continuing coverage- charges are filed after a deadly crash in clermont. authorities say 38-year-old james tackett may have been drinking when he lost control of his car, smashing into this business with a 5 year old little girl in his backseat. he died at the scene- the young girl was taken to a hospital but should be okay. now the mother of the little girl - 27 year old hilary upton - is facing child endangerment charges. why? well the fayette county sheriff says tackett was a registered sex offender-who did not register with the sheriff's office - and upton knew, but still let her daughter be alone with tackett. wl's lauren moss has been looking into this for the last

speaking with sheriff fisher..she joins us now live with the latest. sheriff fisher tells me tackett was convicted of third degree rape back in 2007 in the state of washington. as a convted sex offender, he cannot watch any children- and ininestigators y his girlfriend was well awwre of that- but as we know, he was alone with upton's 5 year old little girl..who was in the back seat during that awful accident. the last time tackett registered was in 2013 in oelwein, but every time he moves, he needs to check in. investigators say he lived with upton and her children since november, but never registered saying he moved to clermont.. they say the night of the accident, he was running errands with the little girl. deputies believe alcohol and speeding were factors in this crash. tackett died on scene. meanwhile, the little girl is okay..however fisher says she should have never been a part of this accident..and she should have never been alone with him. marty fisher- fayette county sheriff "we are always concerned about children who are involved
