"eyewitness news" reporter justin finch is live with the very latest on this still developing story, justin? >> reporter: gentlemen, jessica, two victims tonight, three-year old, boy and father of three in his 40's next-door neighbors both shot by a man that somehow got away. in fact, back on the block tonight, one city leader says it is a reminder for all neighborhoods to take a firm stance against gun violence. worried sick helen waited for word that her son in law william pew was okay. she now knows he should be but hours before pew was shot in his tie in front of the home on the 1300 block of south new kirk by an unknown male shooter who let off at least six shots. perhaps a case of mistaken identity say police but that is not all. >> this defendant goes to the next house, 1335, and he opens the door and fires right now it looks like one round, into

where he has gone. the investigation continuing still tonight. we are live from grays ferry, justin finch, for cbs-3 "eyewitness news". is there a growing rift in new york between city's police department and its mayor with some say he mishandled recent protest before the murders of two officers. this afternoon mayor deplace ohio called for a temporary halt to the protest until the officers are laid to rest. he also took time to meet with their families. offering his condolences. meanwhile police departments across the country are on high alert in hopes of avoiding any further bloodshed. a tense mood in milwaukee tonight, authorities there a announced they will not be charging a former police officer who is white in the deaths of the mentally ill black man. last april christopher manny shot dan trell hamilton 14 times but prosecutors ruled manny was acting in self-defense because hamilton was attacking him with the officer's baton. manny was fired from the force last october because the chief says he instigated that fight.

an emotions are running high among law enforcement following the deaths of the two officers in new york. "eyewitness news" reporter steve paterson went to south philadelphia where some officers are working to develop a tighter relationship, with those they served. >> no justice no peace. >> i understand that they are disappointed. i understand that they are angry. so are we. >> reporter: with all that animosity philadelphia police lieutenant mike is worried about his officers on the street. >> they need to make sure that they make informed decisions and they are safe on the street. >> reporter: but he says he is more concerned about his community and how the streets see them. >> have you guys had any interaction with the police prior to this. >> reporter: the the lieutenant and his officers of the south street detail organized a toy drive for families in the women begins abuse network. they were hoping to collect maybe 200 toys. >> realistically we're almost at a thousand gifts. >> reporter: trace too much to wrap by themselves, so the lieutenant thought it would be a good idea to invite high

jessica, back over to you. two families are home less firing and fire in the philadelphia's frankford neighborhood. chopper three over the scene on tacony street. no word on the cause of this fire, no one was injured, the american red cross ace cyst continuing those who need help we have an video of other fire from wilmington delaware from last night. you can see the flames driving through the roof of an apartment building on butter nut court. four people were hurt including a fire fighter and a paramedic. they are expected to be okay. the the red cross ace cyst continuing six displaced families. also yesterday just a few miles away in claymont an entire apartment building was engulfed, this is on the 200 block of harbor drive. one person , was killed and another victim was taken to the hospital and dozens more were forced out of their homes. investigators are still searching for the cause of both delaware fires, they do not believe they are connect. fill will a police are looking for this man, shawn

king, accused offsetting fire to the home on the 5400 block of west girard avenue that trapped two people last week. fire fighters were able to rescue them but if you know where he is, call the police. a man is abduct on the streets of southwest philadelphia and tonight they say three of his attackers are still on the loop. he was approached on crescent road before being taken to the second location on chew avenue in the olney neighborhood. police got a tip, they responded to the scene, within suspect was arrested and now being questioned to track down his alleged accomplices. a new lead in the search for missing college student shane montgomery has authorities focusing their search around the schuylkill river. dive teams were back out in manayunk after finding his keys along the river's bank. shane's parents were also standing by thanking the search team. the the last time he was seen was walk toward the river thanksgiving morning.

former sportscaster done ton tollefson calls himself an alcoholic, drug as he prepares to defend himself on charges that he cheated charities out of more than $340,000. two months after pleading guilty, he headed to court on what have would have been his sentencing day last week and withdrew his blue saying he had new information that proves his innocence. he says he is looking for a lawyer to work pro buono since his request for a public defender was denied. >> i talked to a lot of attorneys and hope that maybe a couple teamed up they could split the work load but it is difficult for someone to take it on pro buono but i'm not hesitating to call everybody that i possibly can. >> he says today was his 438th day clean and sober living under house arrest in north philadelphia he plans to make restitution by selling sports and memorabilia. his trial is set to begin january 5th.

allegations of health care fraud. the feds say that the hospital billed medicare for procedures that were not performed, only partially completed, or not necessary. two whistle blowing employees, will receive a share of that settlement payment. on cbs-3 healthwatch, this is a special holiday season for a south jersey family who fostered over one hub children. now they are focusing on their own health committed to eating well and losing weight, even through the christmas season. health reporter stephanie stahl is here now with more on how they are doing it and it can be tough. >> it is tough, you know, staying on the diet during holiday is tough for most of us. foster family who hell and dozens of children ended up gaining a unhealthy amount of weight. now they are losing it for the kids. >> thank you. >> reporter: christmas tradition of making holiday traditions cookies with their family is different for trudy and tim mcfalls. they no longer over indulge in sweets. >> i feel better about myself.
