all to get ready for a huge increase in customers over this labor day weekend. terribles and several other businesses i talked with said this is one of their busiest weekends of the year. they say they bring in extra workers and in this case even extra bathrooms for all the people looking to take a break from their drive on i15. drivers i talked with who were stopping in said that traffic this afternoon was actually not as bad as they thought. many said left early to prepare for crowds of people on the road, and they're hoping they avoid the gridlock all weekend. "were really hoping i keeps up because the game starts at 7:10 tonight so we are just praying that we don't run into bumper to bumper." coming up at 5 see how some drivers are using their phones -- not behind the wheel of course -- but to make sure they

more students. charlie could see the writing on the wall. she resigned before she was let go... but in the past few weeks she says david o'mckay academy has had to downsize substantially... more than a dozen teachers let go. it put a lot of pressure on us. i can't imagine the amount of families that were affected by this. we all had an expectation to be able to have the nevada school choice thanks to senator scott hammond to be able to put our kids wherever we felt was the most comfortabl our families. the school has two campuses... but only one is being used right now. both the school and charlie are hopeful that the the funding will come down soon. the school says a decision could be made as early as next week on e-s-a funding... and no later than next month. live in the newsroom... kathleen jacob fox 5 news. local. las vegas. and just a little background... e-s-a funding has had a court injunction on it since january. some argue the funding is

has been arrested, and they have not released any suspect information. and police say just minutes later, a man was accidentally killed in a separate incident. metro police found a man suffering from a gunshot wound near lake mead and m-l-k. he was in a car near a basketball court. police talked to the person they say pulled the trigger... but metro believes this shooting was an accident. the district attorney will decide if charges should be filed in this case. this is metro's 113th homicide investigation this year. a vacant apartment complex is completely destroyed after an early morning fire, and investigators say squatters might be to blame. here is a look at the aftermath of the property near sahara and las vegas boulevard. witnesses told fire officials they saw someone crawl out of a second story window, jump to a roof on the first floor and run away from the scene. investigators found a man that fit the description few hours later a block away from the fire. at that location. we found that person they were suffering from 20 percent second degree burns from the waist up. the person was kind of incoherent but he told us he was involved in a building that was on fire " the man was later taken to umc for his injuries. investigators say theyre still looking into the cause of the fire. fox5's abby theodros talked to the property owner who says he's done everything to keep squatters out. she'll have the full report at 5. fire crews were sent to investigate a suspicious fire early this morning. they now say it was arson. north las vegas fire says it happened at a church on lola avenue...near the silver nugget casino. a reverand at the church tells fox5 she thinks it was vandalism. she says someone threw something with liquid at the door and through the window....and that may have caused the drapes to catch on fire. the fire caused about 10 thousand dollars in damages. attorney's for

trying to get him out of a las vegas jail. "alexander montagu- manchester" has been behind bars for nearly three weeks. his attorneys are worried about his medical condition. they are asking for montagu- manchester's release as a medical necessity today. the duke was jailed for filing a fake police report that violated his terms of release from a burglary charge. he denies committing any crimes. samsung is officially recalling its "galaxy note seven" phone... after some customers complained the phone's battery exploded while charging! according to the smartphone company... it know of at least 35 cases of this battery problem, including one we told you about here in las vegas. samsung told the wall street journal it estimates about 24 out of every million phones is faulty. yesterday we spoke to a local woman, who told us her phone burst into flames by her bed. " thousands of people don't have power, and you can see there is a lot of damage left behind. the storm isn't over yet. hermine has been downgraded to a tropical storm, and it is headed up the east coast. forecasters warn the storm will be dangerous and it will affect

millions of honeybees are dead in south carolina... after an aerial pesticide spray was used to control mosquitoes that might be carrying the zika virus. "i was angry that day. i mean, it just didn't make any, i just couldn't wrap my head around the fact that we spray poison from the sky." beekeepers say they were not warned about the spraying...and that they're devastated from the loss. the e-p-a warns those concerned should bring grills...pets...and kids toys indoors during the sprays. idea the pesticides were going to be sprayed. honeybees are the world's most important pollinator of food crops -- and they are dying at alarming rates due to the extensive use of herbicides. fewer bees mean a smaller food supply. a former stanford university swimmer who received a 6 month sentence for sexually assaulting an unconcious woman... is out of jail three months early. brock turner's case sparked outrage around the world.

next for turner. just after six a-m local time friday... former stanford university swimmer brock turner walked out of the santa clara county jail. he'd served three months of a six- month sentence for sexually assaulting an unconscious woman. (sheriff laurie smith/santa clara county) "he should have never been in our jail, he should have been in prison. but, this is the end of it for us, yes, he's been released from custody." turner was arrested in january of 2015 and charged with three felonies. he was convicted on in march. but instead of the six year sentence recommended by prosecutors, santa clara county judge aaron persky sentenced him to six months. turner found himself in the national spotlight -- and the subject of protests -- when his victim's heart- wrenching impact statement went viral. (kamilah willingham/harvard law school rape survivor) "to read that victims words and to see that brock turner only got three months for violating her so egregiously

protests... and their could be other consequences. (michele dauber/stanford law professor) "we believe that judge persky is biased in cases of violence against women and we do not think he is the best we can do for a judge in santa clara county. we believe the voters will agree with us so we are going to be working toward his recall. turner will have to register as a sex- offender. now, he's expected to return to his family's home in ohio. i'm kim hutcherson reporting the judge in this case requested to be re-assigned to the court's civil division last week. there were many calls for his resignation after the ruling. the university of nevada reno is defending colin kaepernick's decision to sit out the national anthem... his alma mater says memorabilia of the star's career with the wolf pack will stay at the reno- tahoe international airport.... even though passengers and people in reno are complaining about it. the unveristy's president says the

we want to tell you about some breaking news, north las vegas police say a homicide suspect has escaped police custody. police are looking for 25- year-old "alonso perez". they say he was taken to the north las vegas detective bureau and placed in interview in handcuffs. a detective stepped out of the room, and police say perez was able to break free. he stole a white 2016 ford f-250 pickup truck and took off. we are gathering more details on this story, and will bring you more updates at 5. a boston sports anchor decides to get the hands-on experience... when an alligator is brought on the show. and it doesn't take long for this situation to get crazy! why this gator got spooked in the studio... and

we begin fox5 news at five with breaking news-- a homicide suspect escapes police custody. i'm john huck. i'm christine maddela. police in north las vegas say the man they arrested today for a man's death over the weekend-- managed to get out of handcuffs and a police station interview

tonight he's on the run. this is 25-year-old alonso perez. he's believed to have shot and killed 31-year-old mohammad robinson at a mcdonald's on las vegas boulevard and pecos saturday night. police say a detective stepped out of the room and perez turned the handcuffs until he broke free. he escaped the building and later stole the white 2016 ford f-250 that you see on your screen. it has nevada license plate 2-6- c-8-1-9. police believe perez is armed and dangerous-- so if you have seen him, call north las vegas police immediately at 702-633-9111. it's expected to be a busy holiday weekend - here in las vegas. the roads will be packed over the next few days. right now - we are taking a live look at interstate 15.... near the california state
