fox5's eric hilt is live in the newsroom...eric talked to the childress family about the ruling. family members of keith childress jr. say today's review was difficult, and forced them to relieve the day of the shooting all over again. "get on the ground" childress was shot and killed on new years eve of last year... this is body cam video from that day -- it shows him ignoring demands from officers. those officers thought he had a gun in his pocket, but it was just a cell phone -- childress was the district attorney's office ruled the shooting as justified, and today's review was meant to address concerns from the public. but childress' family told fox5 they have unanswered questions. "why? that just my only question. why. it never had to go down like this. why did this happen. there was no reason for it, absolutely no reason for it." us marshals had tracked childress down that night and called metro for backup when

marshals told metro that childress was wanted for attempted murder -- but that was wrong. childress was facing charges from a home invasion in arizona. soc childress' death sparked a large public reaction including a protest on the strip. jury selection took place today... in the trial of one of two men - charged in the robbery of a student - that turned deadly. police say marcos arena was walking to school back in 2013... when two men in a car - who tried to take his i- pad but the 15-year- old wouldn't let go. he was run over by the men - who then took off. the suspects were later identified as michael solid and jacob dismont. they pleaded not guilty to murder, robbery and conspiracy charges. the trial for michael solid - continues tomorrow. a new school year begins one week from today - and safety remains a concern for students who walk to school. many of them

democratic vice presidential nominee tim kaine is trying to shore up labor support. "you have never let this son of an iron worker lose. i'm 8-0 in elections and i'm going to be 9-0 after november 8-th (cheers) " kaine addressed the annual convention of the ironworkers' union today at the mirage. he was joined by his father - al kaine - who owned a union-organized ironwork and welding shop in missouri. "iron workers work for companies that export products and we want them to sell even more an create more jobs here in the united states and that's why we're going to make sure any trade rule is fair and advances jobs and advances wages rather than hurts them. kaine also offered his support to both congresswoman dina titus... and senate candidate catherine cortez-masto... who were at today's event. major unions have endorsed the

republicans argue that presidential nominee hillary clinton is beholden to wall street - not the working class. donald trump cancelled plans to return to las vegas this week. the republican presidential nominee was going to hold a rally at the south point arena friday. but the casino confirmed to fox5 the event has since been cancelled. the trump campaign didn't say why it cancelled the event. trump is still expected to attend a fundraiser for the nevada republican party... that night at harrah's lake tahoe. the "black lives matter" movement has been growing over the past year. now some are saying... it's been more than a week - since violent protests were felt in milwaukee, wisconsin. they erupted after a police officer shot and killed a suspect. "despite something bad happening, let's make sure it doesn't happen again and become closer than we were before." now - community leaders say the city is learning from the chaos. from the ashes.. together... cleaning up the destruction... preaching peace... and trying to move forward as a stronger community. "i think people have a willingness to come to the table and sit down and talk about what needs to be done, discuss real solutions and get down to the root causes." the violence and looting in milwaukee led to several businesses are now being demolished - due to damage from the violence and looting. criminal investigations are underway to determine who should be held responsible. . in houston, texas.... about a dozen people held

(nats) on a sunday morning (8/22)... outside the naacp in the third ward, about a dozen protesters gathered for a white lives matter rally. reed says: "we came out specifically today to protest against the naacp and their failure in speaking out against the atrocities that organizations like black lives matter and other pro black organizations have caused. the attack of and killing of white police officers." carrying the confederate flag and guns, these protesters argued there is aggression toward white people... and that it's time someone spoke up about it. lacy says: "we are who we are. we should look out for our own and they should look out for theirs. the problem is the double standard involved. we can't do it without being labeled a hater or whatever." but people in the third ward, a

called their message convoluted and said their rally was about intimidation. neighbors gathered across the street and protested back. at times, tensions flared, and insults were thrown around. houston police were there to keep the peace. jones says: "one of the things that the naacp is supportive of is the right to the freedom of speech. and so while we may not agree with the message that was held right here in front of our headquarters, we do agree with their right to say it. boykins says: "we have a loving city again, people that care about this city and for that small minority that came thinking they were achieving a goal of disrupting the lives of people of organizations like the n-a-a-c-p, they got an f today." in may - the city of houston voted to rename seven schools named after people with ties to the confederacy... including robert e-lee..."stonewall" jackson... and jefferson davis.

swimmer dies - while at a water park in washington state. "we saw him jump off but we didn't see him come up and i went underwater to see it a little and he was just laying there. " the wild waves theme park says lifeguards pulled the man out of one of the activity pools saturday night. c-p-r from first responder teams - and later - firefighters - failed to revive him. guests at the park noticed some changes the next day. "a lot more higher security in the waters... the ride that the accident happened on is completely closed down and roped off and extra employees making sure nobody goes around that area." the drowning comes after a 10- year-old boy was killed on a huge slide at a kansas water park earlier this month. a final report has been released - after a chiild was attacked and killed by an alligator at a disney park in florida.

and wildlife comission says little could be done to prevent what happened. the report says the gator acted in a "predatory manner" - and that 2-year old lane thomas graves did nothing to provoke the reptile. the gator grabbed the boy when he bent down and the boy's father tried to pry open the gator's mouth that was clamped on his son... but the animal broke away. the report also says a man alerted staff to gators about 45 minutes prior to the attack- and was on his way down to warn families when he heard a woman scream. disney has since added additional measures in an effort to secure the beach. the flood waters are receding in many areas of louisiana... allowing evacuated families a chance to get back to their homes - and assess the damage. will carr has more from sorrento - a town hit hard by the severe weather. the rain still falling in parts of southern louisiana as evacuation orders are lifted... folks here are cleaning out their homes... assessing the damage from some of the worst flooding the region

now thousands of volunteers are pouring into the state - to help re- build. mos says: "we take for granted we can go out and have lunch, we can have dinner and these people have nothing. they don't have food. they don't have water. there's nothing." meanwhile, president obama is scheduled to visit the area tomorrow... he'll meet with flood victims and local officials, getting an update on evacuations and recovery efforts. the white house - refuting critics who say the president should have cut short his summer vacation - and visited sooner. earnest says: "as long as the team here on the ground is working closely with local elected officials and the governor and getting the job done, that's what we're worried about." and the federal response effort is ramping up as well. fema says it's opening three new disaster recovery centers in louisiana... and the obama administration will offer low-interest disaster loans for homeowners trying to rebuild. the white house says - all federal resources will be at the state's disposal for a recovery effort expected to take years. earnest says: "the response you've

breaking news... we can now confirm the man attacked by a swarm of bees on august 4-th in the southwest valley near grand canyon and oquendo - has died. 49-year-old jose moreno pacheco of las vegas died thursday - at the hospital. the clark county coroner is investigating the cause and manner of the death. the investigation is expected to take another 6-8 weeks to complete. the battle continues across the state line... to fight the blue cut wildfire. the fire is now 89-percent contained. "cal fire" says it has burned more than 37-thousand acres.

orders have been lifted. they affected more than 80- thousand people at one point. some roads - including parts of highway 138 have limited access. more than 100 homes and 200 outbuildings - such as sheds or barns - have been destroyed by the flames. but no one was killed. the inferno began in the cajon pass area and scorched about 57 square miles. one of the buildings destoryed was a historic restaurant called the "summit inn". it was a familiar sight to drivers on the i-15... but now - has been reduced to rubble. last week - fox five spoke to the current owner - who bought the diner just weeks ago. paul vercammen caught up with the former owners - who are sad to see history - go up in flames. natsot: "the wine rack, a lot of other stuff, the gumboil machine over there." cecil stephens, longtime owner of the summit inn before he sold it a month ago can't believe the bluecut fire torched his life's work.
