united states representative cresent hardy is recovering tonight after suffering a minor heart attack. i'm christine maddela. i'm john huck. representative hardy represents nevada's fourth district. the republican is running for re- election this year against democrat ruben kihuen. congressman hardy's communications statement tonight: congressman hardy was recently hospitalized for a minor heart attack and has undergone a routine medical procedure. out of an abundance of caution, doctors are continuing to observe him while he makes a full and speedy recovery. we expect the congressman to return to a full schedule later this week and is expected to be in washington next week for votes when congress returns from the august district work period. many lawmakers and friends are posting to social media tonight... wishing congressman hardy a swift

opponent. state senator ruben kihuen tweeted: "glad to hear that rep. hardy will make a strong and quick recovery. wishing him and his family all the best." noise complaints about construction are nothing new in the valley. but now, some homeowners are taking legal action against the builders next door, saying their property is being damaged by the new construction. fox5's miguel martinez valle was at one of their neighborhood meetings today, and miguel .. did you see the damage they are talking about? i did .. cracked foundations, broken tiles, and split cielings... neighbors tell me these problems only began over the last few months... right around the same time these explosives started going off at a nearby construction site. " i just hit the floor, i grabbed my service dog and hit the floor, because i thought it was a 145 shot" " the whole house shook, and at first we thought it was an earth quake, what else would

be" " she fell out of her chair, and my husband had a friend over that practically ran out of the house " a new construction project is causing quite the shake up in this southern highlands neighborhood near cactus and rainbow. and its not just noise these neghbors are worried about, they say their property is taking a hit... " they set these blasts off the whole house shakes, i have crack on my garage floor, my patio is cracked in two spots" " we noticed that was cracked shortly after the last one which was for us, the biggest one" " it starts here and it goes all the way to the back" " theres the crack begining here, well actually begining up here..." these neighbors have tried reaching out to richmond american homes of nevada and western explosives systems, the companies they say are responsible for these damages... they were told the cracks were a result of natural settling, and they weren't going to stop the explosions any time soon. " think theyre trying to dodge a bullet and say they have nothing to do with

they have a lot to do with" so the neighborhoods getting together, theyre meeting weekly, and taking legal action to save their homes... " we filed a lawsuit about a week and a half ago, we have not yet decided wether it would constitute a class or not" " we're not asking for a million dollars, we just want them to fix what theyre ruining" the neighbors are planning to keep track on any new damage caused by future explosions, theyre also trying to get enough people on board to file a class action lawsuit. fox5 reached out to the companies

it's been eleven years since hurricane katrina devastated new orleans. today -- the city remembered more than 18-hundred people killed in the storm. "amazing grace, how sweet the sound. that saved wretch like me." city officials and community leaders gathered for a wreath- laying ceremony this morning at the katrina monument. it's where nearly a hundred unidentified victims of the storms were buried. many of those evacuated from hurricane katrina moved to las vegas. one family found a new home here... and opened "t-c's rib crib" -- near durango and spring mountain. the family says the restaurant is thriving. "vegas is home for me. you think you would never experience you never think it

and here is it second time. i cant imagine going through that." the family says they have been sending money back to other family members affected by more flooding -- that hit the area over the last few weeks. latin american music icon juan gabriel has died. a vigil was held on the strip to remember him. "he was like a father, a father figure, my spirtual guide, he was somebo always looked up to" gabriel passed away from a heart attack in santa monica on sunday. this comes two days after playing a sold-out show. gabriel's legal name was alberto aguilera valadez. a hearse took his body to l-a-x today to be flown to mexico -- his home country. gabriel sold more than 100-million records during his career. he was 66 years old.

wilder -- has passed away. the comedic actor and author died in his stamford connecticut home this morning. wilder is known for his roles in "the producers"... "willy wonka and the chocolate factory"... and young frankenstien. he is also known for comedy classics like "blazing saddles" and "stir crazy." wilder is survived by his wife karen boyer. the two were married for 25 years. wilder's nephew says he died of alzheimer's complications. he was 83 years old. the first day of school is in the books for hundreds of thousands of clark county students... but -- police saw dangerous driving in school zones... and many drivers were ticketed! how the rules in school zones are different from last year. and overcrowding still a problem in the classrooms. how the school

thousa receiving construction skills training for "project neon". it's designed to make the i-15 between sahara and the spaghetti bowl safer. "these are all going to be local hires. here in las vegas. we have skilled and ready here. and so we're happy to bring jobs here to southern nevada. project neon will create 4000 jobs in total." "project neon" is the largest

project in the state of nevada. counstruction training will focus on how to make mechanically stabilized earth retaining walls. it will require more than a hundred-thousand man hours to finish. construction will last through the summer of 2019. despite the warnings ahead of the first day of school in clark county -- many drivers were given tickets for being unsafe in school zones. fox five's adam herberts shows us the new rules. the first day of school is already stressful enough for the kids in the i needed to learn lots of things and try to make new friends. it was hard. ...but before you even get that far, man, it's tough just to get to school on time... especially because these roads feel like a parking lot. maybe it's a traffic jam? or maybe it's just a red light not working. i don't even know. i just don't even know! to make matters worse -- the police say there have been plenty of crazy parents trying to

no no warnings today. everybody's getting a ticket. it's important as a parent that you have a conversation with your child. and really the age doesn't matter. the schools say every year they spend the whole summer getting ready for this day... but somehow it's still chaotic every time. they say it's okay if mom and dad want to walk to their little one to class... but they still need to park in a legal parking spot. i'm pretty sure it happened all over town. because they've pretty much been sticklers in this area since she's been going to this school. way... another third school. now the police say -- please. educate yourself on the new rules. set a good example for your kids. and just try make life a little easier for everyone else on the road. if you're not sure if you're supposed to stop. stop. because you're certainly not going to get in trouble for that. and police want to remind drivers of the rules in school zones. stop completely at crosswalks...

sidewalk. do not make u- turns. do not pass any cars in any lane. make sure to park in a legal parking spot. more than 300- thousand students make up the clark county school district. at overcrowded schools -- students will be learning in portable classrooms. fox five stopped by one of the district's most overcrowded schools -- william v. wright elementary school -- near durango and blue diamond. when it was built -- the district expected it to hold around 750 students... but this year -- the school has around 13- hundred students. it has 28 portable classrooms... and a portable cafeteria and portable bathrooms. some teachers say it causes a problem with accessing resources. "one of the hardest parts of being in the portable is not having access to all the technoloogy inside, you have to walk in there but if you're in one of the pods you can easily send out kids to do vmath whereas here we dont have that opportunity." c-c-s-d says

ongoing issue -- a new elementary school is being planned just three miles away from wright. this could reduce the number of students at the school. it's set to open in 2019. the first day can be an emotional time for kids and parents. but today -- a local mom threw a party for those both celebrating... and crying. "hankies and mimosas" is a back to school bash hosted by mom nicole terry. guests get a hanky if they're sad... and a mimosa if they're glad. terry says it's a day for moms to forget the stress... and give them a free pass to let loose. only one mom at the party needed a hankie. "i think having older kids i just know eventually the beds are empty you know just one more summer that's wrapped up and... mike- you're going to lose it arent you? (laughs) there were food... drinks... hula hooping and music to get the party going. this is the fourth year for "hankies and mimosas".

certainly delivered moments that have people talking tonight. while there's still a lot of talk about the v-m-a's last night... the ratings plummeted. it drew an audience of six and a half million people. that's down more than three-million viewers from last year. but -- there were more streaming viewers than ever before. m-t-v says they had more than 45- million on facebook. "the blue man group" is looking for talented drummers. it's part of their first ever drum- off competition right here in las vegas. "blue man group drum off is here. spins the drumstricks. entries due by midnight friday september 30" the resident crew at the luxor wants creative and innovative drummers to sign up. they'll face off for a grand prize of six-thousand dollars! video submissions are now open... but need to be sent in by september 30- th. the final round takes place on october 22-nd at the container park in downtown

fitbit's latest line of fitness trackers will finally be safe for swimming. the company unveiled two new devices that are water-resistant... and can measure laps in the pools. they're called the "swim proof flex two" and the "flex two". the "flex two" model is sleeker than the previous versions... while "the charge two" is an update to its bestseller -- the charge h-r. this tracker will have guided breathing and cardio fitness levels to challenge users. a new feature called "adventures" will also track users distances against actual hiking trails. the app will
