfl quarterback has been training on the diamond for months in scottsdale, arizona and los angeles. tebow has served an espn broadcaster since his three-season nfl career ended with the new york jets at the conclusion of 2012 season. c-a-a baseball says this isn't a publicity stunt. chad moeller, a former major league catcher who has been training tebow says he "truly believes tim has the skills set and potential to achieve his goal of playing in the major leagues." he also thinks it could happen relatively quickly.

against warner brothers over the new "suicide squad" movie. his complaint? there's not enough of "the joker" in it. "blah, blah, blah... chit chat is going to get you hurt. i can't wait to show you my toys." the movie about a group of comic book super- villians... features "the joker" heavilly in the ads... but the character - played by jared leto - only sees about 15 minutes of total screen time. the fan - who posted about the lawsuit online - says ads and trailers for the movie even include scenes featuring the joker - that were cut from the final edit. he calls the marketing misleading - and claims his case has been accepted - and goes to court august 11-th. disgusting... and dangerous. those are some of the words being used to describe donald trump's comments - about who he calls "second amendment people." what he said today - that's setting off another controversy. your fox5 weather
