victim a local doctor. the suspect puts his hands around the woman's waist. investigators say, she was then threatened, forced into her apartment, where she was row pete educationally raped. the suspect then made off with her keys and cell phone. yesterday, police questioned four men in the case, all live in a house on eighth and moore streets. police sources say they released three of the men, but have since charged the fourth who they pick up at broad and christian, where the suspect works. detectives also confiscated the man's bike. >> police tell us they do plan to release that suspect's name, once commissioner ramsey has been notified later this morning. that's the latest outside of special victims unit. jen bernstein, cbs-3, "eyewitness news". >> jen, thank you. also, this is new this morning. a 18 year old is in critical condition after shooting in north philadelphia. the victim was shot six times on the 400 block of glenwood avenue. he then ran over to, any street where he collapsed. police say hi powered assault rifle was found near the

victim. they're interviewing witnesses and looking at surveillance video at this hour, shooter remains at large. >> meanwhile, no charges are expected against a store own here shot and killed a man that tried to rob her at knife point. it happened yesterday, at a health food store, in the 7100 block of frankford avenue in philadelphia's mayfair neighborhood. police say the store owner is a former police offer -- officer. >> looking more like a horror movie, a steam pipe burst. near the convention center last night, as steam filled the air. remember the fog and the mist that fell? well, liver at the scene right now, that area remains closed to traffic although it appears the pipe has been capped. there is no word on what cause that pipe to burst. no one was injured. coming up on a 03:00, our traffic and weather together. katie, how are we looking today? >> not bad. end up with decent day, nice summer day un folding for us locally, we can expect to see sunshine, couple of clouds as

relationship with a 14 year old student. the judge should decided to if there is enough evidence to put amato on trial. also due in court, three men charged in the deadly stabbing outside kensington restaurant. mendoza, louise, and ramon, face murder charges. this in the death of 31 year oldies a bell hernandez outside passion restaurant on g street near allegheny last month. >> parents and student fighting for funding for philadelphia schools will head to harrisburg today. they will rally outside the state capitol building, to encourage law makers to let the city add a 2-dollar tax on each pack of cigarettes sold in the city. the money from that would help fill the $216 million hole in the district's budget. well, we should learn more today about what caused a crash of asian airlines 213 in san francisco last summer. ntsb will release now report detailing probable cause. three people were killed, when the boeing 777 hit the see see wall at the end after runway

new is morning, chaotic scene in southern california, rounds -- rowdy mexican soccer fans took to the streets to celebrate their country's win over croatia in the world cup. those fans blocked traffic and shot fireworks in the streets. police arrested four of those fans, with a win mexico advances to the next rounds of the tournament. a jogger out for routine run in houston made a miraculous discovery when stumbled upon missing baby. han was on her morning jog, found eight month olds girl in a carseat all alone in a field. here's what police say

happened to her. the baby was sleeping in the back of her mother's car when the car was stolen. she said she normally doesn't run in that area, but her decision to do so likely saved that girl's life. >> i was watching -- god was watching over this child. even though the witness had found the child, for some reason she decided to turn left, as she was jogging north over here on melon. for some reason, she said she decided to turn this way. >> just amazing. the girl was treated for some and the bites, but otherwise, told she is doing just fine. we have some breaking news at the top of our headlines right now, philadelphia police have charged a man in the rape after 26 year old woman saturday morning, in her rittenhouse square apartment. we have details in a live report just minutes from now. and 18 year old male is in the hospital after he was shot six times in fair hills just after midnight. next to the victim police say they found an assault rifle. >> and a lot of eyes are on us secretary of state john kerrey

if you are going up to the poconos, however, you have got a decent shot of it, just isolated shower if not thunderstorm, the rest of us will stay just again warm, muggy, with a couple of clouds, getting in on the sunshine otherwise, very similar sky cover to what we saw yesterday. mostly cloudy, tonight, a lot of air conditioner probably hum withing this forecast, 07 degrees for the nighttime low. will definitely start to feel muggy, too. so somewhat uncomfortable, unfortunately, for those that have to go without an air conditioner orphan, hopefully you have one or the other. meanwhile next couple every days mid to upper 80s, generally across the board, 86 the magic number for most of the forecast. tomorrow though we start to see our next cold front moving in. and more than anything, since we're building up moisture content in the atmosphere, some of the showers and storms could easily produce heavy rainfall, at this point, does not appear that any storms would turn locally severe. we'll definitely keep our eye on that, bob, we send it into you. >> 5:14,. >> pretty good start. a loft bridge openings this morning. first, we go outside to the

"eyewitness news" reporter todd quinones has more on the hunt for this he will lewes i have bear. >> the people here at first thought it might have been a large dog, but, as the animal got closer to the playground here, everyone realized he was a bear, and some people even got out their cell phones. this was a black bear, that gave dad and trenton police officer, lenny, a bit of a scare monday afternoon. >> i tell everyone stay here, there is a bear, there is a bear. of course everyone looks at me like i have three heads when i say a bear. >> he was playing with his son just before 4:00. people in the pool also saw the bear. >> have you ever seen a black bear before? >> just in the zoo. never out in the wild. >> we like locked the doors, got the kids back in here. >> worried about the kids in the playgrounds, he pick up one of these chairs, lifted it up over his head, got within about 50 feet of the bear, and told the kids to get behind the fence. >> start go away, bear, go away, bear. and he kind of grunted at me. i flung the chair.

ross all the way in through center city philadelphia. burlington bristol traffic stopped on both sides, for an opening, that's the second one there, this morning. and a crash down in delaware, airport road, at route 273, to look out for, and crews are still working on the pennsylvania turnpike right near the ft. washington interchange. and the new construction project began yesterday, along route 100, watch for delays during the midday, both directions right near route 113, no problems coming in from new jersey, and mass transit looking good with no delays. here's ukee now with a look at sports. phillies began their home stands with a celebration but the mood soared as soon as the game against the marlins started. before the game the phils honored jimmy rollins, j-roll, from becoming the team's all time hits leader. good vibrations did not last, though. the marlins scored twice in the first inning. then held the phillies off the board, the rest of the way. the marlins win, four-nothing, and the two teams will go at it again, later tonight.

well, good news this morning, for the phillies chase utley, holds commanding lead over the other second baseman in the national league when it comes to getting all-star game votes. chase has 700,000 more votes, next closest competitor near walker of the pirates. all-star game july 15th in minneapolis. well, the flyers are using the summer to retool the team for next season. new gm ronnie hextall is making his mark. long time flyers scotty hartnel on his way to the columbus blue jackets, traded yesterday, for former flyer, r.j. umberger, both the 32 years old, but this deal is more about salary relief. umberger scored 18 goals for columbus last season. well, after make that trade, forum burger, hextall gave center a new contract extension worth report, and last, had career high goals in assists, came over in the trade that sent former captain mike richards to los angeles. erika, back over to you. >> we have breaking news coming up at 530:67:89 our jen

>> reporter: good morning, police sources do tell us they've made arrest overnight, a 28 year old man, was charged with rape as every right now. >> police are not yet releasing the suspect's name. >> the police brought in four men. police sources tell us they've released three of the men, since charged a fourth. but they pick him up at christian where he works. they also confiscated the man's bike. last few days, investigators working around the clock to figure out who physically and sexually assault add 26 year old woman, inside her center city apartment, saturday morning. now, it happened on the 1900 block of spruce street. police say man locked his bike on the block, then approached the victim who was a local doctor. the victim told police, she was threatened, and forced into her apartment, where she was repeatedly raped. the suspect took her cell phone and keys. police sources tell us, they do plan to release the
