continuing, but police say they believe the suspect here fired first. >> half inch over, bit more, and we would be planning a funeral now. >> philadelphia police commissioner, charles ramsey, says the department is very fortunate this morning, that one of their own is alive, after an exchange of gunfire in the talcony section of the city. >> he suffered a graze wounds to the left side of his head, very, very fortunate that he was not injured any more seriously. >> authorities say, around 12:45, officer steve, and his partner, respond today radio call, for a man with a gun on the 6400 block of ditman street. >> they saw the male at magee and torresdale. they went to stop the male. immediately the male fired upon them striking officer, left side every his head. >> he and three other officers returned fire, striking the 40 year old suspect. the man's gun was recovered at the scene, and he was pronounced dead around 1:30. when medics arrived, officer was sitting up and talking. neighbors say gunfire is

with the vicious attack on a park ranger caught on camera. but they are still looking for at least one more person. nineteen year old curtis tanner and 17 year old are now charged with aggravated assault, making terroristic threats, and recklessly endangering another person. this vicious beating here was caught on camera friday afternoon in center city's love park. police say the attack happened after the ranger approached several skateboarders telling them they could not skate there in the park. "eyewitness news" talked to a skateboarder who also says a -- also a park and recreation worker. >> this is somebody that i would be working with, these guys keep these places clean, these guys keep these places safe. >> the ranger is out of the hospital. police want anyone who knows about the third person seen in this video to please come forward. it is coming up on 5:03. traffic and weather together. good morning, katie. >> hey, natasha, good morning, everybody, i know still pretty comfortable outside right now, not terribly muggy in the city of philadelphia.

but, we have eaked out couple of additional degrees since this same time yesterday. and depending where you are, the humidity hasn't really start today creep up on you yet. but it will. in the meantime, we've been coasting here, below average, we talk about the temperatures as every late, now, in this particular day of august, we should be at about 85 degrees. we haven't even necessarily had a chance to even flirt with that in recent days here. but i do think we will be little more seasonable today and tomorrow, and we're also going to start to notice that humidity like i mention. here's y storm scan3, quiet for the moment. see the thin vale of clouds off to the south? that's actually the northern most edge of a disturbance to our south. so, some of that disturbance's moisture is being fed our way, as a result of that, it is going to help creep up with the humidity. so currently, we're at 68 degrees at the airport, 55 by comparison in allentown, so with the system to the south, where it is a little cooler, also little less humid. you got clearer sky.

sixty-four, live neighborhood network, one loan car passes by outside whitt fields elementary school in west lawn, pennsylvania, very light wind expected out there today. overall, it is not a bad day at the shore you're going to have more of on shore flow to make it more of cool breeze to you. but really decent day if you are going to the beach, and overall, decent day just in general. dow think the far west suburbs, have a shot for a shower, but that's it. otherwise, you have got another nice day to enjoy. bob, we send it into you. >> sounds great. 5:04, good morning, everyone, we begin with local detour in northeast philadelphia, all surrounding our top stories this morning, let's go outside, live look at the police activity blocking torresdale avenue, in northeast philadelphia, you can see in the background here, those little yellow triangles, as police investigate. this is actually where they pick up the bullet casings, and this is at torresdale and magee in northeast philadelphia. so you can see, with the police presence here, at least through the first half of our morning rush hour, and until they finish the investigation, torresdale avenue will be

closed. so your best bet, through the neighborhood, yep, you have all of those secondary roads, the side streets, the gang from the northeast, you know which ones i am talking about, ditman, walker, keystone, but for the most part your best bet stay with frankford avenue. so torresdale closed from levick, over to princeton, frandford's the way to go, and that's going to impact the 56 bus. the route 56 bus runs along torresdale avenue, and we are waiting for word from septa as to exactly what that route will be for at least the morning rush hour. live look, the schuylkill expressway, common into downtown, no problems at all here near the roosevelt boulevard. the roads are dry, and overnight crews still with us on the pennsylvania turnpike at ft. washington, otherwise, mass transit looking good. erika, back over to you. >> bob, thank you. following breaking news right now, smoke from tear gas fills the air once again as protesters continue to clash with police in ferguson. authorities say they faced outburst from angry crowds, for throwing rocks, bottles, even molotov cocktails. correspondent andrew spencer has more now on the overnight

developments. the national guard now on hand in ferguson missouri police did not try to enforce any kind of curfew overnight. instead, they formed lines of law enforcement ready to responds to violent outbursts. even as members of the community urged for calm, a bottle is thrown, just over 11:00 p.m., and police swarm to arrest a man in front of the crowd of protesters. elsewhere, a protester holds the line with a ripped out street sign. do not enter. but as more flare ups prompted more arrests, and with reports of people being shot, police started moving forward, launching smoke and stun grenades, and in some gas.# ne ukd to disperse immediately or you will be subject to arrest. do it now. >> it wasn't long before police started moving everyone. >> officer, what's going on? >> clearing out this area, not safe to be here any more. >> okay, you are moving the protester or the media or -- >> everybody.

>> a mid mostly peaceful protests episodes of violence are taking a toll on the commune. >> i captain stressed demonstrators monday night. >> listen, i want you to look back at other communities where we've had riots throughout this country, and these communities aren't being rebuilt. >> this beauty supply store, looted twice in the last week, is among the businesses which will be boarded up for good. andrew spencer, cbs-3, "eyewitness news". well, a nine year old boy is recovering this morning after he's hit by a driver in a pretty bizarre accident. it happened on elkart street in philadelphia's kensington neighborhood last night. we're told that the driver of this pick-up truck then took off with the boy, much to the shock of eyewitnesses on that street. a friend of the boy's mother spoke to "eyewitness news". >> mom said like she appreciated everybody's prayers, and julio was in stable condition, and they expect a full recovery. >> police say the driver did flag down some officers. they took the boy to the

hospital. there is no word on if the man is going to face any charges. it is sentencing day for a former philadelphia city council secretary, caught stealing social security checks. nancy gonzalez will learn her punishment for stealing almost $25,000 worth of money from the government. gonzalez took the checks from an elderly woman she was taking care of. you can get ready to see plenty of students roaming around broad street today. temple students will start moving in to campus dorms this morning. freshman owls can begin unloading all of their belongings, and in just a few hours, starting at 8:00 a.m. move in for a new students runs through thursday. >> oh, move-in day. >> i know, those times. >> trying to hide the microwave behind the bed somewhere. >> exactly. fitting everything in there. >> 5:08 right now. we are continuing to follow breaking news, a philadelphia police officer shot in the head overnight. we have an update on his condition coming up next. plus: i'm surprised and kind of scared at the same time, you know?

>> scene near magee in talcony, still pros egg this scene. suspect shot officer steven, grazing him in the head. officers returned fire, killing the suspect. once again, officer is in stable condition, and is expected to be okay. well, you know, we should learn more today about two teenage boys who allegedly planned a mass school shooting in california. investigators say, the teens intend today kill three staff members, at south pasadena high school. and as many students as possible. administrators tipped off police, after learning about the threat, police say the two did not have weapons, but were trying to get them. ten people are rushed to the hospital including several children, after this suv plows into southern california restaurant, here, let's play this video. suv finally stopped halfway inside the little ceasar's

>> that nettle gets me every time. i have to check my prescription bottle and make sure it takes care of nettle on my allergy meds. 5:14, the scene of the police shooting this morning that we've been telling but all morning long, the scene, torresdale and magee, there is the intersection here with all of the police activity, and they have about three blocks on either side here, blocked, in northeast philadelphia. so, here's the deal. torresdale avenue, closed this morning, between levick, up to princeton, now, if you are in the neighborhood, you know the local streets, sometimes cottage can get you across, keystone, or walker. your best bet is stay with frankford avenue. so, frandford avenue, runs parallel here to torresdale. and that's the way to go. however, torresdale avenue is also the route for the 56 bus. so i just talk to septa. anyone going eastbound, the bus also gun levick, to frankford, and back down nor if you are coming the opposite way, will use nor to frankford, and back down.

>> breaking right flu, a philadelphia police officer is lucky to survive a shoot-out with suspects on the streets of talcony. the officer is in the hospital this morning, after getting shot in the head. that shoot-out ended with suspect dying. "eyewitness news" reporter cleve bryan; live at einstein medical center, with the latest on his condition. cleve? >> reporter: good morning, i just checked in with the hospital. they say that officer has been admitted. he went in through the emergency room this morning, with a deep graze wound to the head. but officials tell us, they believe he will be okay. now, all this started around 12:45 this morning, officer and his partner, were responding to a call for a man
