overnight. police say a construction workers was hit and killed by a car near route 100 around 11:00 o'clock. we are toll the driver stayed at the scene. we are waiting to hear if charges will be filed against had driver. that accident remains under investigation. demonstrators upstaged a tree lighting ceremony in city a hall. >> reporter: they gathered in protest not to indict police officers in the death of two unarmed black member. "eyewitness news" reporter justin finch is a at city hall with reaction from spectators and protesters, justin, good morning. >> reporter: good morning, ukee and nicole. wait as i day of demonstrations yesterday that began with the silent demonstration at 30th street station. from there the protest moved here to city hall for that tree lighting where things got a lot louder. lets take you to video. we are looking at inn identify city hall courtyard where protesters and families gathered for that ceremony last night.

street you will notice things are wide opened for you. commuting southbound up and over girard point bridge making your way in to delaware county no delays or problems. traveling northbound we have the same store friday delaware county all the way into far northeast. overall our speed sensors are still high up in the 50's just how we like it. fifty-five on the schuylkill. same thing on i-95 inn blue route. pennsylvania turnpike, northeast extension, all things moving well and 422 looking great, finally. if you are traveling, however in the northeast there is a roosevelt boulevard at welsh there is no cross traffic due to a traffic light malfunction. best alternate to use would be to take grant avenue. that is your best bet. traveling northeast extension beyond lansdale we are dealing with construction. be mine full of the guys and girls until the hard hats n delays for mass transit. things at the airport are looking fine, ukee. as justin finch mentioned at the top of the broad was the justice department is conducting a federal investigation in the death of the man put in the choke hold by a new york city police

officer. >> no just advertise, no peace. >> reporter: protesters took to the streets in new york last night after a grand jury decided not to indict officer daniel pantleo in the death of eric garner. officer is white, garner is black. video camera incident happened in july. several officers were trying to arrest garner for selling illegal cigarettes when pantleo used a choke hold. he died an hour later. his death was ruled a homicide. last night pantleo says he feels very bad about garner's death. his widow says it is too late for remorse. >> your time for remorse when my husband was yelling to breathe. that would have been the time for him to show on type of remorse. >> nypd bans choke holds and department is conducting its own investigation. >> new this morning philadelphia police are looking for a gunman who shot a man in oxford circle.

investigators say man fired in the car in the 6600 block of castor avenue. he wounded a 41 year-old man three times in the arm. victim is in stable condition, police believe the gun man drove off in a dark red jeep. an apartment building fire lights up the sky in west philadelphia displacing at least 15 people. crews responded to the scene at 53rd and montgomery around 7:30 last night. chopper three shows fire fighters trying to get control from the rooftop. a woman lived in the first floor apartment and he spoke with "eyewitness news" while she watched the fire burn but did not want to show her face. >> when i looked out the window he told me that the house next door was burning down. so i just got out. i grabbed the stuff in my reach and i ran out of the back door. >> fire fighters gained control of the flames around 9:30 and fortunately no injuries were reported. the cause of the fire remains under investigation. happening today, nasa is about to test the next phase

grand jury decisionness missouri and new york spark demonstrations across the country including right here in philadelphia protesters disrupted last night's city hall christmas tree lighting festivities by can chanting slogans and blocking traffic. demonstrations were over the deaths of unarmed black men at the hands of the white police officers. police made just one arrest there. the tree lighting took place as scheduled. several people are in the care of the red cross after this apartment house fire at 53rd and westmontmont have avenue in wynfield. there were no reports of injuries and no word so far on the cause. the oryan spacecraft lifts off in two hours bound for four and a half hours, test flight. there are no astronauts on board. it is expected to orbit earth

i-95 is wide opened heating in the southbound direction as you are here, maybe traveling northbound further into the the north east, you look nice and not only around center city, northeast philadelphia, delaware county, delaware itself, so things are, just a great start, 76 at 202 we have the same story. wide opened, no volume, no problems, only a few vehicles on the road. speed sensors still high up in the 50's, schuylkill rather, 95, 52 is what you are traveling on 476, no delays in the northeast extension, pennsylvania turnpike all moving well. however in the northeast from the roosevelt boulevard from welsh road there is no cross traffic, they are doing traffic light malfunctions. if this is where you are heed use grant avenue as an ultimate. the when sun comes up, rush comes in. it seems like we will finally have some sunday, katie. >> we will get in on a brighter day. a nice little brake for a chance. and it is coming in courtesy of high pressure building in
