why he committed the act, what's unclear is whether or not this was legal. just after 10:00 o'clock, officers from the 15th district responds today a report after person shot in the rear driveway of a property on the 4500 block of torresdale avenue. they arrived to find a 30 year old man lying near a pick-up truck, and a garage door, with at least one bullet wound in the head. soon pronounced dead at the scene. police say the man re complains at the scene and handed over his gun. at this point, they believe the shooter interrupt add burglary of his truck, but authorities can't say whether the man had acted within his legal rights. >> usually the shooter fleas after firing a weapon n this case the 56 year old shooter remained on location, turned the weapon over to police, and voluntarily came with us to homicide. they do have some surveillance

cameras in the area, they're not sure yet if there is usable video from that. they are holding the suspect until they are able to talk with the district attorney's offers, and we don't have any information yet on the shooting victim. we're live in the northeast, cleve bryan, cbs-3, "eyewitness news". thank you, cleve. also, breaking, police investigating overnight armed robbery at popular northeast philadelphia diner. it happened at the red robin diner, on the 6300 block of frankford avenue, in mayfair. police say two men, stormed into that diner, while they were still customers inside, at least one of the suspects was caring a gun. >> got away with some cash. no one hurt. >> rather surprising video, suspect caught on camera planting explosive device right there inside of chinese take out restaurant. even more disturbing the suspect appears to be in his early teens. it happened wednesday night, at the orient al kitchen, on north 18th street in the city's francisville neighborhood. amazingly no one was injured.

men may have had a gun. but, luckily, no one was injured. this is just heart breaking story. new jersey man charged with horrific case of animal abuse. he is accused every killing his dog at his toms river home using his car's exhaust. prosecutors say, 75 year old clifford robbins killed his dog mocha by stealing the pet's travel carriers, connect ago host to the exhaust of his car. the dog died back in april but robbins was just charged yesterday. that case has outraged people in the community, demanding justice for mocha. if convicted robbins faces to up five years in prison. well, you know, sorry, i just got distracted my horrible story. let's get over to katie, though, katie, i think -- >> we love when natasha is around, it means she can help bus ukee's streak here, he continues to win, but changing gears, talking weather tray trivia.
