hit-and-run. but first, more dreary weather just in time for the holidays. a lull in the action right now as people make their way around rittenhouse square but more wet weather is on the way. a live look now at storm scan3. you can see another system headed toward our area. that system will make for a very soggy christmas eve. good evening, i'm jessica dean. chris may is off to night. >> meteorologist kate bilo keeping her eye on things from the cbs3 weather center tonight. kate. >> thanks jessica. this is a large scale storm system that's impacting much of the eastern half of the nation some snow a cross portions of the great lakes in the upper midwest but it's the rain that will be an issue for us. not snow this time around but very warm air moving in with this system almost tropical temperatures are in the 70s along the gulf coast today. you can see the rain and even some strong thunderstorm along the squall line moving into portions of georgia at the mommy. for us it's the rain and it's lifting northward right along the i-95 corridor as we head through the overnight hours and into early tomorrow it will be with us all day tomorrow.

also dealing with patchy dense fog. mist and drizzle outside tonig tonight. a break in the action from the instead yesterday rain but again watch for that fog if you'll be out and about visibility down to third a mile in dover. a half mile in the poconos and 1 mile in wilmington the fog can um up on quickly dense here in chester county. play it safe. timing it out we can see light rain through the overnight hours but it's really tomorrow morning around sunrise that the instead yesterday of the rain starts to move and in it just comes in waves all day long. 3:00 p.m. still raining. 7:00 o'clock we still see the rain starting to move into the shore points and then a little break in the action before another round of showers comes through overnight and into early christmas morning. so what to expect for your christmas eve periods of rain all day long. this is going to be like a 3:00 a.m. to 3am storm. amounts about three quarters of an inch to inch and a half and that could lead to ponding on the roads. also, near record temperatures for your christmas eve. i'll have more on that and also your christmas day forecast coming up in just bit. jessica? >> kate, thanks so much. remember you can get the forecast at your fingertips.

"eyewitness news" reporter david spunt is live at the police department's accident investigation division in north philadelphia with more on this. david? >> reporter: jessica, the victim was just 33 years old. police are working quickly in the building behind me to find not only the tow truck but the person driving the tow truck. that person facing a charge of vehicular homicide. >> i don't know how anybody could do that. it's traumatizing. one minute she's there and gone. >> reporter: linda, says she saw everything happen in just seconds. she was driving her suv on state road in holmesburg around 5:15 tuesday night when she says a black tow truck hit a woman crossing the street. >> i saw her like walk up to the center line and then she was gone and then her cell phone and

purse hit my car. report roar police say the woman did not use the crosswalk. other witnesses tell "eyewitness news" the driver didn't even slow down after hitting the woman. >> there were no brake lights, nothing to even, you know --, by the time i realized it was a person, i stopped my car and just to see if i can help her. >> police were on scene within minutes. spending over two hours collecting evidence. detectives found glass on the road. likely from the tow truck's health. >> when somebody strikes a human being, and then intentionally fleece the scene, involved in a hit-and-run, then that's just a horrific tragedy. >> reporter: tragedy linda says she'll never be able to forget. >> you knew he hit someone. you, her, him, whoever the driver was knew they hit her. >> reporter: this picture on your screen right now is part of the health from the tow truck. i just took that picture on my cell phone about 30 minutes ago. detectives just brought it back here to investigate a little bit

more. they'll be looking at surveillance video from surrounding businesses, again, we're talking about a black tow truck with part of the health missing. if you have any information police want to hear from you. reporting live from west philadelphia tonight, david spunt cbs3 "eyewitness news". >> david, thank you. breaking right now, former president george hw bush was taken to houston hospital tonight after experiencing shortness of breath. a spokesperson for the 41st president says he's being held for observation as a precaution tonight. despite health problems in june the former president celebrated his 90th birthday with a tandem parachute jump near his summer home in maine. volunteer firefighters rescue a baby from a burning mini van on the garden state parkway. it all happened near exit 74 in lacy township, ocean county this morning. firefighters pat o'donnell and eddie barker pulled over after seeing flames erupt from the hood when the driver told them her baby was in the mini van. o'donnell worked to suppress the

flames while barker pulled that baby from the back seat before fire over took the vehicle. amazingly nobody was injured. new developments to night in the sony hacking scandal. sony has decided to release the movie at the center of the controversy the interview. and a theater in wilmington delaware will show that film. the interview will open at the penn cinema riverfront on christmas day. tonight we talk with the owner of the theater on the phone. >> we're really feel as though buying a ticket to see this movie in and of itself is a statement, you know, it's a statement of support for our country and for the freedom that we you will enjoy but really people mostly are just interested in having a good time and not being told what they can or cannot see. >> we're told that film will also be available on demand. cbs news reporter danielle nottingham has more now on sony's decision to show that film. >> they hate us because they ain't us. >> reporter: the interview is back on. sony pictures reversed course tuesday and is allowing select

theaters to show the film beginning christmas day. the seth rogen james franco comedy is about a plot to kill north korea's leader after a devastating hacker attack exposed secret internal documents and embarrassed sony pulled the film when the hackers threatened terror tax. fans, artists and even the president were critical. >> i think they made a mistake. >> reporter: but sony delivered another plot twist tuesday. saying, we are proud to make it available to the public and to have stood up to those who attempted to suppress free speech. the film will be shown in more than 200 theaters. on social media the film's stars called it a victory and said "the people have spoken. freedom has prevailed ". >> zone know says it's working to get more platforms and more theaters to show the interview so it can reach the wide defendant possible audience. >> i think it's really the outpouring of people all over the us and the world who want to

support, you know, freedom of cray tiff have the. freedom of suppression. >> that some theaters owner will extra security on hand to ensure the safety of movie goers. in los angeles, donyell nottingham for cbs3 "eyewitness news". >> new tonight the community is coming together to help the family of a police officer displaced by an arson fire in lower pottsgrove township montgomery county. thanks to the generosity this holiday season will be just a little brighter. "eyewitness news" reporter todd quinones has details. >> reporter: the fire police say was intentionally set by the next door neighbor while the family was away on vacation. limerick township police detective ernie morris and his wife christine were left with virtually nothing. their two daughters were scared and their family cat was killed. the story sent shock waves through the lower pottsgrove community. >> devastating. sad to know someone could do this to somebody else r. >> reporter: tuesday night this texas road house in royersford was packed. >> this is a how much turn out which is awesome because i

didn't expect anything like this. >> the staff is telling me the wait might be 45, 50 minutes maybe longer. >> that's not a problem. we're hear to support a good cause and that's what we want to do. >> reporter: the staff and management here decided to donate 10% of the entire night's revenue to the morris family. the goal was about a thousand dollars. which is on ton of the thousand dollars raised by members of the limerick fire company. >> it's amaz amazing. it's a blessing that came out out of all this of this to be honest with you. >> the entire community has been so generous and the support has been overwhelming. >> reporter: according to pennsylvania state police, next door neighbor 52 year old donna krupp had an ax to grind. and blamed detective morris for her own son's incarcerated on unrelated charges. she's been charged with setting the fire earlier this month. the morris family right now is staying in temporary housing and considering the circumstances surrounding the arson, at this point they're in the even sure if they plan on rebuilding on

that piece of property. and with so much up in the air right now, fundraisers like this one is helping the family look forward to christmas. >> we're kind of looking forward to a peaceful christmas eve, peaceful morning and family activities. in royersford, todd quinones cbs3 "eyewitness news". >> a bomb threat forces the evacuation of atlantic city international airport on one of the busiest travel days of the year. cbs news reports bomb sniffing dogs checked airplanes as well as the airport terminal. operations at that airport are back to normal tonight. another airport incident this one at los angeles international. terminal four had to be evacuated due to a suspicious device at a security screening station. about 20 minutes later police deemed that device to not be a threat and passengers were allowed back inside. >> the sole survivor of the killing spree in montgomery county is at home tonight after being released from the hospit hospital. 17-year-old anthony flick suffered cutting wounds during the december 15th attacks by

bradley stone. authorities say stone killed his ex-wife nicole and five members of her family at three locations in montgomery county. autopsy results released today show stone died from a drug overdose. his body was found in the woods near his home in pennsburg a day after the murders. >> a man accused of two rapes in 2010 is back in philadelphia and behind bars. federal investigators traveled to mexico to extradite alberto suarez back to the u.s. he was wanted for rape that happened just across the street from police headquarters as well as another rape in western pennsylvania. >> thought it was very fitting that a philadelphia police officer accompanied by an fbi agent traveled to mexico city, put the handcuffs on alberto suarez and brought him back to philadelphia. suarez was veiled in mexico in april 2012. >> a south jersey doctor is under arrest accused of criminal sexual contact with three

patients. this is the suspect. police tell us the alleged contact happened during medical askings in his office at premier neurology on english creek avenue in egg harbor township. the doctor's arrest followed three month investigation. bail was set at $25,000. a montgomery county woman is facing charges tonight. 42-year-old iris gibney of pottstown is accused of having sex with a 17-year-old mail. police say she found her having sex with the teen in a car at a park on november 15th. and that both admitted to engaging in sexual activity. gibney and the victim met at pottsgrove high school while attending a school function. police say gibney then sent nude photographs of herself to the victim using her cell phone. >> tense moments at a south jersey high school today after a bullet was found near an entrance. "eyewitness news" at clear view regional high school in mullica hill. a maintenance worker found a 22

caliber bullet near the school's media entrance. the school and the nearby middle school went into lock down for short time. no weapons were found and police say there were no threats made. students were dismissed after a half day. new york city is on edge as marchers continue to protest racism and police violence tonight. hundreds attempted to shut down manhattan's fifth avenue shopping district. this despite appeals from the city's mayor to set aside such demonstrations until the funerals have taken place for two murdered police officers. raphael ramos and wenjian liu were shot dead in their patrol car by a man who later took his own life. that tragedy hits close to home for pennsylvania congressman pat meehan. >> officer ramos son justin is a classmate of my own son at bodine college in brunswick, maine i discussed this issue with my son and the entire classmates are all still very very affected by the moment. >> congressman meehan was among

>> prices at the pump continue to fall just in time for the holidays. aaa gas prices have now dropped for 89 days in row. the national average is now 2.38 per gallon. nel zen research surveyed couldn't sum mers. they found 36% of them gas saying on holiday gifts. 47% now have an extra 25 to $75 a month to spend. >> went and filled up my tank last night and there was a $30 savings over sick months ago. i said i'm going to go to the mall and i'm going to spend that $30 on christmas. >> this will strengthen holiday spending but also strengthen

tomorrow. any snow with this storm is way off to the west. maybe portions of michigan, we will not get in on the cold side of this storm in fact we may challenge a record high tomorrow. 47 degrees at the airport now. it's 48 in millville. 47 in wilmington temperatures rising as this storm approaches. steady rain by 8am and watch this rain move up the eastern seaboard 4:00 p.m. we're still dealing with rain. could be a little bit of a break in the action tomorrow night and then another round tries to develop overnight into early christmas morning but you can see by 8am cloud cover starting to move on out to sea. we will see some sunshine for our christmas morning. so that is some good news. but very soggy very warm christmas eve is on deck for tomorrow. in fact our record is 64 degrees. the high tomorrow around 62 but we may get close to that number. the warmest part may be right around midnight and that means christmas day will be one of those sneaky days temperatures may actually be in the 60s at midnight and in that drop through the course of the day. christmas eve forecast rain
