start to clear out in time for the holiday. so, we'll have all of the details on, that time out the rain, because so many of you may be traveling here in the next few days, and meanwhile, also talking about, as we mentioned, that surge on the thermometer, too. jess? >> thanks, katie, currently no problems out on 95, around the vine street expressway. you can see some shiny roadways, there, so things may be little slippery in the north or southbound lanes. we do have some over night patches of work out there in new jersey, we will tell you all about where they are in the next couple of minutes. erika, back to you. >> thank you, new this morning, man shot in the back in grays ferry. investigators tell us the 33 year old man was walking home from the store at 25th and moore streets when he heard shots, ran home, and then called police. the victim is in the hospital in stable condition. >> the victim has no idea why he was shot. just coming from the store going home when he heard the gunshots and realized he was shot. he had no argument. he was not robbed. he does not know why he was shot.

>> officers found eight shell casings at the corner of 25th and moore. police are reviewing security cameras in that area to help in their search for suspects. now, nearby, another shooting in grays ferry where a three year old boy was shot inside his home. that shooter is still on the loose this morning, "eyewitness news" reporter jan carabeo joins us now at children's hospital, where that toddler is recovering. jan, good morning. >> reporter: erika, good morning, we are very lucky we're not talking about a child who was shot and killed in grays ferry yesterday, as you mentioned, that three year old now here at chop in stable condition at last check, and we are told he is expected to make a full recovery. meantime, this shooting investigation continues, and so does the hunt for the shooter. a mid sparkling lights, and christmas tree, yellow police tape outline this grays ferry neighborhood monday, after a three year old was shot and rushed to the hospital. an act never acceptable, but specially shocking, councilman johnson says, around the holidays.

>> it makes no sense, this is the holiday season, so we definitely shouldn't have a family going to the hospital with the three year old shot in the leg. >> the shooting unfolded in the 1300 block of south newkirk street in broad daylight. police say an unknown suspect, approached a man here on his porch shall, the two got into an argument, and at some point the gunman opened fire striking the man in his leg. now, police say, this may have been a case of mistaken identity, because of what happened next. >> 1335, opens the door, fires, looks like one round into the house. >> that's when the toddler was shot. his father refused to speak with reporters on monday after police say he may have been the intended target. meantime the adult victim's mother-in-law is upset about what she calls slow response from neighbors after hearing gunshots. >> the complacency of people not to call 911 after you heard six shots outside your door? where are the morals?

>> many neighbors, "eyewitness news" spoke with, didn't feel comfortable going on camera, but had this to say in response. >> around here frequently you hear gunshot, so a loft people usually just turn the other way. >> now, that adult victim was able to drive himself to the hospital after being shot in the leg, we're told he's also in stable condition, and is expected to be okay. we're reporting outside of chop this morning, jan carabeo, cbs-3, "eyewitness news". >> jan, thank you. 5:03, and wet street out there. >> certainly very damp to start the day off. but i have to till, definitely more after nuisance travel day. any wet weather we find will be strictly rain for everybody. it is too warm even in the poconos for anything but plane old rain. but, you know, you will see it coming through in scattered variety much like what storm scan3 has up its sleeve right now. again, that's not too bad out there. it is verbal enough you'll need to slow down, certainly enough i would at least suggest wet weather gear, whether a rain jacket or

umbrella, but you can see how the moisture is beginning to pack up in our area here, that's just a sign of things to come really. more than anything. we are seeing a very large storm system, start to solidify, start to take shape here, it will be bringing the brunt of it impact your area by tomorrow. still, just rain, though, folks, that's all we're expecting out of it. 51 degrees the current temperature in atlantic city, 51 degrees already, at 48 in philadelphia, that's already what is it five, six, 7 degrees above the seasonable average on this particular day of the year. we expect to sort of level off at the thermometer readings. solo or mid 50's, expectation around philadelphia and the shore points respectfully. up in the poconos, even you will be above average at 43 degrees. while there will be showers, while it will be a dreary day, say it, could be worse, it could be ice, and that's not what we're dealing with, thank goodness. now that said, it also means it is not a white christmas this time, because we are expecting it to continue to rain into tomorrow. that will also be when we see the heaviest rain come through. but then skies do start to clear out for the holiday itself.

we expect at least a little bit of sunshine for the holiday toward the days end. but the winds starts to pick up too. sort of just day of transition for us. jess? >> thanks, katie. yep, not much in the way of volume out on any major roadways so far. but the main problem this early, so far, is that most of the roadways are little bit wet. i'll show you what i am talking b out on 95, see some shiny roadways there around the vine street expressway. northbound, and southbound lanes, still, in or out of the city moving along great so far. now over on 309, over at the pa turnpike, you can see some ponding there on the roads, some water sprague up from the cars as they drive on by, southbound moving along great, still, northbound doing the same. but we do have some over night work out in new jersey, 295, in both directions, near route 168 until about 6:00 a.m. so another hour or so there. you can expect some clean up, and until about 6:00 a.m., as well, route 168 at ferry avenue also out in bellmawr, new jersey. 202, from route 30 into the schuylkill expressway northbound, still 12, 15

minutes, schuylkill expressway eastbound from the blue route into the vine street expressway. >> community comes together following last week's shooting rampage in montgomery county. hundreds gathered at souderton area high school to remember ninth grader nina flick, and pray for her brother, anthony's recovery. police say bradley stone murdered nina and her five relatives on december 15th. seventeen year old anthony, survived the attack. >> one of the strongest kids i know. and, you know, i can't even begin to imagine, you know, what it must be like, but i know he is strong, and i know he will pull through this. >> we are all here for each other. and that we're just going to stay strong. >> a go fund me campaign has raised more than $25,000 toward anthony's medical costs, and other needs. >> right now it is 5:06. new york city's mayor has called for a temporary halt in demonstrations against police until after two officers killed in a ambush are laid to rest.

don champion joins us now, he is live in new york where more protests over perceived police brutality are expected to continue. don, good morning. >> reporter: good morning, erika, the mayor's call for calm came for he and the police commissioner net with the two grieves families of the officers killed. meanwhile investigate verse new clues on what the gunman was doing right before saturday's deadly encounter. >> this is a difficult time for both of our families. >> as the families of wenjian liu and rafael ramos prepare to lay their loved ones to rest, new york city mayor bill diblasio called for a moment of reflection. >> until these funerals are passed, let's focus just on these families and what they have lost. >> but protesters, like this group, that staged a sit-in at grand central terminal monday vowed to keep up the fight. >> if anything, this is a time to protest even more. >> they don't want ismaaiyl brinsley's violent act to detract from calls for police

reform. >> it is just sort of seems like this plan, you know, two try to attack this one guy with the hundreds of thousands of protesters who have been protesting against police brutality in general. >> along with posting threats against police on instagram, they say brinsley watched and reported a protest in the city earlier this morning, but did not participate. his sister maintains he was not targeting police. >> he was emotionally troubled. it had nothing to do with police retaliation. >> authorities released last known video of brinsley caring a small white bag, possibly with the gun he used to kill the officers inside. they're now trying to piece together where he was in the hours before the shooting. now the mayor says he does plan on attending the funerals of both officers, officer ramos' funeral, scheduled for this weekend, officer wenjian liu will be laid to rest once his family arrives here from china. back to you. >> don champion in new york,

thank you. with so many recent protests over police shootings chester county officials plan to show a support today for first responders. they'll thank police officers, firefighters, and other emergency responders, at the chester county f.o.p. lodge later on this afternoon, diana? >> north korea is back on line this morning after the country experienced a widespread internet outage for more than nine and a half hours yesterday. officials declined to say if the united states was responsible for the temporary service disruption. the black-out followed an us have i to respond to the crippling cyber attack on sony pictures, that the government blamed on north korea. >> they want to help here, as they indicated over the weekends, they it, then they can admit their culpability, and compensate sony for the damages this attack caused. >> president obama has called the sony hack, an act of cyber vandalism, not war. right now the us is reviewing how it will responds to north korea. this morning, cuba deals a big blow to new jersey state police, who are trying to bring one of the country's

related. so milder air will continue to fun nel here. but you can see, how our storm system, the one that we've been looking ahead to now for about a week; really starting to solidify, take shape here. as it continues to do so, we will have to deal with wet weather issues. so booth today, tomorrow, featuring some rain, tomorrow's the heaviest rounds every rain that moves through, and it looks like it could come through in pockets at any time. both days, i would say, just have your wet weather gear ready to go. expect i would say to slow down the most by tomorrow. come christmas day itself, maybe ripping open the prints, may still be wet weather around early in the morning, but skies should start to clear as the day progresses, just few showers meantime here today, 51 degrees, nuisance kind after day, somewhat dreary obviously, and the rain, steadiest rain, starts to move in overnight, i would say, closing in on dawn tomorrow. but, you are not going to see too much sunlight out there tomorrow. it is looking like very mild day, however, check this out, 62 degrees, 62, on christmas eve, not bad stuff, if you like the mild air. merry christmas to you.

but, no white christmas this time obviously, temperatures only head back mid 50's by thursday, even though skies are clearing, we are looking at strictly rainout of this one. jess, over to you. >> thank you, katie. good morning shall everybody, yes there is early, not much to really deal with in terms of volume. but as we go outside, show you the cameras here on 95 at cottman, you can see some shiny roadways, we know everything little wet. so we want you to take your time and head out the dorra little bit earlier, anyway, just give yourselves little bit of caution there. so southbound, moving along great so far. also, losing out the right-hand lane and shoulder due to ongoing construction, that's something we're used toment you can see some shiny roadways here, also, headed northbound toward northeast philadelphia. now, over on the boulevard, everything moving along great around ninth street. that sound great. northbound great there, as well. but travel times, everything still pretty clear, 202 northbound from route 30 into the schuylkill expressway, and that's about 13 minute trip, and 15 minute on the schuylkill eastbound from the blue route into the vine street expressway. erika, back over to you. >> jess, thank you. one man in the hospital after a shooting early today in

south philadelphia. police say at least eight shot fired 33 year old man near 25th and moore around 1:00 this morning. that man was hit once in the back. the shooter remains at large. >> and less than a mile from there, police are looking for the person who shot a three year old and a man in south philadelphia. both of those injuries are non-life threatening. and us state department officials say north korea should admit their cyber attacks on sony pictures. meanwhile, north korea's internet service is back after an outage yesterday. us officials declined to say if the us was involved in that shut-down. >> a young boy has a simple wish for saint. now he is about to get a gift he'll never forget a as his letter goes viral. >> also, a very ugly toned college football game when fists fly after the final whistle. more of this brawl that left some players bloody. >> ♪

>> it means no white christmas this year, but also means we have to dodge some wet weather specially tomorrow. we take you out, there already, we've got some rain showers on the map here on storm scan three moisture building up. little fog up toward the pocono region, just heads up if that's where your travels take you. meanwhile we look ahead here. we take you in the early morning, early afternoon, i should say, and will be scattered showers sort of rolling through at will, at any time today. but, notice, by early tomorrow morning, about the time the sun is just starting to come up, the steadier rounds of rain start to move in, as the brunt of our warmfront with this large storm system really move in. so we're already warming up now. 48 degrees the current temperature at the airport, we stay somewhat steady through the day, expecting low 50's at best for daytime highs. look at tomorrow. that's good stuff. if our fan of mild air, but again, because it is so warm, and there is no snow on the ground, we don't have a chance every seeing any of it for christmas day itself. even though there may still be lingering showers early christmas morning it, appears as though it will be just the rain, and then skies will clear, and we get little bit of sunshine for the second half of the holiday.

"eyewitness news" reporter jan carabeo joins us at children's hospital where the little boy is recovering. jan, good morning. >> reporter: erika, good morning, we're told that toddler, that three year old boy; here at chop this morning, recovering, we're told, at last check, he is in stable condition and will make a full recovery. now, this investigation is continuing, and so is the hunt for the shooter, if you take a look at the video, you can see the scene as it unfolded in broad daylight yesterday. >> this was monday morning, just before noon, on the 1300 block of south newkirk street, in the city's grays ferry section. police say gunman approached a man who was sitting on his porch. the two got into an argument, and at some point the unknown gunman opened fire, striking the man in the leg. well, that shooting may have been a case every mistaken identity, because police say the shooter then went next-door, and opened fire into that home. and that's when this three year old was shot in the leg. we're told the child's father may have been the intended
