♪ >> breaking news right now at 11:00. a raging fire tears through a philadelphia apartment building. fire crews from across the city spent hours battling this big blaze. good evening, i'm jessica dean. >> i'm chris may. and it is a busy night of news. we'll get things started with die app in a rocco live at the fire seen at 53rd and montgomery in wynnefield. diana? >> reporter: chris and

jessica, within the last hour, that fire has been brought under control. but it was burning out of control for the better part of two hours this evening. chopper three overhead. you can see just what's happening right now many firefighters are still trying to put out some hot spots. i'm told that at least four units were affected. the red cross is on scene. they've just brought in a septa bus for all of the people who have been standing on the street for hours waiting for word. they say right now at least five people have been displaced. but that number may grow. flames shoot from the roof of this building on 53rd street chopper three shows firefighters on the roof trying to gain control from up above. the fire broke out just before 7:30 wednesday. neighbors say it started in an abandoned building next door to the apartments and quickly spread. two hours later, smoke still pours from the second floor. and flames light up the sky. from the street firefighters can be seen moving through the building. next next door to the abandoned

building and heard banging on her doors. she talked to "eyewitness news" as she watched units next to hers burn but didn't want to show her face. >> when i looked out the window they told me the house next door was burning down and to get out many i grabbed the stuff that was in my reach and iran out the back door. when i walk outside the window busted and the flames was coming towards my car. so i jumped in the car and moved the car. >> reporter: what are you thinking? >> 20 times worse than it was when it started. >> reporter: that woman tells me she will be staying with her parents tonight. fear fighters are still searching for what started all of this. still a lot of people waiting to get back into their apartments. many anxious to check op pets. we're live in the wynnefield second of the city night, diana rocco cbs3 "eyewitness news". >> diana, thank you. tonight grand jury decisions in ferguson and new york city are fueling new protests in philadelphia.

demonstrators took over 30th street station lying on the ground in silent protests. they then descended upon the streets of center city blocking traffic during their march to city hall. tonight demonstrators expressed their outrage by disrupting the lighting of the city's christmas tree. "eyewitness news" reporter todd quinones is there live to show us what happened tonight. todd? >> reporter: jessica, quite frankly it was a strange collision of christmas carols and protesters shouting. >> surreal seen demonstrators filled the courtyard at city hall. >> we're out here because we want justice and we've seen people of color being killed on dale basis and the cops that killed them are getting i was. >> reporter: all of this happening in front of families trying to enjoy the christmas tree lighting ceremony some of them while one man got into an argument with demonstrators. >> all these young folks down here they practiced to put on a good show and they drown them out with sirens. why didn't they protest somewhere else. >> this is something that should

be kept positive. the people down here are going about it the wrong way. >> there were a few minor brief confrontations with police. one protester was taken into police custody after police say he climbed over a barricade. police on bikes moved in close to the tree among the protesters as there was concern the christmas tree lights may have been tampered with. >> the tree was being unplugged and so forth so we just had to make sure we can reconnect everything and get it going. >> reporter: for three hours demonstrators shouted used sirens from mega phones to make their point about the death of michael brown and eric garner. >> it's travesty of justice what happened and we'll have to take to the streets and make a change. >> reporter: after the protesters left the names of michael brown and eric garner would be seen spray painted on decorations. >> they're only ruining it for the rest of the enabled and the rest of the people who want their children to see something like this. why do it? i don't understand. what do you get out of it? >> all this began with what was called a die in at 30th street

station from demonstrators laid on the ground. then the protesters took to the streets marching chanting through center city before making their way to city hall. and despite those minor -- those minor conflicts with police here the protesters were loud but they were peaceful. reporting live tonight from city hall, todd quinones cbs3 "eyewitness news". >> no justice, in piece! >> reporter: rage in new york city tonight after a grand jury declined to indict an nypd officer in the choke hold death of err rec garner and the tone of tonight's protest reminiscent of those that followed the ferg energy case with demonstrators accusing the police of racism. garner was black man officer daniel pent lay yo is white. the two came together in july on staten island in an incident that was caught on amateur vid video. several police officers were trying to arrest garner for selling illegal cigarettes when

pant lay yo used a choke hold to take him down. the 43-year-old died an hour later. his death was ruled a hmm side. tonight new york's mayor and the president spoke about the grand jury's decision. >> they've said black lives matter. they said it because it had to be said. >> the concern on the part of too many minority communities that law enforcement is not working with them and dealing with them in a fairway. >> tonight the justice department tells cbs news it will open a criminal civil rights investigation into garner's death. breaking news into the newsroom much police in burlington county are investigating after a pedestrian was hit and killed by a car tonight. chopper three over route 130 at the cooper street intersection in edgewater park. we're told that road is shut down right now. police have not yet released the victim's name. >> new tonight, we've learned

crews have recovered a body from the christina river in delaware. it is believed to be of 25-year-old emmanuel gatling. he disappear after the barge he was on capsized near the port of wilmington last night. two other men also went overboard. they were quickly rescued. also, new tonight, a campus community comes together in show of support and strength. they turned out for missing west chester university student shane montgomery. he disappeared exact al weeing a early on thanksgiving morning. "eyewitness news" reporter david spunt tells us those at tonight' vigil say they're not giving up hope. >> reporter: it's the first time shane montgomery's friends have been together on campus since he mysteriously disappeared one week ago. >> just the fact that he's gone is making the atmosphere on campus different. >> reporter: joanna rodriguez is one of montgomery's closest friends on campus. >> it's really hard walking around knowing that he should be on those streets with us also. especially just because it's already tuesday.

and he has so many class that is we should have crossed paths. >> reporter: on the cam pass shane montgomery loved candlelight brought together his family, friends and complete strangers. earlier in the day some of the same crowd braced the rain to post missing person's signs with updated information in manayunk. >> we need to just get as many prayers and thoughts out as there as we possibly can. >> montgomery's roommate ryan says coming back to school after thanksgiving break is almost impossible. >> how weird it is just knowing that he's missing and everything here is still going on. and i'm still trying to wrap my head around that. >> he says negativity does not help any situation. so he's doing his part to stay positive hoping something will break. >> i really deep down in my heart feel shane is alive somewhere, and i know the fbi is doing everything they can. >> this is the official missing poster for shane montgomery. if you have any information call

the fbi2154184000. reward now $31,000. reporting from west chester university campus, david spunt, cbs3 "eyewitness news". >> tonight philadelphia police want your help to catch some suspects wanted for a beating that was caught on surveillance video. this happened november 15th on north fourth street. a 1784 old male was walking home just before 1:00 in the morning when these three suspects attacked him. had a he was injured. he lost consciousness. a $1,000 reward is now being offered for information leading to the arrest and conviction of the suspects. >> a 15 year old girl is in critical condition tonight after being hit by a pickup truck on the boulevard. she was hit this morning in the northbound outer lanes near ryan avenue. a student at little flour catholic high school, she was walking to the bus stop at the time and was in the crosswalk when she was hit. the driver of that truck did stop at the scene. >> new at 11 camden county

police department honoring some of its finest tonight. the department presented citations and service awards to officers and civilians. "eyewitness news" at camden county college's campus in camden. more than 120 there were honored for consistently going above and beyond the call of duty. >> right now nasa is preparing for the nation's newest space craft for humans. the orion launches from cape canaveral florida in the morning for its first test flight. it's hoped this mission will be the first step toward human exploration of the solar system possibly leading to a trip to mars. the test flight will not carry a crew that way the mission team can see if everything work without worrying about loss of life. >> haven't had this feeling in while since the end of the shuttle program launching an american space craft from america's soil and beginning something new. >> after soaring to an orbit 3600 miles above earth the capsule will then descend through temperatures nearing

>> bill cosby under fire. the day after a woman filed a lawsuit in california alleging he molested her in 1974 when she was just 15. three more accusors have come forward telling their stories along defense attorney gloria allred. >> the three women were all moved to tears as they leveled allegations of sexual abuse at the em balanced comedian bill cosby. shalon claims she was just 17 when cosby drugged and sexually assaulted her. >> i couldn't move or say anything. >> beth ferrier claimed to have an affair with cosby and accuses him of drugging her in the mid 80. >> i woke up in the back of my car alone. my clothes were a mess. my bra was undone. >> hell hen hayes detailed what she claims was unwanted sexual advance in pebble beach more than four decades ago. >> he approached me from behind and reached over my shoulder and grabbed my right breast.

>> these three women joined roughly a dozen other who's have come forward in recent weeks accusing cosby of sexual abuse. he has never been criminally charged, and with his accusors detailing allegations often decades old, it's unlikely he ever will. local law professor marcy hamilton tells "eyewitness news" the cosby saga reveals a flaw in the system. >> there is no justification for statute of limitation against child sex abuse victims. they typically can't process it. they honestly don't understand many times what was happening either because they've been drugged or they're made inn tock indicated. >> the 77-year-old actor has repeatedly declined to address the allegations. his attorneys previously called the claims of sexual abuse absurd. >> cosby's weekend performances near new york city have been postponed on monday he resigned from the board of trustees at temple university. >> the supreme court is now weighing whether employer shows accommodate pregnant women who are no longer able to do some of

the tasks they were hired to do. moms rallied out the court in support of peggy young a former ups driver. she wanted lighter duty after a doctor told her she would no longer be a able to lift more than 20 pounds but ups put her on leave without a salary or health benefits. the court is weighing whether ups violated the federal pregnant discrimination act. >> it wasn't ups's place to force peggy young to choose between giving birth to her daughter trinity or working her job. >> ups says it followed the law. but recently changed its policy to offer more com indications for pregnant women. >> the company behind bill millions of defective air bags is refusing the government's call for a nationwide recall. air bags made by takata have been linked to several deaths and dozens of injuries they have inflated suddenly shooting metal pieces into the passenger compartment. >> takata says there's no

"eyewitness weather" watchers reporting a variety of conditions. let's start toward the shore tuckerton tim is saying 39 degrees and clear skies the there. moving toward philadelphia still on the jersey side, 39 degrees in cherry hill. allison is reporting barometer rising that is a sign that fair weather high pressure is moving in. to the north and west of the city of philadelphia, eileen says 35 degrees. not much of a wind the pressurizing and cold, clear and moonlit.

pressurizing that's already beginning. for friday still chilly with temperatures in the 40s. but more clouds. as this warm front approaches from the south. that warm front will be the start of a rainy period. rain friday night, rain saturday, even though it's mild around 50 and there are some indications that this could stall and keep some rain in the forecast for the eagles game on sunday. fir things first though. here's saturday. periods of rain. this will be the rainy eighty three day. with about half an inch in philadelphia potentially higher amounts to the north and west and even ponding on area roads. overnight look for those moonlit skies us it will be seasonably. 34 in the city. colder in our suburb. thursday sunshine increasing high clouds as that warm front gets a little bit closer. it will be cool with a high item which are of 45. but with that northwesterly wind we'll feel a chill in the air in if you're lucky enough to go down to the linc with a ticket for that game on season day can be you've at 4:25 right now it looks like a chance of showers. a little bit of a wind out of the northeast temperatures
