girl from the west philadelphia elementary school and sexually assaulting her. "eyewitness news" reporter walt hunter is live at criminal justice center where he spoke with the victim's attorney, walt. >> reporter: in her opening argument the prosecutor here called this every parent's nightmare, what happens to this lit 58 year-old girl. the prosecutor said that while many children have nightmares about things going on beneath their bed and in their rooms, in this case, the monster under the bed was all too real. the prosecutor described accused attacker cristina regusters as the monster under the the bed, in her opening argument. jurors told that video would show her kidnapping a five-year old from the brian elementary school on january 4th 2013. keeping her prisoner under a bed in a nearby home, where blindfolded she was sexually violated for 19 hours, her injuries so severe, that they required surgery, and a colostomy. >> she had the most brutal,

horrible assault on her that you could imagine. >> reporter: attorney tom kline who represents the little girl and her family in the civil lawsuit was in court as the the prosecutor told jurors how the victim was eventually abandoned in an upper darby play ground when shivering in the darkness wearing only a t-shirt, during the ordeal, the blindfolded five-year old, prosecutors say, told by regusters it was someone else a man actually assaulting her. this is the man your mother sold you to, this is your new daddy. thinks the man that did terrible things to you. regusters attorney, questioned about the identifications in the video and from the alleged victim's statements telling jurors that the suspect herself was a victim of sexual assault. finally prosecutors told the jury that the little girl would appear in court, to testify against her allege attacker, face-to-face. >> i have absolutely no doubt that she will rise to the occasion when she is called to

confrontation with officer darren wilson. police say wilson opened fire, after brown thought was the officer and charged at him. witnesses say brown was shot while surrendering. marley hall for cbs-3 "eyewitness news". a solder has died after barricading herself in an army office and shooting herself in the head. this happened at fort lee, virginia earlier today. that facility there was locked down as a result. the unidentified woman is a sergeant first class who was in the army for 14 years and was stationed at fort lee for three. the gun man was not her service weapon. "eyewitness news" has exclusive video of the wrong way driver on the schuylkill expressway. take a look, the car was traveling west in the eastbound lanes this happened near south street earlier this morning. state troopers believed that driver got off at the next exit and thankfully no one was injured. a car crash in montgomery county claims life of one person and send another to the hospital. this happened just before

alarm for nation's leading pediatricians. american academy of pediatrics is recommending student in middle school and high school, start their day at 8:30 a.m. or later. >> the average adolescent is not getting the eight and a half to nine and a half hours of sleep that they typically need. >> reporter: studies show lack of sleep, in teens can lead to poor grades, obesity, depression, and drowsy driving accidents. more than 40 percent of the the nation's public high schools begin before 8:00 a.m., only 15 percent start at 8:30 or later. >> there is a solid body of research which now shows that delaying school start times, that is both middle and high school level, reverses the negative consequences. >> reporter: matt says between playing sports and studying it is hard to get to bed early. he thinks later school start will help him perform better. >> it would just help things out because i would be more focused. >> reporter: just like good diet and exercise

steve paterson is live at cooper university hospital where that man is being treated, steve. >> reporter: jessica, 23 year-old kevin tran has a licensing red to recovery. his family says he has just completed one of what is expect to be a half dozen surgeries. doctors are telling his family he could remain in the hospital, recovering for the next ten months. amid all of this they are calling for justice because they say they have none and they are hoping somebody right now watching can help. please, we know how are, please turn yourself in. >> reporter: mother's plea to the person who nearly killed her son hoping there is some guilt in the driver lacking the compassion to stop. >> do the right thing. >> reporter: police say 23 year-old kevin tran was walking home from his job at this pizza shop in sicklerville sunday night. sometime after ten he was walking on this well lit crosswalk near sicklerville and jarvis road when headlights came out of the darkness. she said her son is in bad

expressway we are not dealing with the great situation at all, multi vehicle accident with pedestrians on the roadway if you are traveling in the eastbound direction of the vine as you approach the broad street exit. it looks like it could have been maybe a couple fellows heading down to the phillies game but it is blocking left-hand lane. traveling on the eastbound side of the vine this is delays things back on the schuylkill expressway so trying to make your way to center city will be a problem. if you are heading in the westbound direction making your way towards broad street and schuylkill we have a gaper delay as well. you will net noisy mergecy teams on the scene just yet but we may need tow truck or two. we will update you on. that if you can a avoid vine street expressway. traveling on the pennsylvania turnpike watch out for heavy eastbound volume affecting the toll plaza as you try to make your way down toward 309 in willow grove. traveling from the westbound direction we also still have delays between area of bucks county and mid county tolls, 24 is your average on the schuylkill expect usual there, 19 on 476, dropping down to ten on i-95.

"eyewitness news" reporter cleve bryan is live, near the scene with the story, tonight, cleve. >> reporter: hi jessica. this plane as it was flying around was going over lots of homes and businesses and that pilot was able to put it down mostly here in a sports field. part of the tail does go into a neighbor's yard but we spoke to the eyewitness who says he is proud of the job that the pilots did, putting down that plane and avoiding a disaster. >> it didn't miss it by much. >> reporter: donald's house is 20 feet from where mosquito control helicopter came crashing down monday morning. >> all have of a sudden we heard this noise like the rotors hitting the trees. it sounded like somebody was cutting brush, with the big brush cutter. >> reporter: cape may county officials say crew on board was doing mosquito larvae inspections all over the salt marsh prior to the crash. they had taken off and landed a dozen times and were returning to base when pilot heard a bang and started losing altitude. he aimed for sports field
