and they're off, happening right now the start of the 2014 philadelphia marathon, thousands of elite runners getting started on a 26-mile journey. our syma chowdhry is live at the starting point with more on. that. first on 3a northeast philadelphia a man arrested two years ago for slashing tires is once again in trouble with the law. david toledo is arrested again. we will explain. and a live look at center sit friday campbell's field, we are getting readied for possible record breaking warmth tomorrow but there could be travel troubles ahead this week. just in time for the holiday. we will break it down. it is sunday november 23rd good morning thanks so much for joining us. i'm nicole brewer. it is 7:00 o'clock on the dot. lets get a check of the forecast and already we are warmer today then yesterday, car will ol. >> we are a lot warmer and a it feels so good, as they say

because these temperatures are 20 degrees, in some cases, above where they were yesterday morning and tomorrow morning, i think we can probably add another 20 degrees to that. we have a warm upcoming. look at how pretty it looks out there. center city out there, you can see silhouette of the ben franklin bridge, the sky, very, very interesting this morning. we have comfortable temperatures. 41 degrees is the reading in reading. this morning we have light cloud cover and then storm scan three and notice to the south this area of precipitation that will be starting to move in here as we move through the evening and especially the the offer nighttime period and first thing tomorrow. so, decent amount of rain will be coming into the area overnight and first part of tomorrow but warm up follows right with it. 41 degrees in philadelphia we have 39 in trenton. 35 degrees in wilmington. everybody is above the freezing mark. look at the poconos, 40 degrees this morning. that is 23 degrees warmer then it was yesterday morning. we're 24 degrees warmer in millville then it was

famous marks like city hall, independence mall, they will get through fairmount park. it is an amazing day for these guys who have been training for months, for years, and they have been training to get here in philadelphia. it is a 21st annual, lots of folks out here. super excited. they have been broken down in groups. this is first group that is taking off right now. the mayor was here, he has been blowing the horn getting everybody all excited about the philadelphia marathon. he has also been doing his special high five and if you guys remember every marathon he comes out and high five's all of the run hours pass him by. it is a monumental day to be out here on the ben franklin parkway to see the flags of the international community here because this is not just a regional race or just isn't something that people all over the country participate in. this is an international event here in philadelphia. so lots of runners will be running down ben franklin parkway looking at the flags that they represent. so it is one of those moments

where you sit there and proud to be here in philadelphia, watching, and a cheering these folks on. some of them are philadelphian. some of them are coming from all over. again, we have 30,000 participants but countless numbers, of people coming in here and just cheering them on, and if you do want to come down here there are certain cheering sections thaw can go and cheer on just perfect strangers. but if you want to come to philadelphia for other reasons you may want to give yourself on is extra time because there are a lot of road closures and, of course, find that out on our web site as well. i'll send it back to you, nicole. >> hey if you need some within to cheer for my sister and brother-in-law running in the race today. best of luck to them. >> wow. >> same, thank you. >> reporter: it is 7:04. new this morning police are investigating a shooting in philadelphia's frankford neighborhood. it happened around 1:00 a.m. in the 4600 block of penn straight. a three two-year old man was shot in the leg there and taken to the hospital where he is listed in stable condition and in word on a suspect at

this time. controversial former washington d.c. mayor and civil rights activist marion barry has died. a spokesperson says he passed away early this morning at a hospital in washington. barry served four terms as mayor and was reelect to city council in 2012. but he may be mess remembered for his scandals, including a 1990 drug arrest for which he served six months in jail. a cause of death has not been released, marion barry was 78 years old. this is a story you saw first on three, david toledo made headlines two years ago when i was arrested for multiple tire slashing in mayfair. this time police say he was caught trying to vandal ice a septa vehicle. "eyewitness news" reporter matt rivers was first to break the story. >> reporter: the alleged crime happened right here near toledo's oxford circle home. this time the tool of choice a glue mouse trap with nails stuck on top. >> we think i he its nuts.

the guy needs help y would you want to destroy peoples property. it is ridiculous. >> reporter: on wednesday police say toledo walk up behind a septa vehicle parked near this intersection and place aid trap behind the tire. they say a septa employee was in the front seat and watched street owe walk back inside his home on the block. woman inside shut the door on us when we asked for comment. neighbors say the block surrounding the home have been target by vandalism for months with screws, nails and even glass left in streets and driveways. >> when i heard bit, i went and checked it out and i found a few behind my house. >> reporter: so far police have not linked toledo to those crimes. it was back in may that he was sentenced to two years probation for slashing tires in mayfair in 2012. after prosecutors push for five to ten years in prison. >> just very happy with the outcome. >> reporter: neighbors were not as pleased. >> when you heard he only got probation back in may were you fearful this could happen. >> i knew it would happen. knew would it happen.

absolutely. >> there is always that fear that it will pick up again and apparently it has. >> reporter: it was just after 7:00 o'clock saturday evening toledo was formally arraigned on a criminal mischief charge and several other related offenses. we are live outside northeast detective, matt rivers, cbs-3 "eyewitness news". authorities say a gunman on the run struck a philadelphia police officer with his getaway car in west kensington. it happened on the 2300 block of north fair hill street where officer was responding to a call with the person with the gun last night. officials say the officer suffered scrapes and bruises but is okay. the suspect was arrested. the search is on for a cause of the town house fire that killed a young man in horsham, montgomery county. flames broke out in the 300 block of green meadow lane early saturday morning. one unit was heavily damaged, several others have water and smoke damage. it took fire fighters about an hour to contain the flames. police say that a father accidentally shot and killed his adult son during a hunting

trip in west windsor, new jersey. investigators say the father, in his 70's, mistakenly shot his 45 year-old son in the back of the head. he was pronounced dead at that scene. it all happened on old trenton road a large farm around 4:00 yesterday. the victim and his father were only two people in that hunting party and they were both licensed to hunt birds. that investigation is ongoing, details point to this being a hunting accident. developing right now, sources tell cbs news a grand jury decision in ferguson, missouri is not expect before monday. panel is deciding whether to duty police officer for shooting death of the unarmed teenager but as cbs news correspondent omar villafranca tensions remain in ferguson as anxious residents await that decision. >> reporter: barricades are going up around a the courthouse in clayton, missouri, it is inside this building that a grand jury has met for more than three months, charged with deciding whether to indict ferguson

police officer darren wilson for shoot to go death 18 year-old michael brown last august. protests are expected, regardless of the grand jury a's decision, police say they have concerns but they are ready. >> biggest concern would be just that, you know, regardless of the decision that we see the violence that we saw in august. if somebody runs at a policeman, whether that is somebody protesting and exercising their rights that is seriously injured or killed. >> reporter: there have been fewer than a dozen a rests after three straight nights of protests outside the ferguson police department as a tense community awaits a grand jury's decision. most of the arrests came after protesters block traffic. authorities activist and even the family of michael brown are calling for calm, as the grand jury's decision draws closer. >> hurting others or destroying property is not the answer. >> reporter: 1,000 local police officers have received extra training in how to handle protesters. another 400 members of the national guard and 100 fbi

olympics. japanese officials say it was a magnitude 6.7 but so far, no deaths have been reported drivers in western pennsylvania were hit the by slick conditions. freezing rain was blamed for a number of crashes throughout the pittsburgh area officials closed sections of several highways and interstates and in one spot icy roads caused a a ten car pile up. well, progress to report in buffalo, new york, drivers are now free to exit the new york state through way in the area pummeled bias much as 7 feet of snow but as cbs news correspondent jericka duncan explains is there a new round of concerns. snow is still stopping people from getting around western new york. days after two storms dumped 7 feet of snow in some places, plows are out clearing streets, cars and even trucks remain buried under several feet have of snow. officials have recovered more than 500 abandoned vehicles. >> our motto is, prepare, for

>> reporter: he said he lost thousands of dollars last week and isn't looking forward to losing more because of flooding. >> but again, you know, there is nothing we can do about it. we have to get with the flow and see what happens. >> reporter: jericka duncan, cbs-3 "eyewitness news". wow. >> such a mess up there, carol. >> it is. >> it is, it brings home the reality and harshness that weather can do to lives and that sort of thing. that is just awful. we are looking by contrast at a nice day today. we have nice looking weather starting to day and will last all day long. the sunnies up at the shore. we will be seeing sunshine today, looks terrific here. what else do we see outside our window? we will find the following. a 41-degree temperature in philadelphia. we have 39 in trenton. thirty-five wilmington. thirty-six in millville. all of these temperatures so much warmer then it was yesterday morning. so that is a little gift that we get today. now, the punishment out of all of this may be the rain that we start to see but i'll tell

you what, it comes with temperatures in the lower 70's. if you have to have lower 70's with rainy think after the cold we have seen we will probably sake that combination. we will get it anyway so we might as well take it. this rain moving in the our area. warmer temperatures from the south, also moving in the area. it will be a mild day today with temperatures getting into the 250's, middle 50's. yesterday we were in the middle 40's. warm front comes through. our temperature tomorrow will be about 70, 71 degrees. this is just about record warmth, 71 is the record. cold front comes through here and that is later on monday night and that drops our temperatures on tuesday, to the 50's and then there is a system that will be forming and we will talk about that. lets get through this rain first. here is the computer model that says and it is already changed this morning. so, nothing is set in stone. just know that probably most areas, under an inch of rain though there could be some spots, where we pick up a little bit more than that and maybe not even necessarily

where it is indicated here as i said the computer models have been changing a a lot on that but just know that rain and possibly heavy at times can be happening overnight tonight, and for the first part of tomorrow. let's show you this. this is on our future weather. we will see this rain here at 1:00 in the morning. this is 5:00 o'clock, 6:00 o'clock, we have seen heavy rain coming through. generally it leaves after the morning hour, lingering shower and then warm and breezy for rest of the day on monday, and then tuesday we will start to see some clouds. wednesday we will start to see some clouds and this is the other issue, we've got a coatal storm that may be forming off the coast, where did his it get? track is in the set. one scenario takes it a little further out, we will get some rain. another one brings it closer drawing down more cold air and some spots could be picking up some snow mixing in. computer models have been changing a a lot, this will not look probably like it looks, some area may in the get anything. we may in the get anything out of this.

the chances of significant accumulating snow are pretty remote but this computer model says you could see a mix in here through philadelphia, not much at the shore, little bit more as you go north and west. i don't think the amount that will be as problematic as the timing, the day before thanksgiving. so philadelphia today they no problems, 55, 55 at the shore, poconos, 48 degrees. i think it is just a reminder that on wednesday if you can leave earlier just to avoid any kind of wet weather if it is just rain, might be a good idea. fifty-five for us. today is a good day to get away from work tomorrow. 48 degrees. shower overnight. some of that could get heavy overnight. most of the day tomorrow we should be rain free but we will start wet, morning rush impacted, 72 degrees tomorrow. tuesday, 55. it is dry. wednesday we will pick up the clouds. we will also pick up some rain, snow, is it mix? is it just rain? does it change over to a little will bit of snow? that is still way far out and yet to be determined, but we

today, it is sunday in 23rd, good morning, thanks so much for joining us. i'm nicole brewer. just past 7:30. let check that forecast and a warm up is already underway, um, carol, a lot better out there. >> a welcome warm up too. there are no complaints, being heard on this one. we've got temperatures today, nicole and everyone that will be 10 degrees warmer then they were yesterday and we will be warmer than that tomorrow. but it is beautiful out there lets look outside and find the very quiet, ocean city boardwalk with the blue skies, it looks beautiful down there. then you head up to jack frost big boulder and another look, a couple clouds through that area and some snow that they have made and i have watched people yesterday sipping down that ski slope. so it looks like a wintry weather but it will not feel

wintry over the next couple of days. 37 degrees in kutztown right now with an interesting sky out there. just a very quiet morning. storm scan three in our area not showing anything. we have a few clouds around as you can tell by those camera. otherwise it is a lot warmer, 40 degrees in the poconos. yesterday in the teens at this hour. thirty-four in allentown. yesterday was 15 degrees up there. right now 41 in philadelphia. everybody is much warmer today and we will be getting even warmer tomorrow. by noon time we are at 51 degrees, by 3:00 p.m. we will reach the high in the middle 50's today. i want to put this time line on it real quickly and you can see a couple clouds this afternoon but some sunshine too and then as we go through the overnight time period we will start to pick up heavier rain and we will find that moving through the area, throughout the overnight time period and first part of that morning rush hour but a huge warm up tomorrow and then possibility of some travel issues on wednesday. maybe not huge but there will

be so many people out that could make it huge, so we will talk more about that, coming up, nicole. >> carol, thank you. well, 26th annual philadelphia marathon is underway, about 30,000 runners are participating in this years race, our syma chowdhry is live on the ben franklin parkway where the first set of runners took off 30 minutes ago, syma? >> reporter: yeah, just a little less than 30 minutes ago and there are still groups, taking off from here. i know it is hard to see from where i'm standing but there are groups of people that go all the way around eakins oval. 30,000 runners. just the runners. forget about people coming out here to cheer them on. there is a lot of folks out here, getting ready to just start running. whether they took off at a great speed. it is a amazing, amazing, experience for those folks out there, and we just talked to some people who they were first time runners, they were really excited to be part of that. there is some cheering sections for those whether or not running or they want to

watch, and participate in that way. lots of great spots. they will be stopping at around city hall, independent mall, and it is a great brand for philadelphia in general. hosting a all of these people. these people are not just from this area they are not just from this country a lot of these people are also international runners. now we have spoken with one marathon trainer who had a group together, and she took brand new runners, people who have have never run, a mar then let alone a 5k or anything like that, and decided to train them for six months and this is what she had to say. >> you can totally to it. anyone contact than do it. we started program in may. six month long program. the these people cannot run a lap around the track on day one. you can do it over a long period of time, slow and steady and you will like it. so, anyone can do it. >> slow and steady is key. so, if you are going to train,

hand of their mother. vigil will be held at 6:30 at the town hall there. new jersey state police say jeaninne lepage shot her three children and then turn the gun on her son, nadia harriman and her brother nicholas harriman died. le page and another child are listed in critical condition. will well, strong show of support for president obama's plan to fix the immigration system. philadelphia community leaders gathered in center city to praise the president's decision to use an executive order to implement his plan. it will allow 5 million undocumented parents of u.s. citizens or legal permanent residence to stay in the country and work. republican leaders say that the president is over stepping his authority by by passing congress. meantime the new york times is reporting that president obama has signed a secret order involving our troops in afghanistan. it reportedly authorize a more expansive mission next year. the reported move would ensure american troops have a direct role in carrying out missions

well, thanksgiving is just days away but the holiday came early for a group of south jersey resident, as our natasha brown tells us it was a special event that provided not only a delicious meal but highlighted the true meaning of the holidays. >> reporter: at least 100 volunteers and five star chef helps make this the perfect thanksgiving day dinner for hundreds of south jersey residents. their church in winslow township, new jersey is providing a thanksgiving meal filled with turkey and all fixins for those who may otherwise be dining alone or not at all this thanksgiving day. >> really what we want is not only to give people food but restore human dignity, so we want to make sure it is done in an environment where that

minnesota made a stop along the banks of the schuylkill river right here in philadelphia. it is part of their 2,000-mile voyage to celebrate 50th anniversary of the wilderness act and promote protection of the boundary waters in northern minnesota for miles. >> gathering signatures, all along the the way to support the boundary waters and we are telling everybody about what a special place it is, and encouraging people to come to northern minnesota and visit for themselves. >> all right. there you go. they have been on their journey for 90 days. they have ten more until their arrival in washington d.c. wow. crazy. well, we have all heard of chestnut stuffing, right? this is a stuff bye a guy named chestnut stuffing himself. you know all about this guy. competitive either and frequent wing bowl participant joey chestnut won a competition yesterday. all he had to do was scarf down an entire thanksgiving day turkey. >> three, two, one...

>> so they start. this competition specifically is a 20-pound turkey. each competitor has the same weight. at the end of the ten minutes there will be a weight change. whoever eats most, wins. >> the the pulse quickens, begin to sweat, the whole deal. it was absolutely amazing today. joey chest nut. >> i stuck to my plan, bottom meat first, take out a breast and just drink, drink, swallow. >> he ate 9.35-pound of turkey meat off the bone. i have never seen anything like it in my life. >> drum stick right there. >> we saw not just a world record set but completely obliterated. >> i have never seen anything like it.

there. michael says it is beautiful out there in mount gretna. i want to show you his picture because we are looking at beautiful, look at that, gorgeous picture. leaves are gone. you can see the sky. so a nice start to the day. it is pretty through center city philadelphia. and, so many people out there, and they are running around, and ben franklin bridge showing us ben franklin bridge and the the skies, beyond which of course more important to us since we're talking about what the weather will be today. i think weather to take will be just fine. we've got temperatures that will be in the middle 50's, quiet all day long weather-wise and then we will get rain tonight and start the day tomorrow. huge warm up tomorrow, and then we will get quiet again before we don't get that quiet again. quite a little will pattern we have got going. 41 degrees in philadelphia we hit 39 in trenton. thirty-five in wilmington. forty in the poconos. you can tell just how much warmer it is this morning then yesterday morning when we started in the teens in so many locations. owe storm scan three showing a

large area have of precipitation. we will be finding rain moving into our area as well, it starts right around midnight, tonight, give or take an hour or so in your area. that will be leading to a very warm day tomorrow because rain coming up from the south and those temperatures are coming up from the south as well. so today, just about where it should be. where it should have been for weeks now, we should have been in the middle 50's. you know how cold it has been. it will be in the middle 50's today. tomorrow we will be around 70 degrees. we might even be a couple of degrees higher then that after the warm front goes through. the rain comes. and then monday night, a cold front comes through here and that will drop us, somewhat dramatically but still back into a comfortable where we are seeing range in the 50's by the time we get to tuesday. as far as rain goes, computer models are saying that, you know, generally we should be looking at least than a inch of rain but it could be a substantial amount have of rain, an inch of rain is, plenty of rain, and then maybe some areas, picking up more than.

that we will time it all out and you can see today, it looks fine. we have a couple of clouds from time to time. it is tonight that we will pick up this heavier rain and this is at 1:00 o'clock in the morning. notice yellow. those yellow goes have gone through philadelphia the 6:00 a.m. according to this computer model. some of the heavy. we will be finding some ponding on the road and that sort of thing. then the rest of the afternoon it looks like we will generally look for better weather, it is warmer tomorrow. the breeze picks up. and then we will start to await what is coming, next, and that is going to be a low pressure system off the coast, and how closely does it come to the coast? that is going to change. computer models have various solutions to this, not set in stone, at this point, and neither is this but everybody wants to know what are we talking about. well, maybe nothing. maybe just rain, snow mix. we will refine that as this gets closer but the threat of a significant snow is pretty remet but little bit of snow could be mixed in on wednesday. biggest problem with that is
