picture from the scranton times, frein shows in that orange jumpsuit being escorted from state police barracks in blooming grove. cbs news correspondent marlie hall in milford where frein appears before a judge coming up later this morning. >> one of the most wanted fugitives in america is now in police custody. eric frein, was captured thursday, after being on the run for 48 days. >> let me assure you, from everybody here, justice will be served. >> the take-down of frein, ended weeks of tension and anxiety in the area. >> he can no longer hide behind his rifle, can he no longer hide in the woods, and he's no longer on the run. and now he will have to answer for his violent actions. >> several thousand members of law enforcement, from at least five different state, had been searching for frein since september 12th. when he allegedly opened fire outside the blooming grove police barracks, killing trooper brian dixon, and

seriously wounding trooper alex douglas. he evaded capture by hiding in the woods where officials say they found pipe bombs, ammunition, and even handwritten note describing the ambush. us marshals finally captured him near and abandoned air plan hangar. >> corporate dixon's handicuffs were placed on him and put in corporal dixon's car. >> knelt down, calmly put his hands up, arrested without incident, will have preliminary arraignment hearing later this morning. frein faces first grew murder charges, two counts of possession of weapons of mass destruction. prosecutors plan to seek the death penalty in the case. >> marlie hall reporting. "eyewitness news" reporter nicole brewer joins us now, she is live at that scene in cobbs creek, where an investigation into how that blaze started is underway. nicole? >> and erika, we're told that those two people that you mentioned were taken to the hospital of the university of pennsylvania, both in stable condition, the nature of their injuries at this point still unknown. this after flames tore through the chestnut park apartments, you see behind me, early this morning. >> i don't wish this on nobody. >> for residents in west philadelphia, a scary site, this halloween morning, as dozens wait to find the upper level of their apartment building fully engulfed in flames. >> oh, i never seen a fire like this a day in my life. i never seen it. it was flames and fire everywhere up there. >> it was just before midnight when firefighters were called to the 6200 block of chestnut street for report of heavy fire. >> i had no idea that they was going through my home where i live at, to come see it burning down like that, crazy,

man. >> samantha bowler didn't believe it at first when officers came knocking, she didn't answer, until -- >> he kicked that door in. and i mean, he kicked that door in and the whole door went boom. when i came outside, the whole third floor was in flames. >> the two alarm fire took about an hour and a half to get under control, as fire crews evacuated between 50 and 60 resident. >> we did transport one civilian, one firefighter, to area hospitals, and they are stable at this time. >> now, the american red cross has opened a shelter at thayer junior high school, 5800 walnut st. we're told 66 residents are checked in for the night. there they will be provided with the cots, blankets, pillows, and other emergency items to keep them comfortable throughout the night. but definitely a scary scene here in west philadelphia. we'll send it back to you in the studio. >> all right, nicole, thank you. right now 5:03, we want to head out to katie on the skydeck. morning, chill. >> i you see the coat i have

new picture from the scranton times shows frein from orange prison jumpsuit, faces arraignment at 9:00 a.m. state police captured him yesterday, in northeastern pennsylvania, after seven weeks on the run. prosecutors want the death penalty. >> more breaking news, firefighter and another person are injured after huge apartment fire near 62nd and market in west philly. dozens of people are in the care of the red cross this morning. and, philadelphia state senator leanna washington resigns her office today. washington avoids jail time, and keeps her pension, despite a guilty plea to conflict of interest charges. >> well, maine's governor says he's ready to use the quote full extent of his authority to keep nurse casey hickox away from the public. hickox recently returned from treating ebola patients in west africa. and she's now defying a state order to stay in her home. hickox took a bike ride with her boyfriend yesterday. she says she has no symptoms and that a quarantine violate her right. her boyfriend spoke out last night saying the quarantine

storm system number two, developing, actually, on the tail end of the front that came through earlier in the week. this is going to roll north. and eventually merge with that other storm, and that provides the moisture. so here is your cold. here is your moisture source, when the two meet up, you get a monster storm, and the appropriately named because we've got halloween here on our hands. what's it mean for us? now, by tomorrow, the chill starts set it in. the breeze kicks in. see some showers in some of these little pocket of rain could be steady rain, especially if philly on southeastment then the two pieces merge, and the whole thing, look at this, ramming up here, out to sea, but will clip southeastern new england, so we're really dodging the worse of this, when it comes to, you know, when this rolls on through, what we end up seeing. 57 degrees in the meantime here today. watching for the clouds to eventually roll in with time. if you have got trick-or-treat plans, who doesn't, mostly cloudy skies out there, we keep up in the mid to lower 50's, throughout the course of all of the festivities here. so sweatshirt weather i would

eric frein scheduled to face a judge for the first time this morning, here in pike county court, right around 9:00. he'll be arraigned on number of charges including murder, and district attorney says he will be pursuing the death penalty in this case. now, this is the beginning of the end for very long and stressful chapter for northeast pennsylvania, after a 48-day manhunt. eric frein was captured last night, by us marshals, near an abandoned airplane hangar in pocono township. officials say he meekly gave himself up around 6:00 when law enforcement approached. he knelt and put his hands into the air. officials say he was unarmed. now everything during the arrest, we're told, frein was handcuffed, with corporal brian dixon's cuffs, and taken away in his cruiser, and investigators say frein shot and killed dixon, and seriously injured another pennsylvania state police trooper outside of the blooming grove barracks in early september during late night shift change. since making his escape, hundreds in law enforcement have searched for frein, at times, closing area schools, cancelling outdoor event, and blocking roads, his
