♪ >> now at 11:00, a woman left dead on her 93rd birthday. now police are trying to figure out if the hit-and-run driver that crashed into her home should face charges. good evening to you, i'm jessica dean. chris may is off tonight. this crash happened on red brook lane in levittown, bucks county. after finding and questioning that driver, police say they aren't ready to charge him yet. "eyewitness news" reporter diana rocco has new information in this story. >> reporter: jenny russo died on her 93rd birthday after a hit-and-run driver slammed into her bedroom in the early morning hours friday. the 20-year-old pickup truck driver turned himself in to bristol police 12 hours later after they found the damaged red dodge pickup at a home nearby. >> he expressed remorse. like i said he's been cooperative through the entire process. >> reporter: russo' family

felt the house shake and saw headlights leaving the scene around 3ama trail of tire mark left in the grass. >> yesterday was christmas and today now is her birthday, and, you know, we knew she was getting ill. but we didn't know that something like this would happen russo had been in hospice care. the impact pushed her dresser into her bed leaving her room exposed to the outside. her son said he had to move her twice to a warmer location in the house while emergency crews repair the hole. too much for her 58-pound body. she died a short time later. >> she really wanted to pass in her own bedroom and unfortunately was not able to do that. >> she was a lively woman. she like to get dressed up and go out and have fun and stay active with the seep yours. >> reporter: police found the red dodged on bath street in bristol bore o suspect's family leaves bristol township police station. police decided not charge him until they talk to the district attorney. they say the man is remorseful and has apologized to the russo family.

>> i wanted the family members of the driver respond to do their home with an apology and they were very gracious to him and accepting it. >> reporter: police are not releasing the name of the that 20 yeared driver. the da is expected to make a decision on what if any charges will be filed early next week. in bristol township, i'm diana rocco cbs3 "eyewitness news". >> new tonight police are investigating a serious crash in delaware county. two vehicles collided at north state and gulf view roads in springfield. from chopper three you can see one of vehicles overturn. we're also told first responders pulled at least one person from that car. it's unclear if anyone also was hurt. one person was killed after a motorcycle and truck collided in king of prussia tonight. chopper three over river road and eau mccoys just after 5:00. a second person was flown to the hospital. that person's condition has not been released. the cause of that crash is under investigation. >> a hazmat scare prompts the evacuation of a home in

germantown. chopper three over the 200 block of after 6:00 this evening where a substance leaked from truck. once the spill was contained official determined it was gas and allowed the family to retu return. a beautiful day made way for pleasant evening across the area but will the weekend stay sunny meteorologist kate bilo joins us from the cbs3 sky deck with a check on your first forecast. kate. >> thanks jess casm it's getting cold out here now tonight as we have a clear sky temperatures dropped off pretty quickly although we're still holding on to the fours here at cbs broadcaster center. 42 degrees many spots in our suburbs way down into the 30 already. but tomorrow looks like another mild day. let's take look outside and see what we have got going on storm scan flee. notice a few clouds starting to creep in from the west as a system moves towards us from the west but really we'll see that southwest flow. kind of see the direction of those clouds moving from southwest to northeast pulling in warmth and moisture from the south and west and the system we're watching for sunday and

monday is still way back over the northern plains it's not going to get here for sometime. in the meantime we're enjoying high pressure overhead and temperatures actually slightly above average for the time of year even tonight. 40 at the airport right now. 32 degrees in millville. 33 in mount pocono but already subfreezing in allentown and reading. millville sitting at 32. so planning out your weekend if you're traveling home from your christmas destination tomorrow looks great. sunny and bright at 54. more clouds sunday with couple of showers through the afterno afternoon. 52 degrees will be the high on sunday next week we return to winter full force as temperatures drop drastically more and that with the seven day forecast coming up in just a bit. >> kate, thanks so much. >> a 94 year old woman who disappeared christmas eve was reunited with her family today. she was driving from her home in lansdale to gilbertsville, montgomery county when she somehow lost her way. her family called police. this afternoon detectives found her 50 miles from home at the wawa on south church street in

mt. laurel, new jersey. her neighbor says she's known for her independence. >> she live by herself, yes. i see her almost every day. when it's warm she cut the grass and clean the yard. very, very nice lady. >> authorities say she was disoriented but otherwise unhurt. it's unclear where she was all those hours in between. tonight philadelphia police are investigating a crash involving a schoolbus loaded with children on the roosevelt boulevard. chopper three over the scene near henry avenue and east falls this afternoon. authorities say the driver suffered burns from wires on that bus that caused him to lose control. none of the students on the bus were injured. they were transferred to another bus. >> a worker was killed at the cherry island landfill in wilmington this afternoon. authorities say 42-year-old jose louis garr so ya hernandez of newark was hit by a large piece of equipment. chopper three over that scene around 2:00 o'clock. investigators tell "eyewitness

news" a tractor was pushing trash in a large pile and was backing up when it hit the victim. new tonight thousands gathered in new york city to honor a fallen police officer. raphael ramos and his partner were ambushed while sitting in their patrol car. reporter jessica schneider of our sister station ccbs was there for tonight's emotional remembrance. >> he was my rock. he was the beacon of wisdom. he was my absolute best friend. dad, i'll miss you. i'm miss you with every fiber of my being justin ramos was in the middle of his sophomore year at bodine college in maine when this 40-year-old father was murdered in his patrol car. tonight image broadcast on a screen for the thus sands waiting in line justin ramos spoke briefly about the man his father was. >> my dad would have been there for everyone else and to see so many people here for him is a testament to how he was as a

person. it's been so helpful in this difficult time. >> reporter: the wake began at 2:00 p.m. but people lined up well before and waited for hours longer. officers in uniform, friends and even those who never met him. >> a lot of officers thank me for coming. i feel duty bound as a citizen. >> reporter: the people poured in for more than seven hours. governor cuomo spoke with the family and promised them suppo support. >> helping them with financial support, with the tuition payments. with the mortgage payments. that was obviously important. the practice and concerns are very real. >> reporter: but it wasn't all somber. there were a few laughs as family members reflected on the man they loved. >> i'm going to keep this short and sweet just like my brother. i know you always worried about me but you know how i roll because we were two peas in a pod. never think just do and hope for

the best. you were one of the most simple people i know and having you as my brother is the highest honor that could have been be stowed upon me. >> reporter: new york city bill diss blass yo came to the church for 15 minutes tonight to visit with the family he will be delivering remarks tomorrow at the funeral at 10 a a.m. in glendale queens, jess at a schneider, cbs3 "eyewitness news". >> hundreds gathered on the boardwalk in atlantic city today to honor police officers there. the rally was organized by local physician john baker and radio host harry hurley. it was in response to the murders of the 2nypd officers last weekend. speakers the that rally includ d mayor don guardian. >> millions of gamers are in the midst of a blackout. sonny play station network has been off the grid since christmas morning. another system is having problems. >> reporter: the day after christmas in the dividio household means one thing, game time. but 10-year-old olivia says, she's out of luck. at left for now. her sony play station is not much more than a paper weight. >> i'm really frustrated because i can play some games i want to play with friends. lights went out microsoft x bock network on christmas day from the same hacking group. they call themselves the lizard squad. the group of anonymous hackers announced online they wanted to prove a point. that main stream networks on game consoles and every day computers are not bullet proof. >> i would love to play games the day after christmas that i get for christmas. pretty much every kid wants to do. >> her dad happens to be an expert on cyber security he's a professor at drexel university. >> the bigger picture is here how a loosely connected group of individuals can attack major

corporations and bring them to their niece. dr. dividio says it's too early to say if any payment information was hacked but he tells "eyewitness news" it's unlikely. >> this is not a problem that's going away, right? you have to look at the types of attacks and you can grade them based upon how they're going to impact the end use sr., the consumer. >> reporter: why should you the consumer care? dividio says it's simple. the gaming hacks are just the beginning. sony pictures is still digging out from a large attack and the us is blaming it on north korea. and just one week ago, staples nounsed almost 1.2 million payment cards are at risk. shoppers toll "eyewitness news" the list continues. >> i think it should raise some alarms that i think we have just internet security issues in general. >> i'd like to have more assurance every time i swipe my card, you know, are they, you know, looking out for me? >> reporter: dr. dividio

top of her young sons as peaces of a plain crashed into their maryland home december 8th. the money will be given to marie' husband and that are daughter. and we've set up a link on our website at cbsphilly.com. police say a serial bang robbery suspect wanted in philadelphia struck again today. investigators say the latest heist happened at the wells fargo bank on 52nd street in parkside this morning. this suspect is wanted in three other bank robberies and one a tammied robbery all in the city over the past two weeks. if you recognize this man, call police. >> dozens of philadelphia taxi companies are suing uber. cab owners say the san francisco based car service operates in bad faith. the suit receivers to uber as quote gypsy cabs that have undermined the entire industry. it also accuses that company of wire fraud because of the way the drivers are paid. uber says it will vigorously defend itself in core. the rush for returns still on the way tonight.

>> late this afternoon septa released this photo of two of their officers posing with the baby they helped deliver. this baby was born on a market frankford line train last night at 15th and market in center city. mom and baby are now resting comfortably at hahn nan hospital. and mom has named that little boy chris in honor of his birth on christmas. wall street wrapped up the holiday week on high note. the dow picked up 23 points on friday closing at another record high. the nasdaq added 33. wall street strong day was fueled in part by some positive consumer spending reports. the national retail federation says holiday sales could hit more than $617 billion. falling gas prices are the gift that keeps on giving.

"eyewitness news" was in cherry hill today as gas prices were lowered at a gas station along route 70. the national average now sits at $2.39 a gallon. that is the low we have self since may 2009 according to triple a. let's take look at the average gas prices in our area. these are also from aaa drivers are paying 2.63 in pennsylvania. 2.32 in new jersey. and 2.46 in delaware. winter fest at the riff ring at penn's landing is a site to behold. with view of the river and the lights, it's just beautiful. you can see those light shows on the hour beginning at 5:00. a picture perfect setting for ice skating and, hey, when you get cold you can take break warm up with a cup of hot chocolate. and don't forget to join cbs3 on new year's eve. we'll be broadcasting live from penn's landing and we will bring you the spectacular firework show at the stroke of midnight. you can be a part of our special by zenning us your new year's

temperature dropped below freezing we're sitting rye at the freezing mark right now in millville. today was nice. high pressure overhead. but as we head into tomorrow, you can see that high starts to shift a little further east. so kind of living on borrowed time so to speak. our saturday looking beautiful with sunshine and that southwest flow but here comes cold front start to move through sunday. sunday we still hang on to the 50s showers around through the midday time frame time that out for you here on future weather you can see here comes the fro front. stelle well off to the west for tomorrow. so saturday afternoon looking beautiful here's 2:00 p.m. overnight still clear, but as we head into sunday morning the clouds increase and really midday sunday here's noon that a few showers start to move through. it will eventually taper off it's not total wash out sunday. just not as nice as today and tomorrow will be. then watch this next area of precipitation mainly going stay to our south if the high stays strong enough imagine if this got shift add little bit further to the north early monday morning temperatures near the freezing mark. could be oh few snowflakes mixed in most of the models keeping

♪ >> levittown family grew significantly on christmas morning welcoming three more family members. she delivered triplets two girls an boy yesterday at the hershey medical center. courtney and her hub justin already have two children. the family is from myers town about 80 miles northwest of philadelphia. now these triplets weren't due until february. but doctors say mom and all the babies are doing just fine. congratulations to them. what a gift or three.
