filled limo means there is no avoiding spotlight for 35 year-old kevin roper. early saturday morning he slam a wal-mart tractor trailer in the limo bus on the new jersey turnpike. critically injuring several people, including actor tracie morgan and killing fellow comedian james mcnair. roper is accused of driving sleep deprived. authorities say roper failed to low for traffic and tried to swerve at last minute to avoid a crash but instead rig slammed in the back of morgan's limo. under new jersey law driver can be quick if there is proof he has been with the sleep for four hours when the accident occurred. >> kevin roper is being charged with one count of vehicular homicide, he is additionally being charge with assault by auto. >> reporter: roper pleaded not guilty to sleek lar homicide and assault by auto and released on $50,000 bail. have after court he and his lawyers were swarmed, looking for their ride but they never stopped to answer questions. >> i check with tracie more

as we take a look to the south, we will see showers and thunderstorms, even tornado watches in effect and tornado warning in bed forward county, pennsylvania well to the west of us. we are seeing all this lifting to the north tonight and by the time it makes it into lancaster county, berks county, lehigh valley, it will be light showers. that is good news. as we take a look at our future weather during late night hours, perhaps the scattered showers, sprinkle will, heavier rain well to the west, very, light rain, even as you head to the poconos, during overnight. coming up we will track those storms because that warm humid air does come back tomorrow or friday but that means our flooding threat will return. also have to look ahead to fathers day weekend and we do expect brightening skies. for now chris, back to you. well, tonight there are calls for defibrillators to be placed in all schools after a close call in burlington county. student collapses, teachers come to her rescue. there was a medical emergency

at burlington township middle school where "eyewitness news" reporter syma chowdhry is live tonight with the story, syma. >> reporter: well, chris there was scary moments at the the middle school this morning after a student collapsed in gym class. the school officials say a medical device, and cpr trained staff are responsible for saving that girl's life. >> put in an applied pads report report this aed device in the trained staff use it are being credited for saving a young girl's life, a burlington township middle school student collapsed during gym class wednesday morning, faculty members performed cpr and used this device. >> i have no doubt that there was no defribillator and in trained personnel, the outcome would not have been as good as it is today. >> reporter: school has 2aed devices in the building. this is first time it was used in the district. school officials trained with the locally mergecy squad for past few years, to prepare staff in case of an emergency.

>> we have trained various members of our operational staff including transportation staff, food services staff, administrators and, most of our coaches, all coaches in the district and most of our physical education teacher. >> reporter: school staff can volunteer in the summer, so far 140 faculty members have signed up. >> every school district should have these, it is a cool with the thing that every school needs to have in their possession. >> reporter: that is exactly what will happen this fall across new jersey. >> as of september 1st, 2014, so later on this year it will be a requirement that all schools have an aed, cpr response team, the law commonly referred to as janet's law, however, burlington township school was ready to day. >> reporter: as for the student she was taken to the hospital, officials say she is alert and responsible. we're live from burlington township syma chowdhry for cbs-3 "eyewitness news". well, tonight police continue their investigation

into how a first grade's inquired heroin that she brought inside a west philadelphia school. "eyewitness news" reporter walt hunter has new information live at southwest detectives where that girls mother and mother's boyfriend are being questioned tonight, walt. >> reporter: chris, right now mother, the boyfriend awaiting a decision by district attorney's office on whether or not they will face any criminal charges. meanwhile investigators tell me that the little girl not only didn't know what heroin was she had no idea it was in our pockets. when she found them she took them out and began playing with them. on the day after 20 students from the barry elementary school were taken to children's hospital to be check out as a precaution, when a first grader brought 11 packets of heroin to her class, parents of students, heading to school were still deeply shaken. >> that is ridiculous, dangerous. some kids could have died. >> it is disturbing.

i sent my kids to school and expect them to be safe and i have to worry about this and it is in the true. >> can you tell us what happened. >> reporter: girls mother, seen leaving the school with officers, remains in police custody. police awaiting word from the district attorney's office, on whether or not any criminal charges will be filed against the girls mother, three two-year old marie hunter, or her male companion 28 year-old christopher troy jenkins white. police say a search of the home where the little girl lived, found 18 packets of marijuana stuffed in the jacket pocket. police say that the little girl, found the 11 heroin packets, inside her pockets, and not realizing what they were, began playing with them, on her desk in class. police credit a very alert teacher with spotting the packets, seizing them and protecting the children.

investigators hearsay they are reinterviewing both little girl and three of her siblings as they gather more information leading to a decision on whether or not charges will be filed. live from southwest detectives division i'm walt hunter, cbs-3 "eyewitness news". walt, thanks very much. quick moving house fire seriously injured two people in north philadelphia earlier today. this happened in the 1700 block of north 21st street and started just before 7:00 o'clock. fire fighters pulled a 50 year-old woman and 35 year-old man from this house, we are told man suffered burns to half his body. there is still no word on what caused the blaze. well, police are searching for a suspect robbed a deli in philadelphia's roxborough neighborhood. yesterday afternoon that suspect had a hand gun went inside m and m deli on markell street. he stole money from the clerk and register and then began punching the worker who had triggered the the the silent alarm. suspect got off with $1,500 in

cash and merchandise, the clerk was treated and released after suffering a broken bone. philadelphia city council is stepping up to help catch strapped philadelphia school district pay its bills. today finance committee proved a plan to bureau 27 million-dollar to help district pay its bills by the end of this month. the original plan was for the city to bureau about 20 million-dollar. but with the sale of school buildings, still unresolved, school superintendent doctor william hite says he need the extra money. >> we are facing, 800 some layoffs of teachers, class sizes of 40 and so what we're pleading with council to consider is increase borrowing amount. >> reporter: full city council will vote on the 27 million-dollar request on june june 9 event. protests by philadelphia high school students who walk out of class, to will rally for more money. today they marched from school district headquarters to the center city office of tom

corbett. students say that budget cuts have have stripped their schools, of many basic services, they are asking governor to close tax loop holes to help fun education. the son of the late philanthropist lewis katz has withdrawn his plan to buy the philadelphia inquirer, daily news and philly.com. drew katz says that the turmoil following his father's death prompted that decision. on may 31st, lewis katz and six others died in the plane crash outside of boston. just four days before that katz and partner jerry lenfest had purchased the newspaper group for 88 million-dollar. well, there is much more ahead tonight here on "eyewitness news" including a montgomery county woman about to embark, on the 250-mile an hour hike. she's doing this for two young boys fighting a a rare disease. the goal, she's hoping to reach as she hikes for hope. plus do you ever just crave one more bite? there is a brand new study that looks in the psychology

memory plays a role in how much you eat. researchers have found it is the the last bite that makes people go back for more. they also found that the smaller your portion, the more enjoyment you get for food. well, after a couple stormy days, we did get a bit of the break from downpours and flash floods today but we are far from out of the woods. we have live, team three weather coverage tonight with meteorologist kathy orr and justin drabick. we will start with justin live on penns landing tracking current conditions with the mobile weather lab, justin. >> good evening, chris. that is right, it is not feeling like summer here we are in june, it is cool right along the the river but we are starting to get in the summer theme in penns landing. something cool is happening. construction underway for a new park called spruce street harbor park with a beach theme with it. check out this crane which is beginning stages of building

this park. they will help anchor down three floating barges in the river with a restaurant, bar real cool place to hang out and back where i'm standing there is a boardwalk built as well that will have arcade and things like. that just like at the shore. like i said not feeling like summer now but it will. check out our current conditions. this tells us how much moisture humidity in the atmosphere. to point of 60 degrees. tomorrow, different story, we will crank up dew points backup to 68. so what does that mean. it will feel very humid. it will have that oppressive feel. we will get back in that summer-like weather which is actually probably some good news for folks planning to come down here as this park does open up on june 27th here on penns landing. it is cool. check it out in a few weeks. live with the mobile weather lab, it is a cool 68 degrees with the easterly wind but that will shift, bring in the heat and more shower and storms. for rest of the forecast back inside to kathy.

>> yes, that higher dew point definitely in the a welcome change to our weather forecast. as we look live at sky cam three here in the center city studios skies are brightening somewhat but we will stay mostly cloudy right in the late night hours and temperatures in the changing all that much. down the shore, everybody is walking the boards, this is north even, of course with the rides and amusements in the background but we have coats on, people have their pants on, certainly doesn't feel like mid-june but we will be feeling like mid-june over the next couple of days and you can see our camera shaking with those strong easterly wind. storm scan three we are looking at showers and storms well to the southwest through baltimore and washington. all this lifting north through hageers town and williamsport. we can see a few spotty showers overnight but that easterly win will protect us, bringing us clouds and cooler temperatures mainly in the 60's and we will stay there overnight. heat is to the south and to the west and in the 80's and that is what we will be seeing

come tomorrow until further notice. it will stay warm and sticky. during the day on thursday we will see warm front approaching from the south. temperatures in the 80's with higher humidity, showers and thunderstorms. more numerous showers and storms as this approaches from the west and i think concerns for flooding will grow during the day on friday about heat, a lot of humidity and that front is a lifting mechanism to set off showers and thunderstorms. we have high pressure build in and flow around it is clockwise, we will get more northwesterly flow so air comes from canada, midwest, dryer air will bring in more comfortable conditions and easier to breathe with lower humidity and temperatures still comfortable in the 80's. overnight tonight temperatures staying in the mid 60's with a few showers, scattered showers and storms developing, thursday afternoon, down the shore, scattered showers or storm possible with highs in the 70's, staying in the 70's friday but bet chance ovulate day or early evening storms on friday. look the at the weekend? on the eyewitness weather

expressway heading in to south philadelphia for phillies game. traveling vine street westbound jammed entire length. traveling on the schuylkill your average speed is 16. twenty-three on 476 southbound and 20 on i-95. high volume through construction zones. lincoln drive southbound at johnson street police are directing traffic there and beginning tonight new traffic patterns will be in place on the northbound side of 95, this is through girard, allegheny maybe delaware avenue is a good idea heading from the phillies game or heading out of the phillies game. traveling from philadelphia international airport we have 30 minute delays. broad street line looks great heading down to the game. >> vittoria, thanks very much.
