where osha stepped in and investigated performance builders inc. in six of those cases -- the cases were closed and the company wasn't fined for any reason... but in the other three, investigators found multiple instances of "serious violations." in fact -- the last time they were investigated was just a few months ago... when osha determined the company had serious violations... which appears to be related to the scaffolding. now of course -- as soon as we found that out -- we asked to that case -- just to see if there were any similarities between that case and what happened last week in tivoli village. osha said they're not releasing the specifics at this time... but they might be able to release it to us later this week... so stay tuned for that. another organization we talked to today was the union that represents construction workers... and when we asked them about this company, they said it has a little bit of a reputation. so we sat down with frank hawk -- he's an administrator with the carpenters union

complaints about this specific construction site at tivoli village for weeks. now he says he wish he could have done something to shut down the project before somebody lost their life. they say four men where in a sam's town hotel room when a gun accidently went off around 1-40 a- m. the victim was taken to the hospital and is expected to be okay. officers are looking for the man who fired the gun to ask him exactly what happened. police say they'll wait to get more information before filing any charges. people living in the west valley could be seeing faster police response times. metro is opened the spring valley area command office today. the station off of sahara and durango will service 31 square miles of housing and commercial areas. about 100 officers will serve the areas between charleston to flamingo...and the eye 15 to red rock. the six year old was supposed to go to a daycare less than a mile away, but ended up at the bus depot on the other side of the valley. fox5s eric hilt talked with the boy's mother today. eric. samone topps told me either steele elementary school or the clark county school district needs to be held accountable, six year old dazani started first grade yesterday... afterward supposed to be picked up by his daycare -- but was put onto a school bus instead. samone said she was called by the daycare - not ccsd - about after two hours he was found asleep in the back row of one of the buses... but that came after hours of

an australian man is identified as the person who died trying to run across interstate 15 this week. 26-year-old matthew graves died in a crash sunday near flamingo road. police say he was struck by a vehicle in the southbound lanes. the driver involved in the crash was taken to sunrise hospital with minor injuries. the freeway was closed for several hours during that investigation. a woman who died snorkeling at lake mead this weekend is 63-year old bonnie wong. the clark county

death was caused by heart disease. being submersed in water was also a factor. the national park service says wong became unconscious while snorkeling with friends... it happened at the overton arm of lake mead. this was the second death at lake mead over the weekend. a florida police officer died while scuba diving. congressman cresent hardy says doctors repaired a collapsed artery in his heart before it worsened to the point where it could have been fatal. he is out of the ho suffering a heart attack sunday. hardy is already resuming political activities - including a roundtable discussion today in las vegas. hardy says he feels better now than before the episode. the 59-year-old hardy republican is running for re- election in nevada's 4th congressional district, which leans democratic and includes north las vegas and rural central nevada. the nevada green party is fighting for ballot representation in court this week. they're preparing for a rally wednesday...regar

decision against apple overseas. the european union finding the u-s company received illegal tax benefits. now - apple is on the hook for more than fourteen billion dollars. benjamin hall is in london to explain. union... thinking differently about apple's taxes. the company ordered to pay up to 14-point-5 billion dollars in back taxes, plus interest, to ireland after the e-u determined it received illegal tax benefits for over a decade. according to the bloc, apple paid 56- dollars in taxes for every 1-point-1 million in profits under its last rate. vestager says: "..this decision sends a clear message. member states cannot give unfair tax benefits to selected companies."

after a three-year investigation into the i-phone maker. for their latest quarter, apple posted 42-point-4 billion dollars in revenue and a net income of 7-point-8 billion. the california- based company says it employs nearly 6-thousand people in ireland... most of them in cork. lawler says: "..they've followed the tax rules of ireland. so what's under question here is those tax rules in ireland." both ireland and done nothing wrong, and will challenge the e-u's decision. apple c-e-o tim cook releasing an open letter reading, quote... "beyond the obvious targeting of apple, the most profound and harmful effect of this ruling will be on investment and job creation in europe. using the commission's theory, every company in ireland and across europe is suddenly at risk of being subjected to taxes under laws that never existed." start of trading, tuesday. in london, benjamin hall, fox news. the treasury department is critical of the ruling.. saying it could - quote - "threaten to undermine foreign investment, the business climate in europe and the important spirit of economic partnership between the u.s. and the e-u." police found a body buried in concrete and dirt... this happened in kingman arizona.. police says they found the body in the yard of a man who was arrested after he confessed to the killling. an autopsy is pending - but the sheriff's office says the body recovered by a jackhammer and other equipment is believed to be that of 65-year-old john holland. richard polaski is charged with premeditated first-degree murder. authorities said polaski confessed to a homicide while speaking with police in laughlin. he told investigators he gained access to holland's investment account after killing holland in 2015. a 35-year-old kingman woman was killed when shot by an officer monday night. the mohave county sheriff's

paula dell phillips was the driver of a vehicle that had stopped on a road monday night. they say she pointed a gun at the officer - who stopped by to check on the vehicle. the officer fired several shots - killing the woman. the officer was not injured and - has been placed on administrative leave during the criminal investigation. a man who police say posed in battlefield gear and assault weapons for an internet video - is due to face a judge this week on terror threat and conspiracy charges. bryce cuellar was heard on video - saying he planned to shoot "satanists" and "homosexuals". the 24-year-old could be facing up to 20 years in state prison. he is in jail on 150-thousand dollars bail. google alerted authorities to the youtube post in july. officers arrested cuellar hours later. by then - police say he'd attacked his wife. he pleaded no contest july 6-th to misdemeanor domestic violence. a neighborhood is taking legal

construction work being done near their homes. people living in a southern highlands community near cactus and rainbow filed a lawsuit - against richmond american homes of nevada and western explosives systems company. the homeowners say these companies are setting off explosives near their homes - causing an array of issues. not just noise - but also damage. "they set these blasts off the whole house shakes, i have crack on my garage floor, my patio is cracked in two spots," "the whole house shook, and, at first, we thought it was the lawsuit was filed about a week and a half ago. a lawyer is working to see if it will qualify as a class-action suit. more renovations are coming to the boulevard mall. it will soon welcome the "seaquest interactive aquarium." this will be an indoor and outdoor attraction. guests will be able to take part in shark and sting-ray touch exhibits. seaquest is also bringing in rainforest reptiles and tropical birds. the attraction opens this fall. we're taking a live look at the bogart wildfire in california. it has burned throught at least 125-acres in cherry valley near beaumont. the fire is only five percent contained. no homes have been lost of evacuated. sidewalk stickers are being used - in

pedestrians being hit by vehicles. as part of a "zero fatalities" campaign... city and state transportation and public safety officials installed 20 decals along eastern avenue. they remind people not to jaywalk - and to cross the busy road safely. officials say the death toll is climbing statewide - with more than 46 pedestrian deaths so far this year. that's up nearly 50 percent from the 31 deaths reported in the same period last year. most deaths have been in clark county, where 34 cases have been rebel fans are getting pumped up for a new year. the season is kicking off and coach tony sanchez says it's time to light the fuse. the unlv alumni association hosted the rich abajian football luncheon today. fox5's sports director kevin bolinger was there to emcee. he spoke with coach sanchez who's encouraging fans to come out and show their support.
