the chest. police say it doesn't appear he knew the gunman... pedro garcia... who entered the starbucks at rainbow and warm springs - after a credit card dispute at the drive-thru. metro says garcia fired twice into the ceiling - before shooting khutsishvili . i was just mortified and so scared for all the people working here. garcia is behind bars - pending a court appearance on murder - and other charges. it's not clear yet if he has an donald trump and hillary clinton - claiming victory after their first debate last night. now - clinton says she's looking forward to the next two - including the final debate here in las vegas - whether trump shows up or not. a fire captain is dead and five people hurt after a house explosion in new york city this morning. fire crews responded to reports of a gas leak... at a two- story bronx home. they discovered what appeared to be a drug lab and called police. that's when there was an explosion - and fire. the captain was rushed to a local hospital after getting struck by debris - and was later declared dead. "it is with profound sorrow that i announce the passing of battalion chief michael fahey, 17 year veteran of the fdny. a very devoted father of three, a very devoted member of the fdny and a good man." at least four nypd officers and one civilian were also taken to hospitals with minor injuries. a bag of baseballs - have washed ashore in miami beach. police say they could help piece together the tragic death of marlins pitcher jose fernandez. he was killed

with two friends - when their boat crashed. the bag was found about 20 blocks away. it contained fernandez's checkbook and four autographed baseballs with his signature and numbers that could be dates - written by the star athlete. meanwhile - fans are leaving flowers outside marlins park - and thinking about the family that fernandez left behind. "i can just imagine their new normal life, their new journey without him, his daughter without a father; it's just so heart- wrenching." the miami-dade county medical examiner say autopsies on fernandez and his two friends were completed monday... but an official statement won't be released until the toxicology reports are in. florida governor rick scott took a tour of a massive toxic sinkhole that opened up at a phosphate processing plant east of tampa. the visit comes a day after scott directed the florida department of environmental protection to issue an emergency rule that any incidents of pollution must be publicized within 24-hours.

phosphate mine's 3-hundred-foot- deep sinkhole dumped 215 million gallons of contaminated water into the state's aquifer last month. it took officials three weeks to notify the public. the most important thing, i think, for all of us is, my family lives here, is that all of our water is safe to drink. we expect everybody in our state to have safe water and that's my expectation also. he will also propose legislation next year to turn that requirement into state law. firefighters respond to a fire - near vandenberg air force base in california. it broke out just before noon monday and - as sean larsen reports - is proof that wildfire season isn't over just yet. (nats) robert wolfe says he had to pull over to see the fire for himself. he's a local photographer and he wanted to take some photos of the flames.

"well i was on my way home and i saw the fire breaking out so i booked home and grabbed my camera and came back. wolfe has lived in lompoc for nine years.. he says the number of fires that have broken out at vandenberg air force base in the past couple weeks.. is unprecedented. this one started late monday morning...not too far from last week's fires (robert wolfe - lompoc resident) "i have not seen this many in this short of a period of time." the fire broke out a couple of miles from the north base entrance off of corral road and firefighter road.. forward progress of the fire was stopped within about an hour and a half. (nats) thanks to a speedy response from fire fighting helicopters and airplanes. air force base housing and schools were the main concern..but firefighters were able to steer the flames away from those buildings. vandenberg officials called people living nearby as a precaution. (robert wolfe - lompoc resident) "that quick, they're right on top of it today." sean larsen: wolfe says if you want to live in california..these fires come with the territory. going... for nearly 38 miles. 12-time "world trials champion" dougie lampkinfought against strong winds - and traffic since the roads remained open - during the one hour and 35 minute stunt. the challenge - all on one wheel - was shown live on red bull t-v. it followed a full lap of the famous "isle of man tourist trophy motorcycle race". "the last 15 seconds were really lovely. the rest of it was a challenge. in fact, it was ridiculous." lampkin says he spent seven months preparing for the stunt. thanks for joining
