to the fire, fiery end to this one car crash, leaves a man dead. it happened just before 1:30, on hill dale and bummcar roads in cheltenham township. police say the driver trashed into a pole, two park cars, before flipping over and bursting into flames. the crash remains under investigation this morning, police looking for gunman who shot a man in university city. no word on what led to the shooting which happened 40th and market around 12:30 this morning. after that, the 30 year old victim ran into a bar where police say he works as a bar teer. the man is in stage. stable condition with gunshot wound to his left thigh. >> good morning, everyone, thank you for joining us. also this morning, bill cosby firing back, the comedian counter suing a woman who claims he molested her four decades ago when she was just 15 years old. >> yes, cosby's lawyers are asking a california judge to throw out her lawsuit. yesterday, cosby's lawyer accused one of his latest accusers of only coming forward to get some of his money. but the lapd chief says all of the cosby claims are worth looking into, even if they exceed the statute of limitations. >> speaking to the press, thursday, lapd chief charlie said his agency is prepared to investigate sex assault claims, against bill cosby, even if he can't be criminally charged. >> now, they could be using in civil recourse, or number of other things. we don't turn people away because things are out of statute. you come to us specially now with sexual allegations, you know, we will work with you. >> the lapd would not elaborate on the chief's comments, but, former la county prosecutor steve mizer says, the move is unusual, unlikely, and possibly illegal. >> if lapd takes taxpayer dollars, uses them to function as private investigator for private plaintiff, that should be construed as an unlawful gift of public funds and it

should be barred. >> that would apply to the woman who filed suit against cosby, tuesday, she claims the comedian sexually assaulted her in 1974 at the playboy mansion when she was only 15 years old. cosby's attorneys are working to dismiss the suit calling her story false, and saying she tried selling it to tabloids a decade ago, and, made extortion threats to mr. cosby about criminal penalties, coupled with demand for a six figure payday to keep quiet. and offering as proof copies after letter dated december 1st, reading: your demand for money from mr. cosby is rejected. now, the lapd says it has no record of complaints against cosby, this is truly been a water shed week for the comic. we saw him step down from his trustee duties at temple that week, as well, as us navy revoked his honorary chief petty officer status. we are live in the sat center, justin finch, cbs-3, "eyewitness news". >> justin, thank you moore. >> coming up on 03:00, let's get your traffic and weather together.

justin fin in our satellite center to tell you more about it, justin? >> good morning, now the lapd says it could look into all claims against cosby, no matter how old they are. and that development caps off what has been a long week for the comic. now, soon after he broke his silence, to thank celebrities supporters, more claims came down. a california woman filed suit on tuesday claiming cosby assaulted her at the playboy mansion back in 1974. now cosby counter suing her, claiming she has tried to extort him for up to $250,000. and then on wednesday, three more accusers came forward, and that same day cosby announced he would step down as trustee, at temple university. and then, on thursday, the us navy announced it will revoke cosby's honorary chief petty officer status, a mid the growing allegations. and now the list of accusers stands at close to 20, and then the lapd chief says these

afternoon through the west most counties, toward central pennsylvania, you start to see some rain showers picking up out that way, meanwhile, elsewhere, it is really not going to take until i would say toward evening before things start to go down for us around philadelphia. thirty-seven at the airport, 28 in quakertown, and it is a chill start, but again, dry for now, so no issues when it comes to any slick travel for us on day like this. but as we go through the day like i mention, eventually rain showers will creep in. further north, further up in the mountains, may be mixing of some snow or even some ice. something we have to keep an eye on, just rain for almost everybody, again, confined to the mountains where it is cold enough, vet tore crashes could turn little slick, like say up toward i80 for example. >> we will definitely be keeping our eyes on that as far as traffic. because even the slickness, even not super heavy, still causes major incidents, as of right now, we're in the clear when it comes to weather, as katie mentioned us to, at least for right now, but

traffic wise, not in the clear. specifically travel on the schuylkill expressway, 76, headed eastbound, we do have an accident right around girard avenue. but, by the looks of this shot here, the accident is behind trees. so our camera shot can't get a clear look at it. but it does seem to be that since we're getting little bit more movement here, that it looks like it may be pushed to the shoulder. i'll double check that. i'll definitely update it on twitter. follow me vittoria cbs-3 and also i'll tell but it in the next hit. this incident caused delay back toward city avenue. so if you are traveling eastbound on 76, making your way into the city from the western suburbs, it will be slow. just as slow if you're traveling on 95, southbound, out of the northeast, all the way down through the vine street expressway. so, speed censors, are a dropping. fourteen sure average on 95, southbound, 11 on the westbound side of 76. starting to feel that pocket. and then of course eastbound, because of that earlier incident scene on top of rush hour. mass transit is doing okay, nicole? >> torrey, thank you. happening today, in about 30

minutes, take two on test flight for america's newest spacecraft, the orion capsule. this is a look at kennedy space center in cape canaveral. this morning's unmanned trip is scheduled to take off at 7:05. nasa scrubbed yesterday's launch after multiple delays stemming from unfavorable weather conditions, and a fuel valve problem. >> the team was absolutely on their game. listening to everything the rocket was telling us. so we'll go make sure we have happy rocket. and as soon as we do that we'll get back to the pad and send orion off to very, very successful test flight. >> all right, this morning's unmanned trip is scheduled to take off once again in cape canaveral 7:05, nasa once again correct yesterday's launch after multiple delays, stemming against the weather issues and also the fuel valve problem. >> singer cat stevens launches first us tour since 1976.

but ticket scam nearly had fans shut out from the show in upper darby. it is a story he can clues i have to "eyewitness news", more than 100 people bought ticket for thursday's sold out show at the tower theater from third party seller who issued the tickets in the form of a gift card. told they only needed the gift card and drivers license to see the show. but the mix-up occurred when the tower theater stopped honoring those tickets for security reasons, leaving some fans outraged. >> they assured me you will have no problems getting in door, the tickets are on the gift card. >> these tickets all scams. just awful. everybody up there is heart broken, so many people, it is terrible. >> all i want ... cat stevens, that's all i wanted to do tonight. >> now, fans with those gift card based tickets were eventually allowed in, but many had left due to the ticket trouble. cat stevens sent out this tweet to "eyewitness news", saying, quote, sad to hear some fans have been scammed. it is disheartening. hopefully we'll come back to play for them soon.
