>> from the cbs broadcast center in philadelphia, this is cbs-3 "eyewitness news". >> now at 11:00 o'clock an "eyewitness news" exclusive. a man is knocked out in a savage attack in the middle of a philadelphia street. we'll have that story in just a moment but first tonight our eye is on a big rainstorm and it's starting to move

through right now. good evening to you, i'm jessica dean. >> i'm chris may. meteorologist kate bilo is tracking the system for us. kate, what should we expect. chris and jessica, we expect more rain to continue to move in through the overnight hours and the heaviest will actually be early tomorrow morning. so when you wake up on your saturday morning steady rain expected all across the region. you can see most of the rain right now is off to our south. down across portions of the kent and sussex counties in delaware and also into cape may county we are just starting to see the first few raindrops fall down the shore and another batch of showers moving into the harrisburg area but there's lot more rain where that came from. in fact take a look at all this moisture along that same boundary and this will just come through in waves during the overnight hours but especially again early tomorrow morning. take look at our latest model. this model we look at. it really takes you threw hour by hour and you can see as we go through the overnight hours we just expect a few showers to get in. by about 3am. the rain gets a little steadier and then take look at what happens here early tomorrow morning. 6am heavy rain off to the west.

looks like the heaviest may be between about seven and 9am for the city of philadelphia and you can see the orange and yellow shading indicate something very heavy rainfalling tomorrow at the tacony-palmyra much showers then linger until about noon and then the clouds try to hang on into the afternoon. we'll see some some clearing late but most of the day turns out cloudy an bit gloomy with heaviest rain early. what to expect through your saturday morning cloudy and chilly with periods of rain. about half inch to an inch and a half highest amounts off to the south. the rain will taper later saturday afternoon. but doesn't look like we'll clear thing out and get any real sunshine in the forecast at least until sunday but with this wet weather you'll want to keep a very close eye on our forecast. this is the perfect time to download our "eyewitness weather" app if you haven't done so already. you can find it on the app store and now on google play. now available for android devices. back to you. >> kate, thank. exclusively on "eyewitness news", a frightening seen in a savage tack all caught on came camera.

a verbal altercation turns physical and ends with man unconscious in the middle of of philadelphia street. i diana rocco has the individual you'll only see on "eyewitness news". diana? >> reporter: jessica, police say this man was confronting a group of kids on bikes when one of them attacked him from behind. tonight it is believed that this may be the same group that has been causing some instances of harassment and vandalism in the city over the last couple of weeks. as witnesses tell me tonight this video is hard to watch. the eyewitness individual is chilling. a 24 year old man is attacked from behind and left unconscious lying in an intersection after he confronts a group of kids on bikes. by the time i got to him it was about maybe 32nd later so we had regained continues very disoriented. pretty clear he had a concussion and pretty large injury on his face. >> i didn't see think that it would get to the point with all the cars around that there actually would be an altercation in the street. >> reporter: couple who asked

not to be identified watching from their apartment wip dough was able to rush to the man's aid while calling police and shooting this cell phone video. it happened thursday around 9:00 p.m. at 19th and fairmount. police say a group of 10 to 15 minors on bikes were riding through the streets hitting cars with sticks when the victim asked them to stop. >> it was really people were getting upset we became concerned someone was going to get hurt. >> reporter: second later this happened the group circles on their bikes one throws a water bottle didn't the victim and another suspect punches him from behind. leaving him unconscious and bleeding in the intersection. >> he went down quickly and didn't move after that and i was really concern. i stayed with him holding pressure on his face. >> the same group surrounded a couple on lombard street while they were stopped at an intersection and tried to pull the woman passenger from the c car. a short time later police arrested a 16 year old and 212 year oldings from the oxford neighborhood but believe more are valve. >> there's a dee aggressive nature to it that seems planned

and -- that's especially disturbing. >> reporter: the vick testimony was taken to hahnemann hospital with a fractured jaw that had to be wired shut. the three juveniles who were arrested were charged with aggravated assault and criminal conspiracy. police say more arrests may follow as they review the surveillance video. we're live outside central detectives tonight in center city, diana rocco, cbs-3 "eyewitness news". >> all right, diana, thank you very much. developing right now, k mart says undisclosed number of credit card numbers were stolen during a month long data breach of its payment system. tonight k mart does not believe any names or social security numbers were obtained by those hackers. this data theft at k march the latest in a string of breaches at big retailers including target, michaels and home depot. >> this was the site not many people expected to see. former mob boss joe woe merlino was back in philadelphia today. he was in federal court as judge

decides if the 52 year old will go back behind bars on probation violation. federal probation authorities allege met with convicted felons in florida which violates the terms of hess supervised relea release. merlino was sentenced to 14 years in prison on a racketeering conspiracy convict in 2001. there's breaking news tonight of sayreville, new jersey. where prosecutors have filed charges against seven students as part of an investigation into hazing on the sayreville high school football team. the middlesex county prosecutor has filed aggravated sexual assault and criminal restraint charges against three of those students. four others face charges of aggravated criminal sexual contact. you may remember the football season was canceled for this team when these allegations came to light earlier this week. >> well tonight, an emotional father talks about the sudden loss of his young son. 484ed eli waller was the first child to die from enterovirus d68. that is a respiratory virus

sweeping the nation. today, his father said that eli a student at yardville elementary in hamilton township, mercer county, went to bed and the next day he was gone. >> he's like the little puppy dog who just looks -- you know, look at you and wants to make you happy. i kissed him on the forehead, gave him a big hug. gave him his night night. eli, let's have a great day tomorrow. and he just said i will, daddy. i will. >> you have to make choice. and that choice is, are you going to just sit and lang wish and be sad for your the rest of your life or are you gonna make something good happen? >> today he'll lie s father announced a creation of a foundation called first day of school to help kids with special needs like eli's. >> dallas hospital is making procedural changes after the death of an ebola patient there. thomas duncan the first person

to die from the disease in the us. newly released medical records now show his temperature was 103 degrees when that hospital initially sent him home. meanwhile an ebola joke that sparked scare on a flight from philadelphia to the dominican republic shows airlines are taking he have bowl la serious seriously. crews in hazmat suits had to board that plane. they removed the passenger who told the joke. joe mccann was on that flight and he spoke exclusively with "eyewitness news" today. >> certain things you can't say and it's not something you can joke about these days. you can't make a joke like that. you know we're over i don't town head credible on that flight and he almost ruined vacation or -- oh reasons people were down here for what he felt was a stupid joke. >> health officials in the dominican now say that passenger does not have ebola and has never been to an affected area. by the way five airports will begin enhanced ebola screenings for travelers who arrive in the u.s. from west africa this weekend. new tonight, first time dui

offenders may soon find themselves walked out of their cars when they start their engines. lawmakers want to put the brakes on those who drive under the influence. "eyewitness news" reporter matt rivers has details. >> reporter: 50 to 91. that was the vote for a tough new duism bill that passed the pennsylvania state senate this week. the bill would require first time dui offenders with a blood alcohol content of .1 or higher to install one of these, it's an ignition interlock device. convicted offenders must below into it every time they want to drive. attached to the car's electrical system it will start the engine only if there's no alcohol detected on the driver's breath. if passed, the law would have an impact right away. >> back in 2012, under then law 5,856i locking ignition devices were installed that. led to about 14 million tests before drivers ever took to the roads. but if this new bill was in place back then, that would have led to an additional 11,079

interlocking ignition device that is could have have been installed as well. >> i think it can save many, many lives. >> reporter: helen is the dui coordinator in lower bucks county. where she evaluates dui offenders every day. but more than just a job. for her, it's painfully person personal. >> my daughter was killed 19 years ago in a drunk driving crash. >> reporter: 2284 old alice was in the back seat of a car that was crashed by a man who was both drunk and high. >> in matter how much time you're never prepared to lose your child. it's no surprise then that she supports the new law. but she says statistics back her up. according to the centers for disease control, repeat dui offenses drop about two-thirds after an interlock device is installed. >> anybody can make a bad choice. the key is to learn from that. >> reporter: if this is to become law, though, the bill still has to pass the house. but there's only flee voting days left this session and if lawmakers don pass it by then, the process starts all over again n year. matt rivers cbs-3 "eyewitness news". >> frustration and fear mount in

impression of a loud mouth new yorker and getting eagles fans pumped up for sunday night football with the giants. that video was posted on fly eagles fly.com. sunday's game is a huge one for the eagles divisional matchup and tonight the hatch tag black sunday is popular among fans. that's because this sunday the eagles will do something they've never done before. going with all black uniform. pulling out all the stops for this big battle again the giants on sunday night. >> law enforcement officers are helping to boost the spirit of a little boy as he takes on some tough health issues in bucks county. five year old shaken, has cerebral palsy and wants to be a police officer just like his dad when he grows up. he's collected dozens of police department patches, some from as far away as germany and australia. today a friend presented him with blanket made up of the patches. you can certainly call that security blanket. shane can now have the blank wet with him during his visits to

children's hospital. >> contaminated water has forced moorestown new jersey to shut down two wells that supply half of the township's water. tests found that one, two, three try color porphin and industrial solvent in cleanser. that's classified as a likely carcinogen. the chemical was first discovered in the water last year. officials say they'll be able to supply the town's water from other sources until they figure out what to do next. >> if there's one place that you don't want your name to end up as as a result of a mistake, it is the social security administration's death master file. tonight three on your side's consumer reporter jim donovan reveals how you could be declared dead. >> we are sorry to learn of your loss. >> he's reading a condolence letter from the social security

administration on the death of his mother-in-law. >> but there's one problem. his mother-in-law isn't dead. >> she's not dead. she's alive. >> reporter: alive and in need of her monthly benefit from the social security administration cut off after listing her as dead. >> she use that money for hursting home expenses. >> reporter: it was his father-in-law who actually passed away. >> they just killed a woman by putting the check neck it to. >> reporter: it was up to him to prove his mother-in-law is still alive. >> i have to bring a picture of her holding newspapers with today's date to prove that she's alive. i have to bring the statement by nursing home she attending there. plus a picture from -- for the obituary in the local newspaper. >> reporter: how often does this sort of thing happen? well, this audit by the office of the inspector general found that during one, three-year period there were over 36,000 errors instances where the social security administration had to remove death entries from

its matter file. gideon shine is an elder care advocate. he says, mistakes like this can be he can treatmently difficult for seniors to rectify on their own. >> it is pretty complicated. >> reporter: the social security administration says it's complicated for a reason. in a statement, the agency said "social security requires proof of identification to protect people against potential fraud and id theft". >> social security is our everything. if that gets somehow misused, we're in terrible trouble. so they're very careful. and i do understand that. >> reporter: the social security administration in this case wouldn't say whether the error was caused by someone keying in the wrong data or if incorrect information was supplied by an outside source. fortunately social security took immediate steps to correct the records. reporting for three on your side i'm jim donovan. >> "eyewitness news" in center city philadelphia tonight where 1650 arch in the pink. the pink lights on this building

and buildings across the air are reminder for women to schedule a mammogram. october is breast cancer awar awardness month and cbs and cw philly have teamed up once begun with susan g company money philadelphia for the lights for the cure campaign. it is now in its 13th year. ♪ >> i think it's still dry out there right now. has the rained moved just yet. couple of spots it has. pink lights looking nice on this gloomy cloudy night. we have some rain moving into our shore points and no delaware but the heaviest rain for us here in the city will wait until tomorrow morning. let's take look outside though and you can see look closely because it's dark out there. but take lock at the boardwalk here in ocean city and you can see the boards are wet. the rain has moved on in. the boardwalk has certainly cleared out and it is definitely looking a little damp outside right now. storm scan3 shows where the rain is. again, the instead yesterday right now over portions of delaware but you can see light rain the least over taken the

shore points but still a lot of raining to moving in waves into portions of central and western pennsylvania and even more rain here across southern ohio and into portions of kentucky and this will all come through for us eventually and the instead yesterday will be saturday morning. so a bit of a saturday spoiler unfortunately. temperatures across portions of the area here on live neighborhood network in the mid 50s pennington, dover, broomall and bethlehem in the mid 50's at the moment it will drop to the low 50's over it in a bit chilly outside tonight. but not as bad as it's going to feel over the weekend when temperatures don't get much past the low 60s. timing this out between now and 2:00 a.m. we'll see that rain start to move from south to north. periods of rain will be steady yesterday from 2:00 a.m. to noon tomorrow looking at a half inch to half and inch of rain the highest amounts into the shore points the areas getting rain right now. then afternoon time the rain will taper from northwest to southeast. so let's time it out again you can see the rain off to the west for now but take look at 5am

rain overspreads the entire region by 9:00 a.m., eight, 9:00 a.m. heavy rain in philadelphia. you can see the yellow shading there. then after about noon, we start to see this move out to sea. skies try to clear just in time for perhaps sunset. not going to salvage too much of our day. but all in all it's mainly a morning event and then after the noon hour we see things start to settle down a bit. if you have any saturday evening plans they look fine and sunday looks much better. overnight damp and chill will that steadier rain arriving late. morning rain tomorrow then some afternoon clearing at 62. but folks heading tote guilty game you'll look this forecast. it's cool. but it's dry. 56 degrees at kickoff on sunday night. here's a look at your "eyewitness weather" seven day forecast, we're looking at temperatures below average through the weekend but whole lot more sunshine on sunday at 64 degrees. it's milder early next week but that warmer weather comes with a price. more clouds monday, tuesday, wednesday and the chance for showers all three days as well.
