"eyewitness news" reporter jan carabeo joins us at police headquarters to bring us to up date. jan, good morning. >> erika, ukee, good morning. that suspected kidnapper now in virginia, after being arraigned in maryland yesterday morning. if you take a lock at the video, you can see our first look at him. this is delvin barnes, 37 year old, as he arrived in virginia in custody. he spotted -- he was spotted with carlesha gate nerve jessup maryland. police now say carlesha fought even harmed tear get away than originally thought. investigators say once she was thrown into that car, she found a hammer, inside, smashed out a window and attack her abductor, now rest at home with family. meanwhile the investigation

continues into her case and whether barnes could be connected to any other cases we mentioned. he's now in virginia, that's because he is facing charges thereof attempted murder, kidnapping, as well as rape, police say in october barnes hit a girl, a 16 year old girl, in the head with a shovel in that state, through her into the trunk of his car, then made her strip naked before terrorizing her. he reportedly also told that girl that he had kidnapped before. >> we'll go through our missing persons files, see if anything even remotely fits as a possible. we do know one thing, had we not rescued her, the outcome may have been quite different. >> now, "eyewitness news" sources say that barnes has confessed to kidnapping carlesha. that of course is still under investigation. again, she is now at home with her family. we're going have much more on this coming up in our next half hour, including reaction from law enforcement in two states, who say that this has been the highlight of their

career bringing carlesha home safe. reporting live outside of police headquarters, january car bay open, cbs-3, "eyewitness news". jan, thank you. brand new this morning, we now hearing from the former father-in-law every accused kidnapping suspect delvin barnes. he says barnes attacked his daughter, one week after they were married. >> i hope that he spends the rest every his life in jail. we'll give him the death penalty. he really don't deserve to be living. give him the death penalty, or spends the rest of his life in jail. >> what about the three strikes you're out thing? i mean, he got a lot of strikes. was he still doing walking around in the streets? he ain't got no business walking around in the streets. >> barnes served jail time for assaulting his then wife. her father calls this latest abduction allegation haunting. >> now the billing break in that case came thanks to gps. but not the type of electronics you're used to using, how police used the

technology to catch barnes coming up in the next half hour. stay with "eyewitness news" as we follow the investigation into the and duck sean and rescue of carlesha freeland-gaither. our coverage continues on our website cbsphilly.com. >> updating breaking news right now, at least one person died at a fire in north philly a homeless shelter this. >> "eyewitness news" reporter nicole brewer just arrived on the scene on 39,000 block of 22nd street. nicole, what's the latest? >> well, this fire, erika, ukee, was reported shortly before 3:00. then placed under control, roughly, 15 minutes later, sadly, it just wasn't enough time to save everyone inside. we are hearing everyone fatality, a male found dead on the third floor of the 3-story apartment building, it is actually home to alliance abuse mission ministries, homeless shelter here on north 22nd street. we are told the fire broke out on the third floor, and at this point, fire department officials are investigating if the fire alarms were working inside that building. they're also receiving some mixed reports on that front. but again, the investigation

is ongoing. now, it is possible we're told that this fire may be caused by the residents smoking, but again, all of this is unconfirmed at this point. we can tell you, 23 people were safely evacuated. they were taken to a shelter location, a boarding house actually, in the area called francis house. two people we're told were taken to the hospital, shortness every breath of some kind, again, due to this fire and being evacuated from the building. by the way it is the 25th fatal fire of the year here in philadelphia. >> we located an adult male on the third floor front apartment. at this time we still are trying to discern whether or not the alarm system was working. we've had mixed reports. some people say the alarm was working, some people say the alarm wasn't working. >> so, once again, this fire under investigation. we'll bring you more details as they develop here on scene, but that's the very latest live from north 22nd street,

report that fire location, 22nd street closed at toronto. so 23rd would be your best alternate, no delays for mass transit. erika? >> thank you, vet tore y breaking this morning, fire breaks out in a west philadelphia highrise. smoke bill owed from the 18th floor of the west park amounts, on holden street. firefighters got the call shortly before 2:00 a.m., and evacuated three floors of residents. they got those flames under control, about a half hour later. it is not yet clear what caused that fire. the good news, no injuries have been reported. >> and new this morning, police are investigating whether alcohol was a factor in this crash, in southwest philadelphia. it happened just before midnight, over at 61st and osage. police say a woman lost control and plowed into this church. she was taken to the hospital for treatment for a head injury. >> happening today, a ratification vote will take place for members of septa's largest transit union. leaders of transport workers local -- union local 234, and septa ex he can touch board,

approved two year agreement last week. workers are expected to approve that deal, which includes a 5% wage increase over the life of the contract. if workers reject that contract, a strike will commence at 12:01 a.m. monday. >> chester county da will seek the death penalty in the case against a mother and her boyfriends, accused of murdering her little boy. jillian tate and gary felt endbaum accused of killing little scotty mcmillan. happened inside trailer in west caln township, her other zone who is six was badly beaten. he survived. when the victim went to the emergency room, the nurses start today cry. >> the brief nightmare that was his life is over. but i promise you this: though the heavens may fall justice will be done to these defendants. >> the man's wife who also lived in the trailer with her baby is facing child endangerment charges. she reportedly found the body and called 911.

getting new information on breaking news, deadly fire at homeless shelter on 22nd street in north philadelphia. authorities are investigating report that smoke detectors may have been turned off. one person was killed, when the fire broke out on the thir floor of that shelter. some new video of delvin barnes, who is held without bail on attempted murder charges in virginia. barnes was arrested wednesday, in the abduction after philadelphia woman, carlesha freeland-gaither. she was found alive after missing for 72 hours. >> and septa workers are expected to approve a new

friday morning commute. let's get outside and take a look. looking at the schuylkill expressway, right around the area of, i would say, the south street bridge. no delays in either direction. if you are headed either westbound, these headlights here, taillights in the eastbound direction, it is great out there. you can take a sigh of relief, at least for right now. if you are traveling on the blue route, no delays as well. shot around the mid-county toll plaza, southbound, northbound looking good. also looking great on the blue route traveling the schuylkill or 95, inbetween, all of the speed censors are excellent. fifty-five your average on 95, same on the schuylkill and the block route. pa turnpike in the clear, northeast extension, still no delays. now, we do have a fire location, at 22nd street, which is closing in on toronto, best to take 23rd, i would suggest avoid that area if you k in delays for mass transit. things at the airport look even better. ukee? >> vittoria, thank you. new this morning, two pilots killed after army national guard helicopter crashes in idaho. chopper on training mission, when it crashed about 2 miles away from the base in boise.

two pilots were the only people on board. >> we have some wild video now from houston. watch here, as suv slams into a crowded restaurant. the driver hit several diners, even pink some of them against the buffet. a handful of people were hurt, most suffering minor injuries. the driver told police that was trying park but hit the gas instead of the brake. >> also caught on camera, minnesota hospital patient attacking nurses, with a metal bar. this happened over the weekend, but police just released video late yesterday. they say 68 year old charles logan fled after the attack, and died right after officers shock him with a taser and arrested him. >> logan had been initially hospitalized for confusion. it is unclear what prompted this attack. eight nurses injured, one suffered a collapsed lung. >> well, dozens every local grocery stores are about to close for good. find out why the discount stores are shutting down. >> also, flu shot or flu spray? it turns out that one of those

we are continuing to follow breaking news this morning, fire at homeless shelter in north philadelphia has left one person dead. and now there are conflicting reports whether or not the smoke detectors inside that building were working. >> good morning, everyone, let's get you right out to reporter nicole brewer on the scene at 3,000 block of 22nd street. nicole? >> and ukee, erika, this fire was actually placed under control, in about 15 minutes. sadly, it wasn't enough to

rescue everyone inside, as you mentioned, one person, one man, was found dead, inside this three-story apartment building, on the third floor. now, according to officials, walker was found inside that victim's bedroom indicating he may have been disable. he was one of two dozen people, staying here, at the alliance of youth mission ministries, homeless shelter on north 22nd street. now, we are told the fire broke out on the third floor, again, inside that victim's room, at this point, fire department officials investigating if fire alarms were working inside that building, they've actually received some mixed reports, that indicate, they may have been turned off. but again that investigation still underway. it is also possible that this fire may have been caused by that resident smoking by that victim smoking there on the third floor. but again, we cannot fully confirm. we can tell you, 23 people were safely evacuated, they were taken to another shelter location. the board g house called the francis houwo
