with a deep graze wound to the head. but officials tell us, they believe he will be okay. now, all this started around 12:45 this morning officer and his partner were responding to a call for a man with a gun on the 6400 block of ditman street. they saw the maenades joined as heavy set man wearing orange shirt near the intersection of magee and torresdale, when they tried to stop him the man immediately fired at police, striking the officer in the left side of the head. he and three other officers returned fire, striking the 40 year old suspect. the man's gun was recovered at the scene, and he was pronounced dead around 1:30, whether medics arrived they found the officer sitting up and talking. commissioner charles ramsey believes that the department is very fortunate that no officers were killed. >> it is something that, unfortunately, does happen periodically. we have pretty brazen criminals, and our officers, that's what we do. we send them in harms way. we put them in the tough et cetera areas to go after the people, causing a lot of harm out here in our community. live look at the scene

this is an ongoing investigation. the name of the suspect has not yet been released. internal affairs as well as the district attorney's office will look into this officer-involved shooting, more about the officer, 14 year veteran of the force we understand his wife got chance to see him this morning and they've a new three week old baby. live at einstein medical center. cleve bryan cbs-3 "eyewitness news". all right, cleve, thank you so much. well, there is also more breaking news that we're following for you today. philadelphia police were forced to shoot at a dog charging toward them. "eyewitness news" on the scene in north philadelphia. officials say about 2:30 this morning, a pitbull charged toward the officers on the 3400 block of north sixth street. no injuries were reported. it is not clear if the dog was struck. jurors will hear some graphic details about a five year old girl kidnapped from her west philadelphia school. opening statements in christina's trial are set for thursday after lawyers pick a jury yesterday.

avenue closed through at least the morning rush hour. so at torresdale closed between levick and princeton your best bet would be frankford avenue and the route 56 buses on detour, they're using levick over to frankford, down to nor. if you are coming the opposite way, bus also go up nor cross frankford, and back down robbins. so head for frankford avenue as your best bet whether you are in the car or you're going to be looking for the 56 bus through the morning rush hour. now, we had some problems last night on the way home with amtrak. everything is back to normal on the northeast corridor this morning. and both directions on the northeast extension watch for delays between quakertown and lansdale. and late running work crew there. otherwise, we're in good shape on the bridges. natasha, back over to you. >> bob, thank you so much. breaking news, an evening of peaceful protests spiraled into another tense night of confrontations in ferguson, missouri. officers used tear gas to break up large clouds through rocks and molotov cocktails. cbs news correspondent susan macinnis on the grounds in

ferguson with conditions right now. >> reporter: protesters remain on the road in ferguson, missouri overnight even as police fire tear gas and flash grenades in their direction. officers in riot gear formed a line several officers deep, then moved in on demonstrators. arresting several who broke an order to keep moving. missouri state highway patrol captain ron johnson says those disrupting the community are from out of town. >> i've -- i'm not going to let the criminals that have come out here from across the country, or live in this community, to find this neighborhood and to fine what we're going to do to make it right. >> members of the learning have i been trying to restore order. >> we just want people to obey the law of the land. >> national guard units are now in the city protect if things get have been heightened since michael brown and unarmed black teenager was shot to death by a white police officer darren wilson, last week. and independent autopsy done by the brown family revealed he was shot six times

including twice in the head. witnesses have said brown had his arms up and was surrendering at the time. but a forensic expert who worked on the autopsy said monday that's still inconclusive. so, things are calm here as of this morning. we're at a police commands center where you find the national guard troops, troops did not go to the protest seen. zone. we there, media got moved here. as of now everyone just wouldn't earl, natasha same scenario will repeat itself yet again day ten after the shooting peaceful protests early in the evening erupting into violence at night. >> yes, it does seem to be the pattern here. so susan what do we know so far about the attorney general's plan to visit ferguson? >> reporter: the attorney general eric holder coming here tomorrow. he is planning to meet with f.b.i. agents here, and other officials, you know, there is an investigation going on with the federal level as well as at the state level. so he is involved with. that will we do know grand jury could hear testimony as early as tomorrow, as well, that could help determine
