this all stemming from the iowa hot lotto fraud case - - involving eddie tipton. the suit says tipton's fraud is the reason dawson didn't get all of his prize. this video - - showing eddie tipton buying a lotto ticket - - in december of 2010. at the time - tipton was an iowa lottery security lotto machine to rig a winning ticket. flash forward to may 2011 - - larry dawson was the next hot lotto winner. dawson's jackpot - a six million dollar cash value. but his lawyers alleging in this 24 page document - - it should have been a cash value of 16 million. (voice of jerry crawford, attorney) "the lottery executive's rigged numbers were drawn and he won a jackpot of cash value of 10 lottery rules there was no winner because the game was rigged." because there was technically no winner in the december drawing - - the lawsuit claims that money

been in the jackpot in may when dawson won. but the iowa lottery says differently (terry rich, iowa lottery ceo) "the iowa lottery believes that we rightfully paid mr. dawson the jackpot that was advertised and that he was entitled to. of course and in all of this, it's our strong belief to protect the integrity and every lottery player in this state of iowa and will defend this litigation." dawson's lawyers say they have been working on this petition for quite awhile. we've got you covered live in the newsroom . . .jessica hartman kwwl news. dawson is asking for 10 million interest. a very cold night ahead -- let's go to storm track seven chief meteorologist mark schnackenberg

this morning -- as mark mentioned. people getting out their snow blowers and shovels to clear up their driveways and sidewalks after the second batch of snow. take a look at this go-pro video we shot in waterloo today. you can see the road was covered with snow and slush- causing quite a few accidents in black hawk county. crews say plows were being slowed down because of how heavy the snow was. and those people out there lloyd dove- cedar falls "yesterday's snow was like chunks you had ice chunks really heavy." andrew vanpatten- cedar falls "this snow..it's very heavy, it's def. more dense than any snow i have shoveled." the weather also causing some power es in eastern iowa earlier winds and ice overnight.

continuing coverage -- a former iowa correctional officer who smuggled contraband for prisoners and illegally used drugs while on duty is sentenced to more than four years in prison. 29-year-old garrett barton, of anamosa, pleading guilty to multiple charges. barton admitting in a plea agreement to accepting money from an inmate to smuggle two cell phones for inmates to use at the anamosa state penitentiary. he also sold and traded drugs with other correctional officers. along with 57 months in prison, barton was fined $7,500. one person is taken to the hospital after a stabbing. waterloo police responding to the home in the 500 block of reihl street earlier tonight. no word on the victim's condition or what led to the incident. a local embattled superintendent will be with a new school district next year. greg herbst, long time superintendent at east dubuque schools in illinois, accepted a job to take over the same

district. herbst was placed on administrative leave last year after a principal lodged a complaint against him--the school board refusing to release details at the time. kwwl's brad hanson spoke with herbst, as well as got reaction from a couple others tonight. brad joins us live from the t-h media newsroom in dubuque with the latest. herbst was one of three finalists for this position--out of an original field of two dozen candidates. tonight he tells me it'll be hard to leave the community he's worked in for so long, but he's excited for what lay ahead. the days of seeing greg herbst in his office here are position just down the road in galena. (greg herbst, galena superintendent) "it's always fun to take on new opportunities and new challenges. and from what i and i really like history. the district is one to be admired." the announcement coming less than a year after he by the school board. "certainly there are more things that attracted me to galena than

summer. but i'd be dishonest if i said it wasn't a factor. it certainly was. at the time, hundreds rallied to support herbst in what they say was an unfair situation. this announcement a bittersweet moment for many of those supporters. one of the two convicted killers who escaped from a maximum security prison in new york -- apologetic during his sentencing today. david sweat appearing in the new york courtoom. he and richard matt's escape led to a three-week manhunt. matt was eventually shot and killed by officers and sweat was found two days later. sweat is already serving a life sentence for a murder of a sheriff's deputy in 2002. he says he's sorry for the fear he spread during his escape. a car ends up on the roof of a garage after a crash. take a look at the car here near los angeles. fire crews pulling one person from the car -- who was taken to an area trauma center. crews aren't exactly sure how
