>> good morning, everyone, thanks for waking with us. following two breaking stories this morning, an inferno at west philadelphiapartment building injuries a firefighter and forces dozen of people from their homes overnight. >> also, after 48 days on the run, eric frein is captured. we have a new picture right here just released of the accused cop killer in police custody. now, he was one of the fbi's most wanted men. >> now, eric frein is wait to go appear in court. about a thousand law enforcement officers had been searching for him, in monroe county since frein allegedly ambushed two pennsylvania state troopers at the blooming grove barracks september 12th. the survival list was captured at the birch wood pocono air park in tankers ville. "eyewitness news" reporter jan carabeo at the pike county courthouse in milford right now, with more on this story. jan? >> reporter: ukee, good morning, eric frein scheduled to appear for the first time in front after judge here at pike county court around 9:00 this morning. that's when his a rainment will take place. he is facing a number of charges, including murder, and

now the district attorney says he will be pursuing the death penalty in this case. this is the beginning of the end, for a long, and stressful chapter, for this community, in northeast pennsylvania after 48-day manhunt, eric frein was captured last night by us marshals near abandon airplane hangar in pocono township. officials say he meekly gave himself up around 6:00 when law enforcement approached. he knelt and put his hands in the air. officials say he was unarmed. during the arrest we're told frein was handcuffed with corporal brian dixon's cuffs, and taken away in his cruiser. investigators say frein shot and killed dixon and shot another outside blooming grove barracks in september during late night shift change, since making his escape hundredses in law enforcement have search for frein, at times closing schools, blocking roads, cancelling events. his capture brings relief to a community that's been on edge for seven weeks. >> the families of corporal dixon, trooper douglas, and

the pennsylvania state police have suffered an unimaginable harm of unspeakable proportions. they may never be the same. but today everyone can fine some comfort as we take these next steps toward justice. >> everyone is looking forward to getting back to a normal life, again, this is the latest picture of eric frein, leaving state police barracks, in a orange jumpsuit. you can see he is handcuffed with his arms behind his back this morning. again, he's scheduled for arraignment right around 9:00 here in court. reporting live, in pike county, at the pick county courthouse, jan carabeo, cbs-3, "eyewitness news". >> jan, thank you. oh, love to hear what some of your favorite halloween costumes were as a kid, tweet me, katie fehlinger my tag here, you can always hashtag cbs-3 mornings, always love to hear the entire news room what your favorites are around the holidays. meanwhile, we do have a pretty quiet forecast for the halloween parade during recess, for trick-or-treating later this evening, so much going on, so much of it outside, and it looks like the weather will, hey it, will cooperate. so clear for the moment. but that also meant that temperatures got a chance to really bottom out. allentown check you out. 29 degrees, right now, up in the lehigh valley, still at 28, holding steady, generally, in the last two hours, up in quakertown, so, it gives you a sense of the fact that the cooler suburbs, the cooler, more typically, you know, chilly towns, are definitely feeling the chill this morning. and you might end up with some frost on the windshield as a result. meanwhile, around the entire northeast, it is a quiet day for one final day here. your halloween forecast in philadelphia, expect it to reach about 57 degrees with sun, followed up by some

clouds. and we can sort of break this down little bit more so for in you philly. expecting a partly sunny day, what we call it here generally overall. fifty-seven for the daytime high, smidge below average, but we will take it, it is real a generally, again, just quiet way to wrap up not just the month of october, but of course usher in the halloween holiday. vittoria, we send it into you. >> good morning, everyone, you know, we were going thousand some of the cameras in the traffic center. and there is a lot of good news out there for commuters on this holiday morning. traveling on all of the majors, really moving well. let's get outside. take live look. we take a look at the ben franklin bridge, no major delays in either direction. nice move into p a and into new jersey, and all of the bridges look great. if you are traveling, however, on 422, you are going to in the just touch of eastbound volume starting to build, but, nothing major around the area of 29. again, you have still some space inbetween the vehicles here. starting to build a tad, but no full swing rush just yet. overall things are moving well.

now, on the traffic center we also getting report of this very serious accident at 55 northbound in new jersey, which is now closed, just beyond route 40. best alternate take delsea drive willow grove road. not too far away from the franklinville section, no delays for mass transit, and things at the airport will also moving really wellment ukee? >> vittoria, thank you. flames engulf the top floor of this apartment building in west philly overnight. two people were hurt, including city firefighter, and it also left 60 other homeless. "eyewitness news" reporter nicole brewer joins us now, near cobbs creek, to tell you more about it, nicole, good morning. >> reporter: and good morning to you, ukee, yes, if you take a look behind me, see this scene is pretty clear. what you can't see is the extensive damage, pretty much tore through the chestnut apartment just to my left here. but, "eyewitness news" was on scene, as the flames tore through early this morning. >> i don't wish this on nobody. >> for resident in west philadelphia, a scary site this halloween morning, as dozens wait to find the upper

level he their apartment building fully engulfed in flames. >> oh, i never seen a fire like this a day in my life. i never seen it. it was flames, and fire, everywhere up there. >> it was just before midnight, when firefighters were called to the 6200 block of chestnut street for reports of heavy fire. >> i had no idea that they was going to my home where i live at, and to come see it burn down like that, crazy, man. >> samantha bowler didn't believe it at first, when officers came knocking, she didn't answer, until -- >> he kicked that door in. and i mean, he kicked that door in! and the whole door went boom. when i came outside, the whole third floor was in flames. >> the two alarm fire took about an hour and a half to get under control, as fire crews evacuated between 50 and 60 resident. >> we did transport one civil yan, one firefighter to area hospital, they are stable at this time.

>> now, the american red cross has set up shelter at the say err school at 58th and walnut streets, so far 66 resident have checked in, and there they will be provided with things like the cots, blankets, pillows, other sort of comfort items to get them through the night. for now live in west philadelphia, nicole brewer, cbs-3, "eyewitness news". >> nicole, thank you. >> happening today, septa and it largest union get back to the bargaining table at noon with potential strike looming. management and the transport workers union held talks at the wyndham hotel in old city yesterday. but, they couldn't reach a deal. they're reportedly hung up over pension benefits, any work stoppage would affect septa bus, subway, and trolley service. but the union promises to give riders 24 hours notice before a strike. also, happening today, a pennsylvania state senator leanna washington is resigning her office. washington pleaded guilty yesterday to a conflict of interest charge in norristown. the 69 year old democrat admitted using state senate staffers and other resources

to plan campaign fundraisers. >> i've always been known to stand up for what i believe in, and what is right; however, this resolution with the attorney general's office is the best decision for my constituents, my family ... >> a judge sentenced her to five month probation. she'll spend the first three month on house arrest. washington has spent more than 20 years in the legislature. she gets to keep her pension but was ordered to pay back $200,000 to taxpayers. a suspected rob is her behind bars this morning, thanks to social media, and a security camera. let's show you video shot tuesday. police say the man you see there, grabbed the woman by the hair and stole her money, then ran down the 4800 block of windsor street. word of the robbery spread through an on line community bulletin in the university city neighborhood. >> resident in the area began looking at the surveillance video equipment they have at

a little bit of that rush hour pull. so heading out of the northeast, things will only grow from right now, so if you are watching us right now, definitely anticipate that volume on southbound 95 for sure. around girard avenue, actually not awful, but through the construction zones, where things really heat up. take a look at 476, southbound, northbound, commuting around the area bridge pike. no problems just yet. around the mid-county toll plaza, schuylkill, 95, all looking good. unfortunately very serious accident now closing route 55, in new jersey, northbound, just beyond route 40. your best alternate to take is 47 or willow grove road. this accident is involving a dump truck that was containing sand and four vehicles. we will continue to keep you updated on this for sure. no delays for mass transit. ukee? >> vittoria, thank youment breaking news tops today's headlines, captured fugitive eric frein will be in court this morning at 9:00. he was apprehended yesterday in pocono township, seven weeks after he allegedly gunned down a pennsylvania

order to stay in her home. hickox took a bike ride with her boyfriend yesterday. she says she has no symptoms, and that a quarantine violates her right. her boyfriends spoke out last night, saying, the quarantine battle is disrupting his life, as well. >> i'm not able to go to school and if we had kids, they probably wouldn't be able to go to school, as well. hickox has tested negative for ebola twice. she was quarantined against her will for several days in new jersey, after flying into newark airport. >> well, don't forget, this is the weekends, we set the clocks back one hour. researchers at the london school of hygiene and tropical medicine studied whether increased daylight hours would increase children's activity levels. they looked at 23,000 children, ages five to 16, from nine countries including the united state. scientists found when it gets dark early, children are less active. >> hour of daylight and

evening, about 5% increase in the children's physical activity. >> the extra daylight could mean two more minutes of running around each day. it may not sound like a lot, but researchers say children only get about half hour of vigorous activity a day. so even a little bit would help. doctor goodman also says not big enough to get the whole solution to the problem of a lack of physical activity and obesity, but she adds, it is a step in the right direction. >> play 60, try to get 60 minutes a day. >> kids and adults. >> no question about it. trick-or-treaters will be out in full force tonight. if you see teal colored pumpkins they're if the just for decorations. >> painted pumpkins are project from the food allergy research and education organization, also called fair. the group is encouraging people to give out innocent-food treats, so children with food allergies can also enjoy the holiday. homes that are taking part this year will have those teal colored pumpkins out front. now, all week long, we've

right nowment major accident, in new jersey, if you are traveling in franklin township. gloucester county, but first, let's talk about the roosevelt boulevard. southbound roosevelt boulevard, notice, some activity over to the shoulder, good news is, this incident on the shoulder. bad news trying to recover now from residual traffic on top of some rush hour volume. southbound on the boulevard expect delays, from broad street, continuing down through to the schuylkill. >> this accident not too far away from 76, between i would say fox and the twin bridges. as we continue, let's give you update on the accident in new jersey. gloucester county between route 40, little mill road. you will have the right lane block. you have a good stretch of delays. so, a good alternate take 47 or willow grove. this accident wag involving a dump truck caring sand and four vehicles. medical helicopter was called to the scene, but they're not reporting any life threatening injuries. please give yourself more time. we will continue to keep you updated on this incident as well as your entire rush.

ukee? >> vittoria, thank you. firefighters and resident hurt in massive two alarm apartment fire in west philadelphia overnight. "eyewitness news" reporter nicole brewer, is at the scene, in cobbs creek, with more on how they are doing. nicole, good morning. >> good morning, definitely scary scene on halloween, for resident of chestnut hill amount. they woke to up find heavy fire all throughout their apartment building, also some smoke filling the hallways. now, u-shaped building, you can see, so little difficult to see all of the damage from this side, 6200 block every chestnut street here, fire crews had their work cut out for them. they work to get the massive flames under control, safely evacuating between 50 to 60 resident. now, the rest of the displaced are actually getting help from the red cross, which has set up temporary shelter inside the school at 58th and chestnut street.

>> setting one the cots, blankets, pillows, anything they need for the evening. work with the salvation army and other partner organizations, to make sure these folks are taken care of. >> and that shelter, excuse me, actually 58 answer walnut st. told two people were taken to the hospital of the university of pennsylvania. they're both in stable condition. so, other than that, no other injuries reported. live in west philadelphia, nicole brewer, cbs-3, "eyewitness news". all right, nicole, thank you. >> well, the shots taken from the sky, just breathtaking. but many philadelphia resident are cracking down on drones. police asked for the bill after a man flew a drone over the linc during the eagles-giants game october 12th. councilman james kenney says that the ordinance would make it a crime to fly over large crowds or follow people. >> you just want to make sure people understands that there is some price to pay for the misuse of technology, and misuse of things that are available to them. >> well, many people use drones, for recreation, and
