the afternoon commute... not fairing well for drivers on the 95. this is a live look near boulder highway. traffic is being detoured because of a crash that happened before noon... when a man ran on to the freeway... and was hit and killed by a semi truck. metro police say a patrol officer was trying to pull the man over to talk to him about a shooting last week. fox5's adam herbets joins us live near the 95 and boulder highway with details of the crash.. and the backup. closed captioning

the nevada supreme court has ruled the state's education savings account unconstitutional - and says the program should remain suspended. justices issued a 4-2 ruling today - calling for a permanent injunction on the program - which was on hold on a temporary basis. the ruling says the program authorized last spring by the nevada legislature did not have its own dedicated funding source... and is unlawfully drawing on money allocated for public schools in the state's distributive school account. lawmakers passed a republican- backed bill last year creating what was seen as the broadest school choice program in the country. it would allow parents to use public funds for private school tuition. groups filed two lawsuits against it shortly after. no funds were ever disbursed to families. people in the valley are spooked after a bunch of high schoolers at chaparral high school received a friend request

determined the account was a fake. they told us no charges were filed. we also reached out to metro police about the spike in rogue clowns in differnt u.s. cities - they say there are no regulations on freedom of speech so it's not illegal. coming up at 5 - i talked to an expert who scares people for a living. we'll tell you what he has to say about the creepy clown trend. a small wildfire has burned a small area on mt. charleston. the u-s forest service along with the mt. char protection district have responded to the fire.... near mary jane falls and big falls. crews on the front lines have kept the fire damage contained to just a quarter of an acre. the u-s forest service will monitor the fire throughout the night. it is unclear what sparked the fire. now word on any structures damaged. toss to weather

some help is on the way - to help unlv cover the cost of the third - and final - presidential debate. the l-v-c-v-a held a board of directors meeting today. a vote was held to approve four million dollars... for unlv to cover the cost of the presidential debate between hillary clinton and donald trump. it takes place on campus... at the thomas and mack - on october 19-th. any over-runs beyond the four million... will have to be covered by the university.

the man killed in a shooting at a starbucks sunday - was a naturalized u-s citizen from the country of georgia. that's where he served in the military and learned not to back away from conflict. that's according to a lifelong friend from los angeles - who says he used to warn aleksandr khutsishvili about trying to defend other people. he says khutsishvili went by the nickname sasha... and was a twice-divorced father of three who became a u-s citizen in 2004. he as a longshoreman in california before moving to las vegas several years ago. the suspected gunman in the shooting - pedro garcia - is expected to plead not guilty in court friday. a fire today... at a strip mall in the east valley. clark county firefighters arrived shortly after noon... to find smoke rising from the shopping plaza - near tropicana and nellis. crews forced entry into the "u-s dental group" suite... where flames were extinguished. investigators say

there were no injuries. the cause of the fire is under investigation. a medical helicopter crash-landed in oklahoma this morning. it happened outside the comanche county memorial hospital in lawton this morning. hospital officials say the pilot was able to put the chopper down safely near a street. there were four people on board at the time, all of them crew members. three are set to be released from the hospital and a fourth is being assessed. it was a survival flight helicopter - which had just started with the hospital this week. witnesses say the chopper was landing at the hospital and may have lost power. a huge emergency response in hoboken, new jersey today - after a transit train slammed into a platform. so far one person is dead, we are now learning that person was a woman standing on the platform - who was hit by debris. however most of the 108 people injured were onboard the train it's still unclear why the train was moving too fast when it approached the station. " the devastating pictures show the aftermath of a massive crash at a busy rush hour train station in jersey, just outside of new york city. the passenger train slammed into the station, killing one person who was standing at the platform. the crash occured around 8:45 am eastern time this morning. part of the roof of the terminal appears to have collapsed. the ntsb is sending teams to the scene... and will look at all possible factors. thanks for joining us for your only local news at 5:30. let's get you up to date with the latest local headlines. a shootout in kingman arizona - ends with one man dead and a police officer shot. it happened while police were trying to execute a search warrant. police say the officer who was shot was taken to a hospital, underwent surgery and is in serious but stable condition tonight. they also identified the man who was killed as 53 year old jeffery clair cave he was pronounced dead here at the scene. police tell us the shootout started at 9:30 a-m... when police came to a home to search for stolen property. they say cave shot at the officers hitting one of them. they returned fire - and cave was shot and killed. this investigation is being handled by bullhead city since it is an officer involved shooting.
