. today's tuesday, october 7th, good morning, i'm natasha brown. >> i'm erika von tiehl. developing right now, close to 100 people are out of their homes this morning, this after a fire whipped through a delaware county apartment complex. we're live with an update on the injuries. plus, fresh concerns about enterovirus d68. why one local hospital sent out alert to the cdc about this respiratory illness. >> and we're awaiting the arraignment. man accused of viciously assaulting a man in a arts studio. those stories and more, first a check on the forecast, didn't feel so chill think morning. >> no, i was pleasantly surprised even though this shouldn't have been, i'm sure

katie -- >> mentioned it 50 times yesterday. >> but who is counting? >> nobody. >> it is true, though, way milder, and if you notice, there is the haze out there this morning, clouds overhead, so basically acting like nice warm fuzzy blanket. so trapping the heat in. that's part of the reason, part of the reason, anyway, little warmer for us out there this morning. more than anything, we do have warmfront. you know, they call it warmfront for a reason, warmfront, warmer air, temperatures starting to rebounds nicely for you. so yes, not quite as nippy out there this morning, granted, but we are unfortunately having to track some additional wet weather cents as the day goes on, so we time that out for you, little activity even on the radar, details straight ahead, guys, back to you for now. >> thank you. developing right now, an overnight fire rips through delaware county apartment building displacing nearly 100 people. >> "eyewitness news" reporter jan carabeo live at the scene this morning, where some of the residents had to be taken to the hospital. jan, good morning. >> reporter: that the tasha, erika, good morning, the fire department tells me, three

people had to be transported to the hospital as a result of this fire. two elderly people taken just for evaluation, and one woman who lives inside of this apartment where the fire started had to be transported for smoke inhalation. and now, that the fire is out, the main concern becomes how many people had been displaced by this fire? we're told about 100 people from more than 07 units had to find another place to stay the night because the fire and the high levels of carbon monoxide. the fire department tells me those levels are likely down by now, but number of other issues have to be addressed before folks can move back in. the fire stat dollars here around 10:30 last night in first floor unit at the glenn croft club ants, here 100 block of folcroft avenue. fire contained to one apartment, but smoke and co forced entire building evacuation, told there are roughly 72 units here, about 100 people who had to find other accommodations, red cross is assisting, and close to two dozen of those people are at shelter right now that has been set up at the

folcroft fire station. >> here at the folcroft firehouse, we're providing the cots, for people to sleep in, providing food for them, and just general comfort until they're able to get back to the ants tomorrow morning. >> and, there is no word at this time when those residents would be allowed back into this apartment complex, we ' told by the red cross that they are awaiting word, than now all the people at the shelter are thankfully getting a little bit of rest after very busy night. in the meantime, no cause of this fire has been determined just yet. the fire marshall already working on that later on this morning. coming to you live from folcroft, jan carabeo, cbs-3, "eyewitness news". >> right now 4:33, let's get back to katie to hear more about her forecast. >> right now little activity throughout on storm scan3, courtesy of the warmfront moving through. typically warmfronts don't really usher in any casino of role significant precipitation, but we do have some showers coming down, locally, somewhat steadier. predominantly that's up say the northeast extension here toward portions of lehigh

valley, northampton county up into northeastern pa. if your travels are taking you perhaps up toward i80, running into that likely. moving pretty quickly looking at the three hour loop, back edge of this, things fizz link here across virginia, so i do think you will see things winds down, relatively early on, when it comes to these showers, the thing is, we had warmfront this morning, and then you got to have a cold front cross at some point. that will will happen tonight. so by tonight, we will be dealing with rain amounts, around a quarter of an inch or so, but there will likely be some steadier showers, steadier rain, probably thunderstorm that comes along with this, generally the gust will pick up at 25. heavier thunderstorm cell, right now looks like possibility of that, especially through eastern new jersey, those gusts could peak as high as 45 miles per hour, that will send your trash can flying down the road, so we'll keep you posted as things evolve, there something on the way for tonight. currently look at the temperatures, so much warmer by comparison, pair of six's wildwood, ac, at the airport,

they tree to clean that up and get it out of the way take diamond street. pa turnpike both directions frost ben saltam ft. washington overnight work there taking out scattered lanes in both directions, and out in new jersey, both directions there, as well, 168 to route 42, just until 6a. that will get cleared upright before everything starts to get heavier. that's new jersey dart running on time. great alternate. back to you. >> we're awaiting the rainment of a man for brought al sexual assault. behind bars this morning facing rape and robbery charges. they say he is the man seen here in this surveillance video attacking 45 year old woman at an art studio. police are now looking into the possibility the victim may have been targeted. >> the owner recalls the possibility this individual had been in there. so we're looking at the potential of this not being a random attack, but that this individual was targeted.

>> investigators found him at homeless shelter monday afternoon. after several hours of questioning, police charged him with rape, robbery, and attempted murder among other charges. happening today, a bid here lost the bankruptcy auction for the revel casino gets his day in court. florida developer glenn straub claims that the auction was improperly conducted and he filed papers asking for a new auction. brookfield asked management, one with $110 million bid, that's 95% less than the original $2.4 billion price tag on that place. a bankruptcy court judge in camden will decide if the original sale should be approved. 4:37, more concerns about enterovirus, children's hospital of philadelphia now reaching out to the center for disease control. >> chop alerted the cdc about two new patient suffering with accute muscle weakness, changes in the spine. that bridges the total number of patients chop has seen with those symptoms to five. none have been confirmed to be

infected with enterovirus, though testing does continue. also, ebola scare sets off massive emergency response at chicago o'hare international airport. passenger got sick on united flight coming from new york's leguardia airport. the 78 year old woman was taken to the hospital for treatment. officials say there was no basis for fear that the passenger may have contracted the ebola virus. all 167 passengers on board made it off safely. >> update on search for eric frein, man accused of ambushing two pennsylvania state troopers killing one. police say they found a letter believed to have been written by frein that details the attack and how he got away. police searched a nursery for hours sunday, but found nothing. officials say a review of text messages reveals that he lied about working in delaware in order to prepare for the september 12th ambush. a four year old bridges heroin to day care and then passes it is out to other children. >> well there is happened at a day care center in sell bee

ville, delaware, that's in southern sussex county. thirty year old ashley tull of selbyville, mother of the four year old child, now facing charges. police say workers at hickory tree childcare center found 249 bags of heroin in the child's back pack, several kids were hospitalized as a precaution. frustrated school district teachers hit the picket line in delaware county. they have been working without a contract since june. teachers say the main sticking point is a lack of guaranteed prep time for class. but the schools, they argue, it is money. teachers in the district make an average $83,000 a year. par ends, taxpayers, attend dollars school board meeting last night to show support for those teachers? i don't know how it god's name you can sit there and say she doesn't need -- how can she teach 31 children and not have prep time? >> no new contract talks are scheduled. teachers will continue to work based off of their prior

>> the supreme court refuses to hear on same sex marriage. move paved the way in several states. it also impacts six other states, governed by the same lower court. same sex marriage is now legal in more than half of all us states, including, pennsylvania. a north jersey high school, now canceled its entire football season over hazing allegations cents. the announcement was made last night at meeting for the teen parents, at say err ville high school in middlesex county. prosecute remembers looking into allegations of seniors hazing freshmen on the team. school officials declined to

provide any details, other than to say, they are, quote, significant and serious. a very disturbing discovery in central park prompted nypd investigation. >> police say dog walker found a dead bear cub under a bush. investigators don't know how that bear got into the park, but officials do say it is not from the central park zoo. the animal's body has signs of trauma. police are now trying to figure out if the animal's body was dumped there. right now, 4:43, what a difference from yesterday, to right now. >> wait until you see how much warmer it is than this same time yesterday. it is very, very significant. i mean, you walk out the door and you can tell. sometimes it is like the shock of the temperatures that are like, wow, that warm? you'll see. but we do have a warmfront moving through. that's the reason for there is where the clouds come in, rain comes in, couple of showers out there, then tonight the colds front bridges in some rain. there is cents a lot of details to discuss. this isn't a huge storm system for us, though, not major storm system, but it is certainly going to be

responsible for the temperatures getting a lot milder here today, and sort of just back to row al at this. so let's take a look. storm scan3 obviously brinking in little hint of wet weather here, couple of locally heavier showers, rolling through portions of northeastern pennsylvania, right across the garden state border there, but overall, you know, i think it will start to clear out as the day progresses, the probes still have to get the cold front through. looking at the wider zoom here, there is little bit of circulation, and shape to this, that you can start to make out. well we have seen numerous incidents of severe weather breaking out here, down to the lower mississippi valley, texas, over the last day or so, and it doesn't necessarily look like this is going to be major severe weather outbreak for us, but we are actually in a slight risk, right out toward the shore points here, for some severe thunderstorms. and primarily, into tonight, this afternoon, you have to worry about it, but if we brighten up, if we see enough sunlight, will help the up lift get underway for gustier storms, these are primary issues, i think talking gusty

winds out of this, perhaps heavier rain, and yes, definately some embedded thunder, can't have thunderstorms without thunder. meanwhile, what did i tell you? look how much warmer it is, have seen surplus over 15 degrees, in most spots, and some even higher than 20 degrees, from this same time yesterday. so, no frost issues today. do not worry about. that will just little too warm for that. but hey, you might need to flick the windshield wipers number of times. watching for the morning shower chance to just retreat out of here, later today we ends one some sun, then tonight the rain moves in. if there is any showers left over tomorrow, very early in the morning, then should quickly clear out for sunshine, thursday looks beautiful, don't bling, though, already have to watch for some showers as early as friday afternoon. guys, back to you. >> all right, the prime time football game last night, it could have been a lot more one-sided than it was, seattle seahawks had three touchdowns called back due to penalties, but still beat washington. washington did hit on 06-yard touchdown in the first half,

>> dozen of people force from the their homes by late night apartment fire in delaware county. the flames broke out around 10:30 last night in the glenn croft apartments in folcroft. three people suffered minor injuries. authorities at children's hospital of philadelphia, they have notified the centers for disease control about two new patients with symptoms of enterovirus d68. there are now five patients at children's hospital with those symptoms. there are no confirmed cases of enterovirus, but testing does continue. and man police say was caught on security camera

assaulting a woman in chinatown faces arraignment this morning. they say 29 year old brandon menially attacked a woman at art studio on north ninth street early sunday morning. well, it is now 4:50. time for check on business news. >> money watch's jill wagner joins us now from the new york stock exchange, jill, hearing that massive gm recall over defective switches linked to even more deaths, right? >> reporter: yes, that's right, good morning, general motors victim compensation fund has now approved 24 death claims for people killed as a result of the auto maker's faulty ignition switches t has been eight months since gm began recalling more than 2 million cars, because of the defect. the auto maker actually says less than half of the owners have fixed their cars, so gm says it is taking extra steps to get in touch with owners, sending the messages on facebook, even stopping by their house. that would be an interest outcome, natasha.
