seven. >> breaking news at 11:00 o'clock tonight. philadelphia police make an arrest after a vicious attack that spread fear throughout chinatown. good evening, i'm chris may. >> i'm jessica dean. let's get right to diana rocco who is live at the police special victims unit tonight. die nan? >> reporter: chris and jessic jessica, that suspect was picked up this afternoon and taken here to special victims unit where he was questioned for several hou hours. tonight 29 year old brandon menially has been charged with rape, robbery, attempted murder and a slew of other related charges. a rape and robbery suspect now in police custody. 36 hours after police say his vicious attack was caught on tape. >> she was attacked, um, she was sexually assaulted, and robbed. also was struck over the head and sustained some injuries as a result of unknown instrument or metal object. >> reporter: the assault so brutal it's hard to watch. but the video so detailed it led police to make quick arrest.

their suspect 29 year old brandon menially. he was charged monday night after police spent the afternoon questioning him. sources say menially was picked up at a homeless shelter on the 900 block of hamilton street after he was identified from this video. police say he walked into an art studio on ninth street in chinatown sunday morning and attacked a 45 year old woman in the business. the owner recalls the possibility this individual had been in there. >> menially allegedly hit the victim in the head with a hammer like metal object wrapped in bag several times. then pushed her into a back office where police say he sexually assaulted her. police say menially left with $600 in cash. allegedly seen in the video grinning as he put on his hat and walk out. >> it's horrible. it's disgusting. >> reporter: many in the area outraged by at tack are now relieved that the accuse the attacker is off the street and in police custody. >> and from here, menially was

taken to police headquarters where he will be held. that victim was taken to jefferson hospital and released the same day. we're live outside the special victims unit tonight, i'm diana rocco cbs-3 "eyewitness news". >> all right. diana, thank you very much. children's hospital of philadelphia is reaching out to the centers for disease control with concerns over enterovirus tonight. chop alerted the cdc about two new patients suffering from acute muscle weakness and changes in the spine. that bring the total number of patients chop has seen with those symptoms to five. none has been confirmed to be infected with enterovirus though the testing does continue. well residents in hamilton township, new jersey, are feeling the impact of enterovirus. students at yardville elementary returned to class today for the first time since the death of four year old eli waller was linked to the virus much the cdc confirmed on friday it caused the death of the pre-schooler. >> i have son who is extreme asthmatic and my concern is he

can get it anywhere. >> it's here. it's here to stay, and we as citizens and teachers and students have to be diligent in our approach to personal hygiene. >> the hamilton township school district has approved overtime for its custodial staff and ordered bus companies to thoroughly wipe down all surfaces. the cdc is also testing a classmate of eli' who's was hospitalized shortly before his death. that child is recovering tonight at home. >> ebola fears are spreading worldwide do night. a spanish nurse who treated a missionary for the disease at a madrid hospital has tested positive for the virus. it's the first known transmission of the outbreak of ebola outside west africa. meanwhile, the american photographer who contracted ebola while working in liberia is now at a nebraska hospital. he will be treated in a specialized contain many unit there. and doctors in texas say eric thompson duncan's condition

that child's backpack. several children were taken to the hospital as a precaution. toll will be row leased after posting bail. >> well philadelphia's largest teachers union says it was stunned to learn the school reform commission had canceled their contract with the cash strapped school district this morning. the union says that it is this newspaper ad was the only notice given that the src was holding the meet in which that step was approved. this means the union members for the first time will be required to pay into their own health care plan. a cost between five and 13% of their premiums. >> total disrespect for the teachers and other school employees who work in the school district of philadelphia. >> the concept that they are surprised by this is laughable. when i was first appointed to the src in february i said that we would take unilateral action and if they cannot reach angry. >> some teachers are angry with governor tom corbett for this. they gathered outside of his

center city office this afternoon. but we're told the governor was not there. the changes to the teachers union benefit goss into effect on december 15th. teachers in ridley township certainly know how frustrating crack talks can be. they say their discussions in the district have been going on for far too long with far too few result. "eyewitness news" reporter todd quinones tells us what happened when the two sides met face to face tonight. >> reporter: teachers here have been working without a new contract sin the end of june and tonight at least publicly both sides appear to be digging in. ridley school district teachers took to the picket line monday night to hammer home their point they want a new contract. the teachers of the ridley education association or rea say the main sticking point is a lack of guaranteed prep time for class. >> prep time is the time where teachers can reflect and do some research and try some new innovative things, plan effective lessons for the kids. >> reporter: parents and taxpayers showed their clear

support for the teachers. >> i don't know how in god's name you can sit there and say that she doesn't need prep time. how can she teach 31 children and not have prep time? >> reporter: but the school board argues teachers in the distract on average make more than $83,000 a year. the team board agrees that the continuation of raising property taxes to continue to support higher teachers salaries is unsustainable. the rea states the guaranteed prep time is the main issue. we do not we believe it is salary and we will not give up the right to manage the busine business. >> but supporters of the teachers criticize the district for what they call wasting money on i pads for students and high salaries for administrators. >> kids are playing games, instant messaging and visiting social media web sites that are supposed to be blocked. >> reporter: as of right now no new contract talks have been scheduled. in the meantime, teachers here will continue to work based off of their prior contract. reporting from folsom, delaware

>> an incredible chaotic scene is caught on camera in miami. >> a car plows into a group of people dining on a sidewalk. take a closer look at this video. about a dozen people were dining outside a restaurant on saturday afternoon when that out of control car barreled through. 10 people were injured including two pregnant women. no word tonight on their conditions and it's still unclear why the driver of that car lost control.

>> meanwhile what was started out as romantic proposal turned down right dangerous in california. eric beretta was proposing to his girlfriend when their hot air balloon drifted off course. it landed in the ocean just north of san diego. lifeguards and surfers rushed over to help. in the end no one was injured and we're glad to say that his girlfriend accepted that proposal. lost in translation. embarrassing mistake in burlington county. take look at the seal at this brand new library in moorestown township. it says -- the architect and te town officials thought that it read" we confirm things twice "but the literal translation from latin turned out to be" we second guess all ". the seal next to it also reads 1653. it should read 1853 when the friends of the library groom group form. the architect is promising to fix the mistake but so far in

word on how. >> the supreme court refuses to hear appeals on same sex marriage effectively legalizing it in 11 additional states. the move paved the way for marriages today in virginia. the high court's move allowed for same sex marriage in utah, indiana, oklahoma and wisconsin. it also impacts six other states governed by the same lower courts. that makes same sex marriage legal in their states and the district of columbia. olympian michael phelps was suspended today by usa swimming for six months in the wake of his second dui arrest. the olympian can train. he just cannot compete. the news comes a day after he announced on social media he was entering a six week in patient program. the 29 year old was given probation the first time around in 2004. this time he faces up to year in prison. a thousand dollar fine and a suspended license. >> well tonight on the cbs-3 health watch, food fraud. researchers say that 10% of all

food is either miss labeled or misrepresented. tonight our health reporter stephanie stahl shows us the most common items that may not be what they seem. >> reporter: navigating the grocery store can be a challen challenge. so many ingredients to decipher but careful label reading might not be enough. >> it's very frustrating they don't tell the public what's in their products. very frustrating. >> food not as label. >> reporter: amy kerr cher runs the natural center for food protection and defense. to prevent food terrorism and ensure that labels are accurate. >> we've lost control of a supply chain. so it allows people to take advantages of vulnerables in the system. >> reporter: the center has found dozens of examples of fraud. everything from fillers in spices to diluted lemon juice to more serious and potentially dangerous problems easily olive oil. >> if it's oils that we don't consume, so industrial oils or oils we wouldn't use for how man

consumption. we have had cases historically where people have and made people very ill. >> she says alcohol can also have some undisclosed ingredients like a chemical called diem lien glycol. >> like an antifreeze that was added to wine to increase the movement in your mouth. >> reporter: hahn know was found to be fraudulent containing ingredients not on the label like corn syrup or it can come from other countries that use antibiotics. >> to increase production of honey through their bee population, and that might be a substance we ban. >> reporter: with seafood stuff unlabeled ingredients sometimes a cheaper type is sold as a more expensive kind of fi fish. >> substituting he is today lar for tuna. it can cause gastrointestinal problems or contain high levels of toxins. one of the simple rules if one brand of a product is much cheaper than all of the others, that could be a sign it contains fake ingredients.

i'm stephanie stahl, cbs-3 "eyewitness news". >> well, we can tell that you our weather forecast is what it appears to be. unfortunately, kathy that's correct includes rain. >> it d it's going to be warm. it will ab little windy and it's going to be a little wet. little bit of everything in this forecast. to night we're looking at dry conditions, but the weather is going to be changing again. take look outside where we have a partly cloudy sky in center city philadelphia. helping to keep the temperatures up a little bit in the 50s, in the 60s. down the shore, cool as well but comfortable with a mainly clear sky. of course, resorts all decked out in pink in hadn't nor of breast cancer awareness month. atlantic city celebrating that as well. let's take look at our live neighborhood network across the region we've had windy conditions. these are some of the latest wind gusts in bethlehem gusting to 28 miles an hour. new castle county airport 29 miles an hour gusts and malvern at the prep 23 miles an hour gusts. right now in philadelphia we're still gusting to 21 miles an hour at greenwood school.

temperatures mainly in the 60s with some clouds rolling in. 63 in philadelphia. the same in atlantic city. 63 in allentown and some 50s in the poconos and also in trenton. to the west, temperatures didn't get out of the 50s today. in pittsburgh and also state college with rain that arrived. there's a weak disturb dance that's going to be moving through but this precipitation moving more to the north than to the east. that's got news. the best chance of seeing a shower overnight would be through the poconos and also through the lehigh valley. a cold front is still to the west through cleveland and cincinnati. and that will be moving through by tomorrow night. the best chance of rain. so for tomorrow we're looking at temperatures in the 70s. strong southerly winds gusting to about 25 miles an hour. then the front swings through. we'll see little change but breezy conditions on wednesday. the real cool air will arrive on thursday and once we back down into the 60s, we are going to stay there for awhile. that's actually below average. so for no tonight a few clouds, best chance of showers to the

north and west. tomorrow morning looking at a partly cloudy sky. and then during the afternoon a chance of a few showers passing through. this is over doing it i think a bit. showers especially north and west and then the real rain arrives late tomorrow night. after 10:00 o'clock, we'll see a swath of precipitation. a line potentially of showers and imbedded thunderstorms. you may hear a few rumbles of thunder overnight tomorrow nig night. those are the storms moving through the cold front and then by wednesday, drying out again. so most of the precipitation tomorrow night while most of us are sleeping. pretty good timing overnight a few clouds stray shower north and west. the low vick. see temperatures slowly warming for those early morning lows. we'll tame the chill a bit. the past two mornings sunday and this morning in the 40s. tomorrow will be in the 50s peaking wednesday and then those morning lows will be falling off again by the end of of the week. by tomorrow, temperatures will be in the 70s, a chance of an afternoon shower. on the exclusive "eyewitness weather" seven day forecast,
