torey. and, while we wait on that those slippery roads are causing incidents this one here on the vine street expressway an accident eastbound approaching the the vine or excuse me, approaching i-95, and we will have little disable vehicle causing a stir as well. we will have more details, coming up, ukee. a second nurse who contracted ebola from a patient is waking up in atlanta area hospital this morning. >> doctors are treating amber vinson inside emery university hospital infectious disease unit. we have video of a medic escorting her in the hospital last night. this morning cdc is under scrutiny forgiving vinson permission to take a commercial flight one day before she was hospitalized for ebola symptoms. the the agency says they allowed her to fly because they did not meet criteria for someone at high risk. meantime president obama has canceled another travel day to monitor the out break.

>> i'm absolutely confident that we can prevent a serious out break of the disease here in the united states but it becomes more difficult to do so if this epidemic of ebola rages out of control in west africa. >> cdc director tom freed an will testify at a congressional hearing over his handling of the out break. well, news that two dallas nurses are now infect with ebola has prompted some nurse necessary our area and across the nation to speak out. >> they are calling for more training and better protection. "eyewitness news" reporter jane carabao joins us from the sat center with that part of the story, jan, good morning. >> reporter: well, nurses across the country are understandably concerned about ebola because that second helpful care provider was just tested positive for the virus and now the nation's largest health care union, for registered nurses, well, they are demanding that the

president the set mandates for protections for their workers. >> it seems like this, health care workers fighting ebola in africa and here at home are enough to frighten anyone and now imagine what it is like to be a nurse on the front line as the second health care provide inner dallas, texas has toasted positive for the virus. >> in liberia ebola is now called the nurse killer disease. so that gives me great cause for concern. >> reporter: kathy toomey is a nurse at crozer-chester medical center. she's one of the 11,000 health care workers demanding higher standards from hospitals. the nation's largest nurses union say, when it comes to ebola, standards are sub par or non-existent. >> we are the front line. we are the people that will be going in. if you don't have the proper protocols in place one mistake is all it takes. what i am afraid office people trying to short cut your protection and short cut this and ending up like dallas.

>> reporter: nurse necessary dallas alleged the violations include no specific protocol in place, thomas duncan they say was left in the public area with other patients for several hours, nurses didn't have proper protective gear. duncan's lab samples were unsealed and transported through the general distribution system and the nurse hose treated duncan were allowed to interact with other patients. toomey wants standards followed by some university where health care providers have successfully treated patients without further infection. >> if they are not highest standard like emery or university of nebraska then would i not feel comfortable taking care of a patient. >> reporter: toomey says those universities frequently train with anti contamination gear and hazmat suits. meanwhile communities across the delaware valley continue to prepare for an possibly bowl a out break here and, happening today, philadelphia city council will be holding hearings to discuss this city's readiness. we are reporting live, jane carabao for cbs-3 "eyewitness news".

"eyewitness news" reporter nicole brewer joins us from northern liberties where parents are anxiously awaiting for tonight's lottery that will decide who stays and who goes, right nicole. >> reporter: that is exactly right, erika. i would be willing there is a lot more tears then cheers at this lottery conduct today at 5:00. in all 250 student will be told they have to go somewhere else. inside walter palmer charter school education comes down to the luck of the draw, thursday's lottery determines who can stay and who will go. >> i just don't know what to do. all i can do is pray. >> reporter: come 5:00 o'clock

250 prayers will go unanswered as that number of students are forced to find alternative education, several weeks in the school year. >> i feel very blind sided because like i said we have been supportive, supportive, supportive the whole time and then all of a sudden we have an emergency meeting and you tell us it is a lottery pick and it is october. the that is so unfair. >> reporter: it follows a court battle with the fail school district which says 1200 students in kindergarten through 12th grade exceed city charter school cap of 675, district's successfully argument it does not to have reimburse palmer charter for extra 525 students. a decision president and founder walter palmer claims has cost his schools in northern liberty and frankford $300,000 a month. >> we have exhausted almost all of our legal options to try to revitalize this i will continue to fight, for the right reasons. >> reporter: if the school does not obtain additional funding it could mean 300 more

evening that woman with an arrest if she did not perform a sex act. a philadelphia special education teacher is asking for help to find her stolen dog louie. jj pierce and her friend are trying to get the word out to bring louie home. last thursday pierce stopped at the home depot at columbus boulevard and left her labrador in the car. when she came out moment lrter the car and two-year old lab were both gone. >> i'm heart broke even. you know, after the first day he was taken i thought i'll get him back tomorrow and i keep telling myself back and time keeps passing and he is not back. >> police recovered the the car but louie was not inside. pierce said she is offering a generous reward for information that leads to her stolen dog. police are also reviewing surveillance video hoping to catch vandals who targeted a play ground for playground with special needs. field of dreams in absecon atlantic county was covered in canola oil.

lets get the latest on this storm. >> thankfully pulling away at this point but we are stuck with decent pockets of rain falling across new jersey and

eastern pennsylvania. we are not totally out of the woods but we are getting there this will clear out quickly. lets take you out there to storm scan three back edge of the clouds, once that passes you by then you are in the clear, pretty much so for this storm system but the rain is still copping down heavily. looking closely a few lightening strikes being pick upright now down through salem and cumberland counties but this will continue to pull away, perhaps, just leave behind a lingering shower for some of you. look at how the bulk of this just removes itself from our area. even by nine or 10:00 a.m. we will see blue skies peeking through cloud cover but there will be a residual instability and drawback wrap around moisture that can trigger a lingering shower but that will be the exception rather than the normal. crystal clear by tomorrow and this looks like it is smooth sailing heading in the weekend. there will be a new frontal boundary that moves into saturday and sunday and that will knock our temperatures

steven collins is under investigation and facing mor allegations of abuse. investigators with the los angeles county sheriff's deputy are looking into an incident back in 1938 with a then 13 year-old girl. authorities say that the alleged victim came forward last week. the the sheriff's department now joins lapd and police in

let's get traffic and weather tother. is that rain moving out, katie. >> it is starting to. we are seeing back edge of the clouds moving through as well but there is also still some residual problems that we have to contend with here in our area as a result of this. we will start off by taking you you out to the flood advisory still posted and remains posted until 7:30 this morning across berks county and up towards lehigh valley and poconos. poor drainage flood i go is one problem, there may be ponding. if there are drainage issues it could be exacerbated with fallen leaves. smaller streams are also definitely starting to swell up out of their banks in a lot of spots too. here's what the radar looks like right now a snapshot view. there is clearly a back edge to this but, there may even still be residual wrap around shower that comes into play here by this afternoon in a couple spots. we are still expecting lower

07's the the next couple of days and much nicer weather for both tomorrow and saturday. vittoria. thanks, katie. definitely something to look forward to their because you're in the looking forward to this morning's commute, i just have a feeling. it is before 6:00 o'clock, even before 5:30 and we have had three incidents out there, and thinks the the residual delay of. that we are looking at northbound i-95 making your way through girard avenue construction zone. we are seeing delays here and through cottman avenue and that construction zone as well, so, excuse me, usually we'd have a south bun delay heading in the city. north bound delay is little bit something tricky and makes me feel like something else is out there we will look at. that is there nothing in the cameras just yet. over 42 freeway north bound traffic headlights there no major problems. but definitely more volume out there but generally speaking our speed sensors look pretty good and it is not just in pennsylvania but in new jersey and delaware as well, no major problems at the airport or for mass transit, ukee.

thanks, torey n sports flyers take on the dallas stars saturday night looking for win number one on the young hockey season. brayden coburn was on the ice at practice yesterday and he says he could be back in action against the stars. he is working his way back from the lower body injury. stars are one-one, on the season so far. the sixers power forward or flyers forward of the future could make future closer. dario saric is not getting enough playing time for his turkish league team and could pursue terminating his contract it is in the clear if he could join sixers this year. he signed on with the turkish league for this season and next. we will see what happens. kansas city royals scored two runs in the first inning against the orioles and that was all they needed. kansas city pitchers struck out eight orioles and allowed one run on four hits and beat baltimore two to one in game four of the american league championship series. royals have won eight straight
