5:02 am
normally, the shooter fleas immediately after firing the weapon, but in this case, the 56 year old shooter remained on location, turned the weapon over to police, and voluntarily came with us to homicide. >> reporter: police believe the shooter interrupted the burglary of his pick up truck and shot the suspected thief. if that's the case, authorities will have to decide if he's protected under pennsylvania law, in 2011 lawmakers said it is okay to use deadly force to protect yourself from an attacker, but not necessarily property. detectives worked throughout the night gathering evidence. >> fortunately, there were several cameras, on both sides of the driveway that are operational or unknown at this time if they recorded the shooting. >> reporter: so far, we don't have any information about the victim in this case. we know they are holding the truck owner and they're going to confer with the district attorney's office to see if any charges will be filed.
